What Is (And Isn't) Healthism?, Jessica L. Roberts, Elizabeth W. Leonard Jan 2016

What Is (And Isn't) Healthism?, Jessica L. Roberts, Elizabeth W. Leonard

Georgia Law Review

What does it mean to discriminateon the basis of health status? Health can, of course, speak to a number of things, such as the length of our lives, our ability to perform mentally and physically, our need for health care, and our risk of injury and incapacity. But the mere relevance of a particular attribute does not mean that considering it should be legally permissible. This Article explores when differentiating on the basis of health is acceptable- perhaps even desirable-and, by contrast, when it is normatively problematic. While we acknowledge that differentiations on the basis of health status can be …

Victims Of Downing Street: Popular Pressure And The Press In The Stoddart And Conolly Affair, 1838-1845, Sarah E. Kendrick Jan 2016

Victims Of Downing Street: Popular Pressure And The Press In The Stoddart And Conolly Affair, 1838-1845, Sarah E. Kendrick

Senior Independent Study Theses

During the summer of 1842, Emir Nasrullah of Bukhara, in what is now Uzbekistan, beheaded Lieutenant-Colonel Charles Stoddart and Captain Arthur Conolly, two British officers sent to his kingdom on a diplomatic mission. Reports of the officers’ deaths caused an uproar across Britain, and raised questions about the extent to which Britons abroad were entitled to government protection. Historians have generally examined the officers’ deaths exclusively in the context of the Great Game (the nineteenth century Anglo-Russian rivalry over Central Asia) without addressing the furor the crisis caused in England. By focusing too narrowly on the relevance of this crisis …

Is This Thing On? An Investigation Of School-Based Speech-Language Pathologists' Knowledge Of Hearing Technology, Marissa M. Kobylas

Senior Independent Study Theses

The purpose of this study was to investigate the hearing technology knowledge of speech-language pathologists (SLPs) currently working in public elementary schools in the states of Michigan and Ohio. A total of 95 randomly chosen SLPs completed an online survey regarding their hearing technology training, their perceptions of the need for this type of training, and their clinical experiences working with hearing technology in educational settings. The types of hearing technology included hearing aids, cochlear implants, and FM/Infrared (IR) systems. Overall, participants reported a lack of sufficient hearing technology training and low comfort levels with performing hearing technology tasks, such …

Phonetic Shift /Ɔr/ Phonemic Change? American English Mergers Over 40 Years, Joseph A. Stanley, Margaret E. L. Renwick Jan 2016

Phonetic Shift /Ɔr/ Phonemic Change? American English Mergers Over 40 Years, Joseph A. Stanley, Margaret E. L. Renwick

Faculty Publications

In this paper we analyze the vowel formants of a speaker over four decades to show phonemic change through time. Other real-time studies (Harrington, Palethorpe & Watson 2000; Harrington & Reubold 2015) have found that the vowel spaces of UK English speakers shift over the lifetime, likely as a consequence of interaction with speakers of other dialects or social classes. We focus on an understudied variety of English, spoken in the western United States, to investigate a pair of phonological mergers, the cord-card merger and the hoarse-horse merger.

The cord-card merger is a result of a historical three-way contrast of …

Enhancing Cowpea Production Through Arbuscular Mycorrhizal Fungi Inoculation And Wide Interspecific Crosses, Marjorie Bonareri Oruru Jan 2016

Enhancing Cowpea Production Through Arbuscular Mycorrhizal Fungi Inoculation And Wide Interspecific Crosses, Marjorie Bonareri Oruru

All Master’s Theses

Cowpea is a multipurpose legume crop that serves as human food, livestock fodder, and income source and is widely produced in sub-Saharan Africa. Soil fertility and attack by insect pests and diseases are significant limitations to its production. Although farm inputs such as phosphate-rich fertilizers and pesticides can solve the mentioned constraints, they are costly for resource-poor farmers. This study aimed at determining the effect of arbuscular mycorrhizal fungi inoculation on AMF root colonization and growth of cowpea. Additionally, it aimed at developing an insect-pest resistant hybrid by crossing the cultivated cowpea (Vigna unguiculata) with a wild (Vigna vexillata) accession. …

Assessment Of Conservation Agriculture As An Adaptation Option To Climate Change In The Taita Hills, Kenya, Lilian K. Motaroki Jan 2016

Assessment Of Conservation Agriculture As An Adaptation Option To Climate Change In The Taita Hills, Kenya, Lilian K. Motaroki

All Master’s Theses

Climate Change and Variability affects water supply and food security, especially in developing countries where many small-scale farmers rely on rain-fed agriculture for food production and as a main source of livelihood. The extent of the effects of climate change and variability on these small-scale producers largely depends on their level of adaptation, adaptive capacity, exposure and vulnerability. This study evaluates the effectiveness of Conservation Agriculture (CA) as a possible adaptation tool for farmers to climate change and variability in the Taita Hills, Kenya. A mixed research methodology was used entailing literature review, participatory methods, household surveys and experimental field …

Heavy Metals In Sugarcane Juice And Soils: A Comparative Study Of Part Of Nairobi River Basin And Nyahururu Farms, Solomon Kamau

All Master’s Theses

The contamination of food is increasingly becoming a concern in developing countries due to the mounting amounts of heavy metals in urban environments. Juices are common beverages in the usual diet and contribute significantly to the nutritional intake of essential and harmful trace elements. Currently, there is inadequate information regarding the amounts of heavy metals in juice from sugarcane produced along rivers in Nairobi city. In the present study, the levels of heavy metals in sugarcane juice and soils from Nairobi and Nyahururu are determined. This study quantitatively determined the levels of heavy metals such as Fe, Cu, Zn and …

Management Of Mycotoxigenic Fungi And Associated Mycotoxins In Maize By Use Of Hermetic Storage, Angeline Maina Wanjiku Jan 2016

Management Of Mycotoxigenic Fungi And Associated Mycotoxins In Maize By Use Of Hermetic Storage, Angeline Maina Wanjiku

All Master’s Theses

Maize is a staple food crop in Kenya with about 90% of the rural households depending on it. However, the grain is vulnerable to degradation by mycotoxin producing fungi in the field and during storage. Mycotoxins produced by these fungi cause significant economic losses and deleterious health effects to humans and animals. Strategies such as storage of maize in hermetic bags have been developed to reduce post-harvest grain losses due to pest attack, fungal growth and mycotoxin contamination. The objective of this study was to determine the effect of hermetic storage on the population of fungal species and levels of …

Assessment Of Health And Environmental Effects Of Mango Integrated Fruit Fly Management Strategy In Meru County, Kenya, Chris Mwungu Miyinzi Jan 2016

Assessment Of Health And Environmental Effects Of Mango Integrated Fruit Fly Management Strategy In Meru County, Kenya, Chris Mwungu Miyinzi

All Master’s Theses

Mango is among the three most imperative crops in Kenya in terms production and crop area. However, mango production is limited by a number of issues, among which pests and fungal disease infestation are major. Among the pests, mango fruit fly present a real challenge to producers due to losses incurred at the farm level. Majority of the farmers have decided to use of pesticides which have negative impacts on health and environment. To promote sustainable and environmentally friendly agriculture, International Centre of Insect Physiology and Ecology (icipe) developed and implemented an Integrated Pest Management (IPM) fruit fly control package …

Effects Of Hermetic Bag Storage On Insect Pest Damage, Mould Infection And A Flatoxin Contamination On Maize Grain In Makueni County, Kenya, Jeremiah Kinuthia Ng'ang'a

All Master’s Theses

For centuries, maize producers in sub-Saharan Africa have been plagued by post-harvest losses from insect infestation and mould infections, with small-scale producers representing the most vulnerable populations. Participatory on-farm trials were conducted to assess the effectiveness of triple layer hermetic (PICSâ„¢) bags for storage of maize in small-scale farmers' stores in rural villages in Makueni County,Kenya. PICS bags are three-layer hermetic bag-system that forms a barrier against the influx of oxygen and the escape of carbon dioxide.Shelled maize grain was purchased from the participating farmers, filled into jute, woven polypropyleneor PICS bags, and kept in the farmers' own stores for 35 …

Genetic Diversity Of Aphid Species Attacking Amaranth And Nightshades In Different Agro-Ecological Zones Of Kenya And Tanzania, Alex Cherutich Kipnyargis Jan 2016

Genetic Diversity Of Aphid Species Attacking Amaranth And Nightshades In Different Agro-Ecological Zones Of Kenya And Tanzania, Alex Cherutich Kipnyargis

All Master’s Theses

Aphids are the major pests of vegetables leading to a significant yield loss in African indigenous vegetables including amaranth and nightshades. Information on the types of aphids that infest these vegetables and their genetic diversity in Kenya and Tanzania is scanty. This is an important diagnostic component in developing management strategies such as integrated pest management and early detection and control of invasive species. This study used a fragment of the mitochondrial cytochrome c oxidase subunit I (COI) gene region called the barcode region to characterize the species of aphids that attack amaranth and nightshades in different agro-ecological regions of …

Mindfulness In The Classroom: Cultivating Peace From Within, Maya Vandriel Jan 2016

Mindfulness In The Classroom: Cultivating Peace From Within, Maya Vandriel

Honors Program Theses

Teachers are placed with the difficult task of transferring knowledge to the next generation of leaders. This knowledge transfer can be measured in various ways. What cannot be easily quantified is the impact of the life skills taught to accomplish this handoff of reading, writing and math skills. Often times, teachers are the role model of how a student can cope with life inside and outside of the classroom. Teaching mindfulness in the classroom is a powerful method that shows students how to self-regulate emotions in order to cope with whatever life brings them. These life skills are essential for …

Reinterpreting The Status-Contract Divide: The Case Of Fiduciaries, Hanoch Dagan, Elizabeth S. Scott Jan 2016

Reinterpreting The Status-Contract Divide: The Case Of Fiduciaries, Hanoch Dagan, Elizabeth S. Scott

Faculty Scholarship

The distinction between status and contract permeates legal analyses of categories of cooperative interpersonal interactions in which one party has particular obligations to the other. But the current binary understanding of the distinction has facilitated its use as a foil and thus undermined its conceptual and normative significance. This predicament is understandable given that the innate, comprehensive, and inalienable status as well as the wholly open-ended contract anticipated by commentators are corner — rather than core — alternatives in a liberal polity. Hence, to clarify these normative debates we introduce two further, intermediate conceptions: office and contract type. Like the …

When Extrinsic Incentives Displace Intrinsic Motivation: Designing Legal Carrots And Sticks To Confront The Challenge Of Motivational Crowding-Out, Kristen Underhill Jan 2016

When Extrinsic Incentives Displace Intrinsic Motivation: Designing Legal Carrots And Sticks To Confront The Challenge Of Motivational Crowding-Out, Kristen Underhill

Faculty Scholarship

The rise of “nudges” has inspired countless efforts to encourage individual choices that maximize personal and collective welfare, with a preference for less restrictive tools such as setting default options or reordering choice sets. As part of this trend, there has been renewed interest in the behavioral impacts of incentives – namely, rewards or penalties for shaping individual choices, including but not limited to financial incentives. Explicit incentives are pervasive in the law, including carrots offered by governments (for example, tax deductions for charitable contributions, rebates for recycling, sentence reductions for prisoners who complete drug rehabilitation programs, and incentives for …

Appraising The "Merger Price" Appraisal Rule, Albert H. Choi, Eric L. Talley Jan 2016

Appraising The "Merger Price" Appraisal Rule, Albert H. Choi, Eric L. Talley

Faculty Scholarship

This paper develops an auction design framework to study how best to measure “fair value” in post-merger appraisal proceedings. Our inquiry spotlights an approach recently embraced by some courts benchmarking fair value against the merger price itself. We show that merger price deference effectively nullifies the role that appraisal can potentially play in establishing a de facto reserve price for company auctions, thereby depressing both acquisition prices and target shareholders’ expected welfare relative to both the optimal appraisal policy and a variety of other valuation measures. We also examine conditions under which deference to the merger price can be optimal. …

Rerum Novarum: New Things And Recent Paradigms Of Property Law, M C. Mirow Jan 2016

Rerum Novarum: New Things And Recent Paradigms Of Property Law, M C. Mirow

Faculty Publications

The two most recent paradigmatic moments in the development of property law were the construction of "social property" about a hundred years ago and of "international property" quite recently. This study analyses two important texts as illustrations of these changes: Leo XIII's encyclical Rerum Novarum (1891) and John Sprankling's book The International Law of Property (2014). Each text signals a paradigm shift in our understanding of property.

The Age Of Scalia, Jamal Greene Jan 2016

The Age Of Scalia, Jamal Greene

Faculty Scholarship

During periods of apparent social dissolution the traditionalists, the true believers, the defenders of the status quo, turn to the past with an interest quite as obsessive as that of the radicals, the reformers, and the revolutionaries. What the true believers look for, and find, is proof that, once upon a time, things were as we should like them to be: the laws of economics worked; the streams of legal doctrine ran sweet and pure; order, tranquility, and harmony governed our society. Their message is: turn back and all will be well.

Economics Of The Firm: Identifying Factors Affecting The Performance Of Agribusiness Corporations, Casey Engel Jan 2016

Economics Of The Firm: Identifying Factors Affecting The Performance Of Agribusiness Corporations, Casey Engel

Research Papers

This paper is about identifying the factors that affect firm performance. Many economists have attempted to explain how to define an economy based off of many different aspects, but the focus of this paper is to find out what factors affect the performance of a company. This paper discusses different economic theories, and research which is related to the topic. Then I show a few factors that I found in my research regarding how a firm performs, and finish by interpreting and discussing those factors.

The increasing use of technology in the classroom and fluctuation of content standards prompted this research. The results have implications for the classroom teacher of a wide range …

Metabolic Scaling Physiology And The Uptake, Elimination And Toxicity Of Tfm (3-Trifluoromethyl-4-Nitrophenol) To Invasive Sea Lampreys (Petromyzon Marinus), Laura R. Tessier Jan 2016

Metabolic Scaling Physiology And The Uptake, Elimination And Toxicity Of Tfm (3-Trifluoromethyl-4-Nitrophenol) To Invasive Sea Lampreys (Petromyzon Marinus), Laura R. Tessier

Theses and Dissertations (Comprehensive)

Sea lampreys (Petromyzon marinus) have a complex life cycle that involves a parasitic phase in which they feed on the blood and bodily fluids of large piscivorous fishes. Following the invasion of the Great Lakes by sea lampreys in the early 20th century, sea lamprey parasitism contributed to major declines in the populations of commercial and sports fisheries in that basin. The lampricide 3-trifluoromethyl-4-nitrophenol (TFM), developed in the late 1950s,is now routinely applied to tributaries of the Great Lakes to control sea lamprey populations. This lampricide is selectively toxic to larval sea lampreys, which typically reside as …

The Ability Of Horseshoe Crabs (Limulus Polyphemus) To Detect Changes In Temperature, Vilma Vaattovaara, Winsor H. Watson Iii

Honors Theses and Capstones

Previous studies have suggested that horseshoe crabs prefer warm water, suggesting that they may be able to detect changes in water temperature. The overall goal of this study was to test this hypothesis. Our specific objectives were to: 1) find out if horseshoe crabs can detect temperature changes; 2) determine the magnitude of temperature change they can detect, and; 3) determine whether their temperature receptors are located internally or externally. Animals were placed in a light-tight chamber that received a constant flow of cooled seawater. Their heart rates were continuously recorded and a change in heart rate following the addition …
