State Refusal Triggers Constitutional Crisis: Past Is Prologue On Energy And Infrastructure, Steven Ferrey Jul 2015

State Refusal Triggers Constitutional Crisis: Past Is Prologue On Energy And Infrastructure, Steven Ferrey

Suffolk University Law School Faculty Works

There is a new Constitutional “federalism” issue, pitting multiple states versus the federal government in a legal fight over control of competitive power supply as the U.S. moves to more renewable energy. In the new electric economy, while federal agencies mandate competition, several states have refused. FERC Order 1000 prohibits states' favoring monopolies via state “Rights-of-First-Refusal” to insist that all power movement be given to incumbent monopolies rather than competitively allocated. This invokes both the Supremacy Clause under Article 8 of the Constitution, as well as the Article I Commerce Clause.

State sustainable energy policy has endured 10 recent significant …

Neonatal Isolation Stress Inhibits Pre-Weaning Weight Gain And Mild-Stressor Induced Locomotor Activity In Early Adolescent Male And Female Rats, Peter Villavecchia, Mindy Miserendino

Psychology Faculty Publications

The present study looked at the effects of neonatal isolation, an early life stress experience, in male and female early adolescent rats, an age which is underrepresented in the early stress literature. Four stress-sensitive indices were assessed: weight gain during the pre-weaning period, open field activity, and locomotor activity in response to two mild stressors: exposure to a novel environment, and a single IP saline injection. Rats in the neonatal isolation condition were removed from dam and littermates on postnatal days 2-9 in accord with the procedure used by Kehoe et al. (1995); behavioral testing occurred on PN25-PN30 during …

Dynamic Environmentalism And Adaptive Management: Legal Obstacles And Opportunities, Jonathan H. Adler Jul 2015

Dynamic Environmentalism And Adaptive Management: Legal Obstacles And Opportunities, Jonathan H. Adler

Faculty Publications

Noted ecologist Daniel Botkin argues that "solving our environmental problems requires a new perspective" of environmental concerns that incorporates contemporary scientific understandings and embraces humanity's role in environmental management. Recognizing a new perspective is but the first step, however. There is also a need to identify how this perspective can inform environmental policy, not just on the ground but in the very institutional architecture of environmental law and management. Then comes the really hard part, for even if it is possible to conceive of how environmental management should proceed, it may be devilishly difficult to put such ideas into practice. …

Claiming The Social: Beyond 'Law As Technology', Naveen Thayyil Jul 2015

Claiming The Social: Beyond 'Law As Technology', Naveen Thayyil

Socio-Legal Review

This special issue is the first of its kind in seeking to connect the conceptual categories of Law, Technology and Society in India, and this by itself makes it an important moment in the intellectual trajectories of the attention on technology within the legal academy. The task here moves beyond a perfunctory introduction of the remarkable contributions in this issue to the reader. An introduction of such a special issue also requires a survey of the terrain that constitutes law and technology scholarship in India, including an overview of the field’s dominant trajectories and foci. Hence this introduction identifies the …

Identity And Identification: The Individual In The Time Of Networked Governance, Nishant Shah Jul 2015

Identity And Identification: The Individual In The Time Of Networked Governance, Nishant Shah

Socio-Legal Review

The rise of digital technologies has foregrounded the individual as the unit of network and database governance. The focus on the quantified self and data subjects has resulted in an increased attention on the rights, responsibilities, and safeguards to protect the individual at the centre of data mining and regulation practices. There is an increased anxiety about how the existing safeguards and policies are inadequate to both activate and to protect the individual in the face of ubiquitous and pervasive computational practices. This paper argues that attempts at trying to extend the fold of existing policies and frameworks are inadequate …

Curiosity: Philosophy And The Politics Of Difference, Perry Zurn Jul 2015

Curiosity: Philosophy And The Politics Of Difference, Perry Zurn

College of Liberal Arts & Social Sciences Theses and Dissertations

This dissertation takes the concept of curiosity, typically understood as a purely epistemological issue, and investigates its political stakes. I argue that curiosity is not only an underappreciated method of philosophy but also a critical practice for building inclusive political communities. By analyzing poststructural accounts of curiosityespecially from Michel Foucault and Jacques Derrida-I identify two primary modes of curiosity. First, there is a curiosity that objectifies and often fetishizes what is different, and, second, there is a curiosity that destabilizes and transforms. While philosophy has historically dismissed both in favor of a respectful and reliable wonder, I argue that a …

(In)Articulating The Specter: Queer Communicative Resistance In The Hysterical Supernatural, Clare Stuber Jul 2015

(In)Articulating The Specter: Queer Communicative Resistance In The Hysterical Supernatural, Clare Stuber

College of Liberal Arts & Social Sciences Theses and Dissertations

Using discourse analysis, this paper investigates the unresolved nature of a recently documented case of “conversion disorder” or “mass psychogenic illness” experienced by a group of teenage girls in Le Roy, New York. I argue we can see this contemporary embodiment of hysteria as a form of queer communicative resistance, existing in a discursive space called the hysterical supernatural. This new terminology – an alternative to the one-dimensionality of conventional medical models – looks toward the crucial intersection of queer theory, antiracist feminisms, disability studies, and trauma studies. The construction of hysteria becomes an important framework for investigating nuances of …

Oru Cultural Rojak, Bungkus, Please! Negotiating Hybridity In Everyday Moments, Karthiga Devi Veeramani

Research Papers

In this research report, I analyze my diaspora lived experiences to understand how I experience post-colonial diaspora hybridity as a subject position and as a mode of resistance. I use Pathak’s (2013) post-colonial autoethnography as my methodology to present my narratives about my experiences of hybridity. I use memory recollection as my data and analyze specific memories of mine to learn how my border crossings and transnational movements shape the way I experience hybridity. I specifically write about moments in which essentialist cultural identities were imposed upon me. I analyze how I understand my hybridity in relation to such essentialist …

Intersecting Identities: Navigating The Relationship Between Masculine Performativity And Feminist Ideology, Zachary Wagner Pace Jul 2015

Intersecting Identities: Navigating The Relationship Between Masculine Performativity And Feminist Ideology, Zachary Wagner Pace

Department of Educational Administration: Dissertations, Theses, and Student Research

As masculinities scholarship continues to explore how masculinity develops and how differing masculinities contribute to the lived experiences of masculine-identified subjects, it is important to understand how masculinity also intersects with other, salient identities for subjects. Literature related to masculine gender performance, liberatory feminist theory, and student development theory provide important lenses in approaching the topic of masculine intersectionality, but have not otherwise been synthesized to illuminate how masculine-identified students navigate intersectionality with feminism and feminist scholarship.

This qualitative case study explored how one participant experienced and made meaning of zir masculine and feminist identities in the varying spaces on …

Ethnographic Refusal As Research Method: Example From A Study Of A Family Court Child Custody Mediation Program, Alexandra Crampton Jul 2015

Ethnographic Refusal As Research Method: Example From A Study Of A Family Court Child Custody Mediation Program, Alexandra Crampton

Social and Cultural Sciences Faculty Research and Publications

Mediation is a dispute resolution process in which a third party neutral facilitates discussion towards amicable agreement. Parents in Wisconsin filing disputed claims in family court over child custody or physical residence must attend mediation before going back to court. I began research on the Milwaukee Family Court Child Custody Mediation program three years ago with anticipation of data collection challenges due to sensitivity of the topic and need for multiple research permissions. Multiple and ongoing permission is necessary given an ethnographic extended case study research design. This approach was chosen to analyze the meanings of mediation within larger social …

Population Structure Of Central Stoneroller (Campostoma Anomalum) On The Ozark Plateau In Arkansas And Missouri, Mallory Jane Jeffers Jul 2015

Population Structure Of Central Stoneroller (Campostoma Anomalum) On The Ozark Plateau In Arkansas And Missouri, Mallory Jane Jeffers

Graduate Theses and Dissertations

Stream fishes on the Ozark Plateau have been influenced both by historic events (i.e. vicariance versus dispersal) and ecological forces (i.e. flow regime). To examine the role of these processes, genetic structure of Central Stoneroller (Campostoma anomalum), an ecologically important omnivorous minnow with a broad distribution and elevated abundance, was evaluated across populations in the White River drainage of the Ozark Plateau in Arkansas and Missouri. Fin clips of five to eight individuals were taken at each of 20 sites (N=138 individuals; average=6.9), selected so as to represent two different flow regimes: intermittently flashy (N=10 sites; N=73 individuals; average=7.3/ site) …

Long-Term Effects Of Alternative Residue Management Practices On Near-Surface Soil Properties And Soybean Production In A Wheat-Soybean, Double-Crop System In Eastern Arkansas, Christopher Ryan Norman

Graduate Theses and Dissertations

Adoption of management practices that maintain or increase soil organic matter (SOM), which contains 58% carbon (C) on average, may help to mitigate climate change by sequestering atmospheric C. Therefore, the main objective of this study was to determine the long-term trends in SOM, soil C and nitrogen (N), bulk density, various soil chemical properties (i.e., pH, electrical conductivity [EC], and Mehlich-3-extractable nutrients) in the top 10 cm, and soybean yield as affected by residue burning (burning and non-burning), tillage (conventional and no-tillage), irrigation (irrigated and non-irrigated), and N-fertilization/residue level (high and low) in a wheat (Triticum aestivum L.)-soybean [Glycine …

Shiga Toxin-Producing Escherichia Coli (Stec) Detection Strategies With Formalin-Fixed Stec Cells, Christopher Adam Baker Jul 2015

Shiga Toxin-Producing Escherichia Coli (Stec) Detection Strategies With Formalin-Fixed Stec Cells, Christopher Adam Baker

Graduate Theses and Dissertations

Certain pathogenic Escherichia coli known as Shiga toxin (Stx)-producing Escherichia coli (STEC) are commensals in cattle, and typically cause bloody diarrhea in humans once the Stx toxin is secreted in invaded intestinal epithelial cells. Infections with STEC cells can lead to hemolytic uremic syndrome, which is commonly associated with kidney failure. Several STEC serogroups have been declared adulterants in raw, non-intact ground meat, and future regulations could potentially lead to a higher number of STEC serogroup detection strategies for these pathogenic microorganisms. Microbiological research laboratories may benefit from formalin-fixed STEC cells for periodic (daily, weekly, monthly, among others) instrument validation/calibration …

Effects Of Management Practices On Grassland Plant And Bird Community Composition In Kane County Forest Preserves, Colleen R. Zumpf Jul 2015

Effects Of Management Practices On Grassland Plant And Bird Community Composition In Kane County Forest Preserves, Colleen R. Zumpf

All Student Theses and Dissertations

Loss of grassland ecosystems over the past century has increased importance of efforts to improve and restore habitat for native plant species and the biotic communities they support. As a result of these efforts, biotic and abiotic conditions and interactions with the environment are altered. Species evolution based on these particular environmental conditions has caused many species to be mapped onto various environmental gradients which can be defined as niche separation. This study attempted to determine what environmental gradients had the strongest impact upon grassland bird and plant species niche separation, particularly those gradients defined by management activities such as …

The Comparative Effects Of Garden Pansies And Monilophytes On Perceived Stress Among College Students, Paige Dunkle Jul 2015

The Comparative Effects Of Garden Pansies And Monilophytes On Perceived Stress Among College Students, Paige Dunkle

Department of Environmental Studies: Undergraduate Student Theses

This study is designed to compare how college students rate their sense of stress in the presence of garden pansies or monilophytes (ferns). The objective is to discover more ways in which students can incorporate stress-reducing elements in their workspace. 32 students were placed in a room at a desk supplemented by a single pansy or fern. The students were asked to complete a 10 minute timed survey consisting of demographic questions and statements taken from the State Trait Anxiety Inventory. The hypothesis is that students will report feeling less stressed in the presence of the flowering pansy. Results consisting …

Improving Decision Making Through Mindfulness, Natalie Karelaia, Jochen Reb

Research Collection Lee Kong Chian School Of Business

With perhaps a few exceptions per day, we are seldom fully aware of our thoughts, actions, emotions, and what is happening around us. Even when it comes to making decisions, an activity that is often quite conscious, deliberate, and intentional, people are typically not as aware as they could be. We argue that as a result, decision quality may suffer. Consequently, mindfulness, most often defined as the state of being openly attentive to and aware of what is taking place in the present, both internally and externally (e.g., Brown and Ryan 2003; Kabat-Zinn 1982; 1990), can help people make better …

Enterprise Vocabulary Management; A Lexicographic View, Jan Voskuil

Wacana, Journal of the Humanities of Indonesia

The central theme in this paper is the problem of shifting from natural language descriptions, as in traditional dictionaries and thesauri, to working IT (Information Technology) systems that support people carrying out their administrative tasks. An explicit description of the specific language used in an organization is necessary to guarantee properly working IT systems and a healthy flow of information. Traditionally, there are different ways of capturing such a vocabulary. Different options are considered, arguing that the general form of a thesaurus offers the optimal solution for a broad range of cases. Various requirements for such a thesaurus are examined. …

Computational Prediction Of Remodeling Of Collagen Fiber Network In Articular Cartilage Under Dynamic Unconfined Compression, Juan Andres Coello Amado Jul 2015

Computational Prediction Of Remodeling Of Collagen Fiber Network In Articular Cartilage Under Dynamic Unconfined Compression, Juan Andres Coello Amado

Theses and Dissertations - UTB/UTPA

A poroelastic finite element model of a heterogeneous cartilage disk was created based on previous studies and experimental setups; this allows us to study cartilage behavior under dynamic unconfined compression. Previous studies have used a Post Hoc approach, which consist of searching for patterns or relationships between predicted mechanical parameters obtained through computational and experimental results. Our goal in this study is to take the same Post-Hoc approach and identify patterns between predicted mechanical parameters, such as fiber strain or stress, and experimentally-measured collagen fiber distribution (i.e. reorientation of fibers under dynamic unconfined compression). After computational predictions were obtained, it …
