Prisoners’ Rights Lawyers’ Strategies For Preserving The Role Of The Courts, Margo Schlanger
Prisoners’ Rights Lawyers’ Strategies For Preserving The Role Of The Courts, Margo Schlanger
University of Miami Law Review
This Article is part of the University of Miami Law Review’s Leading from Below Symposium. It canvasses prisoners’ lawyers’ strategies prompted by the 1996 Prison Litigation Reform Act (“PLRA”). The strategies comply with the statute’s limits yet also allow U.S. district courts to remain a forum for the vindication of the constitutional rights of at least some of the nation’s millions of prisoners. After Part I’s introduction, Part II summarizes in several charts the PLRA’s sharp impact on the prevalence and outcomes of prison litigation, but demonstrates that there are still many cases and situations in which courts continue to …

Methods Of Murder In Maternal Filicide: An Analysis Of Weapon Use And Mode Of Death, Ami Moller
Methods Of Murder In Maternal Filicide: An Analysis Of Weapon Use And Mode Of Death, Ami Moller
Bakerman Student Research Awards
Maternal filicide, the murder of a child perpetrated by his or her mother, has been studied in an effort to define the causal factors for such behavior. Less information exists on the type of weapons used by mothers. This paper presents a content analysis of twenty maternal filicide cases collected from various newspapers in an effort to determine the common methods of murder and types of weapons used by the mothers. Findings show that blunt objects are the most frequently used weapon by these offenders. A comparison with previous research of the same faction indicates slightly different weapon use even …

Decisions To Prosecute Battered Women's Homicide Cases: An Exploratory Study, Sarah N. Welling, Diane Follingstad, M. Jill Rogers, Frances Jillian Priesmeyer
Law Faculty Scholarly Articles
Discretionary decisions to prosecute cases in which a battered woman kills her partner were investigated using several research strategies and targeting a range of case elements. Law students presented with case elements reported they would consider legal elements over nonlegal (or ‘supplemental’) elements when making a decision to prosecute. In contrast, law students assessed through an open-ended format as to important case factors for deciding to prosecute spontaneously generated high proportions of supplemental case elements compared with legal factors. Vignette comparisons of 42 case elements on participants’ likelihood to prosecute identified salient factors including legal and supplemental variables. Themes from …

Perceptions Of Mental Health Among First Year College Students, Kelly N. Mcgowan
Honors Theses
College students are at risk for exposure to, exacerbation, and development of mental health issues. Exposure to and existence of historical stigmas and misconceptions is a portion of the hesitancy for this population to acknowledge symptoms and seek help. This hesitancy is often put in place by the media, in how they portray mental health Anxiety, mood, eating, psychotic, and substance abuse disorders are prevalent in this population. Colonel Campers are known for their involvement and retention at Eastern Kentucky University and are a representation for this at risk population. The participants were surveyed via a mixed quantitative and qualitative …

Raised Afraid: The Media's Influence In Heightened Fear Of Terrorism, Paige Fetters
Honors Theses
Since the tragic events of September 11, 2001, terrorism has become a household topic and a leading headline for the news media. Following the 9/11 attacks, coverage of the event was played around the clock for the first five days. 99 – 100% of Americans followed terrorism-related events by watching television listening to the radio, or reading print news. Exposure to terrorism-related media have increased substantially since the widespread use of smartphones and social media, where news and topics can be shared and discussed around the world in a matter of seconds. The psychological effects of this exposure could affect …
Capital Punishment At Home And Abroad: A Comparative Study On The Evolution Of The Use Of The Death Penalty In The United States And The United Kingdom, Rachel Gaines
Honors Theses
Capital punishment (sometimes referred to as the death penalty) is the carrying out of a legal sentence of death as punishment for crime. The United States Supreme Court has most recently ruled that capital punishment is not unconstitutional. As a result, states are free to abstain from using capital punishment or to use it, and it is accepted for federal crimes. In 1965, the United Kingdom eliminated the use of capital punishment for murder on a temporary basis, abolishing it permanently in 1969, and adopting two European protocols that eliminated its use perpetually for all crimes in 1998. This research …

Barriers To The Ballot Box: Implicit Bias And Voting Rights In The 21st Century, Arusha Gordon, Ezra D. Rosenberg
Michigan Journal of Race and Law
While much has been written regarding unconscious or “implicit bias” in other areas of law, there is a scarcity of scholarship examining how implicit bias impacts voting rights and how advocates can move courts to recognize evidence of implicit bias within the context of a voting rights claim. This Article aims to address that scarcity. After reviewing research on implicit bias, this Article examines how implicit bias might impact different stages of the electoral process. It then argues that “results test” claims under Section 2 of the Voting Rights Act (VRA) present an opportunity for plaintiffs to introduce evidence regarding …
Strip Searching In The Age Of Colorblind Racism: The Disparate Impact Of Florence V. Board Of Chosen Freeholders Of The County Of Burlington, André Keeton
Michigan Journal of Race and Law
In 2012, the Supreme Court of the United States decided Florence v. Board of Chosen Freeholders of the County of Burlington. The Court held that full strip searches, including cavity searches, are permissible regardless of the existence of basic reasonable suspicion that the arrestee is in possession of contraband. Further, the Court held that law enforcement may conduct full strip searches after arresting an individual for a minor offense and irrespective of the circumstances surrounding the arrest. These holdings upended typical search jurisprudence. Florence sanctions the overreach of state power and extends to law enforcement and corrections officers the unfettered …

On a late summer evening in August of 1997, Nathan Brown was in his apartment rocking his young daughter to sleep when the police knocked on his door. The police sought Brown, one of a few Black men in his apartment complex, after a young White woman said she had been assaulted by a shirtless Black man wearing black shorts with strong body odor walking through the complex’s courtyard. Minutes later the police took Brown outside and put him in the patrol car for a one-on-one “showup.” They brought him out by himself to see the victim wearing black shorts …
Trafficked? Aids, Criminal Law And The Politics Of Measurement, Aziza Ahmed
Trafficked? Aids, Criminal Law And The Politics Of Measurement, Aziza Ahmed
University of Miami Law Review
Since early in the HIV epidemic, epidemiologists identified individuals who transact sex as a high-risk group for contracting HIV. Where the issue of transacting sex has been framed as sex work, harm-reduction advocates and scholars call for decriminalization as a primary legal solution to address HIV. Where the issue is defined as trafficking, advocates known as abolitionists argue instead for the criminalization of the purchase of sex.
Global health governance institutions are porous to these competing ideas and ideologies. This article first historicizes the contestation between harm-reduction and abolition in global governance on health. The paper then turns to a …

Sexual And Reproductive Health Risks Amongst Female Adolescents Who Use Amphetamine-Type Stimulants And Sell Sex: A Qualitative Inquiry In Yunnan, China, Xu-Dong Zhang, Angela Kelly-Hanku, Jia-Jia Chai, Jian Luo, Marleen Temmerman, Stanley Luchters
Obstetrics and Gynaecology, East Africa
Background: China, as other Southeast Asian countries, has witnessed an increased use in amphetamine-type stimulants (ATS) amongst urban youth. Amongst female adolescents who both sell sex and use ATS, risk behaviours are compounded resulting in even poorer health outcomes. However, limited knowledge exists on ATS use patterns and ATS-related risk behaviours, particularly in this context. This research aimed to improve the understanding of these issues amongst female adolescents who use ATS and sell sex, and to inform future programming.
Method: This study utilised monthly focus group discussions (four in total) with the same study participants in Yunnan, China. From within …
Domestic Violence In Saudi Arabia, Sahar Alhabdan
Domestic Violence In Saudi Arabia, Sahar Alhabdan
Maurer Theses and Dissertations
Family violence is a serious issue that affects women in Saudi Arabia. In response to cultural acceptance of violence between spouses in Saudi Arabia, the government issued its first law criminalizing domestic violence in 2013. The Protection from Abuse Act was proposed to improve protection for women and to punish the abusers, but several articles in the Act may reduce its effectiveness. Issuing laws prohibiting domestic violence cannot by itself protect women. Women should be protected under family law by preserving their rights to marry, divorce, obtain custody of children, and receive alimony. This dissertation will study the issue of …

Towards An Institutional Challenge Of Imprisonment For Legal Financial Obligation Nonpayment In Washington State, Devon King
Washington Law Review
Imprisonment for debt is resurfacing in the United States, primarily in the form of contempt proceedings for failure to pay court judgments. Although Washington’s Constitution prohibits imprisonment for debt, the State repeatedly jails individuals for failing to pay legal financial obligations. This Comment explores the adverse consequences of this de facto debtors’ prison system, describes the strong prohibition on imprisonment for debt found in article I, section 17 of the Washington Constitution, and argues that imprisonment for failing to pay legal financial obligations violates that strong prohibition. It then discusses how case law has degraded article I, section 17, making …
