Net Legal Power, Steven Ferrey Jul 2016

Net Legal Power, Steven Ferrey

San Diego Law Review

Law will determine the future of the planet. Net metering, the regulatory mechanism employed by 88% of U.S. states to promote renewable power and to reduce carbon emissions from electricity production, is now legally challenged. The legality of recent carbon control policies is expected to head to the Supreme Court.

The law governing electric power, and electric power itself, is distinct from everything else. The physics of electricity do not align with the law. Electric power, alone among all forms of energy, is the only energy which cannot be stored: The supply of power produced must instantaneously second-by-second exactly match …

Mindfully Discovering One's Authentic Self, Lisa S. Sosin Jul 2016

Mindfully Discovering One's Authentic Self, Lisa S. Sosin

Faculty Publications and Presentations

There is a compelling link between counselee symptoms and the developmentally based capacity to put authentic thoughts, feelings, and choices into words (Greenspan, 1997). When emotional safety and secure attachment are not available and “scaffolding” was not provided to support the development of these capacities, truth is still spoken, but at an undifferentiated, behavioral level, instead of clearly represented with words. Often the symptoms people come to counseling with are related to these undeveloped or constricted aspects of the self (Siegel, 2010). The ability to tolerate and regulate painful emotions is a highly complex skill that requires practice and discipline …

Think, Pig! Beckett At The Limit Of The Human [Table Of Contents], Jean-Michel Rabate Jul 2016

Think, Pig! Beckett At The Limit Of The Human [Table Of Contents], Jean-Michel Rabate

Literature

“Very few critics have all the qualities and competencies required to engage fully with the entirety of Beckett’s work in all genres: a detailed familiarity with Beckett’s texts in both English and French; a sensitivity to his linguistic, stylistic, and thematic maneuvers; an encyclopedic knowledge of his intellectual context; an awareness of the range and detail of Beckett studies; and an ability to write with refinement and wit. It is clear from this remarkable book that Jean-Michel Rabaté is one of those few.” —Derek Attridge, University of York

Continuing To Lead: Washington State's Efforts To Address Ocean Acidification, Amanda M. Carr Jul 2016

Continuing To Lead: Washington State's Efforts To Address Ocean Acidification, Amanda M. Carr

Washington Journal of Environmental Law & Policy

The world’s oceans have become approximately thirty percent more acidic since the Industrial Revolution and are currently acidifying at a rate ten times faster than anything the earth has experienced over the last fifty million years. Washington State is undertaking a groundbreaking effort to address ocean acidification, a global issue that has serious implications for the world’s oceans, marine ecosystems, and the individuals and communities that depend upon the services that they provide. These localized actions, in isolation, will be insufficient to effectively combat and adapt to the acidification of marine waters. While acknowledging this generally accepted premise, Washington has …

Students’ Experiences With Community In An Open Access Course, Stephanie J. Blakmon, Theresa A. Cullen

Faculty Publications - Curriculum & Instruction

Online open access courses have become regular offerings of many universities. Building community and connectedness is an important part of branding and success of such offerings. Our goal was to investigate students’ experiences with community in an open access course. Therefore, in this study, we explored the sense of community of 342 participants in an open access chemistry course. We found that participants did not rate a sense of community as important to them, and did not report feeling very connected to the online course. We will discuss opportunities for building community features in such courses in the future.

Web-Based Training Program For New Custom Decoration Apparel Franchisees, Wesley Parsell Jul 2016

Web-Based Training Program For New Custom Decoration Apparel Franchisees, Wesley Parsell

Master of Education in Instructional Design and Technology Plan II Graduate Projects

Effective franchise training is essential in the expansion of a franchised business. With advances in internet connections, web applications and multimedia capabilities, training for new and existing franchisees can now take place online in the form of web-based e-learning. In addition to potentially increasing the overall effectiveness of the franchisee training, web-based training also eliminates some of the challenges of traditional, face-to-face franchise training like travel expenses, time, and the availability of human resources.

The purpose of this project was to develop an asynchronous web-based training program for new or potential franchisees in the custom decorated apparel industry. The ADDIE …

Reflective Practice Series: Models And Theories To Guide Teaching In The Virtual Classroom, Martin Sivula Jul 2016

Reflective Practice Series: Models And Theories To Guide Teaching In The Virtual Classroom, Martin Sivula

MBA Faculty Conference Papers & Journal Articles

This reflective practice paper utilizes the action research model to discuss the real time, virtual classroom for the “adult” learner. A brief historical context is given on distance education, followed by selective theoretical models that inform the action research. Data was provided by graduate level students in a variety of courses over several years. Educators, trainers, and adult learners might benefit by improving and transforming their instructional practice by the use of these new tools. Physical, on the ground classroom simulation was successfully achieved by the use of video conferencing software products. Empirical testing also revealed that screen sharing, streaming …

Permanent Injunctions In Patent Litigation After Ebay: An Empirical Study, Christopher B. Seaman Jul 2016

Permanent Injunctions In Patent Litigation After Ebay: An Empirical Study, Christopher B. Seaman

Scholarly Articles

The Supreme Court’s 2006 decision in eBay v. MercExchange is widely regarded as one of the most important patent law rulings of the past decade. Historically, patent holders who won on the merits in litigation nearly always obtained a permanent injunction against infringers. In eBay, the Court unanimously rejected the “general rule” that a prevailing patentee is entitled to an injunction, instead holding that lower courts must apply a four-factor test before granting such relief. Ten years later, however, significant questions remain regarding how this four-factor test is being applied, as there has been little rigorous empirical examination of …

Courage, Postimmunity Politics, And The Regulation Of The Queer Subject, Chantal Nadeau Jul 2016

Courage, Postimmunity Politics, And The Regulation Of The Queer Subject, Chantal Nadeau

Indiana Journal of Global Legal Studies

In this paper, I argue that courage is invoked in contemporary political discourses in such a way as to regulate queer legal subjectivities. That is, the discourses of courage re-articulate the social, legal, and political relations that define and restrict the lives of lesbian, gay, bisexual, and transgender (LGBT) citizens. Drawing on Roberto Esposito's theoretical elaboration of the concept of immunity, I remap the legal and political dynamics through which nations incorporate LGBT citizens into the polity. I discuss how the regulation of gay rights in a growing number of democracies in Europe, the Americas, and South Africa has contributed …

Automated Detection Of Deep-Sea Animals, Dallas J. Hollis, Duane Edgington, Danelle Cline

STAR Program Research Presentations

The Monterey Bay Aquarium Research Institute routinely deploys remotely operated underwater vehicles equipped with high definition cameras for use in scientific studies. Utilizing a video collection of over 22,000 hours and the Video Annotation and Reference System, we have set out to automate the detection and classification of deep-sea animals. This paper serves to explore the pitfalls of automation and suggest possible solutions to automated detection in diverse ecosystems with varying field conditions. Detection was tested using a saliency-based neuromorphic selective attention algorithm. The animals that were not detected were then used to tune saliency parameters. Once objects are detected, …

Bioinformatic Analysis Of Human Opn3 Alternative Promoters Associated With Cancer, Mohammed A. Ibrahim Al-Obaide, Abdel-Salam G. Abdel-Salam, Hytham Alobydi, Kalkunte S. Srivenugopal Jul 2016

Bioinformatic Analysis Of Human Opn3 Alternative Promoters Associated With Cancer, Mohammed A. Ibrahim Al-Obaide, Abdel-Salam G. Abdel-Salam, Hytham Alobydi, Kalkunte S. Srivenugopal

Applied Mathematics & Information Sciences

In this bioinformatics study we analyzed the functional motifs and structural features of regulatory regions of OPN3, a member of the guanine nucleotide-binding protein (G protein)-coupled receptor super-family, which is involved in cancer and drug resistance. Our analyses showed major differences in the two OPN3 promoters located at the 5’-side of the locus. The analyzed parameter set, structural differences of regulatory sequences dignified by dinucleotide base stacking energy and GC-skew, CpG islands (CGI) and transcription factors binding sites (TFBS) of alternative promoters, showed differences that can be exploited to modulate and/or enhance the expression of OPN3 in human tissues. Further, …

3d Mesh Sequence Compression Using Thin-Plate Spline Based, Yuan Gao Jul 2016

3d Mesh Sequence Compression Using Thin-Plate Spline Based, Yuan Gao

Applied Mathematics & Information Sciences

We propose an efficient scheme for compressing mesh sequence with different connectivities using a thin-plate spline (TPS) based multi-reference prediction coding. The scheme combines the single-reference prediction with the P-structure prediction, and predicts each frame of the sequence using the TPS transformation. Compared with traditional compression scheme, our scheme imposes the TPS transformation in the prediction coding which utilizes both spatial and temporal correlations of the mesh sequence with different connectivities. We test our scheme for 3D facial meshes and experimental results show that our scheme produces both accurate reconstruction meshes and high compression efficiency.

Linking Social Capital, Cultural Capital And Heterotopia At The Folk Festival, Linda Wilks, Bernadette Quinn Jul 2016

Linking Social Capital, Cultural Capital And Heterotopia At The Folk Festival, Linda Wilks, Bernadette Quinn

Articles

This paper investigates the role of folk festivals in transforming interconnections between people, space and culture. It interlinks three sets of theoretical ideas: social capital, cultural capital and heterotopia to suggest a new conceptual framework that will help to frame a deeper understanding of the nature of celebration. Qualitative data were collected at two long-established folk festivals, Sidmouth Folk Festival in southern England and the Feakle Traditional Music Festival in western Ireland, in order to investigate these potential links. Although Foucault did not fully develop the concept of heterotopia, his explanation that heterotopias are counter-sites, which, unlike utopias, are located …
