Into The Vortex Of A Maelstrom: The Art Of Municipal Governance In Confederate Richmond, Joshua Shaffer
Into The Vortex Of A Maelstrom: The Art Of Municipal Governance In Confederate Richmond, Joshua Shaffer
Theses and Dissertations
From May 1861 until April 1865 the city of Richmond, Virginia served as the capital of the Confederate States of America, during the American Civil War. Throughout the course of the war it operated alongside the established governments of the Commonwealth of Virginia, the County of Henrico, and Richmond City. The body that experienced the greatest fluctuation and change was the municipal government, which consisted of a city council, mayor, and hustings court. The city government faced existential challenges that included an increase in its population, an influx of Confederate soldiers, and the constant threat of the Union army. While …

Protest, Policing, And The Petition Clause: A Review Of Ronald Krotoszynski's Reclaiming The Petition Clause, Christina E. Wells
Faculty Publications
This essay, a short book review of Ronald Krotoszynski Jr.'s book, Reclaiming the Petition Clause Seditious Libel, "Offensive" Protest, and the Right to Petition the Government for Redress of Grievances, examines the variety of restrictions that actually affect protestors in the modern landscape. Professor Krotoszynski effectively argues that the Supreme Court's current use of content neutral time place and manner restrictions allows government officials to engage in surreptitious content censorship and also revives the defunct crime of seditious libel. His proposal to locate protestors' rights in the petition clause of the First Amendment is both historically grounded and attempts to …

Analysis Of The Nebraska Intake Risk Assessment Instrument, Sarah Moore, Anne M. Hobbs
Reports
Under current Nebraska law, a youth in Nebraska should be placed in a secure detention facility for only two reasons: (1) “immediate and urgent necessity for the protection of such juvenile or the person or property of another or (2) if it appears that such juvenile is likely to flee the jurisdiction of the court” (Rev. Stat. § 43-251.01(5)).
In the State of Nebraska, the Office of Juvenile Probation Administration screens youth using the Nebraska Juvenile Intake Screening Risk Assessment prior to making a determination whether to detain the youth. The assessment is referred to in this report as the …
No Refuge: Hungarian Romani Refugee Claimants In Canada, Julianna Beaudoin, Jennifer Danch, Sean Rehaag
No Refuge: Hungarian Romani Refugee Claimants In Canada, Julianna Beaudoin, Jennifer Danch, Sean Rehaag
Osgoode Legal Studies Research Paper Series
From 2008 to 2012, large numbers of Hungarian Romani refugee claimants came to Canada. Their arrival was controversial. Some political actors suggested that their claims were unfounded and amounted to abuse of Canada’s refugee processes -- abuse which could only be prevented through wide-scale reforms to the refugee determination system. Many advocates for refugees, by contrast, argued that persecution against Roma was rampant in Hungary and noted that hundreds of Hungarians had been recognized as refugees in Canada. Some went further and contended that Romani refugee claimants fled persecution in Hungary only to be confronted with similar mistreatment in Canada. …

2014 Federal Legislative Review, Jessica Brockway
Animal Law Review
The 113th Congress escaped the designation of "least productive Congress in modern history" thanks to a particularly active lame duck session. During its session, the 113th Congress enacted 296 laws, 212 of which were "categorized ... as substantive " by the Pew Research Center, a nonpartisan "fact tank." This legislative activity, however, did not benefit animals. Of the pieces of proposed legislation discussed in this Review, none passed and, unless otherwise specified, all died in Committee.

Why Immigration’S Plenary Power Doctrine Endures, David A. Martin
Why Immigration’S Plenary Power Doctrine Endures, David A. Martin
Oklahoma Law Review
The plenary power doctrine, traditionally traced to the Supreme Court’s decision in Chae Chan Ping, has persisted despite a steady and vigorous stream of scholarly criticism. This essay undertakes to explain why. First, the Court’s strong deference to the political branches does not derive from the concept of sovereignty. Justice Field’s opinion for the Court invoked sovereignty not to trump rights claims but to solve a federalism problem — structural reasoning that locates the immigration control power squarely in the federal government, though not explicitly enumerated in the Constitution. The Chae Chan Ping Court’s deference to the political branches instead …

Institutional Racism: Perspectives On The Department Of Justice's Investigation Of The Ferguson Police Department., Cassandra Chaney Phd

On August 9, 2014, Michael Brown, an 18-year old Black man, was fatally shot by Darren Wilson, a white policeman with the Ferguson Police Department. The incident sparked protests and acts of vandalism in Ferguson as well as widespread calls for an investigation into the incident. On September 3, 2014, The Justice Department announced that it would open a broad civil rights investigation that would examine whether the Ferguson police had a history of discrimination or misuse of force beyond the Michael Brown case. On March 4. 2015, Attorney General Eric H. Holder publicly criticized the Ferguson Police Department …

Throw Away The Jail Or Throw Away The Key? The Effect Of Punishment On Recidivism And Social Cost, Miguel De Figueiredo
Throw Away The Jail Or Throw Away The Key? The Effect Of Punishment On Recidivism And Social Cost, Miguel De Figueiredo
Faculty Articles and Papers
"We jail too many people and it costs too much. Incarceration is not only expensive, it also is prone to ""hardening"" and negative peer learning effectshat may increase recidivism. With local, state, and federal budgets at a breaking point, politicians and regulators are increasingly considering alternative approaches to preventing crime. Yet, they face a problem. Studies show that incapacitation is a successful way of reducing crime, yet most scholars and policymakers think that the only way to incapacitate is to incarcerate. This study demonstrates that this assumption is problematic, arguing that we should understand incapacitation along a continuum, with incarceration …

In 2005, New Orleans, Louisiana experienced an interruption in its neighborhood life cycle due to Hurricane Katrina. While federal, state and local administrative policies have tried to manage the process of recovery, the non-profit sector has been a key to the recovery. This paper will examine the case study of the Beacon of Hope Resource Centre (BOH) whose ability to collect data, expand citizen engagement and influence policy made a positive impact upon economic development through public participation geographic information systems (PPGIS) with the Regional Planning Commission and the Department of Planning and Urban Studies, University of New Orleans. Membership Crime Vs. The Right To Assemble, 48 J. Marshall L. Rev. 729 (2015), Steven Morrison
UIC Law Review
The World War I (WWI) era generated the substantive First Amendment. Subsequent jurisprudence, however, has focused on the speech right and left the right to assemble underdeveloped. This is so because courts, lawyers, and scholars view the WWI cases as speech cases. In fact, these cases implicitly tested the assembly right more than they have been read to test the speech right because they involved “membership crime” – criminal conspiracy in federal and state courts, and criminal syndicalism at the state level. This Article uncovers the importance of the assembly right during the substantive First Amendment’s generation. It therefore serves …
