Plea Bargaining As Dialogue, Rinat Kitai-Sangero
Plea Bargaining As Dialogue, Rinat Kitai-Sangero
Akron Law Review
This Article proposes turning plea bargaining into a dialogical process, which would result in lessening a defendant’s sense of alienation during the progress of the criminal justice procedure. This Article argues that plea bargaining constitutes an opportunity to circumvent restrictions existing during a trial or outside a trial, such as the inadmissibility of character evidence and the need for the victim's consent in restorative justice proceedings. This Article proposes to navigate the plea bargaining process in a way that creates a real dialogue with defendants. Such a dialogue can reduce the sense of alienation that defendants feel from their position …
Liberty At The Borders Of Private Law, Donald J. Smythe
Liberty At The Borders Of Private Law, Donald J. Smythe
Akron Law Review
Liberty is both dependent upon and limited by the State. The State protects individuals from the coercion of others, but paradoxically, it must exercise coercion itself in doing so. Unfortunately, the reliance on the State to deter coercion raises the possibility that the State’s powers of coercion might be abused. There is, not surprisingly, therefore, a wide range of literature on the relationship between law and liberty, but most of it focuses on the relationship between public law and liberty. This Article focuses on the relationship between private law and liberty. Private laws are enforced by courts. Since the judiciary …

Genetic Analyses Determine Connectivity Among Cave And Surface Populations Of The Jamaican Endemic Freshwater Crab Sesarma Fossarum In The Cockpit Country, Manuel Stemmer, Christoph D. Schubart
International Journal of Speleology
The Jamaican freshwater crab Sesarma fossarum (Decapoda: Brachyura: Sesarmidae) is endemic to western central Jamaica where it occurs in cave and surface streams of karst regions. In the present study, we examine the population genetic structure of the species, providing evidence for intraspecific differentiation and genetic substructure among twelve sampled populations. Interestingly, crabs from caves appear genetically undistinguishable from representatives of nearby surface waters, despite previously observed and described morphometric differentiation. In contrast, genetic isolation takes place among populations from rivers and caves belonging to different watersheds. In one case, even populations from different tributaries of the same river were …

Route Generation In A Mapping Application, Jason Robert Richard Sanio, Courtney Hampson
Route Generation In A Mapping Application, Jason Robert Richard Sanio, Courtney Hampson
Defensive Publications Series
A route generation system can be used to generate an alternative route in a mapping application user interface (UI) based on a user input. The route generation system presents one or more routes, in a mapping application UI, between a first location and a second location. The system receives the user input that identifies a path between the first location and the second location. The system then generates the alternative route based on the user input between the first location and the second location. The alternative route is presented to the user in the mapping application UI.

System For Providing Push Media Notifications Meeting Search Criteria, Vincent Dureau, Jonathan Wald
Defensive Publications Series
A system and method are disclosed for providing push notifications on TV and movie content meeting set criteria based on categorical queries. The system considers queries recently issued by users, runs them offline, and identifies any new additions to the result set. The system either responds to specific user interest in receiving updates or infers relevance to decide whether or not to send a push notification to the user. The system calculates a score and sets threshold values above which a notification is sent to the user. The notifications could be sent by email, bite-sized alert, operating system (OS) alert …
Method For Providing Metrics To Determine Transcription/Translation Quality, Dimitri Kanevsky, Mark Mao
Method For Providing Metrics To Determine Transcription/Translation Quality, Dimitri Kanevsky, Mark Mao
Defensive Publications Series
A system and method are disclosed for determining the transcription/translation quality of web video content based on metrics derived from indirect feedback of users on existing captioning. The method may take into account how often the closed caption (CC) option was activated by a user on videos and the number of times users stayed through the whole video content using the closed captions. The system can also be used in assessing quality of manual transcription for languages that do not have automated speech recognition and to validate acoustic and language models in machine translation/transcription.
MultiLanguage Machine Translation Speech Corrector, Polar Bear Ratinov, Dimitri Kanevsky
MultiLanguage Machine Translation Speech Corrector, Polar Bear Ratinov, Dimitri Kanevsky
Defensive Publications Series
A system and method are proposed that will leverage language models from multiple language machine translations (MT) for better speech recognition. Wherever ambiguity exists in interpreting speech, the system identifies each transcribed option of homophones for interpretation through translation. The system then translates each sentence corresponding to the options of homophones into multiple languages. The method comprises a scoring system that is used by the machine translation system for assessing translations whereby the translation which makes less sense is given a lower score. The system combines the scores assigned to each translated homophone in the various languages and selects the …

Right To Act: United States Legal Basis Under The Law Of Armed Conflict To Pursue The Islamic State In Syria, Samantha Arrington Sliney
University of Miami National Security & Armed Conflict Law Review
Shortly after the beginning of the Syrian Civil War, the Islamic terror group ISIS captured the world’s attention with their rapid advance through Iraq and acts of severe brutality. In short order, the group captured large swaths of territory in Iraq and Syria and declared the formation of an Islamic State. With the integrity of Iraq in the balance, the United States committed to taking military action against ISIS but quickly discovered that as pressure was put on ISIS in Iraq they retreated into Syrian lands, where U.S. warplanes could not go.
This article explores the legal justifications for the …

An Integrated Framework For Fostering Human Factor Sustainability And Increased Safety In Aviation Ramp Operations, Sarah M. Hubbard, Denver Lopp
An Integrated Framework For Fostering Human Factor Sustainability And Increased Safety In Aviation Ramp Operations, Sarah M. Hubbard, Denver Lopp
Journal of Aviation Technology and Engineering
The aviation work environment has one of the highest accident rates of any industry sector in the United States, resulting in significant costs for both employee injuries and equipment damage. In fact, injury rates exceed rates found in areas that are widely recognized as hazardous, such as construction and mining, and it is estimated that aircraft ground damage costs are as high as 5 billion to 10 billion dollars per year. Purdue University’s Aviation Technology Department has conducted numerous safety and human factors studies in the past decade encompassing maintenance and repair operations, corporate flight departments, and over ten major …

Use Of Manual Therapy And Sport Specific Re-Training In An Adolescent Elite Sprinter With Bilateral Pedicle Stress Fractures: A Case Report, Erika Lopez
Case Report Posters
Bilateral pedicle stress fractures are extremely rare, with few cases reported in the literature. The pedicle is known to be the second weakest point of the vertebra, has a short moment arm from the vertebral body, and can resist a large amount of cyclic shear forces. The main causes of lumbar pedicle stress fractures are shear stress and twisting stressors, followed by sudden hyperflexion or hyperextension of the spine. There have been several reports describing pedicle stress fracture in adolescent athletes. However, in those reports the fracture was usually associated with contralateral spondylolysis, and isolated pedicle fractures are rarely found. …

Case Report Posters
Subacromial impingement syndrome is a musculoskeletal condition characterized by shoulder pain and altered glenohumeral kinematics. Conservative treatment can include physical therapy and corticosteroid injections. Surgical option includes subacromial decompression (SAD). Most patients who undergo SAD are approximately 50-60 years old. There is little to no evidence regarding rehabilitation of young, healthy individuals following SAD. The purpose of this case report was to investigate the conservative protocol of a young, healthy gymnast who underwent SAD and rotator cuff [RC] surgery.

© the Owner Societies 2016. Recently, a muscle-like organometallic polymer has been successfully synthesized using Fe2+ as a linker atom. The polymer exhibits acid-base controllable muscle-like expansion and contraction on the micrometer scale. Further development could be facilitated by revealing the polymerization mechanism and by searching for optimal linker atoms. In this work, we have examined possible equilibrium and intermediate polymer structures, which consist of [c2]daisy chains linked by divalent transition metal ions (Sc2+, Ti2+, Fe2+, Co2+, Ni2+ or Zn2+) with various hexa-coordination arrangements, based on calculations using density functional theory. We find that the metal linkers in polymers are …
