Fragmenting The Community: Immigration Enforcement And The Unintended Consequences Of Local Police Non-Cooperation Policies, Natashia Tidwell
Fragmenting The Community: Immigration Enforcement And The Unintended Consequences Of Local Police Non-Cooperation Policies, Natashia Tidwell
St. John's Law Review
(Excerpt)
Part I traces the historical roots of the relationship between local police and federal immigration authorities, beginning with the changes in enforcement strategy precipitated by the September 11, 2001 attacks and leading up to the launch of S-Comm. The federal government's increased reliance on local police to supplement its internal enforcement efforts has raised several Tenth Amendment concerns as the states struggle to define the proper scope of their "inherent authority" to act in immigration matters, with officials in some so-called sanctuary cities insisting that their inherent authority to enforce federal immigration law is commensurate with the sovereign right …

Challenge 1: Roles Of Universities In Resilience Planning And Emergency Response/Preparation, Miguel Ascarrunz
Coastal Resilience Workshop
Representatives from Broward County Government and the U.S. Geological Survey provided a multidisciplinary audience with four challenge questions. Following a Sea Level Rise Expedition on October 26, 2015, natural and social scientists and managers from the local area participated in the scenario-based workshop at the Broward County Governmental Center. Attendees tackled issues related to the recurring flooding caused by sea level rise and issues surrounding a scenario that included an increasing frequency of severe storms associated with climate change. Challenge questions helped the researchers to discuss natural and nature-based approaches capable of improving the quality and resilience of economic, ecologic, …
Exposure And Responses To Pre-Incident Behavior In A College Student Sample, Brandon A. Hollister
Exposure And Responses To Pre-Incident Behavior In A College Student Sample, Brandon A. Hollister
Department of Psychology: Dissertations, Theses, and Student Research
Campus threat assessment has included gathering, assessing, and intervening in situations with pre-incident behavior. However, with limited general population examination, concerns regarding the prevalence, assault correspondence, and reporting of pre-incident behavior exist. With an undergraduate student sample (n = 1,063), this dissertation utilized a survey regarding exposure and response to campus safety concerns. In comparison to students not witnessing concerns, students seeing problematic behavior had higher self-reported antisocial history and campus connectedness. Students witnessing physical assault were more likely to see multiple pre-incident behaviors, multiple incidents of pre-incident behavior, threatening statements, and threatening gestures from the perpetrator than students witnessing …

A New Fulcrum Point For City Survival, Samir D. Parikh
A New Fulcrum Point For City Survival, Samir D. Parikh
William & Mary Law Review
Municipalities have historically enjoyed immense stability. This era of tranquility is over, and fiscal deterioration is accelerating. Policymakers and scholars have struggled to formulate debt restructuring options; almost all have embraced federal bankruptcy law. But this resource-draining process is not the fulcrum point for any meaningful solution to municipal demise. Indeed, for the vast majority of distressed municipalities, the lever of municipal recovery will not turn on the solutions that have been offered to date. This Article radically shifts the municipal recovery debate by arguing that state law is the centralized point at which officials can exert the necessary amount …

One Centimeter Over My Back Yard: Where Does Federal Preemption Of State Drone Regulation Start?, Henry H. Perritt Jr.
One Centimeter Over My Back Yard: Where Does Federal Preemption Of State Drone Regulation Start?, Henry H. Perritt Jr.
All Faculty Scholarship
The proliferation of cheap civilian drones and their obvious utility for precision agriculture, motion picture and television production, aerial surveying, newsgathering, utility infrastructure inspection, and disaster relief has accelerated the FAA’s sluggish effort to develop a proposal for generally applicable rules and caused it to grant more than 600 “section 333 exemptions” permitting commercial drone flight before its rules are finalized.
Federal preemption in the field of aviation safety regulation is generally assumed, but political pressure on states and municipalities to regulate drones and the ability of this revolutionary aviation technology to open up space close to the ground for …
