Patent Anticipation And Obviousness As Possession, Timothy R. Holbrook Jan 2016

Patent Anticipation And Obviousness As Possession, Timothy R. Holbrook

Emory Law Journal

The concept of possession in property law operates to allocate property rights among competing claimants by awarding the property to the first to take possession. Possession in this context requires an act that communicates to third parties that someone has exercised dominion over the item. Patent law operates in similar ways. The doctrines of novelty and non-obviousness ask, in essence, whether the public was already in possession of the invention prior to the inventor. If so, then the patent application should be rejected. This possession-based view of novelty and non-obviousness offers important insights and prescriptions. As to novelty, the possession …

Design And Commissioning Of A Community Scale Solar Powered Membrane-Based Water Purification System In Haiti, Shavin Pinto, Yung Wong, Kyle Fennesy, Yan Tang, Marc Compere

Publications

This paper presents the design and commissioning of a solar powered water purification system at the Ryan Epps Home for Children (REHC) in Michaud, Haiti. This system supplies clean drinking water to the 200 children who live and go to school at REHC and also to the community in the form of a micro-business. This micro-business is the mechanism for income generation for sustainable system operation. The purifier uses a three stage filtration system with a disc-type sediment filter, a 0.1 micron ultrafiltration membrane, and an ultraviolet light for disinfection. The backwash cycle extends the life of the ultrafiltration membrane …

Wide-Scale Small Unmanned Aircraft System Access To The National Airspace System, John Robbins, Brent Terwilliger, David Ison, Dennis Vincenzi

Publications

Expected revisions of federal policies and regulations for the operation and certification of small unmanned aircraft systems (sUAS) are anticipated to significantly increase the volume of traffic in the National Airspace System (NAS). By investigating critical needs of regulatory compliance and safety, as well as new advancements, it may be possible to identify strategies to address the most pressing concerns of sUAS integration. Findings and recommendations from this research are presented to highlight implications and possible solutions to urgent needs of UAS stakehold-ers, including industry, government, and academia.

Project Execution: A Research Agenda To Explore The Phenomenon, James Walter Marion, Tracey Richardson, Matthew Earnhardt Jan 2016

Project Execution: A Research Agenda To Explore The Phenomenon, James Walter Marion, Tracey Richardson, Matthew Earnhardt

Publications

It is observed in the literature that although project management is considered to be an execution-oriented discipline, the Project Management Body of Knowledge developed by the Project Management Institute provides relatively little detail in the Executing process group compared with other process groups such as the Planning and Monitoring and Controlling process groups. It is further observed that project elements considered essential to the success of the project including project Scope, Cost, Schedule, and Risk are not included within the Executing process group. Likewise, the coverage of project execution in the Project Manager Competency Development Framework authored by the Project …

Understanding The Sunni Awakening With Complexity Theory, Diane Maye Zorri Jan 2016

Understanding The Sunni Awakening With Complexity Theory, Diane Maye Zorri

Publications

Concurrent to the surge of U.S. forces in Iraq between 2006 and 2008, Sunni tribesmen in the U.S. Marine‐controlled western Anbar province of Iraq experienced an “awakening” movement, which led them to side with U.S. and coalition forces. The Sunni Awakening demonstrates that individuals will often realign because of betrayal and opportunities for advancement. It also demonstrates that individual motives can have macrolevel social consequences. Complexity theory suggests that political factions will realign based on individual considerations that then develop into macrolevel movements. Complexity theory also combines both agency (in terms of microbehaviors) and structure (in terms of initial conditions). …

Turbulence And Overturning Gravity Wave Effects Deduced From Mesospheric Na Density Between 100-105 Km At Andes Lidar Observatory, Chile, Alan Z. Liu, Channing P. Philbrick, Gary R. Swenson, Fabio A. Vargas Jan 2016

Turbulence And Overturning Gravity Wave Effects Deduced From Mesospheric Na Density Between 100-105 Km At Andes Lidar Observatory, Chile, Alan Z. Liu, Channing P. Philbrick, Gary R. Swenson, Fabio A. Vargas

Publications

Atmospheric turbulence activity in the mesosphere and lower thermosphere (MLT) region is determined from narrowband Na lidar measurements obtained over 27 nights between 85-105 km altitude at the Andes Lidar Observatory (ALO) in Cerro Pachón, Chile (30.3ºS, 70.7ºW). Photocount perturbations in the applicable spectral subrange are used as a tracer of turbulence activity. Mean altitude profiles reveal a log-scale linear increase in turbulence perturbation amplitude above 95 km. The observed trend is compared against global mean constituent transport profiles derived from SABER and SCIAMACHY satellite borne measurements.

Relevant data were collected from a survey of faculty based at professional universities in Pakistan. Results show that while all five chosen factors are significantly correlated with faculty motivation and satisfaction levels, compensation and recognition are the two most important determinants.

Global Distributive Justice, Asad Shahzad Jan 2016

Global Distributive Justice, Asad Shahzad

Business Review

This article analyzes frameworks of global distributive justice embedded in models of global governance associated with Habermas and Rawls. Habermas is chiefly concerned with distributive justice at the level of the European Union while Rawls seeks justice at the global level through redistribution to “burdened” societies. Neither model adequately addresses the problem of global distributive justice.

Beyond Arl Diversity Initiatives: Peer Mentoring, Genevia Chamblee-Smith, Christian I.J. Minter

Posters and Presentations: Leon S. McGoogan Health Sciences Library

Background: The purpose of this research project is to highlight the benefits of peer mentoring as an ongoing resource for career advancement and retention among alumni of the Association of Research Libraries’ Career Enhancement Program (CEP) and Initiative to Recruit a Diverse Workforce (IRDW) program. We define peer mentoring as informal mentoring that happens between individuals to promote career success. This project is in response to “White Librarianship in Blackface: Diversity Initiatives in LIS” in which one of Hathcock’s criticisms of current diversity initiatives is the focus on increasing numbers without addressing long-term retention.

Methodology: The project was conducted through …

Cinempathy: Phenomenology, Cognitivism, And Moving Images, Robert Sinnerbrink Jan 2016

Cinempathy: Phenomenology, Cognitivism, And Moving Images, Robert Sinnerbrink

Contemporary Aesthetics (Journal Archive)

Some of the most innovative philosophical engagement with cinema and ethics in recent years has come from phenomenological and cognitivist perspectives. This trend reflects a welcome re-engagement with cinema as a medium with the potential for ethical transformation, that is, with the idea of cinema as a medium of ethical experience. This paper explores the phenomenological turn in film theory, emphasizing the ethical implications of phenomenological approaches to affect and empathy, emotion, and evaluation. I argue that the oft-criticized subjectivism of phenomenological theories can be supplemented by cognitivist approaches that highlight the complex forms of affective response, emotional engagement, and …

"Can The Audience Want?" On The Artistic Status Of Contemporary Tv-Series, Angela Keppler Jan 2016

"Can The Audience Want?" On The Artistic Status Of Contemporary Tv-Series, Angela Keppler

Contemporary Aesthetics (Journal Archive)

This paper takes up a question that Theodor W. Adorno posed in 1963 relating to television. The aim is to situate the new TV series, which are part of so-called Quality TV, against the backdrop of the tradition, and to analyze the forms in which the medium is being used. An inspection of pertinent sequences leads to the conclusion that the enjoyment we experience when watching these series stems from the very type of active-passive involvement that Adorno described as being essential only for objects of high culture.

Is There A 'Right To Be Forgotten' In Canada's Personal Information Protection And Electronic Documents Act (Pipeda)?, Michael Rosenstock Jan 2016

Is There A 'Right To Be Forgotten' In Canada's Personal Information Protection And Electronic Documents Act (Pipeda)?, Michael Rosenstock

Canadian Journal of Law and Technology

In this paper, I argue that PIPEDA could support a version of the right to be forgotten, subject to three important caveats. First, for search engines to meet the threshold applicability test under PIPEDA, their activities (i.e., crawling, indexing, organizing, etc.) must constitute the ‘‘collection, use or disclosure” of personal information. Ascribing such a role to search engines in information dissemination would likely require a court to distinguish the activities of search engines from hyperlinks on websites, which the Supreme Court in Crookes v. Newton determined did not involve control over content. Second, PIPEDA’s ‘‘all-or-nothing approach” means that if search …

Defining Place Image, Candi Clouse, Ashutosh Dixit Jan 2016

Defining Place Image, Candi Clouse, Ashutosh Dixit

Business Faculty Publications

The image of a place is important as it has implications for investments made in cities, workforce locations, and tourism. Place image incorporates concepts including brand, visual image, reputation, the sense of place, and the identity of the place - all of which create an overall image of a place and can lead to investment or abandonment. Place image has ramifications for decisions made about the place, including where businesses locate, where workers live, and where tourists visit (Smith, 2006). Place image has serious ramifications for decisions made about the place as people choose to stay, work, visit, and invest. …

Cruising The Borderlands: Queer Latinx Creating Space In Lowrider Culture, Elisia I. Campos Jan 2016

Cruising The Borderlands: Queer Latinx Creating Space In Lowrider Culture, Elisia I. Campos

Senior Independent Study Theses

This ethnographic and interview-based study explores how queer Latinx lowriders create community through art, such as The Q Sides, an exhibition of photographs by Vero Majano, Kari Orvik, and DJ Brown Amy. Both lowrider culture and the queer Latinx community are marginalized communities that are often silenced, ignored, and not included in historical preservation or well documented. Lowrider culture and the queer Latinx community have largely been explored separately, such as ethnographer Ben Chappell and interdisciplinary scholar Michael Hames-García. My Senior Independent Study project examines the unique intersection of the queer Latinx experience in lowrider culture in the context of …

Regulating Unicorns: Disclosure And The New Private Economy, Jennifer S. Fan Jan 2016

Regulating Unicorns: Disclosure And The New Private Economy, Jennifer S. Fan

Articles

“Unicorns” are private companies with valuations of a billion dollars or more. As their name indicates, unicorns were originally so rare as to be almost mythical. But Uber and other technology companies have ushered in a new era: we now have a blessing of unicorns, each one of which has the potential to transform financial and cultural norms.

Yet from a legal perspective, these behemoths are regulated just like their much smaller, non-mythical counterparts. Unicorns’ dizzying valuations have not been matched with any expansion or recalibration of regulation. As a result, vital information about these companies remains secret, perhaps for …

The Secession Of The Successful: The Rise Of Amazon As Private Global Consumer Protection Regulator, Jane K. Winn

Articles

In 2005, the Americans for Fair Electronic Commerce Transactions (“AFFECT”) coalition issued a list of 12 principles it hoped would contribute to a new consensus about what constitutes fairness in online consumer transactions. A decade later, a cursory review of different jurisdictions indicates that, while there has been little discernable progress in the direction of the principles in the United States, other jurisdictions such as the European Union have made more progress.

However, the one jurisdiction in the world that comes closest to implementing all 12 principles across the full spectrum of consumer transactions is not a government at all, …

Until The Client Speaks: Reviving The Legal-Interest Model For Preverbal Children, Lisa Kelly, Alicia Levezu Jan 2016

Until The Client Speaks: Reviving The Legal-Interest Model For Preverbal Children, Lisa Kelly, Alicia Levezu

Articles

This article seeks to revive and develop further the concept of legalinterest advocacy, which was first introduced by the American Bar Association in 1996. This overlooked model offers a workable alternative to both the best-interest and substituted-judgment representation models for preverbal clients. Through legal-interest advocacy, attorneys for preverbal children are charged with ensuring that the many rights given to infants are enforced, while withdrawing from attorneys the ability to impose their values on the child client. This article outlines how legal-interest advocacy representation can ensure that a child's legal rights are protected and preserved until the child client can speak …

Victims Of Downing Street: Popular Pressure And The Press In The Stoddart And Conolly Affair, 1838-1845, Sarah E. Kendrick

Senior Independent Study Theses

During the summer of 1842, Emir Nasrullah of Bukhara, in what is now Uzbekistan, beheaded Lieutenant-Colonel Charles Stoddart and Captain Arthur Conolly, two British officers sent to his kingdom on a diplomatic mission. Reports of the officers’ deaths caused an uproar across Britain, and raised questions about the extent to which Britons abroad were entitled to government protection. Historians have generally examined the officers’ deaths exclusively in the context of the Great Game (the nineteenth century Anglo-Russian rivalry over Central Asia) without addressing the furor the crisis caused in England. By focusing too narrowly on the relevance of this crisis …
