This Article builds on a growing body of scholarship discussing the role of reasonableness in consent-search doctrine. Although the language of “voluntary consent” implies a subjective inquiry into the state of mind of the person granting consent, the U.S. Supreme Court has repeatedly injected an objective standard of reasonableness into its analysis of a citizen’s consent. Several scholars have characterized the Court’s consent jurisprudence as focusing not on true voluntariness but on the reasonableness of police conduct, which they argue is appropriate because the touchstone of the Fourth Amendment is “reasonableness.” While the renewed scholarly focus on the role of …

For the vast majority of the twentieth century, trusts served two pivotal roles. The first was as a vehicle to help mitigate federal and state estate tax burdens, the rates of which could be quite significant. The second was to assist in asset preservation, safeguarding trust beneficiaries from their profligacy, former spouses, creditors, and the like.

At the start of the twenty-first century, Congress passed legislation that curtailed the impact of the federal estate tax, and many state legislatures have followed suit, either eliminating or significantly reducing their estate taxes. Intellectual Property And The Presumption Of Innocence, Irina D. Manta

Our current methods of imposing criminal convictions on defendants for copyright and trademark infringement are constitutionally defective. Previous works have argued that due process under the Sixth Amendment requires prosecutors to prove every element of a crime beyond a reasonable doubt, including the jurisdictional element. Applying this theory to criminal trademark counterfeiting results in the conclusion that prosecutors should have to demonstrate that an infringing mark needs to have traveled in or affected interstate commerce, which currently is not mandated. Parallel to this construction of the Commerce Clause, criminal prosecutors would also have to prove that Congress has the power …

The history of sexual harassment law─which I have occasion to consider as part of this symposium on the fiftieth anniversary of Title VII─can be divided, if not neatly, into three eras. The 1970s was home to the emergence of consciousness about the frequency and harm of sexually harassing behaviors in the workplace─and a name to describe them. Twenty years ago, the New York Limited Liability Company Law was enacted, including § 609(a), which explicitly disclaims liability of members, managers, and agents for the debts and obligations of the LLC. However, New York courts have held that this limitation on liability is not absolute, and certain conduct on the part of the owners can erode the liability shield. The statute provides that the members will not have personal liability for LLC debts solely because of their role as owners in the LLC. The statute does not say that members will never have liability, just that any liability will …

Bitcoin has entered the kingdom to stay, yet few are willing to shield its most likely victims.

The cryptocurrency is a mysterious amalgam of technology, transparency, and secrecy. Despite its initial mission of bypassing commercial fees, the currency alternative, presently valued at over $400 a coin, is a more likely candidate for hoarding and speculation. Surprisingly, while its brazen use to facilitate money laundering and drug purchases have been met with prosecution and headlines, Bitcoin’s everyday rapidly growing appeal to investors has been left largely unaddressed.

Perhaps nowhere in family law is this evolution more dramatic than in the burgeoning recognition of rights of lesbian, gay, bisexual, transgendered, and questioning (LGBTQ) couples. Within the past twenty- five years courts, legislatures, and international bodies have addressed the extent to which rights and obligations formerly reserved to heterosexual married spouses should be conferred on other partners.

In 2014, the Brooklyn Law Review published a symposium issue on Restatements of the Law. The organizer of the symposium, Professor Anita Bernstein, did not afford an opportunity for Restatement reporters to comment on the articles. The organizer did invite the Director of the American Law Institute, Lance Liebman, to contribute an essay commenting on the symposium as a whole. Liebman’s essay—unintentionally no doubt—misstated the position that we took in formulating the slayer rule for the Restatement (Third) of Property: Wills and Other Donative Transfers. Terrestrial ecosystems in the southeastern United States have evolved with fire as a common disturbance and as a result many natural communities require the presence of fire to persist over time. Human development precludes natural fires from occurring within these communities; however, prescribed fire is considered to be a critical tool in the effort to restore fire-dependent ecosystems after decades of fire exclusion. Illness representations play an important role in the way people with chronic illness manage symptoms and view their overall health. Those suffering from functional somatic syndromes as well as conventional diagnoses seek information and meaning about their health threats in order to make appraisals concerning health outcomes. The primary interest of this study was to determine whether illness representations predict coping strategies which in turn influence general health outcomes. Many elasmobranchs are considered top predators with worldwide distribution, and in general these fish play an important role in the transfer of energy from the lower to the upper trophic levels within the marine ecosystem. Despite this, little research has been done regarding the rates of prey ingestion, digestion, and the processes of energy and nutrient absorption. Specifically understudied is enzymatic digestion within the intestinal brush border, which functions to break down macromolecules into smaller subunits for luminal absorption across the gastrointestinal epithelium. This dissertation seeks to understand the conjunction of faculty roles as teachers and as researchers. This understanding is pursued through philosophical analysis. Discourse ethics, in particular, is used as a framework by which to best understand the roles played by faculty and if the roles of teacher and researcher are, in fact, commensurable. การวิจัยครั้งนี้มีวัตถุประสงค์เพื่อศึกษาผลของการจัดการเรียนรู้สุขศึกษาตามแนวคิดพัฒนา ด้านจิตพิสัยที่มีต่อเจตคติด้านสุขภาพและผลสัมฤทธิ์ทางการเรียนของนักเรียนประถมศึกษาปีที่ 5 กลุ่ม ตัวอย่าง คือ นักเรียนประถมศึกษาปีที่ 5 โรงเรียนวิชากร จำนวน 70 คน แบ่งเป็น 2 กลุ่มคือนักเรียน กลุ่มทดลองที่ได้รับการจัดการเรียนรู้วิชาสุขศึกษาตามแนวคิดการพัฒนาด้านจิตพิสัย จำนวน 35 คน และนักเรียนกลุ่มควบคุมที่ได้รับการจัดการเรียนรู้แบบปกติจำนวน 35 คน เครื่องมือที่ใช้ในการวิจัย ได้แก่ แผนการจัดการเรียนรู้วิชาสุขศึกษาตามแนวคิดการพัฒนาด้านจิตพิสัย จำนวน 8 แผนมีค่าดัชนี ความสอดคล้องเท่ากับ 0.78 แบบวัดเจตคติด้านสุขภาพและผลสัมฤทธิ์ทางการเรียนด้านความรู้และ การปฏิบัติเรื่องการสร้างเสริมสุขภาพมีค่าดัชนีความสอดคล้องเท่ากับ 0.82, 0.86, 0.95 มีค่าความเที่ยง 0.92, 0.87, 0.90 วิเคราะห์ข้อมูลโดยใช้ค่าเฉลี่ย ส่วนเบี่ยงเบนมาตรฐาน และค่าที? ที่ระดับนัยสำคัญ ทางสถิติ .05 ผลการวิจัยพบว่า 1) ค่าเฉลี่ยของคะแนนเจตคติด้านสุขภาพและผลสัมฤทธิ์ทางการเรียนด้าน ความรู้และการปฏิบัติเรื่องการสร้างเสริมสุขภาพหลังการทดลองของกลุ่มทดลองสูงกว่าก่อนการทดลอง อย่างมีนัยสำคัญทางสถิติที่ระดับ .05 2) ค่าเฉลี่ยของคะแนนเจตคติด้านสุขภาพและผลสัมฤทธิ์ทางการ เรียนด้านความรู้และการปฏิบัติเรื่องการสร้างเสริมสุขภาพหลังการทดลองของกลุ่มทดลองสูงกว่า กลุ่มควบคุมอย่างมีนัยสำคัญทางสถิติที่ระดับ .05

ผลของการจัดการเรียนรู้แบบโครงงานในวิชาสังคมศึกษา โดยใช้กิจกรรมการบริการสังคมที่มีต่อมโนทัศน์และพฤติกรรมจิตสาธารณะของนักเรียนมัธยมศึกษาปีที่ 1, ภาสุดา ภาคาผล, วลัย อิศรางกูร ณ อยุธยา

การวิจัยครั้งนี้มีวัตถุประสงค์เพื่อศึกษามโนทัศน์และพฤติกรรมจิตสาธารณะของนักเรียน มัธยมศึกษาปีที่ 1 ที่ได้รับการจัดการเรียนรู้แบบโครงงานในวิชาสังคมศึกษาโดยใช้กิจกรรมการบริการสังคม กลุ่มตัวอย่างคือ นักเรียนชั้นมัธยมศึกษาปีที่ 1 โรงเรียนม่วงไข่พิทยาคม จำนวน 65 คน แบ่งเป็น 2 กลุ่ม คือ กลุ่มทดลอง จำนวน 35 คน และกลุ่มควบคุมจำนวน 30 คน เครื่องมือที่ใช้ในการทดลอง คือ แผนการ จัดการเรียนรู้แบบโครงงานในวิชาสังคมศึกษาโดยใช้กิจกรรมการบริการสังคม ใช้เวลาในการทดลอง 12 สัปดาห์ สัปดาห์ละ 3 คาบ คาบละ 50 นาที เครื่องมือที่ใช้ในการเก็บรวบรวมข้อมูล คือ แบบวัดมโนทัศน์ จิตสาธารณะ แบบประเมินพฤติกรรมจิตสาธารณะด้วยตนเองของนักเรียน แบบประเมินพฤติกรรมจิต สาธารณะของนักเรียนโดยครูและผู้ปกครอง และแบบสะท้อนความคิดของนักเรียน วิเคราะห์ข้อมูลโดย การหาค่าเฉลี่ย (X) ค่าส่วนเบี่ยงเบนมาตรฐาน (SD) และเปรียบเทียบผลการวิเคราะห์ข้อมูลด้วยสถิติ ทดสอบค่าที (t-test) ผลการวิจัยสรุปได้ดังนี้ 1) นักเรียนที่ได้รับการจัดการเรียนรู้แบบโครงงานในวิชาสังคมศึกษาโดย ใช้กิจกรรมการบริการสังคมมีมโนทัศน์จิตสาธารณะหลังเรียนสูงกว่าก่อนเรียนและสูงกว่านักเรียนที่ได้รับ การจัดการเรียนรู้แบบปกติอย่างมีนัยสำคัญทางสถิติที่ระดับ .05 2) นักเรียนที่ได้รับการจัดการเรียนรู้แบบ โครงงานในวิชาสังคมศึกษาโดยใช้กิจกรรมการบริการสังคมมีพฤติกรรมจิตสาธารณะหลังเรียนสูงกว่าก่อน เรียนและสูงกว่านักเรียนที่ได้รับการจัดการเรียนรู้แบบปกติอย่างมีนัยสำคัญทางสถิติที่ระดับ .05

ความสัมพันธ์ระหว่างภาวะผู้นำใฝ่บริการกับผลการปฏิบัติงานของครูผู้ประสานงานโครงการฟื้นฟูศีลธรรมโลก, มัทนา นิถานานนท์, สนั่น ประจงจิตร

การวิจัยในครั้งนี้มีวัตถุประสงค์เพื่อ ศึกษาภาวะผู้นำใฝ่บริการ ผลการปฏิบัติงานของครูผู้ประสาน งานโครงการฟื้นฟูศีลธรรมโลก และความสัมพันธ์ระหว่างภาวะผู้นำใฝ่บริการกับผลการปฏิบัติงานของครูผู้ ประสานงานโครงการฟื้นฟูศีลธรรมโลก ประชากรที่ใช้ในการวิจัย จำนวน 537 คน คือผู้อำนวยการโรงเรียน หรือรองผู้อำนวยการผู้รับผิดชอบโครงการในโรงเรียนดังกล่าวตั้งแต่ครั้งที่ 1-8 กลุ่มตัวอย่างกำหนดขนาด จากตารางสำเร็จรูปของ Yamane ได้ 222 คน เลือกโดยวิธีการการสุ่มหลายขั้นตอน เลือกผู้ตอบแบบ เจาะจงโรงเรียนละ 1 คน เครื่องมือที่ใช้ในการวิจัยเป็นแบบสอบถามได้รับแบบสอบถามที่สมบูรณ์คืนมา จำนวน 195 ชุด คิดเป็นร้อยละ 87.84 สถิติที่ใช้ในการวิจัย ได้แก่ ค่าร้อยละ ค่าเฉลี่ย ส่วนเบี่ยงเบน มาตรฐานและค่าสัมประสิทธิ์สหสัมพันธ์ของ Pearson ผลการวิจัย พบว่า 1) ระดับของภาวะผู้นำใฝ่บริการของครูผู้ประสานงานโครงการฟื้นฟูศีลธรรม โลกโดยรวมอยู่ในระดับสูง โดยมีองค์ประกอบด้านการมุ่งมั่นพัฒนาบุคคลค่าเฉลี่ยอยู่ในอันดับสูงสุด รอง ลงมาคือการสร้างชุมชน ส่วนการฟังมีค่าเฉลี่ยในอันดับตำที่สุด 2) ระดับผลการปฏิบัติงานของครูผู้ประสาน งานโครงการฟื้นฟูศีลธรรมโลกโดยภาพรวมมีผลการปฏิบัติงานอยู่ในอันดับสูง โดยองค์ประกอบด้านกิจวัตร ประจำวันมีค่าเฉลี่ยอยู่ในอันดับสูงที่สุด รองลงมาคือด้านกิจกรรมสร้างสรรค์สังคม ส่วนด้านการจัดการ เรียนรู้มีค่าเฉลี่ยอยู่ในอันดับตำที่สุด 3) ภาวะผู้นำใฝ่บริการของครูผู้ประสานงานโครงการฟื้นฟูศีลธรรม โลกมีความสัมพันธ์ทางบวกกับผลการปฏิบัติงานอย่างมีนัยสำคัญทางสถิติที่ระดับ 0.01

การวิจัยครั้งนี้มีวัตถุประสงค์ เพื่อ 1) กำหนดสมรรถนะที่พึงประสงค์ของอาจารย์ในมหาวิทยาลัย เกษตรศาสตร์ 2) ศึกษาสมรรถนะที่มีอยู่จริงของอาจารย์ในมหาวิทยาลัยเกษตรศาสตร์ตามที่กำหนดใน วัตถุประสงค์ข้อที่ 1 โดยจำแนกตามวุฒิการศึกษาและประสบการณ์การทำงาน กลุ่มตัวอย่าง คือ ผู้ทรง คุณวุฒิการสัมภาษณ์จำนวน 5 คน โดยเลือกแบบเจาะจง และอาจารย์ของมหาวิทยาลัยเกษตรศาสตร์ ที่เป็นผู้ตอบแบบสอบถามจำนวน 351 คน เลือกโดยการสุ่ม สถิติที่ใช้ในการวิเคราะห์ข้อมูล ได้แก่ การวิเคราะห์เนื้อหาสำหรับข้อมูลเชิงคุณภาพจากการสัมภาษณ์ และ ค่าร้อยละ ค่าเฉลี่ย และ ค่า ส่วนเบี่ยงเบนมาตรฐาน สำหรับข้อมูลจากการตอบแบบสอบถาม ผลการวิจัยพบว่า สมรรถนะที่พึงประสงค์ของอาจารย์ในมหาวิทยาลัยเกษตรศาสตร์ มีดังนี้ 1) สมรรถนะด้านหลักสูตรและการเรียนการสอน 2) สมรรถนะด้านการวิจัย 3) สมรรถนะด้านการให้บริการ วิชาการ 4) สมรรถนะด้านการทำนุบำรุงศิลปวัฒนธรรม นอกจากนี้จากการศึกษาสมรรถนะที่พึงประสงค์ ของอาจารย์ในมหาวิทยาลัยเกษตรศาสตร์ โดยภาพรวมอยู่ในระดับมาก เรียงลำดับค่าเฉลี่ยสูงสุดไปหา ค่าเฉลี่ยตำสุด ดังนี้ สมรรถนะด้านหลักสูตรและการเรียนการสอน สมรรถนะด้านการวิจัย สมรรถนะ ด้านการให้บริการวิชาการ และสมรรถนะด้านการทำนุบำรุงศิลปวัฒนธรรม เมื่อจำแนกตามวุฒิการศึกษา พบว่า อาจารย์ที่มีวุฒิปริญญาโทและเอกมีสมรรถนะอยู่ในระดับมาก วุฒิปริญญาตรีมีสมรรถนะอยู่ใน ระดับปานกลาง และเมื่อจำแนกตามประสบการณ์ในการสอน พบว่า อาจารย์ที่มีประสบการณ์การสอน มากกว่า 25 ปีมีสมรรถนะอยู่ในระดับมากทุกด้าน

กระบวนการนิเทศภายในของโรงเรียนที่ได้รับผลกระทบจาก ความรุนแรงในเหตุการณ์สามจังหวัดชายแดนภาคใต้ ในโรงเรียนอำเภอกรงปินัง สังกัดสำนักงานเขตพื้นที่การศึกษา ประถมศึกษายะลา เขต 1, โศรยา สาและ, สุดารัตน์ สารสว่าง

การวิจัยครั้งนี้มีวัตถุประสงค์ เพื่อศึกษาและเปรียบเทียบความคิดเห็นของครูที่มีต่อสภาพ การดำเนินการตามกระบวนการนิเทศภายในโรงเรียน จำแนกตามประสบการณ์การสอนและขนาดโรงเรียน ที่แตกต่างกัน รวมทั้งศึกษาแนวทางและข้อเสนอแนะของครูเกี่ยวกับกระบวนการนิเทศภายในของโรงเรียน ที่ได้รับผลกระทบจากความรุนแรงในเหตุการณ์สามจังหวัดชายแดนภาคใต้ ในอำเภอกรงปินัง สังกัด สำนักงานเขตพื้นที่การศึกษาประถมศึกษายะลา เขต 1 กลุ่มตัวอย่างที่ตอบแบบสอบถามคือข้าราชการ ครูในอำเภอกรงปินังจำนวน 105 คน กลุ่มตัวอย่างที่สัมภาษณ์คือข้าราชการครูที่มีประสบการณ์ 11 ปี ขึ้นไปจำนวน 10 คน เก็บข้อมูลด้วยแบบสอบถาม ข้อมูลจากการสัมภาษณ์ใช้แบบสัมภาษณ์กึ่งมีโครงสร้าง ทำการวิเคราะห์ข้อมูลด้วยค่าร้อยละ ค่าเฉลี่ย ส่วนเบี่ยงเบนมาตรฐาน การวิเคราะห์ค่า F-test t-test และการวิเคราะห์เนื้อหา ผลการวิจัยพบว่า สภาพการดำเนินการตามกระบวนการนิเทศภายในของโรงเรียนทั้งห้าด้าน ได้แก่ ด้านการวางแผนการนิเทศ ด้านการสร้างความเข้าใจให้ความรู้ ด้านการดำเนินการนิเทศ ด้านการ สร้างขวัญและกำลังใจ และด้านการประเมินผลการนิเทศ ตามความคิดเห็นของครูในโรงเรียนอำเภอ กรงปินัง โดยภาพรวมและแต่ละด้านมีการปฏิบัติอยู่ในระดับมาก ยกเว้นด้านการสร้างความเข้าใจ ให้ความรู้ มีการปฏิบัติอยู่ในระดับปานกลาง ผลการเปรียบเทียบความคิดเห็นของครูที่มีประสบการณ์ การสอนต่างกันเกี่ยวกับการดำเนินการนิเทศภายในทั้งในภาพรวมและแต่ละด้านพบว่าไม่แตกต่างกัน ไม่สอดคล้องกับสมมติฐานการวิจัย ส่วนความคิดเห็นของครูที่สอนในโรงเรียนขนาดต่างกันโดยภาพรวมและแต่ละด้านพบว่าแตกต่างกันอย่างมีนัยสำคัญทางสถิติที่ระดับ .05 สอดคล้องกับสมมติฐานการวิจัย ยกเว้นด้านการวางแผนการนิเทศไม่แตกต่างกัน ส่วนแนวทางและข้อเสนอแนะของครูเกี่ยวกับการดำเนิน การตามกระบวนการนิเทศภายใน พบว่า 1) ควรมีการสำรวจปัญหาและความต้องการครูในพื้นที่ก่อนการ นิเทศ 2) ควรจัดอบรมให้ความรู้ในเรื่องการนิเทศภายใน และวิธีการนิเทศแบบใหม่ ๆ ให้เหมาะสมกับบริบท ของปัญหาในสถานการณ์จริง ให้บริการแก่ครูเป็นสื่อสิ่งพิมพ์หรือสื่อออนไลน์เพื่อพัฒนาตนเอง 3) ควรมี การนิเทศภาคเรียนละ 2 ครั้งและใช้วิธีที่เหมาะสมกับขนาดของโรงเรียนและยืดหยุ่นได้ตามสถานการณ์ 4) ควรให้รางวัลเป็นกำลังใจแก่ครูด้วยความยุติธรรม 5) ควรตรวจสอบปัญหาและอุปสรรคก่อนและหลัง การปฏิบัติงานนิเทศ

The main purpose of this article is to identify factors that influence the development of selected services and platforms for commercial content distribution in Poland at the beginning of 2014. The analysis was made using the scoring method. In this way, it was possible to obtain an objective performance evaluation of the studied sites.
