Enforcing Takings Clauses In China, Jie Cheng Jan 2015

Enforcing Takings Clauses In China, Jie Cheng

Property rights are considered fundamental in constitutional jurisprudence and essential for economic development. However, China’s economic growth over the past 30 years has posed a special paradox to many theorists: for some, it is a mysterious phenomenon that China could continue rapid growth for a few decades without proper contract law until 1999 and without constitutional private property rights until after 2004. For others, the lack of property rights explains the social unrests arising from land-taking and the potential risk of non-sustainability of further development. This does not mean that there is no property protection in China; both the Constitution …

Background: Persistent organic pollutants (POPs) are developmental toxicants, but the impact of both maternal and paternal exposures on offspring birth size is largely unexplored.

Objective: We examined associations between maternal and paternal serum concentrations of 63 POPs, comprising five major classes of pollutants, with birth size measures.

Methods: Parental serum concentrations of 9 organochlorine pesticides, 1 polybrominated biphenyl (PBB), 7 perfluoroalkyl chemicals (PFCs), 10 polybrominated diphenyl ethers (PBDEs), and 36 polychlorinated biphenyls (PCBs) were measured before conception for 234 couples. Differences in birth weight, length, head circumference, and ponderal index were estimated using multiple linear regression per 1-SD increase in …

Activation Of T-Cell Protein-Tyrosine Phosphatase Suppresses Keratinocyte Survival And Proliferation Following Uvb Irradiation, Hyunseung Lee, Liza D. Morales, Thomas J. Slaga, Dae Joon Kim Jan 2015

Activation Of T-Cell Protein-Tyrosine Phosphatase Suppresses Keratinocyte Survival And Proliferation Following Uvb Irradiation, Hyunseung Lee, Liza D. Morales, Thomas J. Slaga, Dae Joon Kim

School of Medicine Publications

Chronic exposure to UV radiation can contribute to the development of skin cancer by promoting protein-tyrosine kinase (PTK) signaling. Studies show that exposure to UV radiation increases the ligand-independent activation of PTKs and induces protein-tyrosine phosphatase (PTP) inactivation. In the present work, we report that T-cell PTP (TC-PTP) activity is stimulated during the initial response to UVB irradiation, which leads to suppression of keratinocyte cell survival and proliferation via the down-regulation of STAT3 signaling. Our results show that TC-PTP-deficient keratinocyte cell lines expressed a significantly increased level of phosphorylated STAT3 after exposure to low dose UVB. This increase corresponded with …

Obesity is a chronic metabolic disorder that may also lead to reduced white matter integrity, potentially due to shared genetic risk factors. Genetic correlation analyses were conducted in a large cohort of Mexican American families in San Antonio (N = 761, 58% females, ages 18–81 years; 41.3 ± 14.5) from the Genetics of Brain Structure and Function Study. Shared genetic variance was calculated between measures of adiposity [(body mass index (BMI; kg/m2) and waist circumference (WC; in)] and whole-brain and regional measurements of cerebral white matter integrity (fractional anisotropy). Whole-brain average and regional fractional anisotropy values for 10 major …

Heartbeat Location Assistance For Electrocardiograms, Sarah Bass Jan 2015

Heartbeat Location Assistance For Electrocardiograms, Sarah Bass

EWU Masters Thesis Collection

"The electrocardiogram (ECG) is the main source of heartbeat analysis throughout the medical community, due to the distinctive appearance of the QRS complex at the time of each beat. There are other signals that also exhibit distinctive patterns at the time of each heartbeat; however, the ECG is still the most prevalently used. Analyzing the ECG alone can be problematic because ECG data can be noisy. The noise often makes it appear as if the heartbeat is missing or that multiple beats occurred in quick succession. This research will analyze the association between a variety of signals and the ECG, …

Long-Term Characterization Of The Chronic Dopamine Microelectrode And Effect Of Electrical Conditioning, Eric P. Marr Jan 2015

Long-Term Characterization Of The Chronic Dopamine Microelectrode And Effect Of Electrical Conditioning, Eric P. Marr

EWU Masters Thesis Collection

Background: Dopamine (DA) is a neurotransmitter involved in movement, reward learning and addiction. Fast-scan cyclic voltammetry (FSCV) has long been an indispensable tool for monitoring real-time DA signaling. Development of polyimide fused silica-encased FSCV microelectrodes have made the technique more suitable for chronic DA monitoring (months) in vivo. Methods: In this study, electrically stimulated DA signals were evoked weekly in an effort to characterize the recovery time and stability of DA signals recorded long-term with silica-encased chronic DA microelectrodes. Additionally, electrical conditioning (etching), previously shown to improve microelectrode sensitivity in vitro, was performed to investigate the long-term impact on DA …

The Dietary Mineral Content Of Claytonia Lanceolata Corms From Multiple Populations Across The Columbia Plateau Region Of North America, Paul Reilly

EWU Masters Thesis Collection

"Since divergence from our ancestral lineage ~ 2.8 mya, humans have relied on foraged foods to obtain dietary mineral nutrition. Around 12,000 years ago, people began shifting towards a lifestyle of food production. The rapid shift in lifestyle significantly altered the human diet, and research suggests our genomes have had insufficient time to adjust. Due to the discord between genome and environment, unprecedented levels of disease and malnutrition are epidemic in certain subsets of the population. Studies suggest the most cost effective way to mitigate the risk of these diseases is to find ways to increase micronutrient consumption. As a …

Indirect Association Rule Mining For Crime Data Analysis, Riley Englin

EWU Masters Thesis Collection

"Crime data analysis is difficult to undertake. There are continuous efforts to analyze crime and determine ways to combat crime but that task is a complex one. Additionally, the nature of a domestic violence crime is hard to detect and even more difficult to predict. Recently police have taken steps to better classify domestic violence cases. The problem is that there is nominal research into this category of crime, possibly due to its sensitive nature or lack of data available for analysis, and therefore there is little known about these crimes and how they relate to others. The objectives of …

Single Mothers Getting By: Cultural And Structural Violence In Public Policy, Amara E. Bates

EWU Masters Thesis Collection

From the birth of government funded welfare in 1935 through current discussions of welfare reforms, the media and politicians have used rhetoric to make poor single mothers the "other." This paper will apply Galtung's model of the rhetorical and enacted route from cultural violence to structural violence ending in direct violence to this case. To explore the in the creation and "reform" of the welfare system, I will use discourse from various sources such as addresses to congress, public policy, media sources and women's personal accounts as well as analyze directly the policies that were created in response to this …

"The fish skull is a complex anatomical structure, comprised of numerous bones that are often unique to the fish's genera or species. These unique qualities allow researchers to use bone to identify and quantify fish in piscivore and archeological investigations. Due to the high degree of similarity among skull bones of salmonids, adequate descriptions for keying out most salmoinds is limited in the available literature. To address this, eight different bones from a sample of 273 fish, representing nine salmonid species, were observed and measured. Observations and measurements were used to construct dichotomous keys and regression models for identifying and …

Training The Transactional Business Lawyer: Using The Business Associations Course As A Platform To Teach Practical Skills, Constance Z. Wagner Jan 2015

Training The Transactional Business Lawyer: Using The Business Associations Course As A Platform To Teach Practical Skills, Constance Z. Wagner

All Faculty Scholarship

Drawing on her own practice background as a business lawyer and her law school teaching experience, theauthor argues for the importance of introducing transactional lawyering skills into the law school course on business associations. She notes that business law practice is transactional in nature, but that the traditional method of teaching business associations centers on case law analysis. This litigation-focused approach misleads students about the nature of business law practice, which requires lawyers to act as problem solvers and planners and to engage in preventative lawyering. To bolster her argument, the author draws on some of the recent literature on …

Sick And Tired Of Being Sick And Tired: Putting An End To Separate And Unequal Health Care In The United States 50 Years After The Civil Rights Act Of 1964, Ruqaiijah A. Yearby

All Faculty Scholarship

Since the end of the Civil War in 1865, the U.S. health care system has been structured to be racially separate and unequal. Ninety-nine years later, the enactment of Title VI of the Civil Rights Act of 1964 (Title VI) was supposed to put an end to this racially separate and unequal health care system by mandating equal access to health care for all races. However, fifty years later, African Americans continue to receive separate and unequal treatment compared to Caucasians, in hospitals, nursing homes, and physician offices. As a result, racial disparities in health status and access to health …

Kamil Kubik: The Artist And Copyright Observed, Elizabeth Townsend Gard, Yvette Joy Liebesman

All Faculty Scholarship

For over 60 years — from the time he fled his native Czechoslovakia in 1948 until his death in August 2011 — Kamil Kubik created amazing oil paintings and pastels. Many of his works were also printed as lithographs and serigraphs, for sale at more affordable prices than the four-to-five figures that he received for the originals. He was not dependent on the sale of these prints, which was a good thing — most of the original works were unprotected by copyright, and many of the prints were unauthorized reproductions.

Copyright law is the key law that protects the artistic …

The Benefits Of Integrating Entrepreneurship Into Business Associations, Ann M. Scarlett Jan 2015

The Benefits Of Integrating Entrepreneurship Into Business Associations, Ann M. Scarlett

All Faculty Scholarship

Integrating entrepreneurship into Business Associations through an emphasis on start-up and small businesses is worth sacrificing some coverage of public corporations. Attorneys are much more likely to work with clients who are self-employed or own small businesses, and thus the legal principles covered in a Business Associations course have more relevance to students when focused on these likely clients. Students are also able to more easily understand the legal concepts presented when focused on start-up and small businesses. Incorporating entrepreneurship also has the advantage of introducing law students to the cross-curricular nature of this practice area and at a time …

Graham v. Fl,orida,1 the Supreme Court's 2010 decision finding a life without parole sentence for a non-homicide crime committed by a juvenile "cruel and unusual' ' has rightly been recognized as a "watershed."2 A major focus of the extensive commentary on the case has been on its application of the "evolving standards of decency'' test to a punishment outside of the death penalty, and to whether Graham might apply also to adults.3 Equally important in Graham, but subject to comparatively less critical attention,4 is the central role that the rehabilitative theory of punishment plays in its …

When Does Copyright Law Require Technology Blindness? Aiken Meets Aereo, Yvette Joy Liebesman Jan 2015

When Does Copyright Law Require Technology Blindness? Aiken Meets Aereo, Yvette Joy Liebesman

All Faculty Scholarship

Within the Copyright Act, innovation and technological advances are the bases for the enactment or amendment of many sections. Technology is often fundamental to the language of the section, and the underlying technology matters even when it is paired with a technology-neutral section. And because technology matters, how it functions could be essential in resolving a copyright infringement dispute.

One such provision, 17 U.S.C. § 110(5), allows small businesses to “publicly perform” copyrighted music via a radio, as long as certain conditions regarding the equipment used are met. Only small businesses are eligible, and the proprietors can only use systems …

Function, Form, And Strawberries: Subverting Langdell, Jeremiah A. Ho Jan 2015

Function, Form, And Strawberries: Subverting Langdell, Jeremiah A. Ho

All Faculty Scholarship

So why do law schools place skills instruction below the dissemination of legal knowledge even though it is the practice of law that lawyers are engaged in doing and not just the mere knowing of it? Both should be equally significant. Although law teaching methodologies have shifted somewhat to accommodate the changing cognitive adaptations of the human mind in this age of digital technology, law instruction in classrooms still possess a deeply-rooted basis in legal formalist considerations of the law from the 19th century that displaces skills instruction for the advancement of the legal knowledge. Consequently, in order to further …

In The Jim Crow Routine, historian Stephen Berrey brings fresh eyes to the intricate set of legal rules that maintained racial segregation in the American South. Building on works like Leon Litwack’s Trouble in Mind: Black Southerners in the Age of Jim Crow and Neil R. McMillen’s Dark Journey: Black Mississippians in the Age of Jim Crow, Berrey focuses not on the rise or demise of Jim Crow so much as the manner in which it disciplined daily life. For average folks, argues Berrey, Jim Crow turned the South into a stage where whites and blacks learned to negotiate one …
