Taking Teacher Quality Seriously, Derek W. Black Jan 2016

Taking Teacher Quality Seriously, Derek W. Black

Faculty Publications

Although access to quality teachers is one of the most important aspects of a quality education, explicit concern with teacher quality has been conspicuously absent from past litigation over the right to education. Instead, past litigation has focused almost exclusively on funding. Though that litigation has narrowed gross fundinggaps between schools in many states, it has not changed what matters most: access to quality teachers.

This Article proposes a break from the traditional approach to litigating the constitutional right to education. Rather than constitutionalizing adequate or equal funding, courts should constitutionalize quality teaching. The recent success of the constitutional challenge …

Spatial Spread Of The West Africa Ebola Epidemic, Andrew M. Kramer, J. Tomlin Pulliam, Laura W. Alexander, Andrew W. Park, Pejman Rohani, John M. Drake Jan 2016

Spatial Spread Of The West Africa Ebola Epidemic, Andrew M. Kramer, J. Tomlin Pulliam, Laura W. Alexander, Andrew W. Park, Pejman Rohani, John M. Drake

Integrative Biology Faculty and Staff Publications

Controlling Ebola outbreaks and planning an effective response to future emerging diseases are enhanced by understanding the role of geography in transmission. Here we show how epidemic expansion may be predicted by evaluating the relative probability of alternative epidemic paths. We compared multiple candidate models to characterize the spatial network over which the 2013–2015 West Africa epidemic of Ebola virus spread and estimate the effects of geographical covariates on transmission during peak spread. The best model was a generalized gravity model where the probability of transmission between locations depended on distance, population density and international border closures between Guinea, Liberia …

Linking Emr To Virtual Care Of Psychiatric Patients In The Acute Care Setting, Howard Louis Beatty Jr. Jan 2016

Linking Emr To Virtual Care Of Psychiatric Patients In The Acute Care Setting, Howard Louis Beatty Jr.

MUSC Theses and Dissertations

The purpose of this study is to test if the implementation of the Tele-Psychiatric Consultation Process (built within the FirstNet (Cerner/EMR) application, which pulls the patient’s current EMR encounter from multiple facility locations to a different physical facility location for consultation) provided increased quality by decreasing in total length of stay. The coordination of virtual care consultations allows for inter-practice data exchange for multi-provider clinical decision support. Documentation of medications and treatment regimens, which may be unfamiliar to the acute care provider, are provided through virtual tele-psychiatric consultations. An eTracking queue within FirstNet was built in-house by Carolinas Healthcare System …

Forced Migration & Health: A Course Proposal, Lauren Ashle Gaston-Hawkins Jan 2016

Forced Migration & Health: A Course Proposal, Lauren Ashle Gaston-Hawkins

Public Health Theses

Forced migration is poised to be one of the leading public health issues of our time. The Syrian refugee crisis in particular has placed issues of forced migration firmly in the consciousness of everyday people in developed nations in a way that has not occurred arguably since the genocide in Rwanda. Thus it is important to capitalize on this moment of awareness to prepare future leaders and public health advocates to effectively address the host of issues that accompany the forced migration of populations. As the number of forced migrants increase and represents a larger proportion of the world’s population, …

Conscientization & Third Space: A Case Study Of A Tunisian Activist, Habiba Boumlik, Joni Schwartz

Publications and Research

This article examines the role of a female cyber and social activist, Amira Yahyaoui, in the aftermaths of the Jasmine Revolution in Tunisia through the lens of adult education. In this case study, the theoretical frameworks of conscientization and third space are utilized to describe Yahyaoui’s development of the watchdog political organization, al-bawsala, for the purpose of transformative learning and knowledge transmission in regard to political practices toward democracy in Tunisia. The focus will be on platforms used by this non-governmental organization (NGO), Al-Bawsala, to educate and raise political consciousness; these participatory platforms are: marsad (parliamentary observatory), debates or town …

Integration Of English And Social Studies, Craig Jeppson, Kasie Payne Jan 2016

Integration Of English And Social Studies, Craig Jeppson, Kasie Payne

The Utah English Journal

One day while eating lunch in the faculty lounge, Kasie commented on a lesson that her students had learned in Craig’s class. As we started to compare notes, it occurred to us that we shared a lot of students. Over the course of that year, we continued to share thoughts, lessons, war stories and even engaged in a little competitive banter. What became increasingly clear was that our classes complemented each other. Craig could guide students to answer content-related geography questions such as: “How can countries grow economically and sustainably?”, “Why do people fight?”, and “How does the physical environment …

An Integrated Hydrodynamic-Marsh Model With Applications In Fluvial, Marine, And Mixed Estuarine Systems, Karim Alizad Jan 2016

An Integrated Hydrodynamic-Marsh Model With Applications In Fluvial, Marine, And Mixed Estuarine Systems, Karim Alizad

Electronic Theses and Dissertations

Coastal wetlands experience fluctuating productivity when subjected to various stressors. One of the most impactful stressors is sea level rise (SLR) associated with global warming. Research has shown that under SLR, salt marshes may not have time to establish an equilibrium with sea level and may migrate landward or become open water. Salt marsh systems play an important role in the coastal ecosystem by providing intertidal habitats and food for birds, fish, crabs, mussels, and other animals. They also protect shorelines by dissipating flow and damping wave energy through an increase in drag forces. Due to the serious consequences of …

El Español En Los Estados Unidos: Panorama De Estudios Sociolingüísticos, Lotfi Sayahi, Juanita Reyes, Cecily Corbett

Languages, Literatures and Cultures Faculty Scholarship

The aim of this paper is to present the principal areas of sociolinguistic research concerning Spanish spoken in the United States. In doing so, we focus on a variety of topics ranging from macro-sociolinguistic issues, such as the sociology of language, to micro-sociolinguistic features having more to do with language variation and change. In our discussion of bilingualism and sociology of language, we explore the situation faced by Spanish speakers in the United States, including discussions of language policies and bilingual education. We also examine cases of contact between various dialects of Spanish in the United States, and some variable …

America's National Cemeteries: A Resource Guide For College Instructors [Instructional Guide], Thomas G. Connors Jan 2016

America's National Cemeteries: A Resource Guide For College Instructors [Instructional Guide], Thomas G. Connors

Open Educational Resources

Developing a Tour of a National Cemetery

There are many ways to view or approach the study of a national cemetery. Each cemetery has a unique history but also fits some general patterns. The most obvious focus of study would be on the history of the cemetery itself or the lives of those commemorated there. Another approach would be through architecture and design, the style of the structures, or the layout of the grounds. A more scientific emphasis might focus on the landscape, its flora, and its wildlife, and investigate what life is supported among the manicured lawns. The geography …

Can Continental Bogs With Stand The Pressure Due To Climate Change?, Nigel T. Roulet, E R. Humphreys, Jianghua Wu, Steve Frolking, Julie Talbot, P M. Lafleur, Tim Moore

Earth Sciences

Not all peatlands are alike. Theoretical and process based models suggest that ombrogenic, oligotrophic peatlands can withstand the pressures due to climate change because of the feedbacks among ecosystem production, decomposition and water storage. Although there have been many inductive explanations inferring from paleo-records, there is a lack of deductive empirical tests of the models predictions of these systems’ stability and there are few records of the changes in the net ecosystem carbon balance (NECB) of peatlands that are long enough to examine the dynamics of the NECB in relation to climate variability. Continuous measurements of all the components of …

The Return Of Coverture, Allison Anna Tait Jan 2016

The Return Of Coverture, Allison Anna Tait

Michigan Law Review First Impressions

Once, the notion that husbands and wives were equal partners in marriage seemed outlandish and unnatural. Today, the marriage narrative has been reversed and the prevailing attitude is that marriage has become an increasingly equitable institution. This is the story that Justice Kennedy told in Obergefell v. Hodges, in which he described marriage as an evolving institution that has adapted in response to social change such that discriminatory marriage rules no longer apply. Coverture exemplifies this change: marriage used to be deeply shaped by coverture rules and now it is not. While celebrating the demise of coverture, however, the …

Virtual Violence - Disruptive Cyberspace Operations As "Attacks" Under International Humanitarian Law, Ido Kilovaty Jan 2016

Virtual Violence - Disruptive Cyberspace Operations As "Attacks" Under International Humanitarian Law, Ido Kilovaty

Michigan Telecommunications & Technology Law Review

Power outages, manipulations of data, and interruptions of Internet access are all possible effects of cyber operations. Unfortunately, recent efforts to address and regulate cyberspace operations under international law often emphasize the uncommon, though severe, cyber-attacks that cause deaths, injuries, or physical destruction. This paper deals with cyber operations during armed conflicts that cause major disruption or interruption effects – as opposed to deaths, injuries, or physical destruction. The purpose of this paper is to explore the consequences of these cyber operations that cause major disruption or interruption effects, and to argue that they might still constitute “acts of violence,” …

Eighth Amendment's Lost Jurors: Death Qualification And Evolving Standards Of Decency, Aliza Plener Cover Jan 2016

Eighth Amendment's Lost Jurors: Death Qualification And Evolving Standards Of Decency, Aliza Plener Cover

Articles

The Supreme Court’s inquiry into the constitutionality of the death penalty has overlooked a critical “objective indicator” of society’s “evolving standards of decency”: the rate at which citizens are excluded from capital jury service under Witherspoon v. Illinois due to their conscientious objections to the death penalty. While the Supreme Court considers the prevalence of death verdicts as a gauge of the nation’s moral climate, it has ignored how the process of death qualification shapes those verdicts. This blind spot biases the Court’s estimation of community norms and distorts its Eighth Amendment analysis.

This Article presents a quantitative study of …

Adaptive Governance Of Water Resources Shared With Indigenous Peoples: The Role Of Law, Barbara Cosens Jan 2016

Adaptive Governance Of Water Resources Shared With Indigenous Peoples: The Role Of Law, Barbara Cosens

Articles

Adaptive governance is an emergent phenomenon resulting from the interaction of locally driven collaborative efforts with a hierarchy of governmental regulation and management and is thought to be capable of navigating social-ecological change as society responds to the effects of climate change. The assertion of Native American water rights on highly developed water systems in North America has triggered governance innovations that resemble certain aspects of adaptive governance, and have emerged to accommodate the need for Indigenous water development and restoration of cultural and ecological resources. Similar innovations are observed in the assertion of Indigenous voices in Australia. This presents …

Decoding Eligibility Under The Idea: Interpretations Of “Adversely Affect Educational Performance”, Jamie Lynne Thomas Jan 2016

Decoding Eligibility Under The Idea: Interpretations Of “Adversely Affect Educational Performance”, Jamie Lynne Thomas

Campbell Law Review

The Individuals with Disabilities Education Act (IDEA) strives to provide children with disabilities equal access to free appropriate public education in order to prepare them for further education, employment, and independent living. The determination that a child qualifies as a “child with a disability” under the IDEA is a pivotal one in the child’s life and can drastically impact his/her future. Once found eligible, the child gains access to the spectrum of resources, safeguards, and benefits that the IDEA guarantees. The contours of the key that opens that door should be well-defined and clear. The IDEA standards for eligibility, however, …

The Swift Water Place: Water Quality, Fish Ecology, And Hydropower In The Merrimack River Since The Time Of Thoreau, Timothy Melia Jan 2016

The Swift Water Place: Water Quality, Fish Ecology, And Hydropower In The Merrimack River Since The Time Of Thoreau, Timothy Melia

Doctoral Dissertations

The Merrimack River and its landscape reflect the priorities that have shaped the stream for two centuries. When Henry David Thoreau and his brother John put their dory into the Merrimack in September of 1839, they were paddling into a landscape that was shifting towards water-powered industries and mill cities. The legal transformation of water and the completion of the Great Stone Dam at Lawrence in 1847 spelled the end of the anadromous fish runs that had populated the Merrimack for centuries. Salmon restoration proceeded for three decades after the Civil War until fish passage failed. Later, water filtration plants …

Computationally Efficient Specifications Of Spatial Point Process Models And Spatio-Temporal Gaussian Models: Combining Remote Sensing Drivers With Geospatial Disease Case Data To Enhance Geographic Epidemiology, Beth Louise Ziniti Jan 2016

Computationally Efficient Specifications Of Spatial Point Process Models And Spatio-Temporal Gaussian Models: Combining Remote Sensing Drivers With Geospatial Disease Case Data To Enhance Geographic Epidemiology, Beth Louise Ziniti

Doctoral Dissertations

In this dissertation, the flexibility of Bayesian hierarchical models specified using a latent Gaussian Markov Random Field (GMRF) are evaluated for use in analyzing large complex spatial and spatio-temporal data with the goal of contributing to an interdisciplinary effort of developing an eco-epidemiological model that quantifies the relationship between remotely sensed water quality and the incidence of ALS (Amyotrophic Lateral Sclerosis or Lou Gehrig’s Disease) over large areas such as Northern New England (NNE).

In particular, a Log-Gaussian Cox Process (LGCP) specified by the logarithm of a GMRF on a regular lattice is shown to allow for simultaneous estimation of …

Sari Not Sorry: A Discussion On Whether Or Not Gulabi Gang's Feminist Vigilantism Is Necessary In A Welfare State, Namrata Mohan

Scripps Senior Theses

The Gulabi Gang is a feminist vigilante based in northern India. They are known as a group that uses physical violence to fight systems of oppressive power. The idea of a Gulabi Gang vigilante, interacting with the people and the state will be discussed, while incorporating John Locke’s social contract theory into the argument as a way to critique vigilantism, or as a basis of critique to then argue why the Gulabi Gang’s vigilantism is necessary. After both sides of argument are weighed, possible solutions of how the Gulabi Gang can better their organization will be discussed in the concluding …

The Female Human Trafficker In The Criminal Justice System: A Test Of The Chivalry Hypothesis, Brielle Francis Jan 2016

The Female Human Trafficker In The Criminal Justice System: A Test Of The Chivalry Hypothesis, Brielle Francis

Electronic Theses and Dissertations

The involvement of women in human trafficking within the United States has received limited research attention. Human trafficking encompasses labor, sex, and organ trafficking (Roberts, 2012). In 2009 the United Nations Office on Drugs and Crime (UNODC) reported that women play a significant role in human trafficking. Nagel and Johnson (1994) conclude that, historically, female offenders have stayed at the edge of the criminal justice system. Generally, theories about prosecution and conviction outcomes derive from the study of male offenders. Women can be involved in all aspects of the human trafficking organizations, from the recruitment, to the supervision of prostitutes …

In Janet Dempster's Footsteps: Reminiscence, David Harper

The George Eliot Review Online, ISSN: 2831-5375

The road from Trent Valley Station down towards the town centre curves gently past the row of horse-chestnuts in Bond Gate with their white candles. To the young boy arriving to take up residence in Nuneaton it promised something new, always interesting, always just out of reach.

From my earliest years I was a keen reader and felt the privilege of our local author's being one of the unquestioned greats; but it was George Eliot's north Warwickshire that initially attracted me, with The Mill on the Floss and Si/as Marner my favourites. This was reinforced by cycling the lanes for …

An Ecotoxicological Survey Of Tributaries Of The Selenge River, Mongolia, August 2010, Viktor T. Komov, Ch. Javzan, William G. Brumbaugh

Erforschung biologischer Ressourcen der Mongolei / Exploration into the Biological Resources of Mongolia, ISSN 0440-1298

The biodiversity of the Selenga river basin and the receiving waters of the lake Baikal, are among the greatest in the world with over 1,700 known endemic species of plants and animals. Mining activities along the Selenga river and its tributaries pose a major threat of chemical contamination, potentially reducing habitat quality and suitability for aquatic species. Moreover, the Selenga river serves as a major water source for the lake Baikal. Little information exists on the chemical contaminant concentrations in the Selenga river basin. Thus, the objectives of our study were to evaluate the concentrations of metals in soil, sediment, …
