Resting Orientations Of Dinosaur Scapulae And Forelimbs: A Numerical Analysis, With Implications For Reconstructions And Museum Mounts, Phil Senter, James H. Robins Dec 2015

Resting Orientations Of Dinosaur Scapulae And Forelimbs: A Numerical Analysis, With Implications For Reconstructions And Museum Mounts, Phil Senter, James H. Robins

College of Health, Science, and Technology

The inclination of the scapular blade and the resting pose of the forelimb in dinosaurs differ among reconstructions and among skeletal mounts. For most dinosaurian taxa, no attempt has previously been made to quantify the correct resting positions of these elements. Here, we used data from skeletons preserved in articulation to quantify the resting orientations of the scapula and forelimb in dinosaurs. Specimens were included in the study only if they were preserved lying on their sides; for each specimen the angle between forelimb bones at a given joint was included in the analysis only if the joint was preserved …

The Origins Of Legislation, Ganesh Sitaraman Dec 2015

The Origins Of Legislation, Ganesh Sitaraman

Notre Dame Law Review

Although legislation is at the center of legal debates on statutory interpretation, administrative law, and delegation, little is known about how legislation is actually drafted. If scholars pay any attention to Congress at all, they tend to focus on what happens after legislation is introduced, ignoring how the draft came to exist in the first place. In other words, they focus on the legislative process, not the drafting process. The result is that our account of Congress, the legislative process, and the administrative state is impoverished, and debates in statutory interpretation and administrative law are incomplete. This Article seeks to …

Applying Citizens United To Ordinary Corruption: With A Note On Blagojevich, Mcdonnell, And The Criminalization Of Politics, George D. Brown Dec 2015

Applying Citizens United To Ordinary Corruption: With A Note On Blagojevich, Mcdonnell, And The Criminalization Of Politics, George D. Brown

Notre Dame Law Review

Federal criminal law frequently deals with the problem of corruption in the form of purchased political influence. There appear to be two distinct bodies of federal anticorruption law: one concerning constitutional issues in the prevention of corruption through campaign finance regulation, and one addressing corruption in the form of such crimes as bribery, extortion by public officials, and gratuities to them. The latter body of law primarily presents issues of statutory construction, but it may be desirable for courts approaching these issues to have an animating theory of what corruption is and how to deal with it. At the moment, …

The Illusive "Reasonable Person": Can Neuroscience Help The Mentally Disabled?, Ian J. Cosgrove Dec 2015

The Illusive "Reasonable Person": Can Neuroscience Help The Mentally Disabled?, Ian J. Cosgrove

Notre Dame Law Review

This Note argues that the distinction between what constitutes a physical versus a mental disability can no longer rationally be sustained. Specifically, its purpose is to show that providing an exception to the “reasonable person” standard in negligence actions for the physically disabled while withholding it for those with mental infirmities is increasingly indefensible. Part I briefly tracks the origins of the current rule in tort law that holds the mentally and physically disabled to separate standards. This discussion is purposely left short because of the breadth of scholarship tracing the standard. Part II seeks to justify, through neuroscientific brain …

Equal Access In Cyberspace: On Bridging The Digital Divide In Public Accommodations Coverage Through Amendment To The Americans With Disabilities Act, Laura Wolk Dec 2015

Equal Access In Cyberspace: On Bridging The Digital Divide In Public Accommodations Coverage Through Amendment To The Americans With Disabilities Act, Laura Wolk

Notre Dame Law Review

This Note will proceed in three Parts. Part I will trace the development of the case law on this issue, which has culminated in a circuit split. It will also discuss the influence of the Department of Justice (DOJ), which has not exercised its regulatory authority on the subject but which has initiated enforcement actions consistent with an interpretation that includes freestanding websites. Part II will argue, based on the text, congressional silence, and the statute’s dual principal purposes, that private commercial websites do not fall within the purview of Title III. Part III will propose that disability rights advocates …

From Literacy To Literacies: Negotiating Multiple Literacies In The English Classroom, Breanne S. Campbell Dec 2015

From Literacy To Literacies: Negotiating Multiple Literacies In The English Classroom, Breanne S. Campbell

Department of Teaching, Learning, and Teacher Education: Theses and Other Student Research

This dissertation is a narrative description of my teaching moves as I attempted to negotiate within my classroom both traditional print literacy and new literacies afforded by emerging technology. In this study, I sought to reconcile my rhetoric with my reality (Zeichner, 1999) by teaching students how to read and design multimodal compositions within the traditional framework and curriculum required by my school district. Students composed traditional memoirs and then participated in the synaesthesia process by remediating their memoirs using technology. Students were also asked to write a Statement of Goals and Choices (Shipka, 2011), reflecting on their own rhetorical …

West Central Research and Extension Center, North Platte

The management of the soybean aphid Aphis glycines Matsumara is a major challenge to soybean production in the north-central United States. The identification and characterization of the insect predator community has informed integrated pest management strategies by providing insight on predators that can suppress soybean aphid populations. Hoverflies (Diptera: Syrphidae) are known predators of A. glycines, but more information is needed on their diversity, abundance, and performance to evaluate their importance as biological control agents of A. glycines. In this study, syrphid abundance was evaluated across two growing seasons in four soybean fields in east-central Minnesota. Six methods …

Glucose-Fructose Likely Improves Gastrointestinal Comfort And Endurance Running Performance Relative To Glucose-Only, P. B. Wilson, S. J, Ingraham

Athletic Performance Research

This study aimed to determine whether glucose-fructose (GF) ingestion, relative to glucose-only, would alter performance, metabolism, gastrointestinal (GI) symptoms, and psychological affect during prolonged running. On two occasions, 20 runners (14 men) completed a 120-min submaximal run followed by a 4-mile time trial (TT). Participants consumed glucose-only (G) or GF (1.2:1 ratio) beverages, which supplied ~1.3 g/min of carbohydrate. Substrate use, blood lactate, psychological affect [Feeling Scale (FS)], and GI distress were measured. Differences between conditions were assessed using magnitude-based inferential statistics. Participants completed the TT 1.9% (−1.9; −4.2, 0.4) faster with GF, representing a likely benefit. FS ratings were …

We report on a measurement of low energy ion irradiation effects on as-grown films of SiO2 on a Si substrate. Beams of normally incident Na+ ions with kinetic energies of 2 keV to 5 keV were focused onto ~ 1900 Å SiO2 films. Aluminum top metal contacts were subsequently deposited onto these targets such that irradiated regions and unexposed (pristine) regions of the target could be compared using capacitance-voltage (C-V) measurements of individual metal-oxide-semiconductor (MOS) devices. The C-V data reveal an energy-dependent shift in the flatband voltage ( VFB) that can be returned to its near-pristine value by a low …

Overweight Predicts Poorer Exercise Capacity In Congenital Heart Disease Patients, Karen Kuehl, Alicia Tucker, Munziba Khan, Paula Goldberg, E. Anne Greene, Megan Smith Dec 2015

Overweight Predicts Poorer Exercise Capacity In Congenital Heart Disease Patients, Karen Kuehl, Alicia Tucker, Munziba Khan, Paula Goldberg, E. Anne Greene, Megan Smith

Pediatrics Faculty Publications

Background

Overweight (OW) and obesity (OB) are endemic in the United States and affect adolescents and adults with congenital heart disease (ACHD). Defining the burden of excess weight on the cardiovascular system in ACHD is the goal of this study. Limitation of exercise capacity due to overweight or obesity might be reversible with weight loss and improve quality of life for ACHD adults.

Methods

Exercise tests performed using a Bruce protocol and measurement of maximum oxygen consumption were retrospectively reviewed on 418 CHD patients. OW and OB were defined as the 85–95 or > 95 percentile respectively for age and gender …

Inflationary Dynamics In Guatemala, Thomas M. Fullerton Jr., Miguel Martinez, Wm. Doyle Smith, Adam G. Walke Dec 2015

Inflationary Dynamics In Guatemala, Thomas M. Fullerton Jr., Miguel Martinez, Wm. Doyle Smith, Adam G. Walke

Departmental Papers (E & F)

Short-run price dynamics for Guatemala are analyzed using a linear transfer function methodology. This approach has previously been employed for other national economies such as the United States, Mexico, Colombia, Ecuador, and Nigeria. The data for this study range from 1960 to 2010. Inflation is measured using the consumer price index. Explanatory variables include the monetary base, real output, interest rates, and the exchange rate. All of the estimated coefficients exhibit the arithmetic signs hypothesized by the theoretical model. Almost all of the parameter estimates satisfy the 5-percent significance criterion and all exhibit economically plausible magnitudes. Estimation results indicate that …

Helping My Little Brothers And Sisters, Megan Gillson

In lieu of an abstract, below is the essay's first paragraph.

When I think about my trips to El Salvador, I think of peace and joy. I also think of peace and joy when I think about Christmas break and summer. In the blur of a school day, it can be so hard to find these things—why? How is it that we can accomplish so much in one day, from 8am until midnight, but still feel as though we’ve missed out on something bigger, something better? My argument is this: I think we were created to experience life to the …

Problematic Use Of Revelation In Dispensational Theologies, Joseph Deraddo Dec 2015

Problematic Use Of Revelation In Dispensational Theologies, Joseph Deraddo

Verbum

In lieu of an abstract, below is the essay's first paragraph.

Dispensationalist theologies that use the Book of Revelation as their primary source of evidence are exegetically and hermeneutically problematic. The dispensationalist doctrine utilizes scripture in consistently literal interpretations. Followers of these various theologies are often jarred when told to switch hermeneutical gears to better understand unfulfilled prophecies. The primary belief fueling these theologies concerns dispensations, or separated periods of time thought to reveal God’s different purposes for human history and in particular the destinies of Israel and the Church. This paper seeks to demonstrate how these theological views fail …

Reading Comprehension In Deaf Education: Comprehension Strategies To Support Students Who Are Deaf Or Hard Of Hearing, Lisa M. Bickham Dec 2015

Reading Comprehension In Deaf Education: Comprehension Strategies To Support Students Who Are Deaf Or Hard Of Hearing, Lisa M. Bickham

Education Masters

Because students who are deaf or hard of hearing often struggle with reading comprehension, this research study asks “what strategies can be used to successfully support the development or improvement of reading comprehension of students who are deaf or hard of hearing?” Using data collected from questionnaires, focus groups, and student scores before and after interventions, the conclusion was that there are several different strategies that are currently being used with students who are deaf or hard of hearing to support their reading comprehension. The implications of this study can be used to educate teachers of the deaf about which …

An Examination Of Race And Sexuality Perspectives Of High-School Students Through Narrative Writing, Anthony Benson Dec 2015

An Examination Of Race And Sexuality Perspectives Of High-School Students Through Narrative Writing, Anthony Benson

Education Masters

This study asked the question: how does narrative writing reflect students’ personal experiences with race and sexuality? Students expressed their underlying opinions of both groups by writing a short story involving characters created using their personal experiences. With minimal guidance, students drafted their characters, wrote their story and responded to interview questions related to the personal experiences behind their creations. Also, students were exposed to different perspectives and tasked with creating new characters after reflection. Students with fewer interactions relied on media portrayals, which reinforced stereotypes. Exposure to different perspectives was not completely successful, as they lacked the real life …

Use Of Preponderance Of Evidence In Campus Adjudication Of Sexual Misconduct, Elizabeth Sommer Dec 2015

Use Of Preponderance Of Evidence In Campus Adjudication Of Sexual Misconduct, Elizabeth Sommer

All NMU Master's Theses

How higher education institutions (HEI) handled sexual misconduct cases matters. It matters for survivors, accused, administrators, parents, HEI leaders, regulatory bodies (such as the Office for Civil Rights), and the general public. The 2011 Dear Colleague Letter published by the Department of Education’s Office for Civil Rights mandated the use of preponderance of evidence in all sexual misconduct cases (Ali, 2011). The change to utilize a low burden of proof, preponderance of evidence, was and is controversial. Despite a large literature base of legal opinions on the use of preponderance of evidence in the campus adjudication process, there are few …

Emergent Themes Surrounding The Implementation Of The Common Core State Standards For Mathematics For Students With Learning Disabilities In Mathematics, Andrew R. Mills

All NMU Master's Theses

As the nation transitions into a new national curriculum, the Common Core State Standards for Mathematics (CCSSM), educators face the challenge of meeting the needs of a diverse student population coupled with a change in standards. The purpose of this phenomenological study was to understand educators’ perceptions surrounding the implementation of these standards specific to students with learning disabilities in mathematics. Five rural, middle school educators were interviewed using a series of questions that investigated their experiences related to implementation of the CCSSM. Interviews were recorded and transcribed. Coding was used to identify emergent themes surrounding the phenomenon. Six emergent …

Jessie Fauset’S Not-So-New Negro Womanhood: The Harlem Renaissance, The Long Nineteenth Century, And Legacies Of Feminine Representation, Meredith Goldsmith Dec 2015

Jessie Fauset’S Not-So-New Negro Womanhood: The Harlem Renaissance, The Long Nineteenth Century, And Legacies Of Feminine Representation, Meredith Goldsmith

English and Creative Writing Faculty Publications

Fauset’s texts offer a repository of precisely what critic Alain Locke labeled retrograde: seemingly outdated plotlines and tropes that draw upon multiple literary, historical, and popular cultural sources. This essay aims to change the way we read Fauset by excavating this literary archive and exploring how the literary “past” informs the landscape of Fauset’s fiction. Rather than viewing Fauset’s novels as deviations from or subversive instantiations of modernity, I view them as part of a long nineteenth-century tradition of gendered representation. Instead of claiming a subversiveness that Fauset might have rejected or a conservatism that fails to account for the …
