Discriminatory Policy Of The Indonesian Government Toward Advocate And Poor People, Funding Solution For Legal Aid, Agus Raharjo
Discriminatory Policy Of The Indonesian Government Toward Advocate And Poor People, Funding Solution For Legal Aid, Agus Raharjo
Indonesian Journal of International Law
Constitutionally, obtaining legal aid for the poor is a right, whereas for advocates, legal aid is an obligation. The rich can select the desired advocate, while the poor should be defended by an advocate under the principle of pro bono publico. Legal aid for the poor is the answer to the principle of equality before the law. Although the poor have a right to be defended by an advocate, some of them do not get legal aid, due to either the factor of the advocate or the poor themselves who do not have access to justice. Government policy to allocate …
Adversary Breakdown And Judicial Role Confusion In “Small Case” Civil Justice, Jessica K. Steinberg
Adversary Breakdown And Judicial Role Confusion In “Small Case” Civil Justice, Jessica K. Steinberg
BYU Law Review
This Article calls attention to the breakdown of adversary procedure in a largely unexplored area of the civil justice system: the ordinary, twoparty case. The twenty-first century judge confronts an entirely new state of affairs in presiding over the average civil matter. In place of the adversarial party contest, engineered and staged by attorneys, judges now face the rise of an unrepresented majority unable to propel claims, facts, and evidence into the courtroom. The adversary ideal favors a passive judge, but the unrealistic demands of such a paradigm in today’s “small case” civil justice system have sparked role confusion among …

Abused And Alone: Legal Redress For Migrant Domestic Workers In Malaysia, Jennifer Whelan, Rohaida Nordin, Ma Kalthum Ishak, Nursyuhada Matwi
Indonesia Law Review
Malaysia’s rapid economic development has relied on Malaysian workers as well as on migrant workers, especially from ASEAN countries and South Asia. The sustained high economic growth rates in Malaysia over approximately three decades caused the increase in migrant workers, who were to meet the rising demand in certain sectors of the Malaysian labour market. The objective of the article is to identify potential opportunities for policy and legislative reform in relation to Malaysia’s implementation of its obligations as a Migrant Domestic Worker (MDW) receiving country specifically in relation to the barriers to MDW bringing claims where their rights have …

Canada is in the midst of an access to justice crisis. The rising costs and complexity of legal services in Canada have surpassed the need for these services. This article briefly explores some obstacles to civil justice as well as some of the court-based programmes and initiatives in place across Canada to address this growing access to justice gap. In particular, this article explains the Canadian civil justice system and canvasses the procedures and programmes in place to make the justice system more efficient and improve access to justice in small and simple matters. Human Trafficking: Exploration Of Best Practices For Restoration And Integration For Survivors In Southeastern United States, Joel D. Shafer Mr.
Human Trafficking: Exploration Of Best Practices For Restoration And Integration For Survivors In Southeastern United States, Joel D. Shafer Mr.
Honors College Theses
Domestic human trafficking, especially of minors, has become a serious though largely
invisible issue in the United States. There are, however, organizations and policies in place that
have become active in caring for, restoring and reintegrating those survivors who have been able
to escape. Through the perspectives of service providers, this exploratory qualitative study
examines the factors of vulnerability of victims, the issues that support reintegration for
survivors and the best practices as well as indicators of success when caring for survivors. This
was accomplished through in-depth, semi-structured interviews with representatives from
various social service agencies in Georgia that are …

The Pledge For The Public Good: A Student-Led Initiative To Incorporate Morality And Justice In Every Classroom, Alexi Freeman, Katherine Steefel
Sturm College of Law: Faculty Scholarship
“The first thing I lost in law school was the reason I came.” Many students arrive at law school with intentions to dedicate their careers to supporting others, but unfortunately, this becomes their reality. To reverse this tide and integrate public interest ideals into the entire law school curriculum, the Chancellor’s Scholars at the University of Denver Sturm College of Law developed the Pledge for the Public Good. The Pledge asks faculty to make explicit connections to the public good in their classrooms. In the inaugural year, over sixty full-time professors signed on. This article, written by a faculty member …

Situated Learning And Latino Male Gang Members At Homeboy Industries, Mauricio Arocha
LMU Theses and Dissertations
Gang intervention is crucial to improving the lives of Latino males in Los Angeles. The effectiveness of these programs is dependent on society’s perspective of gang members, and its ability to support the work of gang intervention programs. As documented in this research, Latinos face unique obstacles and situations, in education and in life. This qualitative research study aimed to provide insight as to the perceived impact of a Gang Intervention Program, Homeboy Industries, on Latino males. This study also provided insight as to the methods, behaviors, strategies, and situated learning perceived to positively affect former gang members at Homeboy …

Having A Say: Democracy, Access To Justice And Self-Represented Litigants, Jennifer Ann Leitch
PhD Dissertations
Access to Justice is one of the most contested issues on the law-and-society agenda. There is a long-standing exchange over its meaning, objectives, and success. Beneath that engagement, there is a deeper and more basic debate about the overall ambitions for access to justice: is the goal to improve peoples access to the legal process and generate more positive outcomes (the practical thesis), or to enhance peoples participation and ultimately their ability to affect justice as an end in itself (the democratic thesis)? This thesis adopts the latter approach.
The plight of self-represented litigants (SRLs) offers a revealing glimpse into …

Redefining The Rico Statute: Potential Avenues For Improvement, David Scouten
Redefining The Rico Statute: Potential Avenues For Improvement, David Scouten
Senior Honors Theses
The civil application of the Racketeering Influenced and Corrupt Organizations Act (RICO) has been misapplied by the lower courts, but the statute can be improved by incorporating elements that will make the statute a better tool for justice. It is evident from examining the procedural limitations of the statute and important case law that the securities fraud gap, terrorism financing, and difficulties for indirect victims are three critical subjects that need to be addressed by enhancing RICO. Flaws and shortcomings of the RICO statute have led to inconsistencies in court rulings. The expansive language of RICO can be limited to …
