The Rules And The Reality Of Petition Procedures In The Inter-American Human Rights System, Dinah Shelton Jan 2015

The Rules And The Reality Of Petition Procedures In The Inter-American Human Rights System, Dinah Shelton

Notre Dame Journal of International & Comparative Law

In this Essay, Professor Dinah Shelton draws on her personal experience as a member of the Inter-American Commission on Human Rights to discuss the underlying causes of a "crisis of commitment" to the Inter-American system of human rights. Shelton traces the roots of this crisis in large part to the Inter-American petition procedures. Giving an in-depth account of the structure of the Inter-American Commission on Human Rights and the details of the petition procedures, Shelton explores the issues of legitimacy, transparency, effectiveness, and efficiency raised by various aspects of the petitioning process, and discusses the various ways in which these …

How Does The Audit Report's Structure Affect Nonprofessional Investors' Attention To Its Content?, Brian Matthew Goodson Jan 2015

How Does The Audit Report's Structure Affect Nonprofessional Investors' Attention To Its Content?, Brian Matthew Goodson

Electronic Theses and Dissertations

This study experimentally examines whether and how two potential changes to the audit report’s structure affect the extent to which nonprofessional investors attend to the report’s content when evaluating a potential investment, and whether the potential effects differ across levels of investor sophistication. Specifically, I examine the impact of descriptive paragraph headings and the relative location of the opinion paragraph on judgments of financial statement reliability and investment decisions. Results indicate that when the audit report includes descriptive paragraph headings, less sophisticated investors perceive the report to be more readable, which, in turn, leads them to attribute higher levels of …

The Effectiveness Of Teaching Methods In Traditional Amish Schoolhouses In Lawrence County, Tn, Ann Marie Paley Jan 2015

The Effectiveness Of Teaching Methods In Traditional Amish Schoolhouses In Lawrence County, Tn, Ann Marie Paley

Electronic Theses and Dissertations

The Amish community at Ethridge in Lawrence County, Tennessee is one of a handful in Tennessee, and, with a population of 1,500 and more than ten church districts, is the largest in the South and one of the top 20 in the nation. This particular Amish community was colonized when three families led by Dan Yoder, Joe Yoder, and Joseph Gingerich moved to the area from Ohio in the mid-1940s due to problems with the establishment of their own schools. Swartzentruber Amish are a subgroup within Old Order Amish society and occupy a distinct place on the conservative end of …

An Evaluation Of Geophysical Methods In The Detection Of Toddler-Sized Burials During The First Six Months Of Burials, Paul Sullivan Martin Jan 2015

An Evaluation Of Geophysical Methods In The Detection Of Toddler-Sized Burials During The First Six Months Of Burials, Paul Sullivan Martin

Electronic Theses and Dissertations

Geophysical survey has become a major tool in the search for clandestine graves associated with missing person cases. However, relatively little research has been done to evaluate the efficacy of different instruments. Ground-penetrating Radar (GPR), magnetometry, resistivity, conductivity, and susceptibility survey data were collected over the first six months of interment at approximately 30-day intervals for two research plots: an open grassy area and a wooded area. Each area contained five pig burials representing toddler-size (less than 50 pounds) remains and two areas of disturbance or false burials to serve as control graves. The resultant imagery was evaluated in terms …

An Unapologetic Defense Of The Classical Liberal Constitution: A Reply To Professor Sherry, Richard A. Epstein Jan 2015

An Unapologetic Defense Of The Classical Liberal Constitution: A Reply To Professor Sherry, Richard A. Epstein

Faculty Articles

In my response, I undertake three interrelated tasks. The first is to make clear my own view on these substantive issues, and the second is to critique the alternative vision that Sherry tries to advance. The third is to call attention to the inability of progressive constitutionalists like Sherry to develop an alternative theory of their own — an inability Sherry herself acknowledges. At the outset, let me flag a point that I shall elaborate on later. As a matter of first principle I do take the position that a unified conceptual framework should apply to what are called economic …

Interpreting The Rules Of Insurance Contract Interpretation, Mark A. Geistfeld Jan 2015

Interpreting The Rules Of Insurance Contract Interpretation, Mark A. Geistfeld

Faculty Articles

The rules for interpreting insurance policies — the doctrine of contra proferentem for ambiguous policy language, and the doctrine of reasonable expectations for unambiguous language — are surprisingly difficult to define. The rules themselves are ambiguous and subject to differing interpretations, and yet courts have not been clear about which form they have adopted or are otherwise applying in a particular case. In light of this case law, the Restatement of the Law: Liability Insurance faces a daunting problem. Without widespread agreement about the appropriate method for interpreting insurance policies, how can the case law be restated in a manner …

Don't Ask, Must Tell—And Other Combinations, Adam M. Samaha, Lior Jacob Strahilevitz Jan 2015

Don't Ask, Must Tell—And Other Combinations, Adam M. Samaha, Lior Jacob Strahilevitz

Faculty Articles

The military’s defunct Don’t Ask, Don’t Tell policy has been studied and debated for decades. Surprisingly, the question of why a legal regime would combine these particular rules for information flow has received little attention. More surprisingly still, legal scholars have provided no systemic account of why law might prohibit or mandate asking and telling. While there is a large literature on disclosure and a fragmented literature on questioning, considering either part of the information dissemination puzzle in isolation has caused scholars to overlook key considerations. This Article tackles foundational issues of information policy and legal design, focusing on instances …

'Furor' As Failed 'Pietas': Roman Poetic Constructions Of Madness Through The Time Of Virgil, Emily A. Mcdermott Jan 2015

'Furor' As Failed 'Pietas': Roman Poetic Constructions Of Madness Through The Time Of Virgil, Emily A. Mcdermott

Classics & Religious Studies Faculty Publication Series

Roman poetic portrayals of mad characters through the time of Virgil construct a fundamental opposition between madness, an ipso facto self-absorbed or egoistic condition, and sanity, which duly fixes its gaze outside of itself, on parents, forebears, and the walls of state. The poets conceptualize furor less as what a modern sensibility would label insanity or mental illness than as a passion-fueled state antithetical to social order, able to be held in check only by rigorous adherence to the duty-oriented cultural code of pietas. In this moralized conception of madness, erotic furor is not a metaphorical by-path but a …

Development And Validation Of An Instrument To Measure Moral Distress Among Counselors Working With Children And Adolescents, Ian Scott Turnage-Butterbaugh Jan 2015

Development And Validation Of An Instrument To Measure Moral Distress Among Counselors Working With Children And Adolescents, Ian Scott Turnage-Butterbaugh

Electronic Theses and Dissertations

Falender and Shafranske (2004) stated it is “essential for clinicians to develop and understanding of all the influences, from conscious beliefs and culturally embedded values to unresolved conflicts at the margin of awareness, that contribute to clinical practice” (p. 81). The purpose of this study was to meet this professional imperative by developing an instrument designed to assess moral distress among counselors working with children and/or adolescents. Using open-ended surveys and semi-structured interviews, detailed descriptions of participants’ experiences of moral distress were obtained in order to gain an initial understanding of the ways in which the phenomeonon is experienced in …

Female Representations In Contemporary Postmodern War Novels Of Spain And The United States: Women As Tools Of Modern Catharsis In The Works Of Javier Cercas And Tim O'Brien, Joseph P. Weil Jan 2015

Female Representations In Contemporary Postmodern War Novels Of Spain And The United States: Women As Tools Of Modern Catharsis In The Works Of Javier Cercas And Tim O'Brien, Joseph P. Weil

Theses and Dissertations

In this thesis, the notion of women being used as tools of modern catharsis is explored through the comparative analysis of the Spanish novel Soldiers of Salamis (2001) by Javier Cercas, and the American novel The Things They Carried (1990) by Tim O’Brien. The two novels, separated by linguistic and national traditions, and personal choices by each author, will both be evaluated for their unique postmodern treatments of war, memory, and verisimilitude. Expanding from this base and through an application of feminist theory, the female representations—which are partly crafted by an unconscious masculine language—will be deconstructed for their intended and …

Revival Of The Fittest: A Return To Writer Subjectivity In Composition, Ashley Mcclary Jan 2015

Revival Of The Fittest: A Return To Writer Subjectivity In Composition, Ashley Mcclary

Theses and Dissertations

Writing can be unpleasant. And most examples of good writing start from early attempts to identify a partial understanding of complex, complicated concepts that emanated from a willingness to be honest and open and smart about the surrounding world. The inception of a good text—especially when paired with the strength to fulfill an incessant, ridiculous desire to tell a truth—can produce an affected writing sample, one of purpose and presence. In the field of Composition, when instructors ask students to write and suggest they do it well, it is easy to overlook the demand that students take new risks in …

Mourning, Melancholia, And The Need For Grace In Sherwood Anderson's "Godliness", Victoria Chandler Jan 2015

Mourning, Melancholia, And The Need For Grace In Sherwood Anderson's "Godliness", Victoria Chandler

Theses and Dissertations

Published in 1919, Sherwood Anderson’s Winesburg, Ohio engages in the modernist project of collective grieving for social losses. This thesis looks specifically to Seth Moglen’s Mourning Modernity, in which he articulates the various grieving strategies, mourning and melancholia, employed by modernists in order to process their rapidly changing world. I explore the various ways that “Godliness,” one of Anderson’s stories in Winesburg, engages in both mourning and melancholia, and I draw on Ruth Levitas’ notion of secular grace, from her book Utopia as Method, in order to suggest that modernist subjects need a form of secular grace in …

The Sensory Environments Of Civil War Prisons, Evan A. Kutzler Jan 2015

The Sensory Environments Of Civil War Prisons, Evan A. Kutzler

Theses and Dissertations

The dissertation explores the experiences of four hundred thousand Union and Confederate prisoners during the American Civil War. While much has been written on the overlapping experiences of soldiers, civilians, and slaves, less attention has been paid to those behind masonry walls or wooden stockades. The premise of the dissertation, borrowed from the theory and methodology of sensory history, is that while human sensory physiology changes slowly over time, perception is fluid and varies by time, place, and culture. Drawing from nearly two hundred unpublished manuscripts as well as newspapers, government records, and postwar narratives, this dissertation explores the experiences …

Exploring Culturally Relevant Teaching: Lessons From A Middle School Classroom, Kristen H. Gillaspy Jan 2015

Exploring Culturally Relevant Teaching: Lessons From A Middle School Classroom, Kristen H. Gillaspy

Theses and Dissertations

In the public school setting and beyond, African American males are often positioned as a problem. Educators have implemented and studied the use of culturally relevant pedagogy (CRP) in an effort to shift this deficit perspective of African American male students, as well as other students of color. CRP positions all students as knowledgeable and capable of learning while valuing their cultural backgrounds and experiences. CRP also provides an opportunity to explore issues around race and culture. Though some research has been done in the area of CRP, very little focuses on the students’ experiences in culturally relevant classrooms, and …
