Institutional Entrepreneurship, Governance And Poverty: Insights From Emergency Medical Response Services In India, Gerard George, Rekha Rao-Nicholson, Christopher Corbishley, Rahul Bansal

Research Collection Lee Kong Chian School Of Business

We present an in-depth case study of GVK Emergency Management and Research Institute, an Indian public–private partnership (PPP), which successfully brought emergency medical response to remote and urban settings. Drawing insights from the case, we investigate how the organization established itself through institutional entrepreneurship using a process conceptualized as opportunity framing, entrenchment, and propagation. The case and context highlight the need for innovation in organizational design and governance modes to create a new opportunity that connects state actors, private healthcare providers, and the public at large. We consider the role of open innovation and novel business models in creating these …

Questionnaire Design Effects In Climate Change Surveys: Implications For The Partisan Divide, Jonathon P. Schuldt, Sungjong Roh, Norbert Schwarz Mar 2015

Questionnaire Design Effects In Climate Change Surveys: Implications For The Partisan Divide, Jonathon P. Schuldt, Sungjong Roh, Norbert Schwarz

Research Collection Lee Kong Chian School Of Business

Despite strong agreement among scientists, public opinion surveys reveal wide partisan disagreement on climate issues in the united States. we suggest that this divide may be exaggerated by questionnaire design variables. Following a brief literature review, we report on a national survey experiment involving U.S. Democrats and Republicans (n = 2,041) (fielded August 25–September 5, 2012) that examined the effects of question wording and order on the belief that climate change exists, perceptions of scientific consensus, and support for limiting greenhouse gas emissions. wording a questionnaire in terms of “global warming” (versus “climate change”) reduced Republicans’ (but not Democrats’) existence …

Perspectives On Abandoned Houses In A Time Of Dystopia, Kermit J. Lind Mar 2015

Perspectives On Abandoned Houses In A Time Of Dystopia, Kermit J. Lind

Law Faculty Articles and Essays

This article describes various perspectives on abandoned houses in urban neighborhoods and the reactions from those perspectives. It notes how conflicting reactions perpetuate the crisis of blight for individual residents and their communities. It argues that real solutions for management of abandonment must be based in local communities and tailored to local conditions. Priority must be placed on consistent maintenance in compliance with local housing and neighborhood health, safety and environmental codes. Housing preservation, rehabilitation, reutilization programs will not succeed without improved and sustained maintenance. Localities will need to take the lead in remodeling residential maintenance using new strategies, methods …

Longstanding Agency Interpretations, Anita S. Krishnakumar Mar 2015

Longstanding Agency Interpretations, Anita S. Krishnakumar

Fordham Law Review

How much deference—or what kind—should courts give to longstanding agency interpretations of statutes? Surprisingly, courts and scholars lack a coherent answer to this question. Legal scholars long have assumed that longstanding agency statutory interpretations are treated with heightened deference on judicial review, and federal courts sometimes have made statements suggesting that this is the case. But in practice, federal court review of longstanding agency interpretations—at both the U.S. Supreme Court and courts of appeals—turns out to be surprisingly erratic. Reviewing courts sometimes note the longevity of an agency’s statutory interpretation as a plus factor in their deference analysis but at …

Rocky Mountain High: The Impact Of Federal Guidance To Banks On The Marijuana Industry, Tyler T. Buckner Mar 2015

Rocky Mountain High: The Impact Of Federal Guidance To Banks On The Marijuana Industry, Tyler T. Buckner

North Carolina Banking Institute

This Note considers the implications of these recent federal guidelines issued to financial institutions with respect to their freedom to do business with the state-sanctioned marijuana industry. It also discusses whether viable legal alternatives might be available to allow growth in the burgeoning marijuana markets while still remaining faithful to the federal government’s position regarding marijuana as a dangerous drug worthy of prohibition. This Note attempts to balance competing economic and governmental interests in an emerging industry that continues to evolve amid a tumultuous national landscape. This Note argues that current guidelines are excessively onerous for financial institutions and without …

Executive Compensation And Regulation Imposed Governance: Evidence From The California Non-Profit Integrity Act (2004), Sandip Dhole, Saleha B. Khumawala, Sagarika Mishra, Tharindra Ranasinghe Mar 2015

Executive Compensation And Regulation Imposed Governance: Evidence From The California Non-Profit Integrity Act (2004), Sandip Dhole, Saleha B. Khumawala, Sagarika Mishra, Tharindra Ranasinghe

Research Collection School Of Accountancy

This study examines the impact of the California Nonprofit Integrity Act of 2004 on CEO compensation costs in affected organizations. Contrary to the stated objective of the Act that executive compensation is “just and reasonable,” we find that CEO compensation costs for affected nonprofits during the post-regulation periods have increased by about 6.3 percent when compared with a control group of comparable unaffected nonprofits. In addition, the relative increase in CEO compensation appears to come from nonprofits that have experienced greater regulatory cost increases. We do not find evidence that the Act resulted in a change in CEO pay performance …

Staying Connected: Keeping Justice-Involved Youth “Close To Home” In New York City, Jeffrey A. Butts, Laura Negredo, Evan Elkin Mar 2015

Staying Connected: Keeping Justice-Involved Youth “Close To Home” In New York City, Jeffrey A. Butts, Laura Negredo, Evan Elkin

Publications and Research

When justice-involved youth are supervised by local agencies and placed with locally operated programs rather than being sent away to state facilities, they are better able to maintain community ties. They stay connected with their families, and they are more likely to remain in local schools. Policy reforms that localize the justice system are often called “realignment.” New York’s “Close to Home” (or C2H) initiative is a prominent example of youth justice realignment. Launched in 2012, it is the latest chapter in a decade-long commitment by New York State and New York City to improve the justice system for young …

From Mayberry To Ferguson: The Militarization Of American Policing Equipment, Culture, And Mission, Cadman R. Kiker Iii Feb 2015

From Mayberry To Ferguson: The Militarization Of American Policing Equipment, Culture, And Mission, Cadman R. Kiker Iii

Washington and Lee Law Review Online

We are at the dawn of a new era of policing in the United States. In recent months, images of armed police officers patrolling the streets of Ferguson, Missouri, and of a toddler burned by a Georgia SWAT team’s grenade have been indelibly branded into America’s social consciousness. There is a unique bipartisan outcry from Washington in a time otherwise marked by bitter political divides. Politicians and journalists alike are questioning the efficacy of a militaristic police force and the path that led to this shift in the paradigm of policing.

This Essay examines the how and why of police …
