Legal Education In Transition: Trends And Their Implications, Sheldon Krantz, Michael Millemann Jan 2015

Legal Education In Transition: Trends And Their Implications, Sheldon Krantz, Michael Millemann

Nebraska Law Review

In Part I, we briefly describe what the critics are saying about legal education and steps the regulators are taking to stimulate what they perceive to be needed reforms. In Part II, we provide an overview of reforms now underway or in development in the first year; developments in experiential courses and programs in upper-level curricula; the emergence of some programs of specialization; the movement to add practice-based courses to the third year; and the creation of post-J.D. transition programs. In Part III, we propose an agenda for law faculties in the strategic planning that law schools should now be …

Sports Investment, Beliefs About Food-Related Behaviors, And Engagement In Problematic Eating Behaviors During Adolescence, Kaitlyn A. Ferris Jan 2015

Sports Investment, Beliefs About Food-Related Behaviors, And Engagement In Problematic Eating Behaviors During Adolescence, Kaitlyn A. Ferris

Graduate Theses, Dissertations, and Problem Reports (ETD)

Involvement in sport is the most widely reported organized activity among children and adolescents. To date, organized sports also represent the only organized activity examined in conjunction with youths' eating behaviors. Organized sports serve as contexts where messages about healthy eating and body image are communicated, and adolescents' beliefs about food and their bodies' degree of thinness and muscularity has the potential to be amplified in such settings as youth strive to perform at high levels during athletic competitions. However, inconsistency in the measurement of both organized sports participation and adolescents' engagement in problematic under- and over-eating behaviors has resulted …

Defining Cardiovascular Dysfunction In The Metabolic Syndrome: Therapeutic And Nutritional Approaches To Treatment, Sara Brooks Fournier Jan 2015

Defining Cardiovascular Dysfunction In The Metabolic Syndrome: Therapeutic And Nutritional Approaches To Treatment, Sara Brooks Fournier

Graduate Theses, Dissertations, and Problem Reports (ETD)

Metabolic syndrome (MetS) is a complex disease state defined by the manifestation of a cluster of cardiovascular (CV) risk factors including, abdominal obesity, dyslipidemia, hypertension, and hyperglycemia. Individuals afflicted with MetS have been demonstrated to assume the burden of a 3-fold increased risk of cardiovascular disease (CVD) mortality, myocardioal infarction, stroke, type II diabetes (T2DM) and all cause mortality. The national prevalence of hyperglycemia and abdominal obesity paralleled by a surge in sedentary lifestyle behavior underscore the importance of early identification and treatment of MetS. Deleterious adaptations to both vascular and myocardial structure and function have been demonstrated in MetS. …

Does Self Love Lead To Spying On Ex-Partners On Facebook? The Examination Of Ego Factors In Facebook Stalking, Brittany Furbee Jan 2015

Does Self Love Lead To Spying On Ex-Partners On Facebook? The Examination Of Ego Factors In Facebook Stalking, Brittany Furbee

Graduate Theses, Dissertations, and Problem Reports (ETD)

This study aims to identify predictable personality traits that can influence ones likelihood to stalk an ex-partner on Facebook. Particularly, the study focuses on the traits related with self-concept, given that motivations of using social network sites (SNS) are highly associated with self-concept. This includes self-esteem, two types of narcissism (grandiose and vulnerable narcissism), and self-efficacy. Furthermore, in order to better assess the predictability of these factors, this study considers other control variables while assessing predictability of personality traits, such as Facebook usage, length of the relationship, and time since the break- up, drawing from both social psychology and SNS …

Persuasion, Police, And Public Safety: Message Framing, Compliance, And Perceptions Of Law Enforcement, Alexander L. Lancaster Jan 2015

Persuasion, Police, And Public Safety: Message Framing, Compliance, And Perceptions Of Law Enforcement, Alexander L. Lancaster

Graduate Theses, Dissertations, and Problem Reports (ETD)

In the everyday interactions between law enforcement and the citizens of their communities, officers attempt to gain compliance verbally, before resorting to physical force, if necessary. This dissertation examined the use of persuasive verbal messages by law enforcement officers when encountering citizens. These messages were created to represent a progression of asking, telling, and making, to gain compliance from an individual.;The officers in this study were university police officers, because university police departments are charged with providing a safe learning environment on campus. Due to the visible, community oriented policing in which university police departments tend to engage, it is …

Productivity Promises, Precarious Realities: Ethnographic Study Of Harm Reduction Implementation In Indonesia, Sari Damar Ratri Jan 2015

Productivity Promises, Precarious Realities: Ethnographic Study Of Harm Reduction Implementation In Indonesia, Sari Damar Ratri

Antropologi Indonesia

This monograph examines the implementation of harm reduction programs in Indonesia that failed to improve the quality of drug users’ lives. The failure is the result of programs that merely provide drug users with instrumental strategy to deal with addiction through substitution therapy. The designation of legal substances such as methadone and subuxone is only to replace illegal drug addiction. In the end, the program fails to provide drug users with sufficient information to manage their dependence and even leads them to uncontrolled poly-substance use. This three months of ethnographic fieldwork focuses on examining Harm Reduction (HR) experiences in both …

Grassroots Strategic Planning: Involving Library Staff From The Beginning, Anne Marie Casey Jan 2015

Grassroots Strategic Planning: Involving Library Staff From The Beginning, Anne Marie Casey

Publications

Strategic planning is often considered a managerial tool. The management of an organization surveys the environment and develops a plan that they introduce to the organization as a whole. Most modern organizations seek employee involvement in the planning process and feedback to some degree with varied results. But for one academic library, employee involvement in the development and execution of the strategic plans has been a vital part of the processes. The Hunt Library at Embry-Riddle Aeronautical University has been developing strategic plans for several years with active input from the librarians and staff. This case study chronicles the different …

Planning For Veterans’ Success: The Degree Map As An Advising Solution, Tracey M. Richardson, Jason M. Ruckert, James W. Marion Jr

Publications

Due to the expected influx of veterans attending college, it is critical that higher education not only be cognizant of the projected growth but also take a proactive stand and properly plan for these students’ success. Academic planning begins with advising professionals developing open communications and becoming equipped to guide veteran students through the matriculation process. Veteran students often have difficulty interpreting university scheduling and frequently have access to only a limited advising staff for course selection information, which may prompt some to not persist in an online degree program. This study’s findings suggest the degree map is a powerful …

Marbles: The Application Of Input-Output Concepts To Safety Management Systems, Tim Brady, A. Stolzer, Anthony Brickhouse, Antonio Cortes, Dan Mccune, Jayathi Raghavan, David Freiwald

Publications

The goal of this research was to apply the economic concept titled Input-Output Analysis to an aviation safety concept titled Safety Management Systems (SMS). Input-Output (IO) is based upon the interrelationships of various components of an economic system and what happens to the system when one or more of those components changes. Since SMS is, by definition, a system with definable components, the research sought to determine if the interrelationships between those components could be determined and quantified. The term ‘‘marbles’’ was used to describe the activities that led to the IO-SMS matrix. Marbles was used as a metaphor for …

Causes And Trends In Maintenance-Related Accidents In Faa-Certified Single Engine Piston Aircraft, Douglas Boyd, A. Stolzer Jan 2015

Causes And Trends In Maintenance-Related Accidents In Faa-Certified Single Engine Piston Aircraft, Douglas Boyd, A. Stolzer

Publications

The accident rate for general aviation remains high. While most general aviation accident studies have been pilot-focused, there is little research on the involvement of aircraft maintenance errors. We undertook a study to answer this question.

The Microsoft Access database was queried for accidents occurring between 1989 and 2013 involving single engine piston airplanes operating under 14CFR Part 91. Pearson Chi-Square, Fisher’s Exact Test, and Poisson probability were used in statistical analyses.

The rate of maintenance-related general aviation accidents was 4.3 per million flight hours for the 1989–1993 period and remained unchanged for the most recent period (2009–2013). Maintenance errors …

“Great Nature, Refuge Of The Weary Heart:” A Regional And Literary Exploration Of The Early Grove Plays Of The Bohemian Club, Jeremy Denouden Jan 2015

“Great Nature, Refuge Of The Weary Heart:” A Regional And Literary Exploration Of The Early Grove Plays Of The Bohemian Club, Jeremy Denouden

Master's Theses

In 1872, a group of San Francisco newspapermen came together to start their own men’s club. This group, which named itself the Bohemian Club, was an outgrowth and a representative of the rapid development of the city of San Francisco at that time. Shortly after its founding, the club began making an annual retreat to the redwood forests north of the city. Eventually, the club began producing elaborate performances of musical dramas, referred to as Grove Plays, written and performed exclusively for club members at these summer retreats. This thesis, which takes its name from a line in one of …

Walt Kuhn: From Spotlight To Studio, The Art Of Show Business, Emily May Mcewan-Upright

Master's Theses

Walt Kuhn, an American artist born in New York, is often overlooked for his contribution to Modern American Art. Kuhn is typically recognized for his organizational and curatorial role in the 1913 Armory Show, but he was also internationally known in his time for his paintings of show people and as a creative director for several vaudeville and circus acts over his lifetime. During his career as a creative director, Kuhn’s artwork evolved from superficial renderings of theatre scenes to psychologically intense tronies of performers. Kuhn and other American artists, including the Ashcan group and Edward Hopper, examined the relationship …

Labor Law 2.0: The Impact Of New Information Technology On The Employment Relationship And The Relevance Of The Nlra, Kenneth G. Dau-Schmidt Jan 2015

Labor Law 2.0: The Impact Of New Information Technology On The Employment Relationship And The Relevance Of The Nlra, Kenneth G. Dau-Schmidt

Emory Law Journal

The NLRA system of collective bargaining was born during the industrial age of the early twentieth century. As a result, key terms in the statute such as ¿employee,¿ ¿employer,¿ and ¿appropriate bargaining unit¿ were first interpreted in the context of long-term employment and large vertically integrated firms that dominated this era. Beginning in the late 1970s, the new information technology wrought a revolution in the organization of production increasing short-term contingent employment and the organization of firms horizontally in trading and subcontracting relationships across the globe. To maintain the relevance of collective bargaining to the modern workplace, the interpretation of …

The Nature Of Family, The Family Of Nature: The Surprising Liberal Defense Of The Traditional Family In The Enlightenment, John Witte Jr. Jan 2015

The Nature Of Family, The Family Of Nature: The Surprising Liberal Defense Of The Traditional Family In The Enlightenment, John Witte Jr.

Emory Law Journal

This Article shows that many Enlightenment liberals defended traditional family values and warned against the dangers of sexual libertinism and marital breakdown. While they rejected many traditional teachings in their construction of modern liberalism, Enlightenment liberals held firmly to classical and Christian teachings that exclusive and enduring monogamous marriages are the best way to ensure paternal certainty and joint parental investment in children who are born vulnerable and dependent on their parents¿ mutual care. Stable marital households, furthermore, are the best way to ensure that men and women are treated with equal dignity and respect, and that husbands and wives, …

Three May Not Be A Crowd: The Case For A Constitutional Right To Plural Marriage, Ronald C. Den Otter Jan 2015

Three May Not Be A Crowd: The Case For A Constitutional Right To Plural Marriage, Ronald C. Den Otter

Emory Law Journal

This Article takes seriously the substantive due process and equal protection arguments that support plural marriage (being able to marry more than one person at the same time). While numerous scholars have written about same-sex marriage, few of them have had much to say about marriages among three or more individuals. As progressive, successful, and important as the Marriage Equality Movement has been, it focuses on same-sex marriage at the expense of other possible kinds of marriages that may be equally worthwhile. The vast majority of Americans still do not discuss plural marriage openly and fairly, as if the topic …

Rape On And Off Campus, Deborah Tuerkheimer Jan 2015

Rape On And Off Campus, Deborah Tuerkheimer

Emory Law Journal

The need for institutional reform to address the problem of sexual assault, particularly on college campuses, is widely acknowledged. In the midst of increasing moves on campus to codify affirmative consent standards (¿yes means yes¿), rape law remains mired in an archaic view of consent as rather beside the point. This Article recasts the significance of law¿s preoccupation with force by introducing a taxonomy of cases in which force and non-consent tend to diverge. The no-force/no-consent cases raise a question critical to ongoing reform efforts: does the absence of consent make sex rape? Outside of law, this inquiry has for …

The purpose of this study was to examine the feasibility of using functional magnetic resonance imaging (fMRI) to measure pedaling-related brain activation in individuals with stroke and age-matched controls. We also sought to identify stroke-related changes in brain activation associated with pedaling. Fourteen stroke and 12 control subjects were asked to pedal a custom, MRI-compatible device during fMRI. Subjects also performed lower limb tapping to localize brain regions involved in lower limb movement. All stroke and control subjects were able to pedal while positioned for fMRI. Two control subjects were withdrawn due to claustrophobia, and one control data set was …

Isolation Of Microbial Nrps And Pks Gene Clusters For Natural Product Isolation, Danielle N. O'Hara Jan 2015

Isolation Of Microbial Nrps And Pks Gene Clusters For Natural Product Isolation, Danielle N. O'Hara

Honors Theses

Greater than 99% of microbes living in the environment are uncultivable due to their complex nutrient and temperature requirements for growth. These microorganisms present a potential source of natural products that could be developed for biotechnological and pharmaceutical uses. Microorganisms with phosphopantetheinyl transferase (PPTase) activity are of high interest due to the role PPTase plays in activating non-ribosomal peptide synthetase (NRPS) and polyketide synthase (PKS) gene clusters. These gene clusters produce multi-enzymatic, multi-domain megasynthases that produce complex natural products utilized by the host organism for selective advantages. This study isolated genomic DNA from soil samples collected from the University of …

In The Midst Of Life We Are In Death : Suicide Coverage In The South During The Civil War Era, India Miller Jan 2015

In The Midst Of Life We Are In Death : Suicide Coverage In The South During The Civil War Era, India Miller

Honors Theses

The Civil War cast a shadow of despair over the divided nation as it left an estimated 620,000 men—roughly 2% of the population—dead on American soil, killed by American hands. Death and the Civil War are two subjects that are synonymous with one another; it is impossible to write on the war without commenting on its immense number of casualties. That said, relatively little is known about suicides behind the front lines.

Electrical Resistivity Of Sandy Soil With Water, Leachates And Seawater, Lopa Mudra Pandey Jan 2015

Electrical Resistivity Of Sandy Soil With Water, Leachates And Seawater, Lopa Mudra Pandey

Theses: Doctorates and Masters

Liners are used in the engineered containment systems such as landfills for controlling the migration of contaminants. Although there are several techniques for detecting the leakages through the liners, use of the electrical resistivity method can assist in timely detection of contaminant migration in cost-effective manner. This method is based on the well-established fact that the electrical resistivity of soils and other geomaterials is much higher than the electrical resistivity of water, leachates or any liquid effluents which may permeate the landfill foundation material. Additionally, the geotechnical properties of a soil exhibit a close relationship with its electrical resistivity values …

A Shot In The Dark: Why Virginia Should Adopt The Firing Squad As Its Primary Method Of Execution, P. Thomas Distanislao, Iii

Law Student Publications

This comment recommends that Virginia cease its use of lethal injection because of its high botch rates and growing impracticability due to drug shortages. Instead, the Commonwealth should use the firing squad as a more effective means of execution, thereby leading the nation in a transition towards a more efficient and reliable method.

The Library As Publishing House, James Day, Anne Marie Casey, Chip Wolfe

Publications

The academic library has taken on the new role of institutional publishing house, using institutional repository (IR) services to enable journal publishing and manage conference planning. Librarians taking on this new role as publisher must know the journal publishing work flow, including online article submission, peer review, publishing, marketing, and assessment. They must understand international identifiers such as the electronic International Standard Serial Number (eISSN) and Digital Object Identifier (DOI). To manage conference planning functions, librarians need to understand event functions such as presentation submission, program scheduling, registration and third-party payment systems, proceedings publishing, and archiving. In general, they need …

Cyberspace: A Venue For Terrorism, David Bieda, Leila Halawi Jan 2015

Cyberspace: A Venue For Terrorism, David Bieda, Leila Halawi

Publications

This paper discusses how cyberspace has become a venue for terrorists groups for recruiting and proliferating propaganda and terrorism. Moreover, this study explores how the low cost Internet infrastructure and social media sites (such as Facebook, Twitter, and YouTube) have contributed to their networking and operations due to the convenience, in terms of availability, accessibility, message redundancy, ease of use, and the inability to censor content. Concepts such as cyber-weapons, cyber-attacks, cyber-war, and cyber-terrorism are presented and explored to assess how terrorist groups are exploiting cyberspace.
