A New Understanding Of Gang Injunctions, Wesley F. Harward Feb 2015

A New Understanding Of Gang Injunctions, Wesley F. Harward

Notre Dame Law Review

There were over 1.4 million active gang members in the United States as of 2011—an increase of forty percent in gang membership from 2009. It is estimated that “[g]angs are responsible for an average of 48 percent of violent crime in most jurisdictions and up to 90 percent in several others.” Many of the more than 33,000 gangs are increasing in sophistication and organization. Additionally, these “[g]angs are increasingly engaging in nontraditional gang-related crime, such as alien smuggling, human trafficking, and prostitution.”

The rise in gang membership and gang violence “has overwhelmed conventional law enforcement techniques.” State legislatures, city attorneys, …

Assessment Program For Kentucky Traffic Records, Lenahan O'Connell, Eric R. Green, Reginald R. Souleyrette

Kentucky Transportation Center Research Report

During 2013, the Kentucky Transportation Center identified 117 potential performance metrics for the ten databases in the Kentucky Traffic Records System. This report summarizes the findings of three main tasks completed in 2014: (1) assessment of the utility of each metric and/or the availability of data; (2) collection of data on the metrics deemed useful with available data; and (3) assessment the possibility of incorporating a number of the Model Minimum Uniform Crash Criteria (MMUCC) elements into the CRASH database. Interviews with liaisons for each database reduced the number of metrics from 117 to 51. The reason for rejecting the …

The purpose of this research is to use "before and after study design" to follow the grant trends of policing systems in order to examine whether the catastrophic events of 9/11 had a positive or negative impact on the grant funds of the mentioned policing models. Preliminary analyses revealed that there is significant difference in the mean level of funding prior and after the event for Homeland Security, community policing, and general policing programs. Segmented and Stepwise Regressions …

Public Accommodation Statutes And Sexual Orientation: Should There Be A Religious Exemption For Secular Businesses?, Lucien J. Dhooge Feb 2015

Public Accommodation Statutes And Sexual Orientation: Should There Be A Religious Exemption For Secular Businesses?, Lucien J. Dhooge

William & Mary Journal of Race, Gender, and Social Justice

This Article examines the issue of whether there should be a religious exemption for secular businesses from public accommodation statutes that protect prospective patrons from discrimination on the basis of sexual orientation. The Article examines this issue in the context of protecting free exercise of religion versus offering services to all members of the public equally and without distinction. The Article concludes that the perceived threat to religious liberty posed by such statutes is exaggerated, that the consequences of granting exemptions would be harmful, and that state-sanctioned discrimination is contrary to the fundamental principles of justice and equality underlying the …

War, Fields, And Competing Economies Of Death. Lessons From The Blockade Of Leningrad, Jeffrey K. Hass Feb 2015

War, Fields, And Competing Economies Of Death. Lessons From The Blockade Of Leningrad, Jeffrey K. Hass

Sociology and Anthropology Faculty Publications

War can create a massive amount of death while also straining the capacity of states and civilians to cope with disposing of the dead. This paper argues that such moments exacerbate contradictions between three fields and “economies” (logics of interaction and exchange) – a political, market, and moral economy of disposal – in which order and control, commodification and opportunism, and dignity are core logics. Each logic and economy, operating in its own field, provides an interpretation of the dead that emerges from field logics of normal organization, status, and meanings of subjects (as legal entities, partners in negotiation, and …

Public Understanding And Knowledge Of Rip Currents And Beach Safety In The Uk, Eleanor Woodward, Emily Beaumont, Paul Russell, Ross Macleod

International Journal of Aquatic Research and Education

Rip currents present a severe hazard for water users on beaches and account for the greatest cause of lifeguard rescues worldwide. The physical dynamics of rip currents are well studied, and more recently, the social and behavioural science research surrounding human interaction of rip currents has been expanding, providing a social perspective and feeding into public education strategies. The aim of this study was to assess levels of public understanding of rip currents and beach safety on UK beaches. A questionnaire was undertaken (N = 407) during the summer of 2012 on four beaches. Beach users had a poor knowledge …

Conspiracy And The Fantasy Defense: The Strange Case Of The Cannibal Cop, Kaitlin Ek Feb 2015

Conspiracy And The Fantasy Defense: The Strange Case Of The Cannibal Cop, Kaitlin Ek

Duke Law Journal

In the notorious "Cannibal Cop" case, New York police officer Gilberto Valle was accused of conspiring to kidnap, kill, and eat various women of his acquaintance. Valle claimed a "fantasy defense," arguing that his expression represented not conspiracy agreement, but fantasy role-play. His conviction and subsequent acquittal raised questions about the freedom of speech, thoughtcrime, and the nature of conspiracy law. Because the essence of conspiracy is agreement, it falls into the category of crimes in which pure speech is the actus reus of the offense. This Note argues that as a result, conspiracy cases in which the fantasy defense …

Also, it examines to what extent the mobile companies in Egypt adhere to the health and environment standards, namely in the residential areas (informal and poor areas). It demonstrates how the standards set in Egypt are not applied restrictively enough to ban the violations. Besides, there are negative impacts that might be found as a result of not complying with the health standards. In this study, the qualitative research methods were used in the form of in-depth …

The Discourse Of Drug Use In Egypt: An Interdisciplinary Exploratory Study, Alejandro Gutierrez Feb 2015

The Discourse Of Drug Use In Egypt: An Interdisciplinary Exploratory Study, Alejandro Gutierrez

Theses and Dissertations

This thesis sets out to better understand how Egyptian society constructs and labels the ‘deviant’ behavior of drug use. However, it is not about drugs per se, it is about scrutinizing the complex process through which Egyptian society encounters, experiences, and regulates behavior. Through an interdisciplinary approach, it builds an alternative and critical understanding of a stigmatized group of individuals by describing how they shape or are shaped by the dynamic system in which they exist. Thus, it creates a conversation between the structures of power that regulate the moral economy of society on the one hand and individuals practicing …

Street Code Adherence, Callous-Unemotional Traits And The Capacity Of Violent Offending Versus Non-Offending Urban Youth To Mentalize About Disrespect Murder, Zoe A. Berko Feb 2015

Street Code Adherence, Callous-Unemotional Traits And The Capacity Of Violent Offending Versus Non-Offending Urban Youth To Mentalize About Disrespect Murder, Zoe A. Berko

Dissertations, Theses, and Capstone Projects

National statistics are not available on the proportion of violent juvenile offenses driven by the experience of being disrespected. However, the New York Police Department estimates that about 40% of the city's shootings involve members of violent crews of 12 to 20 year olds with most of this gun violence driven by incidents of disrespect. Mentalization, defined as the ability to envision mental states (i.e., feelings, beliefs and intentions) in oneself and others, is viewed as underlying affect regulation, impulse control, self-monitoring, and the experience of self-agency, all of which are implicated in interpersonal violence (Fonagy, Gergely, Jurist, & Target, …

Inmate-, Incident-, And Facility-Level Factors Associated With Escapes From Custody And Violent Outcomes, Bryce E. Peterson Feb 2015

Inmate-, Incident-, And Facility-Level Factors Associated With Escapes From Custody And Violent Outcomes, Bryce E. Peterson

Dissertations, Theses, and Capstone Projects

Introduction: Preventing escapes from custody is a critical function of prisons, jails, and the individuals who run these correctional facilities. Escapes are a popular topic in the news, among lawmakers, and in public discourse. Much of this interest stems from the widespread notion that escapees pose a serious threat to public safety, as well to the safety of correctional staff and law enforcement officers tasked with preventing and apprehending them. However, despite the importance of preventing escapes and minimizing violence, there has been very little empirical research on these issues in the past several decades. Extant research has also been …

Letting Innocence Suffer: The Need For Defense Access To The Law Enforcement Dna Database, Jason Kreag Feb 2015

Letting Innocence Suffer: The Need For Defense Access To The Law Enforcement Dna Database, Jason Kreag

Cardozo Law Review

Law enforcement has gradually amassed a sizable DNA database that holds considerable promise for solving cold cases and identifying suspects. The Supreme Court has blessed this effort, allowing investigators to include profiles of arrestees as well as convicted persons in the database. At present, though, law enforcement has a near monopoly on use of the DNA database, leaving defendants at the whim of the law enforcement officials who control access to this tool. Legal scholars have alternatively praised and decried the database, but none has examined its prospects for proving defendants' innocence post-conviction. This Article fills that void by identifying …
