The Rise And Rise Of The One Percent: Considering Legal Causes Of Wealth Inequality, Shi-Ling Hsu Jan 2015

The Rise And Rise Of The One Percent: Considering Legal Causes Of Wealth Inequality, Shi-Ling Hsu

Emory Law Journal Online

Thomas Piketty's Capital in the Twenty-First Century, which is surely one of the very few economics treatises ever to be a best-seller, has parachuted into an intensely emotional and deeply divisive American debate: the problem of inequality in the United States. Piketty's core argument is that throughout history, the rate of return on private capital has usually exceeded the rate of economic growth, expressed by Piketty as the relation r > g. If true, this relation means that the wealthy class'who are the predominant owners of capital'will grow their wealth faster than economies grow, which means that relatively speaking, the nonwealthy …

Adequate Disclosures In 140 Characters Or Less-Analysis Of How Endorsers Should Approach Advertising On A Platform With Character Limitations, Jacob Hughey Jan 2015

Adequate Disclosures In 140 Characters Or Less-Analysis Of How Endorsers Should Approach Advertising On A Platform With Character Limitations, Jacob Hughey

Emory Business Law Review

Social media websites such as Twitter and Facebook have transformed the way businesses and individuals market their products and services. These websites have given advertisers and promoters the ability to advertise directly to consumers who would most likely be interested in their product or service. However, advertising on social media can also bring an increased risk of consumer deception. As a result, several federal agencies have published guidance on how companies should proceed with advertising on social media sites and have been monitoring how companies advertise on character-limited platforms. For example, the FDA recently issued a warning to the makers …

The Changing Landscape Of Trademark Law In Tinseltown: From Debbie Does Dallas To The Hangover, John Tehranian, Mark Bartholomew

Contributions to Books

This Essay, a chapter published in the book Hollywood and the Law (Palgrave Macmillan / British Film Institute, 2015), explores how courts have sought to balance the competing interests at stake when filmmakers make unauthorized uses of trademarks in their work and brand owners threaten liability for infringement. Using the seminal Rogers v. Grimaldi decision as a key pivot point, the Essay traces the remarkable change in approaches that courts have taken to First Amendment defenses in trademark cases in the past few decades. In presenting case studies of two opinions -- Dallas Cowboys Cheerleaders, Inc. v. Pussycat Cinema, Ltd. …

Which Witch?: Morgan Le Fay As Shape-Shifter And English Perceptions Of Magic Reflected In Arthurian Legend, Cheyenne Oliver

Electronic Theses and Dissertations 2010 - 2019

Descended from Celtic goddesses and the fairies of folklore, the literary character of Morgan le Fay has been most commonly perceived as a witch and a one-dimensional villainess who plagues King Arthur and his court, rather than recognized as the legendary King’s enchanted healer and otherworldly guardian. Too often the complexity of Morgan le Fay and her supernatural abilities are lost, her character neglected as peripheral. As a literary figure of imaginative design this thesis explores Morgan le Fay as a unique “window” into the medieval mindset, whereby one can recover both medieval understandings of magic and female magicians. By …

Expression Of A Dehydrin From The Polar Plant Cerastium Arcticum In Transgenic Tobacco, William Hill

Electronic Theses and Dissertations 2010 - 2019

Water scarcity induced by drought, temperature, and salinity has plagued agricultural sustainability in recent years with unprecedented revenue losses, raising concerns for worldwide food security. Recent studies have revealed unique botanical response mechanisms to combat water related stress, namely the expression of proteins known as the dehydrins. Dehydrin proteins have been shown to serve various intracellular protective functions. The gene for a SK5 type dehydrin from the arctic plant Cerastium arcticum (CaDHN) was introduced into tobacco plants and water deficit tolerance was evaluated. Plants overexpressing CaDHN displayed improved tolerance to salt stress, but no improvement was observed under drought stress.

The Rhetoric Of Law And Love: Legally (Re)Defining Marriage, Volrick Wallace Higgs Jan 2015

The Rhetoric Of Law And Love: Legally (Re)Defining Marriage, Volrick Wallace Higgs

Electronic Theses and Dissertations 2010 - 2019

In just over one year since United States v. Windsor— the case invalidating sections of the Defense of Marriage Act (DOMA) that defined marriage, for purposes of federal statutes, as the “union of man and woman”— more than a dozen states have had their same-sex marriage bans ruled unconstitutional. This suggests a shift in legal meaning; previously successful arguments against same-sex “marriage” now seem irrational as argumentative ground has shifted. Since favorable rulings redefine “marriage” to include same-sex unions, this thesis analyzes Kitchen v. Herbert, a 2014 legal opinion from the United States Court of Appeals Tenth Circuit, to understand …

Transport Of Seawater And Its Influence On The Transverse Tensile Strength Of Unidirectional Composite Materials, Maryann Fichera Jan 2015

The objective of this research was to characterize the seawater transport and its effect on the transverse tensile strength of a carbon/vinylester composite. The moisture contents of neat vinylester and unidirectional carbon/vinylester composite panels immersed in seawater were monitored until saturation. A model for moisture up-take was developed based on superposition of Fickian diffusion, and Darcy’s law for capillary transport of water. Both the predicted and measured saturation times increased with increasing panel size, however the diffusion model predicts much longer times while the capillary model predicts shorter time than observed experimentally. It was also found that the saturation moisture …
