Negotiated Voluntary Licensing Of Pharmaceuticals: The Strategy Against Compulsory Licensing, Daniel D. Kim
Negotiated Voluntary Licensing Of Pharmaceuticals: The Strategy Against Compulsory Licensing, Daniel D. Kim
American University Intellectual Property Brief
Every fight, every encounter in which the pharmaceutical industry has tried to push back against compulsory licensing has the industry losing ground. Fighting this issue, whether in the World Trade Organization or through local courts, is not working. Here, a number of other strategies to mitigate the threat of compulsory licensing are explored. Some are more successful than others. Perhaps the most successful strategy to date though is the “negotiated voluntary licensing” model, most famously employed by Gilead Pharmaceuticals in India. Negotiated voluntary licensing allows the licensor to control the terms of the licensing agreement, the scope of the market …
The Economic Efficacy Of Reintegration Assistance For Former Child Soldiers, Jonathan B. Kaufmann
The Economic Efficacy Of Reintegration Assistance For Former Child Soldiers, Jonathan B. Kaufmann
Undergraduate Economic Review
There is no consensus among scholars on the efficacy of reintegration assistance programs, including how their services affect reintegration outcomes. This research is the first statistical analysis of the economic impacts of reintegration assistance for former child soldiers. Several regression analyses were performed to determine the effect of reintegration assistance on earnings and social capital. The results indicate that no statistically significant relationship exists between reintegration assistance and earnings or social capital. Conversely, societal interventions such as increasing access to education and promoting traditional cleansing ceremonies were effective.

There is confusion about the role that IFN-α plays in the pathogenesis of pulmonary arterial hypertension (PAH) with different investigators reporting a causative or a protective role. There is now clear evidence in PAH pathogenesis for the involvement of BMP4 and BMP9 signaling, and its disruption by mutations in BMPR2. In the present study, we investigated MxA, an IFN-α-inducible cytoplasmic dynamin-family GTPase for effects on BMP4/9 signaling, including in the presence of PAH-disease-associated mutants of BMPR2. In human pulmonary arterial endothelial cells (HPAECs), IFN-α-induced endogenous as well as exogenously expressed MxA was associated with endosomes that aligned alongside microtubules and …

To effectively eliminate the variety of pathogens that an individual may encounter in their lifetime, the immune system has evolved to recognize many different antigens. Within adaptive immunity there are also safe guards where the self-reactive or defective cells are eliminated (1). The removal of such cells is by apoptosis, which is a form of cell suicide characterized by an orderly breakdown of the cell to limit the leakage of cytoplasmic components that could cause inflammation. Apoptosis can be initiated by signaling through specific cell surface molecules and is carried out by downstream mediators. While several model systems of apoptosis …
Medieval Europe And The Culture Of Contempt In The Age Of The Lateran Councils, Frank P. Lacopo
Medieval Europe And The Culture Of Contempt In The Age Of The Lateran Councils, Frank P. Lacopo
Grand Valley Journal of History
The period in European history frequently dubbed the long twelfth century saw increased social persecution against those who were deemed outsiders by the Christian elite. Much of the standard historiography of the period emphasizes that the era was culturally and intellectually vibrant. However, clerical elites unified against social “others” within this context in the process of protecting their position in a changing Latin Christian society. Jews were deprived of their allodial tenures and forced to adopt undesirable occupations, lepers were made into objects of aversion, and those of supposedly unwholesome sexual orientations, particularly homosexuals, were ostracized. This culture of contempt …

The purpose of this multicenter, prospective, randomized, placebo-controlled study was to evaluate and compare the efficacy of two cognitive rehabilitation interventions (Memory and Attention Adaptation Training (MAAT) and Attention Builders Training (ABT)), with and without pharmacologic enhancement (i.e., with methylphenidate (MPH) or placebo), for treating persistent cognitive problems after traumatic brain injury (TBI). Adults with a history of TBI at least four months prior to study enrollment with either objective cognitive deficits or subjective cognitive complaints were randomized to receive MPH or placebo and MAAT or ABT, yielding four treatment combinations: MAAT/MPH (N=17), ABT/MPH (N=19), MAAT/placebo (N=17), and ABT/placebo (N=18). …
The Time Is Nigh: A Proposal For An International Patent System, Ben Mceniery
The Time Is Nigh: A Proposal For An International Patent System, Ben Mceniery
Chicago-Kent Journal of Intellectual Property
The world is slowly but inexorably moving towards adopting an integrated global patent system. It is inevitable that the present inefficient and splintered system in which patents must be separately obtained and enforced in each nation state must evolve to make obtaining global patent protection an achievable proposition for those other than just the wealthiest multinational corporations. The global patent system proposed in this article allows a patent applicant to file a single patent application in an international patent office, have that patent application examined in accordance with a uniform patentability standard, and results in the grant of a unitary …

In Defense Of Patent Trolls: Patent Assertion Entities As Commercial Litigation Funders, Jean Xiao
In Defense Of Patent Trolls: Patent Assertion Entities As Commercial Litigation Funders, Jean Xiao
Chicago-Kent Journal of Intellectual Property
This paper is the first to defend and commend the role of patent trolls in litigation. It argues that trolls either are not the sole source of patent litigation ills or are not responsible for these ills in the first place. Next, it demonstrates that trolls provide the same litigation-related benefits as commercial litigation funders, which also finance patent lawsuits. Troll commentators have ignored these benefits, for which funders are praised, in the evaluation of trolls. Finally, this paper explains that eliminating trolls will not only close off a source of these benefits but also worsen problems by shifting trolling …

Why The Supreme Court Should Use Ariosa V. Sequenom To Provide Further Guidance On U.S.C. § 101 Patent Eligibility, Naira Rezende Simmons
Chicago-Kent Journal of Intellectual Property
35 U.S.C. § 101 provides patent protection to “any new and useful process, machine, manufacture, or composition of matter, or any new and useful improvement thereof.” The Supreme Court previously concluded that Congress intended patentable subject matter to “include anything under the sun that is made by man.” Nevertheless, over the past five years the U.S. Supreme Court has made a series of decisions that narrowed the scope of subject matter eligible for patent protection.
In Mayo the court held that correlations between the concentrations of a metabolite in the blood and the concentration of a drug are not patent …
