Sensing Performance Study Of Sic, A Wide Bandgap Semiconductor Material Platform For Surface Plasmon Resonance Sensor, Wei Du, Feng Zhao
Sensing Performance Study Of Sic, A Wide Bandgap Semiconductor Material Platform For Surface Plasmon Resonance Sensor, Wei Du, Feng Zhao
Electrical and Computer Engineering Faculty Research & Creative Works
The sensing properties of a surface plasmon resonance (SPR) based waveguide sensor on a wide bandgap semiconductor, silicon carbide (SiC), were studied. Compared to other waveguide sensors, the large bandgap energy of SiC material allows the sensor to operate in the visible and near infrared wavelength range, while the SPR effect by a thin gold film is expected to improve the sensitivity. The confinement factor of the sensor at various wavelengths of the incident light and refractive index of the analyte were investigated using an effective index method. Since the change of analyte type and concentration is reflected by the …

Accelerated Life Testing To Predict Service Life And Reliability For An Appliance Door Hinge, Seunghyeon Cheon, Hyunsoo Jeong, So Young Hwang, Seokmoo Hong, Naksoo Kim, Joseph P. Domblesky
Mechanical Engineering Faculty Research and Publications
Appliance manufacturers have traditionally performed physical testing using prototypes to assess reliability and service integrity of new product designs. However, for white goods where service lives are measured in years or decades, the use of endurance testing to analyze long time reliability is uneconomical. As accelerated life testing (ALT) is more efficient and less costly than traditional reliability testing, the methodology is finding increased usage by appliance manufacturers. In the present study, a simulation-based ALT approach was used to predict the service life of a polyacetal hinge cam from a consumer refrigerator. A predictive life stress model based on cumulative …
Land Use And Climate Change Bubbles: Resilience, Retreat, And Due Diligence, John R. Nolon
Land Use And Climate Change Bubbles: Resilience, Retreat, And Due Diligence, John R. Nolon
Elisabeth Haub School of Law Faculty Publications
This Article examines events on the ground in several localities where climate change is lowering property values and analyzes how those changes in value can be reckoned with by regulators. It merges practices and principles of real estate transactions and finance with those of land use and environmental regulation.
Climate change is a planetary phenomenon whose environmental implications are far-reaching. Reports on climate change consequences increasingly focus on what is happening locally and presently, while speculation continues about long-term global consequences. In numerous communities, property values are declining because of repeated flooding, continued threats of storm surges, sustained high temperatures, …
More Than A Woman: Insights Into Corporate Governance After The French Sex Quota, Darren Rosenblum
More Than A Woman: Insights Into Corporate Governance After The French Sex Quota, Darren Rosenblum
Elisabeth Haub School of Law Faculty Publications
In 2011, France enacted a Corporate Board Quota to establish a forty percent floor for either sex on corporate boards. Existing literature presumes that women will change the way firms function and that their presence in upper management will improve both governance and financial returns. To assess the potential impact of the quota, we interviewed twenty-four current and former corporate board members. Our analysis of these interviews generates two findings. First, our results indicate that, at least in the view of board members, the sex quota has had an impact on the process of board decision-making, but adding women has …
Forensic Evidence And The Court Of Appeal For England And Wales, Lissa Griffin
Forensic Evidence And The Court Of Appeal For England And Wales, Lissa Griffin
Elisabeth Haub School of Law Faculty Publications
The Criminal Division of the Court of Appeal has extensively analyzed the role of forensic evidence. In doing so, the court has grappled with the admissibility and reliability of a broad range of forensic evidence, from DNA and computer forensics to medical and psychological proof, to more outlying subjects like facial mapping, fiber analysis, or voice identification. The court has analyzed these subjects from two perspectives: the admissibility of such evidence in the lower courts and the admissibility of such evidence as fresh evidence on appeal. In both contexts, the court has taken a practical approach to admitting forensic proof …

Can Universal Pre-K Overcome Extreme Race And Income Segregation To Reach New York’S Neediest Children? The Importance Of Legal Infrastructure And The Limits Of The Law , Natalie Gomez-Velez
Cleveland State Law Review
This article will examine New York City and State’s current universal pre-kindergarten efforts as related to social goals of serving low-income children in segregated schools to address inequality and close opportunity gaps. It also will examine the educational goals of enhancing cognitive gains and improving school readiness for all children. Part I considers pre-kindergarten in a climate of extreme segregation by race and class and in the context of current technocratic education reforms operating against a backdrop of diminished legal remedies for the harms of race and class segregation and inequality. Part II examines pre-kindergarten, with a focus on New …

“Jim Crowing” Plyler V. Doe: The Resegregation Of Undocumented Students In American Higher Education Through Discriminatory State Tuition And Fee Legislation, David H.K. Nguyen, Zelideh R. Martinez Hoy
Cleveland State Law Review
This law review article examines the re-segregation of undocumented students in education, more specifically, re-segregation through state laws and policies impacting their attendance at American colleges and universities. Under no fault of their own, undocumented students are marginalized even further after graduating from high school, since they are not afforded the same benefits as their peers to attend college. This article explores the current landscape of these laws and policies after providing background on Plyler v. Doe and state and federal attempts to challenge education for undocumented students.
The Award Of E-Discovery Costs To The Prevailing Party: An Analog Solution In A Digital World, Steven Baicker-Mckee
The Award Of E-Discovery Costs To The Prevailing Party: An Analog Solution In A Digital World, Steven Baicker-Mckee
Cleveland State Law Review
Against this backdrop of the spiraling cost and burden of the discovery process, an issue is percolating through the lower and intermediate courts—the recoverability of e-discovery expenses as a component of the costs awarded to the successful party under Rule 54(d). Two divergent approaches have emerged in the judicial opinions and in the limited scholarship addressing the application of Rule 54(d) to e-discovery costs. The first contingent contends that Rule 54(d) is only intended to reimburse the prevailing party for a small subset of the total costs that the party has incurred. These jurists and scholars reason that Congressional intent …

Clients Want Results, Lawyers Need Emotional Intelligence, Christine C. Kelton
Cleveland State Law Review
Thinking requires emotions and emotions enhance thinking. This Article suggests that the emotionally intelligent lawyer is more likely to serve the needs of clients and the legal community than the lawyer who has less understanding of, and control over, emotions. Part II introduces two “emotionally unintelligent” lawyers, Amanda and Rick, and considers how their emotional “unintelligence” affects their new client, psychologist, Dr. Ray Randolph. Part III provides some background on the relevant research on emotional intelligence, including the history of intelligence, from general intelligence, to social intelligence, to multiple intelligences, and to emotional intelligence. Part IV defines and explores the …

Hands-Tied Hiring: How The Eeoc’S Individualized Assessment Is Taking Discretion Away From Employers’ Use Of Criminal Background Checks, Carrie Valdez
Hands-Tied Hiring: How The Eeoc’S Individualized Assessment Is Taking Discretion Away From Employers’ Use Of Criminal Background Checks, Carrie Valdez
Cleveland State Law Review
This article argues that the 2012 EEOC Guidance should not be given deference by the courts. Specifically, the Guidance’s individualized assessment, which imposes a heightened requirement on employers to justify their background check policies, is problematic in three important ways. First, the individualized assessment places an impractical burden by what it requires and whom it requires to conduct such an assessment. Second, employer liability for negligent hiring may actually increase if employers perform individualized assessments. Finally, the practical effect of the individualized assessment may be decreased employer reliance on criminal background checks, and the result will likely not be a …

Colluding Under The Radar: Achieving Collusion Through Vertical Exchange Of Information, Julia Shamir, Noam Shamir Recanati Graduate School Of Business, Tel Aviv University
Cleveland State Law Review
In the absence of antitrust regulations, rational profit-maximizing firms in an oligopoly may freely act in consort to reach a consensus and to maintain prices above the competitive level. However, in light of potential exposure to antitrust investigations and prospective heavy sanctions, firms attempt to achieve collusive outcomes without resorting to explicit agreements. One mechanism that may promote such tacit collusion is information-sharing; that is, the otherwise competing firms exchange their private information in order to set and maintain supra-competitive prices. Thus far, the attention of the antitrust authorities and scholars has focused on the phenomenon of horizontal information-sharing, i.e., …

Can Dead Soldiers Revive A "Dead" Doctrine? An Argument For The Revitalization Of "Fighting Words" To Protect Grieving Families Post-Snyder V. Phelps, Kevin P. Donoughe
Cleveland State Law Review
This Note avers that speech of the Westboro Baptist Church, in the context of funeral pickets, can be construed as targeted personal attacks on grieving families which have the potential to incite—and indeed have incited—immediate breaches of the peace and violent rebuttals. In light of Snyder, and the inadequacy of time, place, and manner statutes as a protection for grieving families, this Note argues for the revitalization of the “fighting words” doctrine to encompass targeted, ad hominem attacks from organizations like the Westboro Baptist Church, thereby leaving this speech unprotected by the First Amendment and exposing the speakers to tort …

Pre-Dispute Arbitration Agreements, Freedom Of Contract, And The Economic Duress Defense: A Critique Of Three Commentaries, Steven W. Feldman
Pre-Dispute Arbitration Agreements, Freedom Of Contract, And The Economic Duress Defense: A Critique Of Three Commentaries, Steven W. Feldman
Cleveland State Law Review
Arbitration under the Federal Arbitration Act (FAA) is the most important topic in current contract law and commentary. The Supreme Court has issued eight merits decisions construing the FAA since 2011, the lower state and federal courts issued more than 1,000 decisions considering the FAA in 2014, and there were 81 fulllength articles, notes, and comments on arbitration in the same year. Recently, three commentators, Professor Margaret Jane Radin of the University of Michigan Law School, Professor Nancy S. Kim of the California Western School of Law, and former Lecturer in Law James P. Dawson of the Yale Law School, …

The National Imperative For Health Care System Transformation: Why Certain Mergers And Acquistions Are Appropriate Despite Section 7 Of The Clayton Act, Nathan D. Sargent
Cleveland State Law Review
Integration among health care providers offers a promising solution to the health care crisis. Unfortunately, some efforts to improve the American health care system through integration have been halted by antitrust concerns and the enforcement of section 7 of the Clayton Act. Health care costs could be contained and clinical quality improved by allowing a narrow statutory exemption to enforcement of section 7 for health care integrations that demonstrate cost efficiency and advance patient care. Under such limited circumstances, relaxed antitrust regulation is an appropriate response to health care’s current financial crisis that will ultimately benefit America’s consumers and economy …
Torpedoing A Transaction: Economic Substance Versus Other Tax Doctrines And The Application Of The Strict Liability Penalty, Thomas C. Vanik Jr.
Torpedoing A Transaction: Economic Substance Versus Other Tax Doctrines And The Application Of The Strict Liability Penalty, Thomas C. Vanik Jr.
Cleveland State Law Review
Transactions designed to intentionally reduce one’s taxes often attract suspicion and become the subject of judicial review. To evaluate suspicious transactions, courts have developed special common-law doctrines that impose additional requirements beyond those in the Internal Revenue Code. These doctrines could be considered standard methods of fact finding or legal interpretation, yet they have taken on their own identity within court analyses with varying interpretations and applications. An examination of cases demonstrates significant overlap in the doctrines and exemplifies how the application of the doctrines adds confusion and uncertainty to tax law. Compounding on this uncertainty is the codification of …
Damage Characteristics In 3d Stitched Composites With Various Stitch Parameters Under In-Plane Tension, Arief Yudhanto, Gilles Lubineau, Isaac Aguilar Ventura, Naoyuki Watanabe, Yutaka Iwahori, Hikaru Hoshi
Damage Characteristics In 3d Stitched Composites With Various Stitch Parameters Under In-Plane Tension, Arief Yudhanto, Gilles Lubineau, Isaac Aguilar Ventura, Naoyuki Watanabe, Yutaka Iwahori, Hikaru Hoshi
Mechanical and Aerospace Engineering Faculty Research & Creative Works
Three-dimensional (3D) reinforcement by stitching is effective in improving the impact resistance of composites. Stitching, however, adversely affects the composite's in-plane mechanical responses, and alters its damage mechanisms due to stitch-induced irregularities. We experimentally investigate the effect of two important stitch parameters, stitch density and thread diameter, on the damage characteristics of 3D stitched multidirectional composites under in-plane tension using X-ray radiography, X-ray micro-computed tomography and digital image correlation (DIC). Our study shows that composites stitched with thicker thread exhibit improved tensile strength due to effective hindrance of edge-delamination. We also found that stitch thread affects damage behaviors. A higher …

An Environmental Understanding Of The Local Land Use System, John R. Nolon
Elisabeth Haub School of Law Faculty Publications
This Article is adapted from Chapter Three of John R. Nolon, Protecting the Environment Through Land Use Law: Standing Ground, published in 2014 by ELI Press. The book updates and expands on the author’s previous work, describing in detail how localities are responding to new challenges, including the imperative that they adapt to and help mitigate climate change and create sustainable neighborhoods. This Article outlines a comprehensive framework for understanding how traditional local land use authority can be used to preserve natural resources and environmental functions at the community level.
Rethinking The Childhood-Adult Divide: Meeting The Mental Health Needs Of Emerging Adults, Barbara L. Atwell
Rethinking The Childhood-Adult Divide: Meeting The Mental Health Needs Of Emerging Adults, Barbara L. Atwell
Elisabeth Haub School of Law Faculty Publications
Part I of this article describes ADHD and explores the extent of ADHD medication abuse, especially among young adults. Part II discusses the characteristics of emerging adults, who may be more likely than their older counterparts to make unwise decisions about medications and other life choices.34 While we protect minors by requiring parental consent for their medical treatments, emerging adults are effectively able to obtain any drug on the market if they convince the doctor that they have the requisite diagnosis. Part III explores HIPAA, the medical malpractice standard of care and the challenges associated with a society that is …

Is America Becoming A Nation Of Ex-Cons?, John A. Humbach
Elisabeth Haub School of Law Faculty Publications
Recent rates of mass incarceration have become a concern, but those rates are only part of the challenge facing (and posed by) the American criminal justice system. An estimated 25% of the U.S. adult population already has a criminal record and, with new felony convictions churning out at a rate of a million per year, America is well on its way to becoming a nation of ex-cons. Already, the ex-offender class is the nation’s biggest law-defined, legally discriminated-against minority group, and it is growing. The adverse social implications of this trend remain unclear and the critical demographic tipping point is …

Mode-Multiplexed Transmission Over Conventional Graded-Index Multimode Fibers, Roland Ryf, Nicolas K. Fontaine, H. Chen, B. Guan, B. Huang, Mina Esmaeelpour
Electrical and Computer Engineering Faculty Research & Creative Works
We present experimental results for combined mode-multiplexed and wavelength multiplexed transmission over conventional graded-index multimode fibers. We use mode-selective photonic lanterns as mode couplers to precisely excite a subset of the modes of the multimode fiber and additionally to compensate for the differential group delay between the excited modes. Spatial mode filters are added to suppress undesired higher order modes. We transmit 30-Gbaud QPSK signals over 60 WDM channels, 3 spatial modes, and 2 polarizations, reaching a distance of 310 km based on a 44.3 km long span. We also report about transmission experiments over 6 spatial modes for a …

New York City Rules! Regulatory Models For Environmental And Public Health, Jason J. Czarnezki
Elisabeth Haub School of Law Faculty Publications
Scholars have become increasingly interested in facilitating improvement in environmental and public health at the local level. Over the last few years, former New York City Mayor Michael Bloomberg and the New York City Council have proposed and adopted numerous environmental and public health initiatives, providing a useful case study for analyzing the development and success (or failure) of various regulatory tools, and offering larger lessons about regulation that can be extrapolated to other substantive areas. This Article, first, seeks to categorize and evaluate these “New York Rules,” creating a new taxonomy to understand different types of regulation. These “New …
