The Minstrel Legacy: African American English And The Historical Construction Of "Black" Identities In Entertainment, Jennifer Bloomquist Dec 2015

The Minstrel Legacy: African American English And The Historical Construction Of "Black" Identities In Entertainment, Jennifer Bloomquist

Africana Studies Faculty Publications

Linguists have long been aware that the language scripted for "ethnic" roles in the media has been manipulated for a variety of purposes ranging from the construction of character "authenticity" to flagrant ridicule. This paper provides a brief overview of the history of African American roles in the entertainment industry from minstrel shows to present-day films. I am particularly interested in looking at the practice of distorting African American English as an historical artifact which is commonplace in the entertainment industry today. Dialogue which is clearly meant as an imitation of African American English still results in the construction of …

Bridging The Divide White Paper On Medication Abortion: Overview Of Research & Policy In The United States, Liz Borkowski, Julia Strasser, Amy Allina, Susan Wood Dec 2015

Bridging The Divide White Paper On Medication Abortion: Overview Of Research & Policy In The United States, Liz Borkowski, Julia Strasser, Amy Allina, Susan Wood

Jacobs Institute of Women's Health

Medication abortion (also called medical abortion) is a safe method of abortion available for the past 15 years in the US. The Bridging the Divide white paper summarizes the scientific evidence related to the current medication abortion process and potential changes to the process that could make it even safer and more accessible for patients, as well as policy considerations and directions for future research.

In the fall of 2000, the US Food & Drug Administration (FDA) approved the drug Mifeprex© (generic: mifepristone) for use in medication abortions. That approval included requirements that affect both patients and providers and that …

Prospective Testing And Redesign Of A Temporal Biomarker Based Risk Model For Patients With Septic Shock: Implications For Septic Shock Biology, Hector R. Wong, Natalie R. Cvijanovich, Nick Anas, Geoffrey L. Allen, Neal J. Thomas, Robert J. Freishtat, +17 Additional Authors Dec 2015

Prospective Testing And Redesign Of A Temporal Biomarker Based Risk Model For Patients With Septic Shock: Implications For Septic Shock Biology, Hector R. Wong, Natalie R. Cvijanovich, Nick Anas, Geoffrey L. Allen, Neal J. Thomas, Robert J. Freishtat, +17 Additional Authors

Pediatrics Faculty Publications

The temporal version of the pediatric sepsis biomarker risk model (tPERSEVERE) estimates the risk of a complicated course in children with septic shock based on biomarker changes from days 1 to 3 of septic shock. We validated tPERSEVERE performance in a prospective cohort, with an a priori plan to redesign tPERSEVERE if it did not perform well. Biomarkers were measured in the validation cohort (n = 168) and study subjects were classified according to tPERSEVERE. To redesign tPERSEVERE, the validation cohort and the original derivation cohort (n = 299) were combined and randomly allocated to training (n = 374) and …

Confusing Clarity: The Pregnancy Discrimination Act After Young V. Ups, Inc., Jessica M. Bretl Dec 2015

Confusing Clarity: The Pregnancy Discrimination Act After Young V. Ups, Inc., Jessica M. Bretl

Notre Dame Law Review Reflection

On March 25, 2015, the Supreme Court issued an opinion in Young v. UPS, Inc.—the most recent case in the Court’s pregnancy discrimination jurisprudence. Young focused on an interpretation of one clause of the Pregnancy Discrimination Act (PDA) and how that interpretation would shape claims of employment discrimination by pregnant employees seeking work accommodations. This Comment argues that the majority opinion in Young did not clarify, but only muddied the waters: the Young framework presents challenges for the lower courts tasked with applying the framework and creates uncertainty for future pregnancy discrimination litigation.

Part I of this Comment provides …

On The Signpost Principle Of Alternate Possibilities: Why Contemporary Frankfurt-Style Cases Are Irrelevant To The Free Will Debate, William Simkulet Dec 2015

On The Signpost Principle Of Alternate Possibilities: Why Contemporary Frankfurt-Style Cases Are Irrelevant To The Free Will Debate, William Simkulet

Philosophy and Religious Studies Department Faculty Publications

This article contends that recent attempts to construct Frankfurt-style cases (FSCs) are irrelevant to the debate over free will. The principle of alternate possibilities (PAP) states that moral responsibility requires indeterminism, or multiple possible futures. Frankfurt's original case purported to demonstrate PAP false by showing an agent can be blameworthy despite not having the ability to choose otherwise; however he admits the agent can come to that choice freely or by force, and thus has alternate possibilities. Neo-FSCs attempt to show that alternate possibilities are irrelevant to explaining an agent's moral responsibility, but a successful Neo-FSC would be consistent with …

A Matter Of Trial And Error, Or Betting On Appeals, Radek Goral Dec 2015

A Matter Of Trial And Error, Or Betting On Appeals, Radek Goral

Notre Dame Law Review Reflection

Sampling from the actual portfolio of a leading third-party litigation financier, this Essay demonstrates that making systematic bets on pending appeals is a viable business model applicable to a wide range of cases. “Appellate investments” may include both consumer and commercial cases, including also public-interest actions where prevailing plaintiffs are permitted attorney’s fees—even if they themselves do not seek monetary relief. Additionally, the analyzed sample indicates that appellate funders buy both from plaintiffs and plaintiffs’ attorneys, often in the same case.

The overview of the business strategy of appellate financing contributes to a larger theme: the role and impact of …

The Failure Of Anti-Money Laundering Regulation: Where Is The Cost-Benefit Analysis?, Lanier Saperstein, Geoffrey Sant, Michelle Ng Dec 2015

The Failure Of Anti-Money Laundering Regulation: Where Is The Cost-Benefit Analysis?, Lanier Saperstein, Geoffrey Sant, Michelle Ng

Notre Dame Law Review Reflection

Regulators have been punishing the banks not because of any actual money laundering, but rather because the banks did not meet the regulators’ own subjective vision of the ideal anti–money laundering or counter–terrorist financing program. However, no one has attempted to show that the supposedly ideal vision of an anti–money laundering or counter–terrorist financing program would actually be more effective than the programs the banks have in place.

Even if the regulators’ ideal vision of an anti–money laundering and counter–terrorist financing program would in fact be more effective than what exists now, it is unclear if the benefits of such …

Large-Eddy Simulation Of The Transient And Near-Equilibrium Behavior Of Precipitating Shallow Convection, Axel Seifert, Thijs Heus, Robert Pincus, Bjorn Stevens Dec 2015

Large-Eddy Simulation Of The Transient And Near-Equilibrium Behavior Of Precipitating Shallow Convection, Axel Seifert, Thijs Heus, Robert Pincus, Bjorn Stevens

Physics Faculty Publications

Large-eddy simulation is used to study the sensitivity of trade wind cumulus clouds to perturbations in cloud droplet number concentrations. We find that the trade wind cumulus system approaches a radiative-convective equilibrium state, modified by net warming and drying from imposed large-scale advective forcing. The system requires several days to reach equilibrium when cooling rates are specified but much less time, and with less sensitivity to cloud droplet number density, when radiation depends realistically on the vertical distribution of water vapor. The transient behavior and the properties of the near-equilibrium cloud field depend on the microphysical state and therefore on …

How To Predict Nesting Sites?, Stephen Escarzaga, Craig Tweedie, Vladik Kreinovich

Departmental Technical Reports (CS)

How to predict nesting sites? Usually, all we know is the past nesting sites, and the fact that the birds select a site which is optimal for them (in some reasonable sense), but we do not know the exact objective function describing this optimality. In this paper, we propose a way to make predictions in such a situation.

Why It Is Healthy To Regularly Challenge Authority: An Algorithmic Explanation, Olga Kosheleva, Vladik Kreinovich Dec 2015

Why It Is Healthy To Regularly Challenge Authority: An Algorithmic Explanation, Olga Kosheleva, Vladik Kreinovich

Departmental Technical Reports (CS)

One way to make group decisions is to select the best decision maker(s) in the group as the authority, and to follow his or her decisions. At first glance, it seems that if the selected authority is indeed the best decision maker, it is beneficial for everyone to obey his or her authority. However, history shows that in many cases, challenges to the authority (even to the authority of the best decision maker) were beneficial to the group. In this paper, we provide an algorithmic explanation for this phenomenon. The main idea behind this explanation is that most practical general …

Entrepreneurship, Creativity, And Local Food Systems: Essays On Regional Economic Development In South Carolina, Kristen Lientz Dec 2015

Entrepreneurship, Creativity, And Local Food Systems: Essays On Regional Economic Development In South Carolina, Kristen Lientz

All Dissertations

Within the existing economic development literature, there is a well-established linkage between the presence of skilled human capital and economic growth. A subset of this literature has focused on the role that a specific type of skilled human capital, known as the “creative class,” may play in facilitating regional economic development. This dissertation builds upon the existing creative class literature by examining the factors that have attracted the creative class to the state of South Carolina. In addition, this research gives special attention to the entrepreneurial activities of creative class professionals who engage in small-scale farming. Recent interest surrounding the …
