Do Corporate Compliance Programs Really Prevent Corporate Wrongdoing? Of Course They Do!, John T. Boese Jan 2016

Do Corporate Compliance Programs Really Prevent Corporate Wrongdoing? Of Course They Do!, John T. Boese

Emory Business Law Review

For over 30 years since leaving the Justice Department in 1977, Mr. Boese has represented corporate and institutional defendants in civil and criminal fraud investigations and lawsuits in various industries. Initially defending those in the defense industry, Mr. Boese's practice evolved into representing many for-profit and non-profit hospitals and other healthcare companies, as well as companies in the oil and gas, import/export, insurance, and financial services industries. His particular area of expertise is defending False Claims Act lawsuits, which led him into internal investigations, corporate criminal defense, and resolution of ancillary agency suspension, debarment and exclusion proceedings arising from these …

Corporate Compliance Programs: Pretext Or Panacea?, Justin S. Brooks Jan 2016

Corporate Compliance Programs: Pretext Or Panacea?, Justin S. Brooks

Emory Business Law Review

Justin S. Brooks' article discusses the effectiveness of corporate compliance programs and factors characterizing well-designed ones. The article explains that mandates to maximize profits for shareholders can encourage bad behavior by officers and directors but that countervailing factors encourage the development and implementation of effective compliance programs. In response to specific questions posed, the author explains that: (1) corporate compliance programs can both weed out non-meritorious or frivolous complaints and facilitate internal and external reporting of meritorious evidence of misconduct; (2) corporate compliance programs sensitize employees to the fact that wrongdoing is plausible, but written directives, communications, and training by …

Differentiating Deference, Anya Bernstein Jan 2016

Differentiating Deference, Anya Bernstein

Journal Articles

When an administrative agency’s interpretation of an ambiguous statutory term is challenged in court, the Chevron doctrine instructs judges to evaluate whether it is reasonable. But how does a court know reasonableness when it sees it? Here, I first show that reasonableness review is more complex than it might seem. Contrary to common images, for instance, courts do not determine a range of reasonable interpretations; and that is a good thing, because they are not competent to do so. Moreover, because traditional statutory interpretation approaches presume the existence of one correct meaning for a given word, they are not well …

Justice Brennan And The Foundations Of Human Rights Federalism, James A. Gardner Jan 2016

Justice Brennan And The Foundations Of Human Rights Federalism, James A. Gardner

Journal Articles

In a well-known and widely cited 1977 law review article, Justice William J. Brennan called on state courts to “step into the breach” and use their authority as independent interpreters of state constitutions to continue on the state level the expansion of individual liberties begun on the national level by the Warren Court. Justice Brennan was right about the importance of independent state constitutional law, but he was wrong about the reason. The benefits of independent state constitutional law have little to do with expanding human rights and everything to do with federalism. The confusion is understandable; both individual rights …

Practice-Driven Changes To Constitutional Structures Of Governance, James A. Gardner Jan 2016

Practice-Driven Changes To Constitutional Structures Of Governance, James A. Gardner

Journal Articles

Among the methods of informal constitutional change, perhaps the least studied or understood is change resulting from alterations in the way governance is practiced. Such changes, typically initiated by political actors in the executive and legislative branches, is probably the most common kind of constitutional change, and is almost certainly the most common source of informal change to structural provisions. In the United States, the best known instances of practice-driven changes to constitutional structure come from the federal level – the rise of a formal party system, for example, or the dramatic twentieth-century expansion of presidential power. Yet by far …

Possible Futures For Teacher Education Programs: Meta-Theory Orientation, Jared C. Svendsen Jan 2016

Possible Futures For Teacher Education Programs: Meta-Theory Orientation, Jared C. Svendsen

Electronic Theses and Dissertations 2010 - 2019

This study problematizes teacher education, and its accreditation guidelines as set forth by the Council for the Accreditation of Educator Preparation. The analysis herein conceptualizes teacher education as contextually contingent on sociocultural metanarratives, as functioning paradigmatically through consensus and gatekeeping mechanisms, and as a structure existing within a matrix of discipline and surveillance that is designed to perpetuate status quo power dynamics. This conceptualization grounds dominant teacher education modalities within a specific meta-theory orientation. Through this analysis, the author also explores an alternative conceptualization of teacher education that appeals to the educative power of contextual awareness, ontological sensitivity, and democratically …

American Robins (Turdus Migratorius) And Cedar Waxwings (Bombycilla Cedrorum) Vary In Use Of Cultivated Cherry Orchards, Rachael A. Eaton, Catherine A. Lindell, Jeffrey Homan, George M. Linz, Brian A. Maurer Jan 2016

American Robins (Turdus Migratorius) And Cedar Waxwings (Bombycilla Cedrorum) Vary In Use Of Cultivated Cherry Orchards, Rachael A. Eaton, Catherine A. Lindell, Jeffrey Homan, George M. Linz, Brian A. Maurer

United States Department of Agriculture Wildlife Services: Staff Publications

Some fruit-eating bird species commonly consume cultivated fruit. Species-specific variation in diet preferences could result in varying use of orchards and impacts on the fruit-producing industry. However, species specific studies of avian orchard use are lacking, particularly throughout the fruit-growing season. Our objectives were to quantify the frequency of daily bird visits to orchards and the amount of time birds spent visiting orchards each day over the fruit-ripening season. Birds are well-documented consumers of cultivated sweet cherries (Prunus avium), which are relatively high in sugar and low in proteins and lipids. American Robins (Turdus migratorius) and …

Identification Of Robust Microsatellite Markers For Wild Pig Fecal Dna, Elizabeth M. Kierepka, Shem D. Unger, David A. Keiter, James C. Beasley, Olin E. Rhodes Jr., Fred L. Cunningham, Antoinette J. Piaggio Jan 2016

Identification Of Robust Microsatellite Markers For Wild Pig Fecal Dna, Elizabeth M. Kierepka, Shem D. Unger, David A. Keiter, James C. Beasley, Olin E. Rhodes Jr., Fred L. Cunningham, Antoinette J. Piaggio

United States Department of Agriculture Wildlife Services: Staff Publications

Collection of fecal samples for use in a genetic capture-mark-recapture framework has become popular as a noninvasive method of monitoring wildlife populations. A major caveat to this process, however, is that fecal samples often yield low quality DNA that is prone to genotyping errors, potentially leading to biases in population parameter estimation. Therefore, considerable care is required to identify robust genetic markers, especially in hot or humid conditions that may accelerate DNA degradation. We identified microsatellite loci in wild pig (Sus scrofa) fecal samples that were robust and informative within warm, humid ecosystems. To examine how degradation affected …

Effects Of Simulated Removal Activities On Movements And Space Use Of Feral Swine, Justin W. Fischer, Dan Mcmurty, Chad R. Blass, W. David Walter, Jeff Beringer, Kurt C. Vercauteren Jan 2016

Effects Of Simulated Removal Activities On Movements And Space Use Of Feral Swine, Justin W. Fischer, Dan Mcmurty, Chad R. Blass, W. David Walter, Jeff Beringer, Kurt C. Vercauteren

United States Department of Agriculture Wildlife Services: Staff Publications

Abundance and distribution of feral swine (Sus scrofa) in the USA have increased dramatically during the last 30 years. Effective measures are needed to control and eradicate feral swine populations without displacing animals over wider areas. Our objective was to investigate effects of repeated simulated removal activities on feral swine movements and space use.We analyzed location data from 21 feral swine that we fitted with Global Positioning System harnesses in southern MO, USA. Various removal activities were applied over time to eight feral swine before lethal removal, including trapped-and-released, chased with dogs, chased with hunter, and chased with …

Natural Product Studies Of Marine Organisms From The Western Atlantic, Andrew Hall Jan 2016

Natural Product Studies Of Marine Organisms From The Western Atlantic, Andrew Hall

Electronic Theses and Dissertations 2010 - 2019

The projects described in this dissertation are focused on compounds derived from marine organisms collected from the western Atlantic marine environment. Chapter 1 provides an introduction to the study of natural products chemistry, marine natural products, and overview of the research undertaken from natural product chemists. Chapter 2 describes the isolation and structure elucidation of a series of rare diterpenoids from the gorgonian Briareum asbestinum, together with their conformational analysis and biosynthetic interconversions. These rare diterpenes from Briareum asbestinum are linked by an unusual transannular oxa-6π electrocyclization which is described in detail and this work demonstates the biomimetic hemisynthesis of …

New Geometric Large Sets, Michael Robert Hurley Jan 2016

New Geometric Large Sets, Michael Robert Hurley

Electronic Theses and Dissertations 2010 - 2019

Let V be an n-dimensional vector space over the field of q elements. By a geometric t-[q^n, k, λ] design we mean a collection D of k-dimensional subspaces of V, called blocks, such that every t-dimensional subspace T of V appears in exactly λ blocks in D. A large set, LS [N] [t, k, q^n], of geometric designs is a collection on N disjoint t-[q^n, k, λ] designs that partitions [V K], the collection of k-dimensional subspaces of V. In this work we construct non-isomorphic large sets using methods based on incidence structures known as the Kramer-Mesner matrices. These structures …
