In Cyclobenzaprine, An Objective Failure To Reach A Long-Felt Need In Secondary Considerations Jurisprudence, C. Dylan Turner
In Cyclobenzaprine, An Objective Failure To Reach A Long-Felt Need In Secondary Considerations Jurisprudence, C. Dylan Turner
Northwestern Journal of Technology and Intellectual Property
Over the tenure of the Court of Appeals for the Federal Circuit, secondary considerations have become increasingly important in the analysis of nonobviousness. However, a close examination of the analytical framework behind these factors tells a cautionary tale. Courts often interpret evidentiary details of disputable import to indicate multiple secondary factors. In particular, the courts’ handling of the secondary consideration of long-felt need has allowed courts to spin mountains from evidentiary molehills. Analysis of the opinions in In re Cyclobenzaprine will demonstrate this proclivity. This Note proposes a solution: a thorough analytical method for each factor, to ensure the independence, …
The Impact Of Negative Publicity On Police Self-Legitimacy, Justin Nix, Scott E. Wolfe
The Impact Of Negative Publicity On Police Self-Legitimacy, Justin Nix, Scott E. Wolfe
Criminology and Criminal Justice Faculty Publications
High-profile events involving police use of force in various cities throughout the US and internationally have garnered enormous media coverage and demonstrated the importance of police-community relations. To date little empirical attention has focused on how such events may negatively impact police officers. Using survey data from 567 officers, this study considers whether perceptions of negative publicity are adversely related to officers’ sense of self-legitimacy (i.e. the confidence they have in their authority). Findings revealed officers who felt less motivated as a result of negative publicity expressed less self-legitimacy. However, the degree to which officers felt their job had become …

Exploring Police Legitimacy Perceptions Among Arab And Chaldean Business Owners In Detroit, Vaughn J. Crichlow, Edmund F. Mcgarrell
Qualitative Criminology (QC)
"Most agree that police officers cannot do their jobs effectively without the support of community members. However, little is known about the perceptions of small business owners who could potentially make a meaningful contribution to safety and security in such communities. There is also a paucity of research on immigrant-owned businesses in disorderly urban communities. To address the gap, this study explores the attitudes of small business owners toward the police in Detroit, Michigan, a city known for high levels of violent crime and presents an analysis of the qualitative data collected from in-depth interviews with small business owners (n …
Racially Neutral Policing?: Puerto Rican And Mexican Young Adults’ Experiences With Order Maintenance Strategies, Claudio G. Vera Sanchez, Jacinta M. Gau
Racially Neutral Policing?: Puerto Rican And Mexican Young Adults’ Experiences With Order Maintenance Strategies, Claudio G. Vera Sanchez, Jacinta M. Gau
Qualitative Criminology (QC)
"Despite the proliferation of seemingly racially neutral police strategies, Latinos continue to report unfavorable views toward police. Limited attention has been given to how urban strategies, such as order maintenance policing, are experienced by young Latino males. The present study uses data from in-depth interviews conducted with male Latino youth in two Chicago neighborhoods: one majority-Latino, predominantly Mexican; and one mixed-race, gentrifying Puerto Rican. Results show that youth in both neighborhoods report enhanced surveillance and aggressive stop-and-frisks. Additionally, neighborhood context shapes the dynamics between police and young Latinos. In the Puerto Rican neighborhood, policing is enmeshed in culture clashes. In …

Harlot: A Revealing Look at the Arts of Persuasion
This essay provides a history and context for emoji as a way of re-materializing composing while simultaneously arguing that emoji do not threaten alphabetic literacy and instead provide a means of creative graphic expression. The essay acknowledges that n some instances emoji do help to clarify the intent or tone of alphabetic writing, but it notes that emoji, like alphabetic writing, is culturally and contextually bound. Emoji expand expression and doing so open themselves to re-appropriation, intepretation and even misinterpretation, along with the affirming possibilities of artistic creation.

A Collective Good: Disability Diversity As A Value In Public Sector Collective Bargaining Agreements, Carrie Griffin Basas
A Collective Good: Disability Diversity As A Value In Public Sector Collective Bargaining Agreements, Carrie Griffin Basas
St. John's Law Review
(Excerpt)
Part I of this Article explains why disability is a helpful lens and reviews the theoretical underpinnings of the roles of contracts, such as CBAs, in setting workplace dynamics and generating "informal laws." Part II describes the methodology used in this study of CBAs. Part III is a taxonomy of the models of disability-framing and workplace dynamics that the CBAs reflect. Part IV presents a new framework for envisioning how the corrective, civil rights vision of the Idealist model might transform workplaces for all workers-marginalized or empowered, public or private-and, therefore, transform labor and employment law. In other words, …

Prefigurative Politics Vs. Party-Building In The Post-Soviet Context: Ideology And Resource Mobilization In Left-Radical Groups In Ukraine, Volodymyr Ishchenko
Prefigurative Politics Vs. Party-Building In The Post-Soviet Context: Ideology And Resource Mobilization In Left-Radical Groups In Ukraine, Volodymyr Ishchenko
Catalyst: A Social Justice Forum
I wrote this paper 10 years ago based on my MA thesis. Many things have changed since that time. The left groups mentioned in the article do not exist anymore. Some of their activists are still active politically but many are not part of radical left politics any more. In addition, now I am more skeptical of the postmodern theories of ideology I tried to use in the paper. If I were writing a similar analysis now, I would try to develop a more materialist and a more complex approach to ideologies and their effects on practical politics. However, the …

‘Capitalism A Nuh’ Wi Frien’. The Formatting Of Farming Into An Asset, From Financial Speculation To International Aid, Luigi Russi, Tomaso Ferrando
Catalyst: A Social Justice Forum
This paper deciphers the formatting of farming into an asset by tracking the modalities by which financial calculation is enabled across different sites of agency.
The first focus of our analysis are commodity futures markets, which have witnessed a double spike in prices in 2008 and in 2012. In the paper, we look at these hikes as the outcome of endogenous dynamics, caused by the changing makeup of market participants after 2000, which turned futures markets into resources for hedging commodity index-linked derivative products.
We subsequently analyse the increasing reliance on financial actors placed by public development agencies that channel …
Praxis With Self-Advocates: Exploring Participatory Video As Radical Incrementalism, Kathleen C. Sitter, Amy C. Burke
Praxis With Self-Advocates: Exploring Participatory Video As Radical Incrementalism, Kathleen C. Sitter, Amy C. Burke
Catalyst: A Social Justice Forum
In this article, the authors report selected findings from a larger study where self-advocates from the disability rights movement created a series of short videos as part of a participatory research project. Self-advocates subsequently integrated these videos into a greater community organizing initiative. While the research process of this study has been published elsewhere, this piece will explore the idea of bridging participatory video, a collaborative research methodology, with community-based advocacy initiatives. The authors contend that this presents an opportunity for radical incrementalism in which to create a praxis driven predominantly by the voices on the margins versus the academic …
The Liberal As An Enemy Of Queer Justice, Craig Schamel
The Liberal As An Enemy Of Queer Justice, Craig Schamel
Catalyst: A Social Justice Forum
Abstract
Liberalism as a historical mode of the political is the context in which the movement and ensuing struggle for queer justice emerged in most Western countries. The terminology, practices, tendencies, beliefs, ethics, laws, and patterns of political and social life which have been determined by this mode of the political, it is argued, are inimical to queer justice and render its achievement impossible. Liberalism as a mode of the political is approached from below, from knowledge gained in practical experience in queer groups which considered themselves revolutionary at least to some degree, and from the effects on such groups …

Is Institutional Ownership Related To Corporate Social Responsibility? The Nonlinear Relation And Its Implication For Stock Return Volatility, Maretno Harjoto, Hoje Jo, Yongtae Kim
Is Institutional Ownership Related To Corporate Social Responsibility? The Nonlinear Relation And Its Implication For Stock Return Volatility, Maretno Harjoto, Hoje Jo, Yongtae Kim
Accounting
This study examines the relation between corporate social responsibility (CSR) and institutional investor ownership, and the impact of this relation on stock return volatility. We find that institutional ownership does not strictly increase or decrease in CSR; rather, institutional ownership is a concave function of CSR. This evidence suggests that institutional investors do not see CSR as strictly value-enhancing activities. Institutional investors adjust their percentage of ownership when CSR activities go beyond the perceived optimal level. Employing the path analysis, we also examine the mediating effect of institutional ownership on the relation between CSR and stock return volatility. We find …

UCF Forum
The United Nations itself had not yet been officially established when its own Food and Agriculture Organization was formed, even though it was by just a few days. The U.N. was established Oct. 24, 1945, just eight days following the establishment of the Food and Agriculture Organization, and it was not until 1948 that the international body ratified its Universal Declaration of Human Rights.

Exploring Ecosystems And Health By Shifting To A Regional Focus: Perspectives From The Oceania Ecohealth Chapter, Jonathan Kingsley, Rebecca Patrick, Pierre Horwitz, Margot Parkes, Aaron Jenkins, Charles Massy, Claire Henderson-Wilson, Kerry Arabena
Research outputs 2014 to 2021
This article highlights contributions that can be made to the public health field by incorporating “ecosystem approaches to health” to tackle future environmental and health challenges at a regional level. This qualitative research reviews attitudes and understandings of the relationship between public health and the environment and the priorities, aspirations and challenges of a newly established group (the Oceania EcoHealth Chapter) who are attempting to promote these principles. Ten semi-structured interviews with Oceania EcoHealth Chapter members highlighted the important role such groups can play in informing organisations working in the Oceania region to improve both public health and environmental outcomes …

The Concept Of The State In American History, William J. Novak
The Concept Of The State In American History, William J. Novak
Book Chapters
Debates about the state rage in contemporary America. On the right, libertarian and tea party rhetoric fulminates about shrinking the state or shutting down the government, frequently in hyperbolic terms like the Americans for Tax Reform notion of" drowning it in a bathtub." On the left, concern about the fate of the welfare state and an ever-expanding warfare and penal state produces equally impassioned retorts. Discussion of the American state-its nature, its size, and its uncertain future-dominates the political landscape as perhaps never before.
