Privatization of public law dispute resolution in workplaces has been under intense scrutiny in the context of arbitration. Another kind of workplace dispute privatization is presently underway, or under serious consideration, in several states. In connection with state workers’ compensation statutes, one state has implemented, and others are considering, a dispute resolution model in which employers are explicitly authorized to “opt out” of coverage. “Alternative benefit plans,” created under such statutes, permit employers to, among other things, unilaterally and without limitation designate private fact-finders, whose conclusions are subject to highly deferential judicial review. This model is arbitration on steroids. While …

This article provides an overview of the importance of cultural competency skills for multijurisdictional practice and a comprehensive list of resources for international business law for G20 nations. Law students today are certain to confront issues of cultural competency in both clinical settings during law school and also during their legal careers as a result of the increasingly global practice of law. An Innovative Matrix For Dispute Resolution: The Dubai World Tribunal And The Global Insolvency Crisis, Jayanth K. Krishnan, Harold Koster

This study examines a legal experiment that occurred during the height of the global financial crisis. As markets from the United States to Europe to the Global South shook, one country – the United Arab Emirates (U.A.E.) – found itself on the brink of economic collapse. In particular, in 2009 the U.A.E.’s Emirate of Dubai (Emirate) was contemplating defaulting on $60 billion of debt it had amassed. Recognizing that such a default would have cataclysmic reverberations across the globe, Dubai’s governmental leaders turned to a small group of foreign lawyers, judges, accountants, and business consultants for assistance. To the extent that family law is governed by statute, all families are treated as though they are the same. This is of course consistent with the equal protection guarantees of the U.S. Constitution as well as those of the states. However, in our pluralistic society, all families are not alike. At birth, some children are born to wealthy, married parents who will always put the children’s interests first and will never engage in domestic violence. Many laws benefit these children, while, according to some academics, they either further disadvantage other children or at best ignore their needs.

In this Article, I make an argument that the state, including the Government of India, is empowered by the Constitution of India to decide which classes qualify as “backward classes” for affirmative action measures under the Constitution. The Supreme Court of India has directed the government to include the transgender population as a backward class and to extend to them affirmative action measures such as reservation in public appointments and university admissions. The Maxine Goodman Levin College of Urban Affairs has been the evaluation partner for the Cuyahoga County Foreclosure Prevention Program (CCFPP) since the program was adopted in 2006. This report is an update to the County for 2015. The evaluation provides the County with metrics to track progress and provides feedback about the program that can be used to improve and adapt it to meet the rapidly changing state and national context surrounding foreclosures.
Since consistent tracking began in 2009, the Cuyahoga County foreclosure prevention program has served over 24,000 homeowners at the five participating counseling agencies. In 2015 alone, …

He went to grade school in the mid-fifties when Mexican-American students went to separate schools from Anglo students. These schools did not have all of the resources that were in the Anglo schools. If they spoke Spanish they were paddled. He felt like he did not receive a very challenging elementary education. Over the past 20 years, human trafficking has gained international attention and resulted in the creation of anti-trafficking laws in the United States. Politicians, scholars, and organizations have called for more professional efforts against human trafficking and advocated for better education and awareness to identify victims and prosecute traffickers. Local law enforcement is recognized for its ideal position in communities to combat this crime. In 2011, North Carolina implemented a statewide human trafficking training program for law enforcement. Findings included estimates of sexual violence, physical violence by intimate partners, stalking, and psychological aggression by intimate partners, as well as estimates of interracial and intraracial victimizations.

Nostalgia tourism is very important for the state of Oaxaca, Mexico. In San Juan Bautista Coixtlahuaca, a community in the Mixteca region of Oaxaca, nostalgia tourism, along with remittances, strengthens economic activities, consumption, and household well-being. However, the annual average stay of visitors to the region is low and not enough to sustain local development. This thesis examines the World Banks Latin America and the Caribbean Blue Water Green Cities (BWGC) urban water development initiative that began in 2009. This program attempts to create a comprehensive Integrated Water Resources Management (IWRM) approach for policymakers at both local and national levels, improving water management approaches and disseminating data on lessons learned. This thesis evaluates the success of the BWGC initiative by analyzing Buenos Aires and S\xe3o Paulo as case studies. This article considers what role, if any, can tribal environmental ethics play in the re-examination and consideration of American environmental ethics? The answer—quite a substantial role. Tribes must straddle two worlds—a traditional one and one dominated by Western culture and values. As a result of this dichotomy, tribes are necessarily experts at adaptation and innovation. To demonstrate the value of looking to tribal environmental ethics when considering alternative ethical paradigms for the United States, this article begins by discussing the link between environmental ethics and policy making.
