“I Am Because We Are”: A Portrait Of Trans* Postsecondary Educators’ Experiences In Higher Education, Symone L. Simmons Jan 2016

“I Am Because We Are”: A Portrait Of Trans* Postsecondary Educators’ Experiences In Higher Education, Symone L. Simmons

Dissertations

Within higher education, trans* students have become more visible and advocacy for them important. To support these claims, scholars have conducted research and produced literature on trans* college students’ identity development and experiences on campuses. However, the lived experiences of trans* educators working in colleges and universities are missing from the literature, consequently from the minds of scholars, practitioners, and administrators alike. Trans* educators experiences are important because they contribute to shifts in higher education conversations around supporting and affirming trans* people on campus. Trans* educators are mentors, advisors, and role-models, teachers, and advocates, and perhaps knowing their journey and …

The Relation Of Exposure To Community Violence To Self- Efficacy Based On Neighborhood, Family, And School Effects In A Community Sample Of Latino-American Youth, Arie Zakaryan Jan 2016

The Relation Of Exposure To Community Violence To Self- Efficacy Based On Neighborhood, Family, And School Effects In A Community Sample Of Latino-American Youth, Arie Zakaryan

Dissertations

Community violence is considered a “public health epidemic” in the US. Latino youth and families are a burgeoning population in the United States, and many of whom live in neighborhoods exposed to community violence. Multiple contexts should be assessed identifying developmental assets youth use to adjust positively when exposed to violence. This study examines how different environmental contexts, i.e., home, school, neighborhood and acculturation, influence the relationship between exposure to community violence and self-efficacy for Latino youth. The current study uses an archival dataset of a larger longitudinal study (Project on Human Development in Chicago Neighborhoods). A confirmatory factor analysis …

Communication Asset Mapping: An Ecological Field Application Toward Building Healthy Communities, George Villanueva, Garrett M. Broad, Carmen Gonzalez, Sandra Ball-Rokeach, Sheila Murphy

School of Communication: Faculty Publications and Other Works

Guided by an integrated theoretical approach combining communication infrastructure theory with methods of assets-oriented community field mapping, this study reports the findings of an engaged scholarship project we term communication asset mapping (CAM). Ecological in orientation and participatory in practice, CAM represents a tool for analyzing urban spaces’ potential as mediums for building healthy communities. This article offers two case studies from different low-income neighborhoods in Los Angeles, the first a researcher-directed CAM application and the second undertaken in collaboration with community health promotion workers. Both offer insights for researchers and practitioners interested in the intersecting roles of communication and …

Ecological Factors Promoting Academic Resilience Of Latina Students, Rebecca Testa-Ryan Jan 2016

Ecological Factors Promoting Academic Resilience Of Latina Students, Rebecca Testa-Ryan

Dissertations

To enhance the academic success of Latina students, researchers and educators must move away from focusing on deficits and risks and concentrate more on student potential and environmental support, which have been found to successfully open pathways to academic achievement. By shifting the focus, stakeholders can gain an understanding of the educational experiences of Latina students considered on a pathway of educational failure and the processes that can contribute instead to their academic resilience. In this qualitative study, I investigate the ecological factors that influence and impact the academic resiliency of Latina students. Urie Bronfenbrenner’s Ecological System Theory of Human …

Individual Criminal Accountability After Civil Wars: Enforced Disappearances In Algeria And Turkey, Jessica Mecellem Jan 2016

Individual Criminal Accountability After Civil Wars: Enforced Disappearances In Algeria And Turkey, Jessica Mecellem

Dissertations

Increasingly, around the world, individuals are being held criminally accountable for human rights violations (Olsen, Payne and Reiter 2010; Sikkink 2011; Kim & Sikkink 2010, 2012; Kim 2010, 2012; Sriram 2005; Lutz & Reiger 2009). Katherine Sikkink

(2011) characterized this change as a normative shift toward individual criminal accountability, which has resulted in a “justice cascade”, or a “revolution in accountability” (Sriram 2005). Much of the justice cascade literature has focused on the role of trials in democratizing countries. In contrast, this dissertation examines the impact of the norm of individual criminal accountability in two non-democratizing post-conflict contexts: Algeria and …

Making Sense Of Email Addresses On Drives, Neil C. Rowe, Riqui Schwamm, Michael R. Mccarrin, Ralucca Gera Jan 2016

Making Sense Of Email Addresses On Drives, Neil C. Rowe, Riqui Schwamm, Michael R. Mccarrin, Ralucca Gera

Journal of Digital Forensics, Security and Law

Drives found during investigations often have useful information in the form of email addresses which can be acquired by search in the raw drive data independent of the file system. Using this data we can build a picture of the social networks that a drive owner participated in, even perhaps better than investigating their online profiles maintained by social-networking services because drives contain much data that users have not approved for public display. However, many addresses found on drives are not forensically interesting, such as sales and support links. We developed a program to filter these out using a Naïve …

Beliefs And Relationships During Children’S Transition To School: Parents, Practitioners And Teachers, Karen Wickett Jan 2016

Beliefs And Relationships During Children’S Transition To School: Parents, Practitioners And Teachers, Karen Wickett

Plymouth Institute of Education Theses

Young children’s experiences, which include their transition to school, can influence not only their academic outcomes but also their life chances. This understanding has led to governments in England investing in the Early Childhood Education and Care (ECEC) sector over the past 20 years. Over time a “discourse of readiness” has become increasingly apparent in ECEC policies. The revised Early Years Foundation Stage (EYFS) (DfE, 2012a) framework states that the purpose of the framework is to ensure children are ready for school. Increased political involvement in the sector has led to parents/families, ECEC practitioners and teachers sharing the task of …

Acquiring The Right To Get To The Light At The End Of The Tunnel: Rationalising Property Theory, Jonathan T. Ward Jan 2016

Acquiring The Right To Get To The Light At The End Of The Tunnel: Rationalising Property Theory, Jonathan T. Ward

The Plymouth Law and Criminal Justice Review

The framework of private property theory has come under increasing scrutiny over recent years. The orthodox bundle theory of ownership and labour principle of first acquisition has been the subject of attack and scepticism. This discussion suggests a new approach to the analysis of property, focus on synthesis rather than contrast. Further, the classic differences between Roman Law and Anglo-American common law, it is argued here, are in fact more apparent than real – their similarities reveal the basis for a universal grammar in property discourse. An examination of the contemporary property theories identifies that it is time to shift …

An Introduction To Corporate Insolvency Law, Hamish Anderson Jan 2016

An Introduction To Corporate Insolvency Law, Hamish Anderson

The Plymouth Law and Criminal Justice Review

English law provides three forms of insolvency proceeding for companies: liquidation, administration and company voluntary arrangements. This paper begins by examining the nature and purpose of insolvency law, the concepts of insolvency and insolvency proceedings, how insolvency practice is regulated and the role of the court. It then considers the sources of the law before describing the distinguishing characteristics of liquidation, administration and company voluntary arrangements. Finally, it deals with the sanctions for malpractice, transaction avoidance and cross-border insolvency.

Alleviating The 'Miserable Condition': Fitzjames Stephen And The Development Of Modern Abortion Law, Kate Gleeson Jan 2016

Alleviating The 'Miserable Condition': Fitzjames Stephen And The Development Of Modern Abortion Law, Kate Gleeson

The Plymouth Law and Criminal Justice Review

Contemporary English abortion law is now typically thought to be a development of the twentieth century, and little academic attention has been paid to its development before the 1938 case of R v Bourne or the Abortion Act 1967. Sir James Fitzjames Stephen's nineteenth century perspectives on pregnancy, abortion and the doctrine of necessity informing the basis of contemporary governance of abortion, child destruction, and infanticide as distinct from homicide, are often overlooked. Stephen understood abortion, child destruction and infanticide as distinct crimes with a common motivation and intention. The desperation of women to conceal or remedy the 'miserable' and …

A Point Of Justice - Granted Or Fought For? Women's Suffrage Campaigns In Plymouth And The West Country, Judith Rowbotham, Kim Stevenson

The Plymouth Law and Criminal Justice Review

The release of the film Suffragette in October 2015, surprisingly the first major feature film on the women's suffrage movement, has raised public consciousness about the issue of women's rights and the role of the suffragettes in demanding votes for women with their call to arms of 'deeds, not words'. But decades before the Women's Social and Political Union was created in 1903 campaigners across the country had begun the struggle for emancipation for women. We argue that the film therefore needs to be seen in a wider context including the high level of male support for the cause and …

Does Julian Assange Illustrate A Gap In Law That Should Be Codified?, Hamish Tye Jan 2016

Does Julian Assange Illustrate A Gap In Law That Should Be Codified?, Hamish Tye

The Plymouth Law and Criminal Justice Review

This article dissects the legality and purpose of diplomatic asylum, an intrinsically controversial area of international law. It becomes evident that diplomatic asylum residing in a grey area of international law suits many states. It provides an opportunity to reject diplomatic asylum as illegal when it suits a state but grant diplomatic asylum when an opportune moment arises. I conclude that it would be appropriate to introduce a form of diplomatic asylum internationally. Diplomatic asylum appears as a legal concept which persists in providing politically persecuted individuals protection regardless of the criticism grants of diplomatic asylum receive. Therefore Julian Assange …

Shattering The Glass Ceiling In International Adjudication, Nienke Grossman Jan 2016

Shattering The Glass Ceiling In International Adjudication, Nienke Grossman

All Faculty Scholarship

The Article shows that women are found in dramatically low numbers on the benches of the majority of the world’s most important international courts, analyzes the causes of this phenomenon and proposes and evaluates solutions. It establishes that the number of women in the pool of potential judges does not appear to dictate how many women become international judges. It shows, too, that when selection procedures are closed and opaque, and there is no quota or aspirational target for a sex-balanced bench, women obtain international judgeships in disproportionately low numbers. On the other hand, when a quota or aspirational target …

Evolving Contours Of Immigration Federalism: The Case Of Migrant Children, Elizabeth Keyes Jan 2016

Evolving Contours Of Immigration Federalism: The Case Of Migrant Children, Elizabeth Keyes

All Faculty Scholarship

In a unique corner of immigration law, a significant reallocation of power over immigration has been occurring with little fanfare. States play a dramatic immigration gatekeeping role in the process for providing protection to immigrant youth, like many of the Central American children who sought entry to the United States in the 2014 border “surge.” This article closely examines the history of this Special Immigrant Juvenile Status provision, enacted in 1990, which authorized a vital state role in providing access to an immigration benefit. The article traces the series of shifts in allocation of power between the federal government and …

Constitutional Law And Rhetoric, Colin Starger Jan 2016

Constitutional Law And Rhetoric, Colin Starger

All Faculty Scholarship

What are the legitimate types of argument in constitutional debate? This is a perennial question in American law and every generation of constitutional scholars has the right to ask it anew. For over thirty years, Phillip Bobbitt’s taxonomy of legitimate constitutional argument types has reigned as the most influential and enduring in the scholarly discourse. In a recent article, Jamal Greene has proposed a welcome but flawed rhetorical re-conception of Bobbitt’s venerable typology. By identifying and correcting the errors in Greene’s framework, this Article provides a rigorous theoretical grounding for the entire constitutional law and rhetoric project.

When properly grounded, …

Modified Modis Fluorescence Line Height Data Product To Improve Image Interpretation For Red Tide Monitoring In The Eastern Gulf Of Mexico, Chuanmin Hu, Lian Feng Jan 2016

Modified Modis Fluorescence Line Height Data Product To Improve Image Interpretation For Red Tide Monitoring In The Eastern Gulf Of Mexico, Chuanmin Hu, Lian Feng

Marine Science Faculty Publications

Several satellite-based methods have been used to detect and trace Karenia brevis red tide blooms in the eastern Gulf of Mexico. Some require data statistics and multiple data products while others use a single data product. Of these, the MODIS normalized fluorescence line height (nFLH) has shown its advantage of detecting blooms in waters rich in colored dissolved organic matter, thus having been used routinely to assess bloom conditions by the Florida Fish and Wildlife Conservation Commission (FWC), the official state agency of Florida responsible for red tide monitoring and mitigation. However, elevated sediment concentrations in the water column due …

Maryland's Family Divisions Are A Model For Change, Barbara A. Babb, Gloria Danziger, Michele H. Hong-Polansky Jan 2016

Maryland's Family Divisions Are A Model For Change, Barbara A. Babb, Gloria Danziger, Michele H. Hong-Polansky

All Faculty Scholarship

In fiscal year 2014, 43 percent of all cases filed in Maryland’s trial court of general jurisdiction (the circuit court) were family law cases (Court Operations Department, 2014: CC-5). Historically, Maryland courts, like many states’ family justice systems, lacked a uniform structure to consolidate family law issues for an individual family. As a result, families often faced multiple hearings before different judges in different courtrooms to address a variety of issues, such as divorce, domestic violence, delinquency, and child abuse/neglect. This system created tremendous hardship for families (particularly low-income families, many of whom were self-represented litigants) and resulted in fragmented …

Evaluating The Impacts Of Integrating Fisheries And Conservation Management, Sarah Gall Jan 2016

Evaluating The Impacts Of Integrating Fisheries And Conservation Management, Sarah Gall

Other Faculty of Science and Engineering Theses

Historically, the governance streams of fisheries and conservation management have run separately to one another, with little attempt at integration despite their similar goals. Efforts to integrate the two have increased as a result of their similarities and the potential benefits that may arise, but a requirement for additional research was identified to determine the effectiveness of this approach. This thesis therefore took an interdisciplinary approach, seeking to combine knowledge and methods from ecological, social and economic disciplines to provide a holistic evaluation of the potential for success. Marine Protected Areas (MPAs) were chosen as a management tool to evaluate …

Tommy Atkins, War Office Reform And The Social And Cultural Presence Of The Late-Victorian Army In Britain, C.1868-1899, Edward Peter Joshua Gosling Jan 2016

Tommy Atkins, War Office Reform And The Social And Cultural Presence Of The Late-Victorian Army In Britain, C.1868-1899, Edward Peter Joshua Gosling

Other Faculty of Arts, Humanities and Business Theses

This thesis examines the development of the soldier in late-Victorian Britain in light of the movement to rehabilitate the public image of the ordinary ranks initiated by the Cardwell-Childers Reforms. Venerated in popular culture, Tommy Atkins became a symbol of British imperial strength and heroism. Socially, however, attitudes to the rank-and-file were defined by a pragmatic realism purged of such sentiments, the likes of which would characterise the British public’s relationship with their army for over thirty years. Scholars of both imperial culture and the Victorian military have identified this dual persona of Tommy Atkins, however, a dedicated study into …
