Please Report To The Principal's Office, Urine Trouble: The Effect Of Board Of Education V. Earls On America's Schoolchildren, M. Casey Kucharson
Akron Law Review
This Note analyzes the Supreme Court’s recent opinion in Board of Education of Independent School District No. 92 of Pottawatomie County v. Earls and its implication for the future of the Fourth Amendment and drug testing. Part II of this Note documents the history and the expansion of the “special needs” doctrine, and illustrates how the doctrine has whittled away high school and middle school students’ Fourth Amendment guarantees. Part III of this Note introduces the parties and gives a picture of the circumstances surrounding the Earls case. Part III then discusses the District Court for the Western District of …
A Preliminary Consideration Of Issues Raised In The Firearms Sellers Immunity Bill, Frank J. Vandall
A Preliminary Consideration Of Issues Raised In The Firearms Sellers Immunity Bill, Frank J. Vandall
Akron Law Review
Snipings, mass-murders by disgruntled employees, children shooting children, and a vast number of spousal murders are everyday news across the country. In the numerous lawsuits brought by individual victims and over 30 cities, it has been alleged that gun manufacturers and sellers have an important role to play in designing guns to be safer and in closely monitoring gun sales. The courts are weighing these issues and have dismissed a large number of individual and city suits for various reasons. As the Senate debates the Bill (S. 659) that shields those in the gun trade from liability, several issues need …
Third Strike Or Merely A Foul Tip?: The Gross Disproportionality Of Lockyer V. Andrade, Joy M. Donham
Third Strike Or Merely A Foul Tip?: The Gross Disproportionality Of Lockyer V. Andrade, Joy M. Donham
Akron Law Review
“The United States is besieged by an incarceration crisis which far surpasses that of any other nation.” Scholars attribute the increasing prison population to changes in sentencing policy. Politicians have used the public pressure resulting from its fear of violence to pass legislation that supports this change in policy and creates more fixed sentencing structures.
California’s Three Strikes law (Three Strikes), an example of such a structure, has resulted in the largest increase in the prison population. Public pressure, spurred by the fear of violent criminals being released and committing the same crimes again and again, led to the enactment …

The Department Of Homeland Security’S Approach To Countering Nuclear Terrorism Through Detection And Technical Forensics, Huban A. Gowadia, Brigitte S. Mardigras
International Journal of Nuclear Security
To combat the threat of nuclear terrorism, the Domestic Nuclear Detection Office (DNDO) was established within the U.S. Department of Homeland Security to focus efforts on developing and enhancing radiological and nuclear detection and national technical nuclear forensics capabilities. With respect to nuclear detection, we at DNDO, in concert with interagency partners, are developing and enhancing a multi-faceted, layered, defense-in-depth framework to make prohibitively difficult the importation, possession, storage, development, transportation, or use of nuclear or other radioactive material that is out of regulatory control. In furtherance of this framework, we conduct research and development on detection and forensics technologies, …

Dudley Do Wrong: An Analysis Of A "Stop And Identify" Statute In Hiibel V. Sixth Judicial District Of Nevada, James G. Warner
Akron Law Review
Part II of this note traces the development of “stop and identify” statutes, including its origins in historical vagrancy and loitering statutes, courts’ treatment of such laws, and the progression of the specific Nevada statute at issue. Part III examines the appellate and Supreme Court decisions in the Hiibel case. Part IV analyzes the Court’s decision in Hiibel under the void for vagueness doctrine and the Fourth and Fifth Amendments, and highlights the recent enactment of a “stop and identify” statute in Arizona. Finally, Part V concludes that the Nevada “stop and identify” statute allows too great of an intrusion …
Chief Justice William Rehnquist: His Law-And-Order Legacy And Impact On Criminal Justice, Madhavi M. Mccall, Michael A. Mccall
Chief Justice William Rehnquist: His Law-And-Order Legacy And Impact On Criminal Justice, Madhavi M. Mccall, Michael A. Mccall
Akron Law Review
In this article, we explore Chief Justice Rehnquist’s criminal justice decisions through an empirical analysis of the Court’s decision-making tendencies for the most recent natural court and a review of selected criminal justice decisions written by Justice Rehnquist throughout his career. To start, we limit the analysis, with only two exceptions, to decisions actually written by Justice Rehnquist. Although Chief Justice Rehnquist, in that position, had an important role in leading other justices to agree with him by assigning cases, we gleaned a substantial amount of information regarding his decisional patterns and policy preferences by analyzing the opinions he personally …

Intestacy Concerns For Same-Sex Couples: How Variations In State Law And Policy Affect Testamentary Wishes, Megan Moser
Intestacy Concerns For Same-Sex Couples: How Variations In State Law And Policy Affect Testamentary Wishes, Megan Moser
Seattle University Law Review
As the number of same-sex couples increases in the United States, concerns regarding the evolution of federal and state law, with respect to rights for same-sex couples, also continue to rise. As marriage is not always available to same-sex couples, they often face very different legal issues than couples in a traditional marriage. Because marriage is typically not a legal cause of action, the question of a marriage’s validity often arises incidentally to another legal question, such as the disposition of a decedent’s estate.
Celebrity Newsgathering And Privacy: The Transformation Of Breach Of Confidence In English Law, John D. Mccamus
Celebrity Newsgathering And Privacy: The Transformation Of Breach Of Confidence In English Law, John D. Mccamus
Akron Law Review
In recent years, a series of leading cases have returned to consider these questions. The implications of these decisions for the current shape of English law relating to civil redress for privacy invasion are the subject of this article. Surprisingly, perhaps, English courts have remained steadfast in their refusal to recognize invasion of privacy as a tort and in doing so have quite explicitly declined to rely on American experience in this area. Rather, English courts have preferred to resist innovation of this kind and leave the difficult question of privacy law reform to Parliament. On a number of recent …
Obama, The Fourteenth Amendment, And The Drug War, Martin D. Carcieri
Obama, The Fourteenth Amendment, And The Drug War, Martin D. Carcieri
Akron Law Review
This article is written to help clarify the full range of understanding Obama would bring to a second term.
Specifically, I defend two related, contested theses. My core thesis, to which this article is primarily devoted, is a jurisprudential claim: contrary to state and lower federal court rulings, marijuana prohibition is subject to strict judicial scrutiny under leading relevant U.S. Supreme Court jurisprudence. I support this thesis primarily by showing that under the Fourteenth Amendment, bodily autonomy—i.e., the control over the borders and contents of one’s body burdened by laws like marijuana prohibition—is a fundamental right, and that the Court …
Off To Elba! The Legitimacy Of Sex Offender Residence And Employment Restrictions, Joseph L. Lester
Off To Elba! The Legitimacy Of Sex Offender Residence And Employment Restrictions, Joseph L. Lester
Akron Law Review
This article will look at why sex offenders are treated differently than other criminal offenders. Sex offenders are subject to sanctions and prohibitions above and beyond what other criminal offenders must face. Next, the article will look at some of the residence and employment restrictions placed on sex offenders to determine if they are rationally related to any legitimate government interest without overbearing the sex offender’s constitutional rights. Finally, the article will offer an alternate means of sex offense prevention that encourages sex offender assimilation back into society instead of further exclusion. This article will focus on those individuals who …
Tribal, State, And Federal Cooperation To Achieve Good Governance, Elizabeth Burleson
Tribal, State, And Federal Cooperation To Achieve Good Governance, Elizabeth Burleson
Akron Law Review
This article considers tribal, state, and federal cooperation to achieve good governance. Part II discusses the patchwork of laws affecting Indian country and analyzes the ways in which criminal jurisdictional uncertainty affects native sovereignty and public safety. Where the legal analysis does not depend upon the use of the term “Indian,” the following discussion uses the term indigenous peoples. Part III addresses civil jurisdiction over non-Indians in general and tribal water quality regulation in particular. Management of natural resources remains one of the core aspects of sovereignty that tribes have retained. The section examines judicial recognition of tribal water rights …
Creating The Public Forum, Samantha Barbas
Creating The Public Forum, Samantha Barbas
Akron Law Review
This article describes the development of the public forum doctrine in the context of a larger story about the nation’s efforts in this period to come to terms with its first modern crisis of communication...The public forum is both a site for public debate and a means of communication for the less privileged. In the 1930s and 1940s, intellectuals and activists sought to enlist the state in the creation of “public forums” on the radio, in print journalism, and in public space. This article examines this public forum movement and its enduring impact on the free speech doctrine and social …
Statutory Misinterpretations: Small V. United States Darkens The Already Murky Waters Of Statutory Interpretation, Michelle Schuld
Statutory Misinterpretations: Small V. United States Darkens The Already Murky Waters Of Statutory Interpretation, Michelle Schuld
Akron Law Review
Part II of this Note will examine the background of this issue by exploring the history and purpose of the Gun Control Act of 1968 and the circuit split arising over the interpretation of the words “any court” under § 922(g)(1). Part III will focus on Small v. United States in detail, including the underlying facts, procedural history, and majority and dissenting opinions. Part IV will analyze this decision and argue that the majority misused canons of statutory interpretation to reach an interpretation that is contrary to the plain meaning of the statute. The section will also discuss the majority’s …

Akron Law Review
This Note will follow the Fourth Amendment from its origins to its modern application to parolee rights, as evidenced by the Samson Court. Part II focuses on the Fourth Amendment, from the circumstances surrounding its adoption to modern court cases that have applied its tenets to prisoners, probationers, and, finally, parolees. Part III details the Supreme Court’s decision in Samson v. California, including a thorough discussion of the facts that gave rise to the case and lower court decisions. Part IV explores the problems with the Court’s framework and suggests other possible frameworks the Court could have used to come …
