Contractual Wills: Misplaced Marital Loyalties: Eunsuing Litigation: Increased Federal Estate Taxes, Addison E. Dewey Aug 2015

Contractual Wills: Misplaced Marital Loyalties: Eunsuing Litigation: Increased Federal Estate Taxes, Addison E. Dewey

Akron Law Review

A MYSTIFYING PLETHORA OF RECENT CASES indicates that husbands and and wives seem to be placing much more euphoric confidence in the judicial enforcement of their contractual wills than they do in unbargained-for assurances by the spouse that the provisions of such will never be changed. Many cases indicate that married couples feel that while mutual trust and confidence may be a revered tradition resulting from matrimonial bliss, they prefer to superimpose upon testamentary dispositions of their estates the common law concept of contract as an agreement which the courts will enforce. The repeated pattern of the various cases is …

The Stress Of Adolescence: The Impact Of Self-Perceived Body Development On Adult Health, Isabelle Christine Beulaygue Aug 2015

The Stress Of Adolescence: The Impact Of Self-Perceived Body Development On Adult Health, Isabelle Christine Beulaygue

Open Access Dissertations

Extant research indicates that early and mid adolescence are times of notable pubertal changes, which are accompanied by rapid physical, cognitive, and social transitions. For young women, these changes are particularly stressful. The female body changes extensively and is subject to societal ideals of beauty, thinness, and objectification. The current dissertation offers a novel bio-psycho-social perspective to the study of adolescent self-perceived development. Utilizing data from Waves, I III, and IV of Add Health, I constructed a composite index of self-perceived body development during adolescence and examined its impact on four health outcomes. After running several regression models, and testing …

Innovating In Higher Education -- Challenges And Responses Within A Conservative Context, John Whikehart, Robert F. Arnove Aug 2015

Innovating In Higher Education -- Challenges And Responses Within A Conservative Context, John Whikehart, Robert F. Arnove

International Journal of Leadership and Change

This article presents a case study of a community college – Ivy Tech-Bloomington (IN) – to illustrate challenges faced by postsecondary institutions around the world. Ivy Tech-Bloomington has faced reduced state funding and increased pressure to emphasize the instrumental value of education – namely, “workforce development” – with constructive responses that diverge in many ways from dominant trends in higher education. Inspired by a vision of serving the common good, of helping those students most likely to fail, and valuing the role of the arts and humanities, the leadership of Ivy Tech-Bloomington has accomplished many of its goals in an …

Using Rhetoric To Manage Campus Crisis: An Historical Study Of College Presidents' Speeches, 1960-1964, Eddie R. Cole

International Journal of Leadership and Change

Student protests and other forms of campus conflict are prominent in higher education; however, little is known about the manner in which college presidents have historically responded to these protests and conflicts. Focused on North Carolina in the 1960s, a decade notable for student protests on college campuses, this article identifies three approaches used by college presidents in their public speeches to manage campus conflict. This research examines the speeches of college presidents in North Carolina, where the first mass protests of the decade occurred during the student movement for civil rights starting in 1960 until 1964 when the Civil …

Creating Shared Vision And Facilitating Transformation In Community Colleges, Dedria Adel Blakely Aug 2015

Creating Shared Vision And Facilitating Transformation In Community Colleges, Dedria Adel Blakely

Dissertations

Why are some community colleges, regardless of location or size, able to successfully engage their communities (both internal and external) to create highly functional strategic plans that guide their institutions to a shared vision and transformational change? This research sought to identify the positive qualitative elements exercised during the strategic planning process. Contextual elements, such as how leaders craft the strategic planning process, how and to what degree they seek feedback from the college’s stakeholders, as well as the social and psychological processes and talents of the people involved in the planning have not been examined in depth in the …

Performance In The Chaordic Age: By Design Or By Destiny?, Raymond L. Forbes Aug 2015

Performance In The Chaordic Age: By Design Or By Destiny?, Raymond L. Forbes

All Faculty and Staff Scholarship

This paper discusses the challenge of performance in an age characterized by high levels of both organizational and environmental uncertainty. Today, business, not-for-profit, and governmental institutions all find themselves besieged by difficult-to-predict periods of disorder and relative certitude. A new structural form, called the chaordic organization, has arisen as one means of operating in such a turbulent and indeterminate environment. This article will consider the chaos-certainty question, examine the concepts of performance and potential, deliberate whether performance can be influenced by calculated design measures, and look at current thinking related to motivation and its relationship to organizational performance. Additionally, a …

Financial Capability And Asset Building In Social Work Education: “The Big Piece Missing?”, Margaret S. Sherraden, Julie Birkenmaier, Michael Rochelle, Gena G. Mcclendon Aug 2015

Financial Capability And Asset Building In Social Work Education: “The Big Piece Missing?”, Margaret S. Sherraden, Julie Birkenmaier, Michael Rochelle, Gena G. Mcclendon

Center for Social Development Research

Since the 1990s, social workers have renewed the profession’s early focus on improving the financial well-being of vulnerable families. Nonetheless, most social workers receive little training and education about how to help clients build stable and secure financial lives. This study uses in-depth interviews and pre- and post-surveys to examine the effects of a Financial Capability and Asset Building (FCAB) curriculum in six Minority Serving Institutions. In-depth interviews with 24 school administrators, FCAB instructors, and faculty colleagues suggest that faculty chose FCAB content based on course goals, content utility, and alignment with social work education standards. Furthermore, faculty reported gaining …

Seniority Layoffs: The Bitter Fruits Of Victory, Andrea Krill Aug 2015

Seniority Layoffs: The Bitter Fruits Of Victory, Andrea Krill

Akron Law Review

IT IS UNDENIABLE that the inertia of the civil rights laws has speeded the progress of equal employment opportunity. Minorities and women at last have enjoyed some measure of increased job entries and upward mobility. The current recession threatens to reverse this process. Seniority is the ambrosia of the working classes conferring a kind of employment immortality in return for their efforts. Those who have drunk deeply from the cup are secure, for their longer service renders them impervious to the furies of economic change. In many instances, those who have merely whetted their thirst are the more recently hired …

The Plight Of The Interstate Child In American Courts, Leona Mary Hudak Aug 2015

The Plight Of The Interstate Child In American Courts, Leona Mary Hudak

Akron Law Review

FOR EVERY THREE MARRIAGES solemnized in the United States each year, one divorce is granted. In some states the statistics approach one for every two. Yet, it is not these almost overwhelming statistics which are the most pernicious aspects of the broken American marriage, but rather the tragic aftermath revolving about custody-visitation when children are involved. Therein lies an opprobrious indictment of the American juridical-legal-legislative system.' For with the official rescission of the nuptial contract begin the devious, sometimes vengeful and often heart-rending machinations and maneuvers of "noncustodian v. custodian" hearing and rehearing,' on the courtroom stages of 52 jurisdictions-all …

Proof Of Scienter In Criminal Obscenity Prosecutions, James P. Edmiston Aug 2015

Proof Of Scienter In Criminal Obscenity Prosecutions, James P. Edmiston

Akron Law Review

Beginning in 1957 with the landmark case of Roth v. United States, and continuing to the present, the courts and legislatures of this country have embarked on a determined, if somewhat confused, effort to prove Milton wrong. The social demand for the enactment and strict enforcement of obscenity laws, designed to remove both the material and its purveyors from society, has placed an enormous burden on the courts, which are charged with interpreting the vagaries of this country's obscenity laws as well as balancing the need for control of obscenity with constitutional freedoms.

The Impact Of Two Tesol Courses On Four Preservice Teachers' Emerging Teaching Identities: A Case Study, Cynthia C. Chasteen Aug 2015

The Impact Of Two Tesol Courses On Four Preservice Teachers' Emerging Teaching Identities: A Case Study, Cynthia C. Chasteen

Dissertations

This multiple case study explores the effect of two Teaching English to Speakers of Other Languages (TESOL) courses on four preservice teachers’ (PSTs) emerging teaching identities. The inquiry was guided by a theoretical framework informed by TESOL content, for example Sheltered Instruction Observation Protocol (SIOP), and context, identity and sociocultural theory. Participants reflected on the impact of their prior experiences as students and TESOL coursework on their fledgling identities through individual interviews and assignments in the TESOL Methods course. Other corroborating data collected include classroom observations and unit plans. Two levels of data analysis were used: (1) first cycle coding …

Digital Scholarship And Interactivity: A Study Of Commenting Features In Networked Books, Jenna Sheffield

English Faculty Publications

Digital scholarly publishing is moving toward the use of commenting features, which allow readers to contribute to the knowledge production of the publication and establish a community of readers within a digital text. In this article, I use theories of interactivity in order to articulate some of the potentials as well as challenges that are inherent in using commenting features within digital scholarship. In using interactivity as the main theory through which scholars understand their decisions about commenting functions, this article argues, digital scholars will better be able to frame the interactions that can occur among readers and the author …

Same-Sex Marriage And Jewish Law: Time For A New Paradigm?, Doron M. Kalir Aug 2015

Same-Sex Marriage And Jewish Law: Time For A New Paradigm?, Doron M. Kalir

Law Faculty Articles and Essays

In recent years the Supreme Court, as well as important segments of society, has come to accept and even celebrate same-sex relations that, in the past, and for some still today, have generated contempt, hostility, and violence. This change in law and culture poses a unique challenge for those who are moved by the plight of gay people yet concomitantly feel bound by their religious convictions and therefore prevented from providing religious legitimacy to people who yearn to be part of their community. Professor Kalir meets this challenge by proposing that the Torah (and Jewish law), read in context, accepts …

Red Rural, Blue Rural; Rural Does Not Always Equal Republican, Dante J. Scala, Kenneth M. Johnson Aug 2015

Red Rural, Blue Rural; Rural Does Not Always Equal Republican, Dante J. Scala, Kenneth M. Johnson

Carsey Publications

In this fact sheet, authors Dante Scala and Kenneth Johnson examine voting data for nearly 9,000 rural residents to identify how voting patterns differ across rural areas comparing farm and recreational counties to those elsewhere in rural America. They also examine voting data from the 2008 and 2012 Presidential elections for each rural county. Scala and Johnson report that rural America is not the undifferentiated Republican bastion depicted by commentators. While Republican presidential candidates do best in rural counties dominated by farming, Democratic presidential candidates do well in rural counties dominated by recreation. In “battleground” states, these rural differences may …

Unburdening Stigma: Identity Repair Through Rituals In Mental Health Court, Karen A. Snedker

Sociology Faculty Articles and Research

A growing trend in the criminal justice system is the move toward problem-solving courts, including mental health courts. Using case studies of two mental health courts in a West Coast city, this article seeks to explore how mental health courts may operate by reducing stigma among clients. From observations of the court process in mental health courts and qualitative interviews with mental health court professional staff and mental health court clients, ritual process emerged as a powerful theme that underscores the management of social stigma. Drawing on Collins’s interaction ritual framework, the study demonstrates the benefits of rituals and how …

Parental Well-Being Surrounding First Birth As A Determinant Of Further Parity Progression, Rachel Margolis, Mikko Myrskylä Aug 2015

Parental Well-Being Surrounding First Birth As A Determinant Of Further Parity Progression, Rachel Margolis, Mikko Myrskylä

Sociology Publications

A major component driving cross-country fertility differences in the developed world is differences in the probability of having additional children among those who have one. Why do people stop at having only one child? We hypothesize that the experience of the transition to parenthood is an important determinant of further fertility. Analyzing longitudinal data from Germany, we find that the experience during the transition to parenthood, as measured by changes in subjective well-being, predicts further parity progression. A drop in well-being surrounding first birth predicts a decreased likelihood of having another child. The association is particularly strong for older parents …

Respondent-Driven Sampling: Evaluating The Effects Of The Cure Violence Model With Neighborhood Surveys, Kwan Lamar Blount-Hill, Jeffrey A. Butts

Publications and Research

This report gives insight into how researchers at the John Jay Research and Evaluation Center used Respondent-Driven Sampling (RDS) to measures changes in violence-related attitudes and values of young men (age 18-30) in at-risk neighborhoods and compares areas with and without Cure Violence programs. The RDS method allows researchers to reach difficult-to-recruit populations and helps to increase the credibility of the study.

Bona Fide Occupation Qualifications And The Military Employer: Opportunities For Females And The Handicapped, Tim M. Callaghan Aug 2015

Bona Fide Occupation Qualifications And The Military Employer: Opportunities For Females And The Handicapped, Tim M. Callaghan

Akron Law Review

This article explores the hiring and job placement policies of the United States military departments' in light of the concept of the bona fide occupational qualification (BFOQ). In essence a BFOQ criterion is a requisite to the actual performance of an employment task; a potential employee may be refused a position if he lacks an ability or characteristic which can be labeled as a BFOQ.

Although the study of military employment practices may induce emotional argumentation, this article avoids any conclusions based upon traditional roles of potential employees and deals with two classes of potential employees. The first class of …

The New Ohio Mental Health Act, Janice Gui, Sandra S. Braden, John J. Lavin Aug 2015

The New Ohio Mental Health Act, Janice Gui, Sandra S. Braden, John J. Lavin

Akron Law Review

The purpose of this comment is to highlight the new procedural and substantive rights that are now guaranteed to the person sought to be committed for mental illness. The writers seek to evaluate it against a background of social and medical desirability, as well as constitutional mandates. One should keep in mind that our current method of dealing with the mentally ill is by no means either universal or necessary. Other societies have used different methods; some have been less compassionate, while others have been more so. In order to attempt to place Ohio's law in this broad perspective, the …

Pre-College Characteristics Affecting Student’S College Graduation In Ecuador, Diego Perez Aug 2015

Pre-College Characteristics Affecting Student’S College Graduation In Ecuador, Diego Perez

Open Access Dissertations

The topic of retention has been considered one of the most studied areas of research in higher education within and outside the United States. Similarly, higher education in Ecuador has recently put their efforts to optimize students’ retention and degree attainment in college. However, Ecuador is lacking in its research that guides researchers and administrators to design the most effective strategy for enhancing students’ retention in college. Therefore, the present study is especially important in that it would build a cornerstone in higher education research in a country where there is minimal work in the area of retention. With a …
