A Critique Of Hobby Lobby And The Supreme Court's Hands-Off Approach To Religion, Samuel J. Levine Dec 2015

A Critique Of Hobby Lobby And The Supreme Court's Hands-Off Approach To Religion, Samuel J. Levine

Notre Dame Law Review Reflection

Part I of this Essay provides a brief overview for analyzing the Supreme Court’s hands-off approach to religious doctrine. Specifically, this Part presents a summary of problems posed by the hands-off approach, followed by a brief taxonomy of different forms of judicial inquiry into religion. This Part aims to clarify which forms of inquiry are permissible—and typically necessary—for adjudication of a case involving a religious claim, and which forms of inquiry are precluded under the hands-off doctrine. Part II of this Essay applies the hands-off framework to the Hobby Lobby decision, considering the taxonomy of forms of judicial inquiry into …

Giving The Federal Circuit A Run For Its Money: Challenging Patents In The Ptab, Rochelle Cooper Dreyfuss Dec 2015

Giving The Federal Circuit A Run For Its Money: Challenging Patents In The Ptab, Rochelle Cooper Dreyfuss

Notre Dame Law Review

My main objective is directed at institutional questions, to help the PTO and Congress as each considers changes to the system and to gauge how well the PTAB could function to ameliorate the effect of Federal Circuit isolation and provide a basis for the court to consider new perspectives, write more persuasively, and provide better guidance. A second goal is to draw greater academic attention to the potential these procedures have for changing the patent system and to provoke discussion—outside the emerging PTAB bar—on how they ought to operate. In particular, the statute layers inter partes review in a specialized …

Hyperbolic Memory Discounting And The Political Business Cycle, T. Scott Findley Dec 2015

Hyperbolic Memory Discounting And The Political Business Cycle, T. Scott Findley

Economics and Finance Faculty Publications

The vintage political business cycle framework of Nordhaus (1975) represents the idea that the macroeconomic business cycle is manipulated opportunistically by an incumbent government to achieve re-election. A key assumption in this prototypical framework is that voters discount their memories about unemployment and inflation at a constant rate. Yet starting with Ebbinghaus (1885) and Jost (1897), a large body of research in psychology documents an empirical regularity that has come to be known as Jost's Second Law of Forgetting-individuals discount recent memories at a higher rate compared to the rate at which they discount older memories. I find that incorporating …

Ecological Niche Modeling Of Pteronotropis Hubbsi, The Bluehead Shiner: Evaluating The Effects Of Spatial Filtering And Maxent Features Across Various Spacial Extents, Justin Matthew Hernandez

Biology Theses

Ecological niche modeling (ENM) has been extensively applied as a reliable tool in conservation biology. Still, challenges abound in generating optimal models, especially when using limited occurrence data. The bluehead shiner, Pteronotropis hubbsi, a threatened species of concern, was modeled throughout its range within the U.S. South Central Plains Ecoregion. The portions of states that overlap this region include Texas, Oklahoma, Arkansas, and Louisiana. I used the Maxent software package (Phillips et al., 2006), as the ENM algorithm for this project. A maximum of 14 geospatial environmental layers (climatic, hydrologic, and geologic) were chosen to determine the species' association with …

An R Package For The Panel Approach Method For Program Evaluation: Pampe, Ainhoa Vega-Bayo

The R Journal

The pampe package for R implements the panel data approach method for program evaluation designed to estimate the causal effects of political interventions or treatments. This procedure exploits the dependence among cross-sectional units to construct a counterfactual of the treated unit(s), and it is an appropriate method for research events that occur at an aggregate level like countries or regions and that affect only one or a small number of units. The implementation of the pampe package is illustrated using data from Hong Kong and 24 other units, by examining the economic impact of the political and economic integration of …

Poems For My Woofie The Story Of Lt. Wilfred V. Michaud, 1st Parachute Battalion, 1st Marine Division, Allison Orr

Honors Projects in English and Cultural Studies

My senior capstone project is the creation of a book of investigative poetry. The subject of the work is my grandfather, Wilfred V. Michaud. He was a lieutenant in the United States Marine Corps during World War II. The poetry addresses the history of Michaud’s battalion and the battles it fought, as well as personal stories of Michaud’s life and experience in the service. Several secondary sources were used to gain historical context for the poetry. Additionally, primary sources were used to provide information about Michaud’s personal experiences. The combination of primary and secondary sources established the necessary background and …

The Image Machine, Jeremy Min Burns Dec 2015

The Image Machine, Jeremy Min Burns

Architecture Senior Theses

Architecture has always been an image machine. From the Lascaux cave paintings to the Sainte-Chapelle in Paris to the multimedia installations of the Eameses to the early projects of Diller Scofidio, images and architecture have cohabited persistently and productively for centuries. However, since the dawn of the digital age, the ontological status of images has changed; and in turn so has the relationship between images and architecture. Rather than being anchored to a specific material support, images exist as manipulable data. While some have viewed the digital turns as the transcendence of information beyond the human subject, an era of …

Architecture Senior Theses

Digital data contributes to an increasingly alienated aspect of our infrastructure. The complex practices of the Internet produce highly specified, engineered objects. Though their forms are ‘optimized,’ their intentions are not: the two primary considerations for the development of the infrastructure of the Internet are energy and security. Each category presents its own deliberations, but both often produce non-architectural, infrastructural elements beyond public visibility. The hidden infrastructure of data storage and mining (the indexing and analysis of data and traffic) produces spaces outside the agency of normative architectural discourse.

The key consideration for the design of the Internet is redundancy, …

The Development Of A Platform For Expression And Purification Of The Mammalian Transmembrane Transporter Abca4, Amaryllis Ortiz Dec 2015

The Development Of A Platform For Expression And Purification Of The Mammalian Transmembrane Transporter Abca4, Amaryllis Ortiz

Graduate School of Biomedical Sciences Theses and Dissertations

Purpose- ABCA4 is an ATP Binding Cassette (ABC) protein localized at cone and rod photoreceptor outer segments of the retina. Though mutations in ABCA4 have been found to cause a broad spectrum of disorders, ABCA4's high molecular weight (~210 kDa) and biochemical transmembrane properties have made ABCA4 functional studies unsuccessful. Identifying how ABCA4 functions might have significant clinical impact and open unanticipated avenues for therapeutic interventions. Thus, the objective of this study was to develop a new expression system able to produce the full-length, correctly folded and fully functional ABCA4 protein.

Methods- the ABCA4 gene was amplified from the PCMV6-ABCA4 …

Magnaporthaceae is a family of ascomycetes that includes three fungi of great economic importance: Magnaporthe oryzae, Gaeumannomyces graminis var. tritici, and Magnaporthe poae. These three fungi cause widespread disease and loss in cereal and grass crops, including rice blast disease (M. oryzae), take-all disease in wheat and other grasses (G. graminis), and summer patch disease in turf grasses (M. poae). Here, we present the finished genome sequence for M. oryzae and draft sequences for M. poae and G. graminis var. tritici. We used multiple technologies to sequence and annotate the …

From Accession To Exemption: A Brief History Of The Development Of Alaska Property Exemption Laws, Eric H. Miller Dec 2015

From Accession To Exemption: A Brief History Of The Development Of Alaska Property Exemption Laws, Eric H. Miller

Alaska Law Review

This Article examines the historical development of Alaska's debtor protections from their beginnings in the period of initial federal administration to the present. The current Alaska statutes protecting certain property of debtors from their creditors descended from policies first enacted by Congress. Although federal authority began in 1867 with the area's acquisition from Russia, Congress did not provide for governmental administration in Alaska until 1884, which act also provided Alaska its first debtor protection statutes. Extension of the federal Homestead Act to Alaska in 1898 brought the first protections for settlers' homesteads from their creditors. By 1912 and the creation …

Harnessing The Power Of Data Can Help Solve Our Housing Needs, Lorcan Sirr Dec 2015

Harnessing The Power Of Data Can Help Solve Our Housing Needs, Lorcan Sirr

Media

Ireland has traditionally been poor at collecting data, collating statistics and disseminating information. It’s not that we are an innumerate country; I think it is more that facts often inconveniently jar with opinion on a range of topics, from rural Ireland to road safety, to housing.

We Can’T Expect ‘The Market’ To Provide A Housing Policy, Lorcan Sirr Dec 2015

We Can’T Expect ‘The Market’ To Provide A Housing Policy, Lorcan Sirr

Media

As the government grapples with establishing a worthwhile housing policy, it would do well to remember that affordability is key. As companies increasingly choose to locate in or near cities, and people followjobs, most of Ireland’s housing needs will be in the greater Dublin area. In 2015, about half the population lives on just 20% of Ireland’s surface area, but by 2030 nearly half the nation will be living on just 10% of the land. Figures vary but the Dublin area will need 8,000-10,000 housing units per year.

Influence Of Rock-Pool Characteristics On The Distribution And Abundance Of Inter-Tidal Fishes, Gemma E. White, Grant C. Hose, Culum Brown Dec 2015

Influence Of Rock-Pool Characteristics On The Distribution And Abundance Of Inter-Tidal Fishes, Gemma E. White, Grant C. Hose, Culum Brown

Ecology Collection

Rock pools can be found in inter-tidal marine environments worldwide; however, there have been few studies exploring what drives their, fish species composition, especially in Australia. The rock-pool environment is highly dynamic and offers a unique natural laboratory to study the habitat choices, physiological limitations and adaptations of inter-tidal fish species. In this study rock pools of the Sydney region were sampled to determine how the physical (volume, depth, rock cover and vertical position) and biological (algal cover and predator presence) parameters of pools influence fish distribution and abundance. A total of 27 fish species representing 14 families was observed …

Autonomic Nervous System Reactivity In A Free-Ranging Mammal: Effects Of Dominance Rank And Personality, Elodie F. Briefer, James A. Oxley, Alan G. Mcelligott Dec 2015

Autonomic Nervous System Reactivity In A Free-Ranging Mammal: Effects Of Dominance Rank And Personality, Elodie F. Briefer, James A. Oxley, Alan G. Mcelligott

Ethology Collection

Modulation of the autonomic nervous system (ANS) activity allows animals to effectively respond to internal and external stimuli in everyday challenges via changes in, for example, heart and respiration rate. Various factors, ranging from social such as dominance rank to internal such as personality or affective states can impact animal physiology. Our knowledge of the combinatory effects of social and internal factors on ANS basal activity and reactivity, and of the importance that each factor has in determining physiological parameters, is limited, particularly in nonhuman, free-ranging animals. In this study, we tested the effects of dominance rank and personality (assessed …
