Extending The Reach Of Legal Aid: Report On The Pilot Phase Of The Legal Health Check-Up Project, Ab Currie

Canadian Forum on Civil Justice

Research makes clear that legal service delivery, especially to the poor, fails dramatically if clients must find their own way to legal aid offices. The Legal Health Check-Up project addresses this by extending legal aid in partnership with trusted intermediary groups that are part of the everyday world of disadvantaged groups. These intermediaries make an active offer of legal service. It is hoped that the intermediaries will go beyond the gateway roles of problem-spotting and legal referral to – with the legal aid clinic – provide holistic and integrated legal services that otherwise would not be available.

Licensing Health Care Professionals, State Action And Antitrust Policy, Roger D. Blair, Christine Piette Durrance May 2015

Licensing Health Care Professionals, State Action And Antitrust Policy, Roger D. Blair, Christine Piette Durrance

UF Law Faculty Publications

In this Essay, we raise some economic concerns about the wisdom of conferring antitrust immunity on professional licensing boards, which are often comprised of members of the profession and therefore apt to be motivated by self-interest rather than the public interest. In Part II, we examine the political economy of special interest legislation, which suggests that little public good results from replacing competitive market forces with self-regulation. In Part III, we employ a basic economic model to generate predictions of the economic effects of professional licensing. Part IV provides a survey of the empirical research in this area, which confirms …

The Guiding Hand Of Counsel: Effective Representation For Indigent Defendants In The Cordele Judicial Circuit, Lesley Rowe May 2015

The Guiding Hand Of Counsel: Effective Representation For Indigent Defendants In The Cordele Judicial Circuit, Lesley Rowe

Mercer Law Review

The right to be heard would be, in many cases, of little avail if it did not comprehend the right to be heard by counsel. Even the intelligent and educated layman has small and sometimes no skill in the science of law.... He lacks both the skill and knowledge adequately to prepare his defense, even though he had a perfect one. He requires the guiding hand of counsel at every step in the proceedings against him. Without it, though he be not guilty, he faces the danger of conviction because he does not know how to establish his innocence. If …

Access To Counsel In Civil Cases, Human Rights Institute May 2015

Access To Counsel In Civil Cases, Human Rights Institute

Human Rights Institute

Legal representation is fundamental to safeguarding access to the legal system. Yet, in the United States, millions of people who are poor or low-income are unable to obtain legal representation when facing a crisis such as eviction, foreclosure, domestic violence, workplace discrimination, termination of subsistence income or medical assistance, loss of child custody, or deportation. Indeed, in the U.S., only a small fraction of the legal problems experienced by low-income people — fewer than one in five — is addressed with the assistance of legal representation.

Racial Mirroring, Dawinder S. Sidhu May 2015

Racial Mirroring, Dawinder S. Sidhu

Faculty Scholarship

“Racial mirroring” refers to efforts by one group to match the primary racial composition of another group. In contrast to racial balancing, which takes place when two groups are adjusted simultaneously to achieve a desired degree of racial equilibrium between them, racial mirroring occurs when the racial makeup of one group is adjusted so as to reflect the predominant racial identity of the second group. Employers and even federal courts engage in racial mirroring. For example, in order to generate trust among customers, employers have hired or promoted individuals of the same race as the employers’ primary customer base. Further, …

State Vs. Federal: Marijuana Legislation And Its Effect On Taxes, Mamie G. Duckworth May 2015

State Vs. Federal: Marijuana Legislation And Its Effect On Taxes, Mamie G. Duckworth

Honors Theses

Marijuana is becoming increasingly popular and accepted within our society; so much so that certain states have legalized it for medical or recreational use, despite marijuana remaining illegal with regards to the federal government. This has lead, and will continue to lead, to complicated and uncertain tax scenarios for the businesses that produce and sell marijuana. Many problems stem from the federal government being unable to recognize or associate with businesses that deal with marijuana. This affects these otherwise legitimate businesses by disallowing the use of federally insured banks as well as taking away the ability to seek federal bankruptcy …

Reframing The Socratic Method, Jamie Abrams May 2015

Reframing The Socratic Method, Jamie Abrams

Scholarly Articles in Law Reviews & Journals

While innovations in law teaching are everywhere, these innovations are being constructed upon and limited by the ancient architecture of the case-based Socratic method, which still endures and persists throughout first-year and upper-level courses. This article highlights how the Socratic method limits the depth and breadth of innovations in law teaching and can be reframed to better catalyze other teaching innovations, create more practice-ready lawyers, and cultivate more inclusive and inviting law classrooms. Within the existing framework of law teaching – the same casebooks, class sizes, and teaching style – the case-based Socratic method can be reframed in three straight-forward …

Does Geography Matter? Barriers Encountered By Service Providers, Amanda Goodson May 2015

Does Geography Matter? Barriers Encountered By Service Providers, Amanda Goodson

Boise State University Theses and Dissertations

Through the professionalization of victim services, research has focused on the barriers that victims of crime face when seeking services. In addition, academics have addressed the unique challenges that arise for victims in rural communities. However, very little research has examined the barriers that arise in service provision. Furthermore, few researchers have explored the relationship between the geographic location of a provider and the types of barriers that are encountered. This study attempts to address this gap in research by examining 117 surveys which were completed by service agencies dispersed throughout a Northwestern state. Quantitative analyses were conducted and results …

The Great Escape: Making The Choice For Upward Social Mobility, Trina Gilliam May 2015

The Great Escape: Making The Choice For Upward Social Mobility, Trina Gilliam

HIM 1990-2015

The goal of my research is to examine motivations for upper mobility vs stagnation of people in poverty. Bandura (1971) states people’s motivations do not come from their willpower and people are not trapped in their situation. However, 43% of Americans born poor, remain poor as adults and 27% of people remain near poor to poor (Pew 2013). I will examine individuals with higher upper mobility aspirations (HUMA) and those individuals with lower upper mobility aspirations (LUMA) in order to provide the salient factors contributing to the desire for upward mobility. Five hypothesis will be analyzed; (1) Individuals with aspirations …

Doc And The Chimera Conspiracy, Jesus Beltran Ii May 2015

Doc And The Chimera Conspiracy, Jesus Beltran Ii

Theses and Dissertations - UTB/UTPA

Doc and the Chimera Conspiracy, is a story that takes place in a world which diverged from our own in 1861 and led to a cooperation between the stoic science of Europe and the holistic science of indigenous people around the world. It is because of the cooperation that there is an explosion in advancements of science and technology. One of these advancements is the creation of Clones and human/animal genetic creations known as Chimera. I tell the story of Jack (a.k.a. Doc) a Chimera who lives in this present day, alternative Earth. The story teeters on the edges of …

Addressing Access To Justice Through New Legal Service Providers: Opportunities And Challenges, Alice Woolley, Trevor C. W. Farrow Apr 2015

Addressing Access To Justice Through New Legal Service Providers: Opportunities And Challenges, Alice Woolley, Trevor C. W. Farrow

Articles & Book Chapters

Most informed observers of the Canadian and American legal systems accept the existence of a significant crisis in access to justice. One possible solution is to permit paralegals, notaries or other licensed individuals with training more limited than that enjoyed by a licensed attorney to practice in certain areas of law. This paper supports these developments, arguing for a regulated and incremental introduction of new legal service providers into the legal services market. It considers the appropriate training and scope of practice for new legal service providers, and some of the associated opportunities and challenges.
