Delaware Corporate Law Recognizes The Fundamental Validity Of The Forum Selection Bylaw: A Survey Of The Boilermakers Litigation, Zachary R. Cormier
Delaware Corporate Law Recognizes The Fundamental Validity Of The Forum Selection Bylaw: A Survey Of The Boilermakers Litigation, Zachary R. Cormier
The Journal of Business, Entrepreneurship & the Law
Boilermakers Local 154 Retirement Fund v. Chevron Corp. represents a new and important chapter in the relationship between the forum selection clause and modern business relations. A forum selection clause is “[a] contractual provision in which the parties establish the place (such as the country, state, or type of court) for specified litigation between them.” Forum selection clauses have most often been analyzed by courts within contractual relationships between businesses, or a business and its customers. The Boilermakers case sets important precedent for forum selection in an equally fundamental business relationship--the corporation and its stockholders. This article will survey the …
Breaking The Mold: Thinking Beyond Deficits, Elyse Hambacher, Winston Charles Thompson
Breaking The Mold: Thinking Beyond Deficits, Elyse Hambacher, Winston Charles Thompson
Education
In an attempt to understand widespread school failure among children of color and children from low-income backgrounds, dominant discourse points to pervasive deficit ideologies that blame a student’s family structure, cultural and linguistic background, and community (Dudley-Marling, 2007; Valencia, 2010; Weiner, 2006). By accepting such a simplistic explanation of blaming the child for a lack of success without examining systemic inequities, deficit thinkers ignore real and complex issues of structural inequity. We agree with Pearl (1997) who argues that deficit thinking ignores “external forces— [i.e.], the complex makeup of macro- and micro-level mechanisms that help structure schools as inequitable and …
Inner Sound: Contemporary Abstract Photography In The Wet-Plate Collodion Process, Brian Barger
Inner Sound: Contemporary Abstract Photography In The Wet-Plate Collodion Process, Brian Barger
Masters Theses, 2010-2019
My work is Neo-Romantic in nature. This description implies a rejection of all that is tedious, mundane, and ugly in the modern world, in favor of looking to history, nostalgia, and mystery for inspiration. I intend for the work to be dreamlike and evocative of fantasy, to be poetic rather than prosaic, and to be beautiful rather than purposeful.
To this end, I am investigating abstraction in photography through the use of the wet-plate collodion process. The work is intended to reference spirituality and the subconscious, through the use of the abstraction of nature and natural forms, using the inherent …
Let’S Chat: Willingness To Communicate And The Development Of A Destigmatizing Campaign, Ethan D. Smith
Let’S Chat: Willingness To Communicate And The Development Of A Destigmatizing Campaign, Ethan D. Smith
Masters Theses, 2010-2019
Abstract
Low treatment rates for depression are commonly observed among young adults of typical college age in particular. Fear of social judgement makes stigma a commonly identified barrier to depression treatment. What is unclear is how the willingness of university students to communicate about depression may influence or be influenced by stigma. Guided by the Theory of Planned Behavior and the Health Belief Model, the present thesis investigates the stigma attitudes of students toward depression, as well as their willingness to communicate about depression. To do this, an online survey was conducted with depression stigma scales and adapted willingness to …
Policing Charities: A Genealogy Of The American Nonprofit In The Context Of Neoliberalism, Jaclyn Carroll
Policing Charities: A Genealogy Of The American Nonprofit In The Context Of Neoliberalism, Jaclyn Carroll
Masters Theses, 2010-2019
This project offers a critical rhetorical history of “the nonprofit” over the last 50 years of American political discourses. The author explicates the value of genealogy and rhetorical history as methodologies in critical communication studies. She then examines three discursive junctures. Beginning with Ronald Reagan’s public addresses and his deployment of the neoliberal epideictic, the author traces different rhetorical treatments of “the nonprofit.” The author then examines the emergence of nonprofit watchdogging agencies in the 1990s, and discourses of surveillance and resistance that developed at this time. Particular attention is paid to the discursive shifts surrounding September 11, 2001.

Blood From Blood And Earth From Earth: Examining Cultural Identity In Second And Third Generation Hispanic Americans, Caroline E. Culbreth
Blood From Blood And Earth From Earth: Examining Cultural Identity In Second And Third Generation Hispanic Americans, Caroline E. Culbreth
Mahurin Honors College Capstone Experience/Thesis Projects
To what extent does a Mexican American identify with Mexico? With the U.S.? How are these identities formed? Through a series of semi-structured interviews with second- and third-generation descendants of migrants emigrating from seven Spanish-speaking Latin American countries, I explore what it means to be Hispanic American. I begin by examining the informants’ perceptions of boundaries between the broad Hispanic and American ethnic groups and their self-defined positions relative to those boundaries. Having established this position, I then analyze the impact of external conceptions of authenticity and access to “ethnic raw materials” in their construction of this ethnic identity. Findings …

A Theatrical Approach To Raising Awareness Of Human Sex Trafficking Across The Globe, Gwenn Gideon
Honors Theses
As a culmination of my theatrical studies and other academic and personal interests developed over my four years at Bucknell University, I conducted a yearlong project that raised awareness of human sex trafficking in the 2014-2015 academic year. My project was composed of three distinct parts that included facilitating in-class workshops, public workshops, and directing a staged reading. The overall goal of this project was to raise awareness of human sex trafficking, get people interested and involved in the project, and give people the information they need to do more. This project was a THEA 319 Independent Study that was …

The current study assessed the effectiveness of Teacher Child Interaction Training (TCIT), an adaptation of Eyberg’s Parent Child Interaction Therapy (PCIT), on teacher and child behaviors in preschool and kindergarten classrooms. The sample included four classrooms in urban, socioeconomically disadvantaged and culturally diverse settings. Two preschool classrooms were included in the first study and one preschool and one kindergarten classroom were included in the second study. Both studies used a concurrent multiple baseline design to evaluate the effects of training and coaching on teacher and child behaviors in the classroom. The intervention focused on the development of a friendly attachment …
The Evaluation Of A Dual Language Reading Club For English Language Learner Students, Sandra M. Gonzalez
The Evaluation Of A Dual Language Reading Club For English Language Learner Students, Sandra M. Gonzalez
Educational Specialist, 2009-2019
Reading is a crucial skill in our society that is needed in personal growth and academic achievement; it is a prominent area of concern in our schools and students. Schools in the U.S. are experiencing a substantial increase of students whose first language is not English and/or do not speak fluent English and are known as English Language Learners (ELLs). These students are typically at risk for having problems with reading if they do not receive the proper or adequate support and intervention. Many ELL students struggle in their ability to read at a proficient level, which has multiple negative …

Post-Traumatic Stress Disorder Within Refugee Populations And Its Effects On Acculturation Into The United States, Brittany Burk
Post-Traumatic Stress Disorder Within Refugee Populations And Its Effects On Acculturation Into The United States, Brittany Burk
Celebration of Learning
The focus of this Honors Capstone research was to better understand the process through which a refugee acculturates into U.S. society. To do this, the effects of post-traumatic stress disorder, cultural differences, United States citizens’ perceptions of refugees, and other challenges were addressed. A survey was conducted involving citizens’ perceptions of refugees, and revealed that individuals’ perceptions were determined by refugee status, PTSD and/or situational differences, depending on the scenario being described. This research seeks to address the problems faced by refugees entering the United States and proposes some solutions to provide a better transition into the U.S. culture by …
Alzheimer's Disease And The Importance Of Music Therapy, Patricia Kautenberger
Alzheimer's Disease And The Importance Of Music Therapy, Patricia Kautenberger
Celebration of Learning
Worldwide, statistics suggest that by the year 2050 as many as 80 million individuals will be living with Alzheimer’s disease (AD). Because current pharmacological interventions can only slow its progression, the pathology eventually overcomes the benefits of the medications, thus leaving a deficit in long-term treatment. However, the preservation of the brain’s ability to work with and benefit from music has created a window of opportunity for an alternative treatment. Music therapy has been shown to be a promising alternative treatment because it has very little risk, and studies suggest that it is effective in improving familiarity and recollection in …

Visual Narratives And Metaphors As Tools For Teaching In The Foreign Language Classroom: A Sociocultural And Critical Perspective, Mónica Alexandra Durán
Open Access Dissertations
This dissertation studies the teaching of visual and metaphorical representations as thinking tools in second language (L2) classrooms from a Sociocultural Theory (SCT) framework. It explores metaphorical representations in narrative and visual texts to advance the practice of appropriating new language abilities to produce a new text that is contextualized and meaningful to learners of Spanish as a Second Language. By providing L2 Learners early in the process with accessible conceptual and representational tools, they may gain a personally significant awareness of the richness of language and of the power of their communicative abilities beyond everyday interactions. Creative writing and …

Objective evaluation of language function is critical for children with intractable epilepsy under consideration for epilepsy surgery. The purpose of this preliminary study was to evaluate word recognition in children with intractable epilepsy by using magnetoencephalography (MEG). Ten children with intractable epilepsy (M/F 6/4, mean ± SD 13.4 ± 2.2 years) were matched on age and sex to healthy controls. Common nouns were presented simultaneously from visual and auditory sensory inputs in “match” and “mismatch” conditions. Neuromagnetic responses M1, M2, M3, M4, and M5 with latencies of ∼100ms, ∼150ms, ∼250ms, ∼350ms, and ∼450ms, respectively, elicited during the “match” condition were …

2015 Claremont Colleges Library Undergraduate Research Award
This study explores the role that a Southern-California nonprofit, community-based organization, called Building Bridges, plays in the lives of low-income, Mexican immigrants. Using participant observations of the different events and gatherings at the site combined with several interviews conducted with parents, students, and staff, this study analyzes the process by which families enter Building Bridges and create a sense of community. Results revealed the significance of homophily in the way the organization initially earns the trust of the families that are trying their programs; the services that meet the perceived needs and aspirations of the community; and the impact of …

Finding ‘A Heart To Continue:’ A Study Of Constructive-Developmental Diversity And Academic Literacy Learning Experiences In The Adult English As A Second Or Other Language (Esol) Classroom, Jennifer Rae Ouellette-Schramm
School of Education and Leadership Student Capstone Theses and Dissertations
Developing academic literacy skills is becoming increasingly high-stakes for Adult Basic Education (ABE) English as a Second or Other Language (ESOL) learners to accomplish goals like passing the General Education Diploma (GED) test or preparing for post-secondary. ESOL literature suggests that academic literacy development is not only a language issue, but a cognitive and academic phenomenon. Related to an adult learner’s cognitive and academic learning is stage of epistemological complexity. Theories of adult epistemological development, including constructive-developmental theories, are based on empirical research demonstrating that the logics through which adults construct meaning can continue to develop over time following predictable …

Negotiating The Federal Accommodation: Minorities And The Issue Of The National Question In Nigeria, Tunde Agara
Journal of Global Initiatives: Policy, Pedagogy, Perspective
Ethnic minority tensions and agitations in Nigeria are important features of the on-going struggle to resolve the “national question” through convening the Sovereign National Conference, all in a bid to dialogue and negotiate a true federal system that incorporates and accommodate the minorities within the federal system. This paper suggests that the minority issue in Nigeria is deeply rooted in the complex triad of pre-colonial, colonial and post-colonial historical and structural processes that have foisted and institutionalized the oppressive hegemony of the country’s three major ethnics over the minorities. To further illuminate this perspective, we have adopted Edward Azar’s Protracted …

Beyond The Physical:Exploring The Function Of Disease In Selected Words Of 19th- And 20th- Century French Literature, Cassandra Maria Ricci
Honors Theses
My thesis, Beyond the Physical, is a project that aims to investigate the function of disease in 19th and 20th century French literature through the analysis of the narrative techniques of three fictional novels and secondary sources. This work is an interdisciplinary study that combines the social and scientific aspects of Public Health with literary elements present in French and Francophone Studies. In La Cousine Bette (1847), a Realist novel by Honoré de Balzac, Valérie Marneffe's obsession with greed and attention leads her to pursue various extramarital affairs in her efforts to augment her financial status. Her death by syphilis …

A Linguistic Phenomenon: Code-Switching In Media And Advertisement, Rebecca E. Cline Tuck
Symposium of Student Scholars
The purpose of this paper is to examine the linguistic phenomenon of code-switching in two different forms of communication: social media and traditional advertising. Code-switching, most common among bilinguals, is the practice of expressing ourselves in conversation, the act of altering the languages we speak, or the ability to switch back and forth between two different languages simultaneously. We all do it, albeit, inadvertently at times, whether it is to fit in, stand out, be understood, emphasize a point, or deliver a message. Throughout this paper, I will analyze code-switching found in a popular actress’ social media account as well …

Misuse Of Information Under The Computer Fraud And Abuse Act: On What Side Of The Circuit Split Will The Second And Third Circuits Wind Up?, Robert D. Sowell
Florida Law Review
The Computer Fraud and Abuse Act (CFAA) has reached a breaking point. The much-discussed issue is whether the CFAA provides a cause of action against persons who use electronic information in a way that violates a relevant computer-use policy. Four circuit courts of appeals have held that the CFAA provides a cause of action for misuses of information, while two have disagreed. In two undecided circuits, the district courts have favored the latter interpretation. As the Supreme Court recently refused to address the issue, these two undecided circuits will play a pivotal role in determining the direction of the CFAA.
Democracy, The Constitution, And Legal Positivism In America: Lessons From A Winding And Troubled History, Edward A. Purcell Jr.
Democracy, The Constitution, And Legal Positivism In America: Lessons From A Winding And Troubled History, Edward A. Purcell Jr.
Florida Law Review
This Article explores the political and philosophical background of the current debate between positivist “originalism” and evolutionary “living constitutionalism” and, more generally, the significance of positivist ideas for both democratic and constitutional theory. Noting the tensions between positivist and nonpositivist ideas that existed in early American constitutionalism, it focuses on the impact of John Austin’s theory of legal positivism in the United States after the Civil War and the way successive generations of Americans interpreted positivist ideas to develop their theories of democracy and constitutionalism. It argues that Austin inspired rival jurisprudential approaches that quickly, but misleadingly, became entangled with …

This paper is an autoethnography, which is a study of me and of my teaching. Through reflecting on my life as a student and a teacher, I have found that the difference between standardization and differentiation has stuck out and influenced both my learning and my teaching. I have chosen to focus on these two areas of education in looking at assessment and instruction. This paper weaves together a review of literature of differentiation, standardization and the history of standardized testing with anecdotes from my life. Throughout this process I will look at the question, “How does one differentiate in …

In the Capstone, I will explore one of the most intense football clashes in history: El Clásico (The Classic), which refers to a match-up between Real Madrid C.F. and FC Barcelona. When these most successful football clubs meet on the field for 90 minutes of intense action, it soon becomes very clear that this is much more than just a game or just sports. The field can be seen as a battleground, and the game could be a substitute for war between two ideologies, cultures, and social classes. This rivalry has a real and profound political tone, which goes back …
