Navigating A "Legal Black Hole": The View From Guantanamo Bay, Carlos Warner Dec 2015

Navigating A "Legal Black Hole": The View From Guantanamo Bay, Carlos Warner

ConLawNOW

This article discusses the unique and perhaps bizarre litigation surrounding the detainees held in Guantanamo Bay, Cuba by the United States Government. The article describes in detail the development of the litigation making “meaningful judicial review” impossible for the detained men. The article also describes how one attorney has strategically advanced the causes of his clients in spite of restrictive classification of material and impossible legal standards. The article describes the conditions and logistics surrounding visiting clients in Guantanamo and litigating cases.

Finally, the article concludes that the only way to "win" the Guantanamo litigation is through a "Dada" approach …

The Unconstitutionality Of Ohio's House Bill 125: The Heartbeat Bill As Analyzed Under The First Amendment Of The United States Constitution, Jessica L. Knopp Dec 2015

The Unconstitutionality Of Ohio's House Bill 125: The Heartbeat Bill As Analyzed Under The First Amendment Of The United States Constitution, Jessica L. Knopp

ConLawNOW

This article examines the constitutionality of Ohio’s controversial House Bill 125 (“H.B. 125”), which includes new restrictions and requirements for abortion procedures performed in Ohio. The author argues that, while the new abortion measures conflict with the Supreme Court’s Fourteenth Amendment jurisprudence established in Roe v. Wade and in Planned Parenthood v. Casey, H.B. 125 also violates the Establishment Clause of the First Amendment by imputing religious beliefs about conception and the value of life onto all Ohioans.

The article first outlines the current legal framework for constitutionally acceptable and unacceptable abortion restrictions, including a discussion of informed consent …

Why It Is Not Unreasonable For The Police To Refuse To Provide A Copy Of The Search Warrant At The Outset Of The Search, M. Jackson Jones M.S. Dec 2015

Why It Is Not Unreasonable For The Police To Refuse To Provide A Copy Of The Search Warrant At The Outset Of The Search, M. Jackson Jones M.S.

ConLawNOW

This article presents numerous reasons why it would not be unreasonable for the police to refuse to provide an occupant of the premises a copy of the search warrant at the outset of the search when an occupant of the premises is present and poses no threat to the officers’ safe and effective performance of their mission. First, neither the plain text of the Fourth Amendment nor the plain text of Federal Rule 41 requires it. Second, there are numerous constitutional and statutory protections that ensure the executing official does not wrongfully execute the warrant.

In essence, requiring the police …

The Potential Tension Between A "Free Marketplace Of Ideas" And The Fundamental Purpose Of Free Speech, M. Neil Browne, Justin Rex, David L. Herrera Dec 2015

The Potential Tension Between A "Free Marketplace Of Ideas" And The Fundamental Purpose Of Free Speech, M. Neil Browne, Justin Rex, David L. Herrera

ConLawNOW

The authors argue that the marketplace of ideas is not competitive in the economic sense. Yet the Court often rules as if it is. What are the implications?

By assuming often that the idea market is competitive, Justices are committing the reification fallacy. They are treating an abstract belief or hypothetical construct as if it represented a concrete event or physical entity. In this instance, the Justices assume that existing markets are structured the same way idealized competitive markets are. In doing so, they treat the marketplace of ideas as inherently good, when in fact one must first determine what …

Using Technology To Improve The Interview As A Selection Tool, Brad A. Chambers, John D. Arnold

Personnel Assessment and Decisions

Using the extant literature on best practices in the selection interview, this paper describes a technology-based selection interview system. The process includes interviewer training and certification, and the construction of standardized interview guides. Linked to a common set of human abilities and skills, answers to the questions and probes are evaluated using behaviorally anchored rating scales for each of a number of competency elements. The process described can be used to help ensure quality interviewing practices following these principles are used in organizations conducting multiple interviewers at different sites. How to use this process to address various research objectives is …

The Failure Of The Canadian Human Rights Regime To Provide Remedies For Indigenous Peoples: Enough Time Has Passed, Jeffery Gordon Hewitt Dec 2015

The Failure Of The Canadian Human Rights Regime To Provide Remedies For Indigenous Peoples: Enough Time Has Passed, Jeffery Gordon Hewitt

LLM Theses

In 2008, Canada amended the Canadian Human Rights Act to remove s.67, which in essence precluded Indigenous Peoples from bringing complaints as against Canada and Band governments. Since the amendment took effect in 2010, a multi-fold increase has occurred in the number of complaints filed with the Human Rights Commission of Canada from dozens to hundreds. The first such significant complaint to be heard by the Canadian Human Rights Tribunal was filed by the First Nation Child and Family Caring Society along with the Assembly of First Nations (the Complaint). The Complaint alleges Canada's funding with respect to First Nation …

Letter From The Editor: Farewell!, Jennifer Ortiz

GWU-Today

Change is inevitable. That’s seen clearly through Gardner-Webb’s shift from a physical student newspaper, The Pilot, to an online-only publication five years ago. It’s seen clearly through the new batch of student journalists, photographers and videographers who volunteer, contribute or sign up for the one credit course each semester. They bring in new ideas, interests and new perspectives to the table, and these aspects always change the style of GWU-Today, for better or for worse.

"It's Always With You, That You're Different": Undocumented Students And Social Exclusion, Jean Williams Dec 2015

"It's Always With You, That You're Different": Undocumented Students And Social Exclusion, Jean Williams

Political Science

This study focuses on undocumented college students who overcame significant barriers to apply to and attend universities, and once on campus, were forced to conceal their immigration status from staff and peers, struggling to pay tuition without assistance from scholarships or federal loans. The concept of social exclusion is used to understand and explore the barriers to their access to higher education and experiences while in college, relationships to community and governing institutions, and struggles with poverty and discrimination. The Obama Administration’s Deferred Action for Childhood Arrivals initiative provides the first real possibility to more fully pursue their educational and …

Big Data Goes To Work: Liberating Latent Value In A Connected World, Peter Coffee Dec 2015

Big Data Goes To Work: Liberating Latent Value In A Connected World, Peter Coffee

Colloquia of the Department of Mathematical Sciences

Conversation around "big data" is too often focused on sheer volume, and the technical challenges of collection. More important are recent findings that roughly 7/8 of organizations look to data as history, not as news: that they use it to document past behavior, seek opportunities for cost reduction, and justify familiar and comfortable strategies and practices. The greater value lies in building predictive tools and recommendation engines that have the power to change behavior and create new value. Peter Coffee, the global VP of Strategic Research for cloud-computing leader Salesforce, will share observations on the engagement and transformation being enabled …

The Effects Of Petroleum Pollutants On Sea Urchins Reproduction And Development, Kellie C. Pelikan Dec 2015

The Effects Of Petroleum Pollutants On Sea Urchins Reproduction And Development, Kellie C. Pelikan

HCNSO Student Theses and Dissertations

Disturbances, such as mass pollution events, threaten the health of vulnerable ecosystems. Recent media attention has focused on the devastating mass oil spills, but daily petroleum input from recreational and commercial ship bilge release has been overlooked. The focus of this study was the effect of petroleum products found in bilge water on fertilization success and larval viability of two sea urchin species, Lytechinus variegatus and Eucidaris tribuloides. Unlike other pollutant studies that have focused on sperm characteristics and concentrations, I chose to examine how egg integrity was compromised by petroleum products. Scanning electron microscopy revealed eggs were degraded when …
