Testimonial Is As Testimonial Does, Ben Trachtenberg
Testimonial Is As Testimonial Does, Ben Trachtenberg
Florida Law Review
In the decade since Crawford v. Washington declared “testimony” to be the touchstone of the Confrontation Clause, courts—from the humblest criminal trial court to the Supreme Court itself—have struggled with two problems. First, defining “testimonial” has proven difficult. Second, in certain cases, the results of defining “testimonial” as Crawford would seem to require have proven unappealing. Justice Antonin Scalia, the author of the majority opinion in Crawford and the most vocal cheerleader of its new doctrine, has consequently had trouble maintaining a majority of Justices for what would seem to be straightforward applications of the opinion. Professor Richard D. Friedman …
Finding Subaltern Voices: A Case For Preservation Of Colonial Legal Proceedings, Kriti Sharma
Finding Subaltern Voices: A Case For Preservation Of Colonial Legal Proceedings, Kriti Sharma
Socio-Legal Review
Colonial courts are seen as places of action for the “two-facedness of colonial law” wherein the British sought to introduce universalist principles of adjudication, such as the ‘Rule of Law’, yet also appeased the native legal conservatives and traditionalists who formed the dominant class. It is realized that in this process the narratives of colonized subalterns- of adivasis, dalits, gender and religious minorities are often found to be lost. In a quest to find their voices and to register their claims, revisiting our legal history is necessary; but has been made impossible due to an inexcusable neglect of legal proceedings …
Judicial Restraint In An Era Of Terrorism: Prevention Of Terrorism Cases And Minorities In India, Shylashri Shankar
Judicial Restraint In An Era Of Terrorism: Prevention Of Terrorism Cases And Minorities In India, Shylashri Shankar
Socio-Legal Review
The article assesses and compares the behaviour of India’s higher judiciary on Prevention of Terrorism Act (POTA) cases with the pattern of rulings on previous preventive detention and anti-terror laws in India. It tests the hypothesis in Scaling Justice: India’s Supreme Court, Anti-Terror Laws and Social Rights, that POTA cases would see more pro-state rulings, particularly after incidents of terrorism, but that Muslim minorities would not be unduly targeted by the judges. The findings from the 103 POTA cases affirm the hypothesis that the judgments of the high court and the supreme court do not exhibit a pattern of disfavouring …

Using Appreciative Inquiry To Identify Strengths In Refugee And Immigrant Families: Implication For Family And Community Assessment, Noël Bezette-Flores, Sacha Lazarre
Journal of Family Strengths
Houston is a diverse and international city. According to the U.S. Census (2000) the racial makeup of the city was 49.3% Caucasian, 25.3% African American, 5.3% Asian, Native American 5.3%, 16.5 % other and 37% Hispanic. In an effort to improve upon existing strengths within the refugee and immigrant families living in Houston communities the Office of International Communities along with the Mayor’s advisory Committee of Immigrant and refugee affairs (Advisory Committee Office of International Communities) tasked an engagement working group to explore the aspirations of the families utilizing an Appreciative Inquiry (AI) methodology with the goal of informing service …

Pirker And Beyond: Questions Of Policy Versus Law On Unmanned Aerial Systems (Uas), Sarah Nilsson
Pirker And Beyond: Questions Of Policy Versus Law On Unmanned Aerial Systems (Uas), Sarah Nilsson
Aviation / Aeronautics / Aerospace International Research Conference
The regulatory versus policy landscape for unmanned aerial system (UAS) users in the United States (US), as of February 2015, is not an easy one to navigate. The whole country is buzzing with the sound of this new technology, not just in terms of engine noise but more so in terms of the public outcry to the invasion of privacy. The federal government is currently drafting laws that will safely integrate these systems within the National Airspace System (NAS). Concurrently, at least 20 states, unable to wait patiently in the sidelines for such legislation, have implemented their own statutes to …

Unmanned Aerial Systems In The Fire Service: Concepts And Issues, John C. Griffith, Ronald T. Wakeham
Aviation / Aeronautics / Aerospace International Research Conference
The presentation will summarize current thinking on the application of Unmanned Aerial Systems (UASs) in the Fire Service. Potential use of UASs to save lives, provide safety and save property has generated preliminary research in three major areas of the fire service to include aviation, structure and wildland scenarios. Roadblocks to the effective use of this technology will also be discussed to include possible command and control issues and governmental actions to limit the use of UASs due to aviation safety concerns. The presenters will recommend areas of future research and steps to implement this technology in the fire service. …
Third Party Airport Crash Risk Model For Non-Towered Airports, Christian Salmon
Third Party Airport Crash Risk Model For Non-Towered Airports, Christian Salmon
Aviation / Aeronautics / Aerospace International Research Conference
This research leverages the objective accident data record towards an individual and societal 3rd party “external” airport risk model for aircraft operations that crash while operating at non-towered airports.
Small aircraft, specifically Part 91, operating at non-towered airports have a crash rate estimated at 10-fold that of commercial operations. Given the nature of the typically non-towered airport, situated in close physical proximity with residential structures, this exposes residents to substantive risk of injury and death due to aircraft crashing.
A 3rd party risk model that maps risk of injury, death and percent structural damage will enable informed decisions …
Unmanned Insecurity: The Safety And Privacy Issues Of Unmanned Aircraft Information Assurance, Donna A. Dulo Ph.D.
Unmanned Insecurity: The Safety And Privacy Issues Of Unmanned Aircraft Information Assurance, Donna A. Dulo Ph.D.
Aviation / Aeronautics / Aerospace International Research Conference
Information assurance and computer security are foundational paradigms in ground based information systems. However, in the aerial realm of unmanned systems, information security often takes the proverbial back seat to high visibility issues such as safety and privacy. Yet, a secure unmanned aircraft is a basic tenant of safety and privacy in the operational arena. Information assurance and security that are enveloped into an unmanned aircraft protect the systems data, communications, as well as internal operations and permeates not only the aircraft’s systems, but also the system’s interactions with satellites, ground stations, and other aerial entities that share data and …
Felony Disenfranchisement: A Literature Review, Carter A. Wilson Dr.
Felony Disenfranchisement: A Literature Review, Carter A. Wilson Dr.
Conference Presentations
This paper examines and critiques legal arguments supporting and opposing felon disenfranchisement laws. It reexamines Richardson v Ramerez, the Supreme Court decision upholding the constitutionality of state laws that deny voting rights to voting aged cities with felony convictions. It summarizes the literature on case law, legal theory, democratic theory and comparative governments related to voting rights and felon disenfranchisement. It presents a typology of different levels of felon disenfranchisement practice. It concludes that the arguments supporting the more severe practices of felon disenfranchisement tend to focus on the 14th amendment while ignoring the 15th amendment; tend to trivialize the …

Dissolved: Lessons Learned From The Portland Multnomah Food Policy Council, Amy K. Coplen, Monica Cuneo
Urban Studies and Planning Faculty Publications and Presentations
The city of Portland, Oregon, is often hailed in news and popular media as the capital of the U.S. alternative food movement. In 2002, the Portland Multnomah Food Policy Council (PMFPC) was established to address the region's growing interest in cultivating a sustainable local food system. Council members contributed to many notable achievements, including a healthy corner store initiative, a beginning farmer training program, and changes to zoning codes to expand urban agriculture. However, the PMFPC was dissolved in the summer of 2012 after local government agencies expressed that the council was losing relevancy. After a decade of conducting food …
Lawlessness Breeds Lawlessness: A Case For Applying The Fourth Amendment To Extraterritorial Searches, Amy E. Pope
Lawlessness Breeds Lawlessness: A Case For Applying The Fourth Amendment To Extraterritorial Searches, Amy E. Pope
Florida Law Review
The purpose of this Article is to revisit the jurisprudence on the Fourth Amendment’s application to extraterritorial searches in which the fruits of seizures are introduced in U.S. courts to prosecute defendants who violate U.S. federal statutes. The Supreme Court has not opined on this issue since 1990,5 and the time for review is ripe.
