The Masculine Mystique, Michael W. Chancellor Jr.
The Masculine Mystique, Michael W. Chancellor Jr.
Master's Theses
This textual analysis explores the rhetoric of exclusion among homosexual men by analyzing DouchebagsofGrindr.com. The rhetoric of exclusion is used by some homosexual men in order to achieve hegemonic masculinity based on performance of gender, age, race, and physical characteristics to conquer stereotypes of femininity. The gay community utilizes civil rights rhetoric in order to create a dialogue about equality; unfortunately a disturbing number of gay community members frequently discount homosexual male minorities, perpetuating the notion that homosexual minorities are unattractive because they violate heteronormative gender performances. Analyzing the artifact DouchebagsofGrindr.com allows for a glimpse into the self-deprecating online behavior …

A Study Of Das Delays And Their Impact On The Wireless Channels With Application To Indoor Localization, Ahmed Sallam Mohamed Ibrahim
A Study Of Das Delays And Their Impact On The Wireless Channels With Application To Indoor Localization, Ahmed Sallam Mohamed Ibrahim
Theses
This research evaluates the Distributed Antenna Systems (DAS) introduced delays and their effects on the indoor channel in simulcast situations where the effect of delays is most prevalent. Different simulcast cases that form the basic building blocks are analyzed to form an understanding of the problem. Two case studies of important indoor environments are presented. Importance of improving ray tracing simulations to include propagation and DAS delays is highlighted.
The paper also introduces a DAS element representation and delay mapping model and explores techniques of engineering DAS delays to optimize location estimation by ranging and RF fingerprinting to achieve E911 …
Incentivizing Excellence: A Suggestion For Merit-Based Reductions From A Twenty-Six-Year Federal Prison Insider, Michael Santos
Incentivizing Excellence: A Suggestion For Merit-Based Reductions From A Twenty-Six-Year Federal Prison Insider, Michael Santos
UC Law Journal
America’s prison population has soared since the early 1970s, when a commitment to mass incarceration began. We now incarcerate more people than any other nation. Further, recidivism rates show that the longer we expose people to “corrections,” the less likely those people become to emerge as law-abiding, contributing citizens. As Justice Kennedy has said, our nation incarcerates far too many people, and they serve sentences that are far too long. We can improve the outcomes of our nation’s prison system by incentivizing a pursuit of excellence, creating mechanisms through which people in prison can earn freedom in gradually increasing levels …

New York City Rules! Regulatory Models For Environmental And Public Health, Jason J. Czarnezki
UC Law Journal
Scholars have become increasingly interested in facilitating improvement in environmental and public health at the local level. Over the last few years, former New York City Mayor Michael Bloomberg and the New York City Council have proposed and adopted numerous environmental and public health initiatives, providing a useful case study for analyzing the development and success (or failure) of various regulatory tools, and offering larger lessons about regulation that can be extrapolated to other substantive areas. This Article, first, seeks to categorize and evaluate these “New York Rules,” creating a new taxonomy to understand different types of regulation. These “New …

Piercing The Privacy Veil: Toward A Saner Balancing Of Privacy And Health In Cases Of Severe Mental Illness, Jorgio Castro
UC Law Journal
On November 19, 2013, Virginia state senator and former candidate for governor Robert Creigh Deeds suffered a high-profile attack from his son, who had been diagnosed with schizophrenia, resulting in permanent injuries to himself and his son’s self-inflicted death. On June 16, 2015, Senator Deeds addressed Congress to highlight one of the biggest challenges to providing adequate intervention and support for his son—the HIPAA Privacy Rule’s restriction on the release of protected health information to family caretakers. Senator Deeds’s high-profile story emerged as a national indication of a serious problem: the immense difficulty experienced by families trying to obtain critical …

The recent interest in Big Data has generated a broad range of new academic, corporate, and policy practices along with an evolving debate among its proponents, detractors, and skeptics. While the practices draw on a common set of tools, techniques, and technologies, most contributions to the debate come either from a particular disciplinary perspective or with a focus on a domain-specific issue. A close examination of these contributions reveals a set of common problematics that arise in various guises and in different places. It also demonstrates the need for a critical synthesis of the conceptual and practical dilemmas surrounding Big …

Technology Assessment Of Waste Disposal Technologies For Tillamook County, Jing Jiang, Abhishek Jain, Jonathan Lui, Jorge Garcia, Standley Limarta
Engineering and Technology Management Faculty Publications and Presentations
We propose a two-level filter system to evaluate the potential for alternative waste management practices by conversion of locally-generated waste products such as animal mortality, manure, and wood waste into beneficial products such as energy in Tillamook county of Oregon. At the first level - coarse grained filter, three basic factors, technical readiness level (TRL), scaling capacity, and feedstock, are used to initially filter out the scanned technologies which can be potentially used in waste management. At the secondary level filter - fine grained filter, a numeric scoring model is created to evaluate technologies from the output of the first …

Career Ladder In Medical Laboratory With Multiple Certifying Agencies, Shirley A. Baker Mt(Ascp)Sc, Ph.D.
Journal of Health Occupations Education
The purpose of this article is to review the medical laboratory career ladder. Every health profession has a career ladder which involves education and experience. During the past few decades, workers were in abundance and entry into health occupations was primarily accomplished through education. Presently, there is a shortage of health care workers during an age of increasing health care needs. Therefore, the time has come to reassess the other avenue of career development, namely experience. Barriers to certification by experience have developed through eligibility requirements established by certifying agencies attempting to ensure public safety during a period of rapid …

Nontaxpayer Suits: Seeking Injunctive And Declaratory Relief Against Irs Administrative Action, John A. Lynch
Akron Law Review
Who should be entitled to challenge Internal Revenue Service (IRS) tax policy decision making? Should the concerned citizen or the aggrieved competitor of a company receiving favorable treatment from the IRS be precluded from seeking review of allegedly illegal action when his own taxes are not specifically involved? ...
It is clear from an analysis of recent decisions that several federal courts have been unwilling to accept the proposition that the Anti-Injunction Act and the Declaratory Judgment Act exception insulate the IRS from judicial scrutiny even when judicial intervention would pose no threat to federal revenues. An analysis of the …

Motor Vehicles; Driving While Intoxicated; Section 4511.19; Implied Consent; Aurora V. Kepley, Amie Bruggeman
Akron Law Review
With the constant problem of accidents caused by drinking drivers and the fairly reliable results of breathalyzer tests established, judicial decisions have upheld the statutory scheme providing for its use through an era when rights of an accused have been greatly expanded. It has been held that the breathalyzer test results are not testimonial but physical evidence and therefore not protected by the Fifth Amendment privilege against self-incrimination. Thus, the accused has no constitutional right to refuse to take the test, and the prosecutor may comment at the trial on his refusal relying on its' probative value as to whether …

Power Of Municipal Corporations To Lay Off Employees, Atwood V. Judge, Warren R. Ross
Akron Law Review
At a time when the future of the American economy appears bleak, and the necessity to curtail vital urban services becomes commonplace in our cities, the significance of the decision rendered by the Ohio Court of Appeals for Columbiana County in Atwood v. Judge' deserves to be noted. The tension between the public interest in maintaining vital services within the community and the state mandate' that a city operate within its budget is not satisfactorily resolved by the court.
The Detection And Recovery Of Contraband Nuclear Material, John N. O'Brien
The Detection And Recovery Of Contraband Nuclear Material, John N. O'Brien
Akron Law Review
The feasibility of detection and subsequent recovery of nuclear fissile material illicitly removed from a facility is a question which has rarely been addressed. This article will explore the adequacy of remote detection and location devices designed to find contraband fissile nuclear materials and will examine the legal consequences of going beyond remote detection and location to actual searches for contraband. The TMI incident made it clear that such societal consequences were not given sufficient attention in the past and their relevance to the issue of whether to use a plutonium economy is unquestionable.

Remembering The Lessons Of 9/11: Preserving Tools And Authorities In The Fight Against Terrorism, Congressman Peter T. King
Journal of Legislation
As Chairman of the Subcommittee on Counterterrorism and Intelligence, a Member of the House Permanent Select Committee on Intelligence, and a Con- gressman from New York, 9/11 was a very personal experience that continues to resonate with me. I lost over 150 neighbors, friends and constituents on September 11th, but no one has a monopoly on grief. This issue went to the soul of the entire country, and touches our lives nearly 15 years later. That day forces us to acknowledge, whether some of us want to or not, that we have an unyielding enemy, vicious and bitter, that will …

Benefit Corporations: Increased Oversight Through Creation Of The Benefit Corporation Commission, Thomas J. White Iii
Journal of Legislation
Traditional for-profit and nonprofit corporate forms do not provide the appropriate framework for an organization pursuing both profits and social responsibility. In response, state legislatures have begun to take initiative by offering new business forms to accommodate for an increased demand in social responsibility. These hybrid forms seek to offer an organization the optimal platform by which to meet their dynamic goals. This Note will analyze the recently popular hybrid form of a benefit corporation. Further, this Note will dissect the Model Benefit Corporation Legislation and explain how benefit corporations provide a solution to the theory of shareholder wealth maximization. …

The Need For Judicial Restriction On The Use Of Drug Detecting Canines, William R. Pomeroy
The Need For Judicial Restriction On The Use Of Drug Detecting Canines, William R. Pomeroy
Akron Law Review
The purpose of this comment is to examine these issues, outline the conflicting positions, and attempt to forecast the direction the courts may take in their effort to bring some harmony to this unsettled (and to some, unsettling) area of law. Few people would attempt to deny law enforcement officials the use of this highly effective and relatively unintrusive law enforcement tool. Yet there are those who fear that the unsettled questions concerning limits on the use of this tool may lead to serious abuse, and who raise the specter of unlimited government intrusion should this type of investigatory activity …

Denial Of Tax Exempt Status For Racially Discriminatory Schools, Bob Jones University V. U.S., Margaret K. Cassidy
Akron Law Review
The extent to which the government may deny tax-exempt status in order to further its goal of eliminating racial discrimination is a question of paramount importance. The United States Supreme Court recently addressed this question in the case of Bob Jones University v. U.S., a consolidated action which involved a conflict between two established public policies: racial equality and religious freedom. The Court held that this nation's policy of racial equality overrides any interest that an educational and religious institution may have in promoting racial discrimination.

Psychosocial Distress: A Case Study Of A Male African American Veteran With End-Stage Colon Cancer, Frances R. Nedjat-Haiem, Iraida V. Carrion, Terri Wingate Lewison
The Qualitative Report
This in-depth single-case-study explored the emergent trauma of psychosocial distress of an older male African-American veteran after being diagnosed with end-stage colon cancer. Using a qualitative case study methodology, three in-depth interviews were conducted which identified the following five themes: (1) the emotional impact of being diagnosed with cancer, (2) experiencing inescapable loss of control and independence, (3) adjusting to nursing home placement, (4) lacking social support, and (5) navigating complicated services. The findings expand our understanding of the need for identifying and managing psychosocial distress. Implications for behavioral health practitioners are discussed.

Escobedo And Miranda Revisited, Arthur J. Goldberg
Akron Law Review
Shortly before the close of the 1983 term, the Supreme Court of the United States decided two cases, U.S. v. Gouveia and New York v. Quarles, which in effect overruled Escobedo v. Illinois and undermined Miranda v. Arizona.
