It will be argued in this article that the EU Recommendation on common principles for collective redress might have limited impact on the field of competition law due to: several uncertainties regarding the legal standing in class actions; difficulties in their funding; and the risk of forum shopping with cross-border actions. Neverthe-less, Belgium and Great Britain have recently introduced class actions into their national legal systems and addressed some of the difficulties which other Member States were experiencing already. It will also be suggested that the Portuguese model – the ‘Popular Action’ – and recent Portuguese practice may be considered …

Unaccompanied & Denied: Regional Legal Framework For Unaccompanied Minors Asylum Seekers (Umas), Rohaida Nordin, Jennifer Whelan, Saidatul Nadia Abd. Aziz, Meerah Deiwi Rajagopal
Indonesia Law Review
Unaccompanied minor asylum seekers are vulnerable and thus, provided special international law protections. However, in reality, they are being mistreated as illegal immigrants and on the receiving end of ethnic violence, discrimination, restrictions in enjoyment of their rights duly recognised by international human rights law. This article identifies legislative, policy and support mechanisms which encompass the minimum UMAS guardianship standards at international law and which are evidence-based from best practice models for the provision of guardians for UMAS internationally. Surface Plasmon Resonance (SPR) refers to the coupling between the electromagnetic wave and the surface plasmonic wave (SPW) on the surface between a metal and a dielectric medium. Since last decade, the SPR behavior is widely applied in prism based SPR sensor, which is bulky and not suitable for remote monitoring applications. To overcome this limitation, photonic crystal fiber (PCF) based SPR sensor had attained great attention with the advantages of easily launching light through the fiber, small-size and design flexibility. The research aim is to produce a competent teaching material in the subject of Plantae regnum with guided inquiry model for ten graders of SMAN 1 Ngunut. 4D development models from Thiagarajan was used. Teaching materials were validated and applied to students in ten graders of SMAN 1 Ngunut. The assessing result of experts expressed that teaching’s material is valid. The result of development test in ten graders expressed that LKS and assessment are valid. Important note from development test was used to complete the quality of teaching’s material.

This research aims at (1) producing the science instructional materials for SMP based on salingtemas and guided inquiry to build the integrated understanding; (2) discovering the validity and reliability levels of the instructional materials, namely Syllabus, Lesson Plans (RPP), Assessment Instruments, and Students’ Worksheet (LKPD). This research used development research design 4D model suggested by Thiagarajan and limited only to the development level. Ethical Dilemma And Nihilism In Munro's "Passion", Xiying Liu, Hongbin Dai

In their article "Ethical Dilemma and Nihilism in Munro's 'Passion'" Xiying Liu and Hongbin Dai discuss ethical issues in Alice Munro's short story "Passion." When attempting to escape the shackles of multiple ethical identities, the short story's protagonist Grace encounters dilemmas and in consequence makes wrong decisions with regard to the principle of ethics. The other protagonist of the story, Neil, commits suicide demonstrating that he breaks off all relationship with the world. Liu and Dai argue that Neil's death deconstructs Grace's ethical dilemmas and thus the narrative constructs a sense of nihilism. Liu and Dai posit that Munro's short …

In her article "Perspectives of Ethical Identity in Ng's Steer toward Rock and Jen's Mona in the Promised Land" Hui Su examines Fae Myenne Ng's and Gish Jen's novels. In the novels, the protagonists make different decisions: in Steer Toward Rock Jack after displacement in China adopts US-American identity and in Mona in the Promised Land Mona, a second generation Chinese American, selects Jewish identity. In her article "Ethical Discourse and Narrative Strategies in Yan's老师,好美 (To My Teacher, with Love)" Zhuo Wang discusses the way in which narrative converges with ethics at the site of a radical "ethical environment" in Geling Yan's novel. Wang focuses on how the novel's first-person confessional narration, third-person reflective narration, and online narration dialogue with and interrogate one another working together to bring forth Yan's reconsideration of the ethical dimensions of her text. In his article "Ethical Dilemma and Ethical Epiphany in McEwan's The Children Act" Biwu Shang attempts to explore the ethical nature of the child's welfare in Ian McEwan's novel. Shang examines the various legal cases processed by the British High Court judge Fiona Maye and the blood transfusion case of Adam Henry in particular. Shang argues that Maye adopts ethical criteria throughout the cases she deals with. In her article "Human Cloning as the Other in Ishiguro's Never Let Me Go" Wen Guo analyzes Kazuo Ishiguro's novel with focus on Ishiguro's analogy between human cloning and people of marginality in contemporary society. Guo discusses the novel's ambience of doubt and suspense and elaborates on how the theme of otherness is addressed by Ishiguro's mock-realism in a landscape of science fiction. The Civilian Conservation Corps employed young white and black men between the ages of eighteen and twenty-five. In 1935 Robert Fechner, the Director of the Civilian Conservation Corps, ordered the segregation of Corps camps across the country. Massachusetts’ camps remained integrated due in large part to low funding and a small African American population. The experiences of Massachusetts’ African American population present a new general narrative of the Civilian Conservation Corps. The Federal government imposed a three percent African American quota, ensuring that African Americans participated in Massachusetts as the Civilian Conservation Corps expanded. The Restatement (Second) and Restatement (Third) of the Foreign Relations Law took notably different approaches to treaty interpretation, reflecting intervening changes in the legal landscape. This symposium contribution identifies five developments in international and domestic law since the Restatement (Third). It then considers their import for the forthcoming Restatement (Fourth). Most importantly, it argues that the Restatement (Fourth) should fully incorporate two articles on treaty interpretation from the Vienna Convention on the Law of Treaties into its black-letter provisions. The Restatement (Fourth) of Foreign Relations Law of the United States has thus far focused on the status of treaties in United States law, and has not specifically considered the topic of customary international law. While the American Law Institute undoubtedly has good reasons for its approach, there is an emerging presidential practice that should catch the attention of the drafters and encourage them to make at least a small foray into customary international law’s impact on the domestic law of the United States. In her article "Narrative Ethics and Alterity in Adichie's Novel Americanah" Nora Berning analyses Chimamanda Ngozi Adichie's novel through the lens of a narrative ethics of alterity. Focusing on the notion of alterity, Berning argues that a specific turn-of-the-century ethics emerges in contemporary fictions of migration in general and in intercultural novels in particular. An ethical genre in its own right, such twenty-first century fictions as Americanah generate a particular kind of ethical knowledge that revolves around questions of identity and alterity and around individual and collective perceptions of self and other. In his article "Ethics of Counter-Narrative in DeLillo's Falling Man" Qingji He analyzes Don DeLillo's counter-narrative in his post-9/11 novel Falling Man. The objective is to show how ethical dimensions function fundamentally in formulating an appropriate counter-narrative and why DeLillo's counter-narrative echoes views expressed in his "In the Ruins of the Future." He argues that DeLillo's counter-narrative entails the necessity of ethical consciousness and responsibility.
