Regulating The Underground: Secret Supper Clubs, Pop-Up Restaurants, And The Role Of Law, Sarah Schindler
Regulating The Underground: Secret Supper Clubs, Pop-Up Restaurants, And The Role Of Law, Sarah Schindler
Sturm College of Law: Faculty Scholarship
Instagram pictures of elegantly plated dinners, long farm-style tables, and well-to-do people laughing in what looks like a loft apartment are followed by commenters asking, “Where is this?” This is the world of underground dining. Aspiring and established chefs invite strangers into their homes (or their friends’ stores after hours, or the empty warehouse at the edge of town, or the nearest farm) for a night of food and revelry in exchange for cash. Although decidedly anti-establishment, these secret suppers and pop-up restaurants are popular — there are websites to help people locate them, and many respected publications have penned …

A Journey 40 Years in the Making
A pilgrimage to the Holy Land became the trip of a lifetime for 15 members of the Class of 1972 when the context, culture and contours of Israel and its history informed and enriched the journey they took four decades after standing together at their Commencement.

Up In The Air: Department Of Homeland Security V. Maclean And The Whistleblower Protection Act, Mike Brett
Up In The Air: Department Of Homeland Security V. Maclean And The Whistleblower Protection Act, Mike Brett
Duke Journal of Constitutional Law & Public Policy Sidebar
This commentary analyzes the Supreme Court case Department of Homeland Security v. MacLean deciding whether an employee of the Department of Homeland Security comes under the protection of the Whistleblower Protection Act when they release potentially sensitive information to the media. Generally, the Act protects whistleblowers unless the information they release is not allowed "as specified by law." The particular statutory question in this case is whether the "law" prohibiting release must be contained in a statute, or can include the Department of Homeland Security's own promulgated regulation. The Author profiles the background of the case, applicable legal precedent, and …

Focusing On Children’S Strengths: Accessing Effective Mental Health Services For Juvenile Justice-Involved Youth Through Collaboration And Understanding Federal Entitlements To Care, Fiza A. Quraishi, Hannah Benton
Journal of Applied Research on Children: Informing Policy for Children at Risk
Between 65 and 70 percent of youth in the juvenile justice system have mental health disorders, with some studies estimating that at least 20 percent of these youth have severe disorders that significantly impair functioning. Many of these youth are entitled to adequate and responsive mental health services through federal programs like Medicaid’s Early Periodic Screening Diagnosis and Treatment Program (EPSDT), the Individuals with Disabilities Education Act (IDEA), and Section 504 of the Rehabilitation Act of 1973 (Section 504). Despite these entitlements to care, by and large, the systems that serve youth fail to provide mental health services that address …

Representing The Educational Experiences Of Black Girls In A Juvenile Court School, Monique W. Morris Ed.D.
Journal of Applied Research on Children: Informing Policy for Children at Risk
Multiple, intersecting factors contribute to the over-representation of youth of color, including Black girls, in the juvenile justice system, and specifically, in confinement. This study examined the self-identified, educational experiences of Northern California Black girls in confinement. This phenomenological study found that Black girls in trouble with the law experience a history of exclusionary discipline and poor relationships with schools that are exacerbated by the absence of a learning environment in confinement that emphasizes their ability to build positive relationships with teachers and each other. The study also found that the use of exclusionary discipline was heightened in the juvenile …
