Straight Lives: The Balance Between Human Dignity, Public Safety, And Desistance From Crime, Lila Kazemian Aug 2015

Straight Lives: The Balance Between Human Dignity, Public Safety, And Desistance From Crime, Lila Kazemian

Publications and Research

This report looks at how the academic and practitioner worlds must collaborate to develop an effective, desistance-promoting approach to criminal justice. Interventions need to be desistance-focused and tailored to individual circumstances rather than standardized programming. Interventions should shift away from an emphasis on risk and criminogenic needs and help individuals overcome obstacles to desistance.

Reducing Economic Disparities For Female Offenders: The Oxford House Model, Sarah L. Callahan Aug 2015

Reducing Economic Disparities For Female Offenders: The Oxford House Model, Sarah L. Callahan

College of Science and Health Theses and Dissertations

Background: In the past 30 years the rate of increase in incarceration for females who abuse substances has outpaced that of men. Women have increased health and economic disparities, and face barriers to economic mobility, increasing their risk of returning to the criminal justice system. Past research suggests that there is a positive relationship between living in Oxford House and employment wages, yet the impact of having a criminal history on this relationship was unknown. Method: This study used a nationwide sample of 136 women living in Oxford Houses in a regression analysis with length of stay in Oxford House …

Measuring Equity In Transit-Oriented Development: Application To Affordable Housing, Beryl Oranga Aug 2015

Measuring Equity In Transit-Oriented Development: Application To Affordable Housing, Beryl Oranga

Capstone Collection

The purpose of this research is to find out how Transit-Oriented Development (TOD) can be measured, with a focus on affordable housing. TOD is characterized by higher density, mixed use and compact development within a walking distance from a transit station (ITDP, 2015). More specifically, this method of development includes: residential, commercial, retail, and recreational space, and is designed to create connections between transit, bicycles, and pedestrians as it radiates within a quarter to half a mile walking distance from its anchoring rail station (Ibid). However, like any other successful urban development initiative, TOD projects tend to cause an increase …

What It Takes To Get Passed On: Message Content, Style, And Structure As Predictors Of Retransmission In The Boston Marathon Bombing Response, Jeannette Sutton, C. Ben Gibson, Emma S. Spiro, Cedar League, Sean M. Fitzhugh, Carter T. Butts Aug 2015

Butts

Communication Faculty Publications

Message retransmission is a central aspect of information diffusion. In a disaster context, the passing on of official warning messages by members of the public also serves as a behavioral indicator of message salience, suggesting that particular messages are (or are not) perceived by the public to be both noteworthy and valuable enough to share with others. This study provides the first examination of terse message retransmission of official warning messages in response to a domestic terrorist attack, the Boston Marathon Bombing in 2013. Using messages posted from public officials' Twitter accounts that were active during the period of the …

Suspicious Person Ordinances - Due Process Standards; Columbus V. Thompson, Joel R. Campbell Aug 2015

Suspicious Person Ordinances - Due Process Standards; Columbus V. Thompson, Joel R. Campbell

Akron Law Review

In the absence of circumstances involving First Amendment rights, we are left without guidelines as to the conduct which may be made criminal by local suspicious person ordinances. Because of this lack of adequate standards, a case by case determination of criminal conduct under the various ordinances is necessary. In Thompson the defendant's conduct was questionable and the court found the ordinance unconstitutionally vague. We can only hope that this decision has a sufficient impact upon law enforcement officials and local courts to minimize the injury resulting from vagueness.

Rescue Units Operated By Municipal Fire Departments: Their Status Under The Doctrine Of Municipal Immunity, John D. Shuff Aug 2015

Rescue Units Operated By Municipal Fire Departments: Their Status Under The Doctrine Of Municipal Immunity, John D. Shuff

Akron Law Review

At the outset it should be indicated that the view taken by this writer does not purport to be unbiased. Rather, it is his intent to place a few more munitions in the arsenal of those who propose that the doctrine of municipal sovereign immunity be abrogated in its entirety.

The first part of the discussion (Section II) will focus upon the background and current status of the municipal immunity doctrine, with special emphasis upon the governmental-proprietary distinction. Section III will discuss the effects and interpretations of the Uniform Traffic Act and how they relate to municipal immunity. In addition, …

Ohio's Post-Gault Juvenile Court Law, Robert J. Willey Aug 2015

Ohio's Post-Gault Juvenile Court Law, Robert J. Willey

Akron Law Review

It is the writer's intention to compare Ohio's new juvenile code with that offered by the Crime Commission, with the Standards for Juvenile and Family Courts, and with the Uniform Juvenile Court Act, which was drafted to meet the constitutional requirements of Kent and Gault. These two cases now force one to reconsider in the juvenile court context the applicability of more formal procedural rules, as well as the applicability of all the Constitutional Rights contained in the Bill of Rights which have been incorporated (as far as criminal proceedings are concerned) into the Due Process clause of the Fourteenth …

Rearrests During Mental Health Court Supervision: Predicting Rearrest And Its Association With Final Court Disposition And Post-Court Rearrests, Donald M. Linhorst Phd, David Kondrat Phd, Ann Dirks-Linhorst Ph.D., J.D.

SIUE Faculty Research, Scholarship, and Creative Activity

Mental health courts are one means to address the involvement of persons with mental illness in the criminal justice system. Using a sample of 811 participants of a municipal mental health court, this study found that 23.2% of participants were rearrested during court supervision. This study also identified factors associated with these rearrests, as well as the effects of rearrests during supervision on program completion and rearrests in the one-year period following program completion. This study concludes with implications for mental health court supervision.

Presidential Impoundment Of Funds: A Constitutional Crisis, Gerald A. Figurski Aug 2015

Presidential Impoundment Of Funds: A Constitutional Crisis, Gerald A. Figurski

Akron Law Review

It seems that our maligned Congress, so docile at times in the face of presidential aggrandizement of power, is forging a constitutional crisis. The basic issue involved is whether the President has authority, either constitutional or statutory, to refuse to spend funds appropriated by Congress. The questions pursued in the following pages are basically four: does the President have the (1) statutory, (2) historical, (3) case, or (4) constitutional authority to continue to impound?

The "Compulsory School Attendance" Case: Wisconsin V. Yoder, Michael Buchicchio Aug 2015

The "Compulsory School Attendance" Case: Wisconsin V. Yoder, Michael Buchicchio

Akron Law Review

It is an important constitutional doctrine that a law generally constitutional "on its face," may be unconstitutional "as applied" in specific instances. The Amish case marks the first occasion that the Court has clearly articulated that exception in favor of a minority religious group. It would appear that compulsory education laws are-"on their face"--within a state's constitutional powers, but under the facts of this case, the First Amendment requires that the Amish be exempt.

The Mobile Home And The Law, Marvin M. Moore Aug 2015

The Mobile Home And The Law, Marvin M. Moore

Akron Law Review

In the past decade, house trailers have dramatically increased their share of the housing market in the United States….The manner in which mobile homes are dealt with under our zoning laws is therefore a matter of some importance. Surprisingly, comparatively little has been written regarding the zoning of mobile homes and trailer parks. The purpose of this article is to lessen this deficiency. The writer proposes to examine the subject by considering the following aspects of mobile home regulation: the need for mobile homes or a similar type of housing; the objectionable features of house trailers and trailer parks; the …

Corporal Punishment In The Public Schools: The Legal Question, William Irwin Arbuckle Iii Aug 2015

Corporal Punishment In The Public Schools: The Legal Question, William Irwin Arbuckle Iii

Akron Law Review

PUBLIC EDUCATION in the United States has come a long way since the one-room schoolhouse days. This phenomenal growth has been paced by the controversy surrounding the use of corporal punishment as a means of enforcing discipline in the schools. From the oldest reported case reaching the issue of corporal punishment' back in 1833 down to the present, the proponents of corporal punishment have had to defend their actions in the courts from a wide variety of attacks based on criminal law, tort law, state statutes, school board regulations and, most recently, constitutional guarantees. Although the attacks on corporal punishment …

Fairbanks Juvenile Recidivism Case Study: A Comparison Of Criminogenic Needs And Case Planning Of Recidivists And Non-Recidivists, Tracy A. Dompeling Aug 2015

Fairbanks Juvenile Recidivism Case Study: A Comparison Of Criminogenic Needs And Case Planning Of Recidivists And Non-Recidivists, Tracy A. Dompeling

Justice

Research has shown that addressing criminogenic needs of offenders, both juvenile and adult, can reduce the likelihood of recidivism. Utilizing the Risk Need Responsivity theory (Andrews, Bonta, & Hoge, 1990; Andrews, Zinger, et al., 1990), the hypothesis for this small case study of youth recidivist and non-recidivists in interior Alaska was developed to compare data to determine if what is identified in research models to reduce recidivism correlated to what was applied in practice with juvenile offenders. Specifically this comparative case study intended to show that youth who had case plans which were identified to be "inadequate," that they had …

Creating, Communicating And Measuring Strategic Objectives Through The Application Of A Balanced Scorecard: The Case Of The University Of Alaska Fairbanks Police Department, Sean Eric Mcgee Aug 2015

Creating, Communicating And Measuring Strategic Objectives Through The Application Of A Balanced Scorecard: The Case Of The University Of Alaska Fairbanks Police Department, Sean Eric Mcgee

Justice

This project served to align the vision and mission of the University of Alaska Fairbanks Police Department with the needs of the University community through the employment of a balanced scorecard. The balanced scorecard itself is a strategic performance management framework that enables organizations to identify, manage and measure strategic objectives. While there have been instances where police agencies have attempted to implement the balanced scorecard in the past, these police agencies have been very large, and they failed to achieve the level of granularity in their balanced scorecard necessary to effectively identify and manage true strategic objectives. In case …

Priority 1, Rj Burgess Aug 2015

Priority 1, Rj Burgess

Master's Projects and Capstones

The CNL theme I have targeted is the development and use of Informatics and Healthcare Technologies. My project developed a method of measuring KPIs within a new EHR specifically tailored for jail health populations. The development of a Jail Health Services dashboard is modeled after the dashboard developed by California Correctional Health Care Services for the California prison population. The clinicians requested the ability to measure how many Priority 1 visits were seen within 24 hours so it could be determined whether the jail was meeting the NCCHC benchmark of 85%. Previously, Jail Health Services had no way to measure …

Theoretical Investigations On Strategies For Sampling Meteorological And Chemical Field Quantities In Smoke Plumes Using Uavs, Mary K. Butwin Aug 2015

Theoretical Investigations On Strategies For Sampling Meteorological And Chemical Field Quantities In Smoke Plumes Using Uavs, Mary K. Butwin

Atmospheric Sciences

Wildfires emit large quantities of pollutants that decrease the air quality in the atmospheric boundary layer. Understanding the chemical makeup of a fire plume is beneficial for air quality studies and for air quality forecasting in communities. To be able to understand the chemical composition, Unmanned Aerial Vehicles (UAVs) should be flown into plumes with an air quality instrumental payload. Before such flights can be completed it is crucial that the flight paths will allow for a complete understanding of the chemical concentration distributions within the plume. To develop such a flight path, with respect to flight altitude, direction and …

Double-Difference Relocation Of Earthquakes At Uturuncu Volcano, Bolivia, And Interior Alaska, Laura Hutchinson Aug 2015

Double-Difference Relocation Of Earthquakes At Uturuncu Volcano, Bolivia, And Interior Alaska, Laura Hutchinson

Geosciences

In order to reliably interpret seismic patterns, we must have reliable earthquake locations. To improve our catalog locations, I incorporate cross-correlations into double-difference earthquake relocations to generate high precision relative locations. I perform relocations for two regions, one volcanic and one tectonic. At Uturuncu volcano, I incorporate a wealth of previous studies to present a picture of the processes at play. Seismic, gravity, InSAR, and electromagnetic studies all show that there is a magma body underlying the entire region, and chemical studies suggest that this magma body (the Altiplano-Puna Magma Body, or APMB) is the source of the large ignimbrite …
