And Justice For All, Someday: Indians, Alaska Natives Face Unique Obstacles, Maylinn Smith Jun 2015

And Justice For All, Someday: Indians, Alaska Natives Face Unique Obstacles, Maylinn Smith

Faculty Journal Articles & Other Writings

There are many conditions making access to justice more problematic for American Indians and Alaska Natives. Without adequate knowledge of tribal cultures, contemporary and historical issues impacting Indian peoples, and the laws applicable to Indian country, access to justice for American Indians and Alaska Natives can never be achieved.

Advancing Tribal Court Criminal Jurisdiction In Alaska, Ryan Fortson Jun 2015

Advancing Tribal Court Criminal Jurisdiction In Alaska, Ryan Fortson

Alaska Law Review

Extensive case law already exists in Alaska on the jurisdiction of tribal courts over domestic relations cases, with one of the seminal cases—John v. Baker—establishing that Alaska tribes have jurisdiction even in the absence of Indian country. A common assumption, though, is that Alaska tribes do not have jurisdiction over criminal offenses. This Article argues that both under the logic of John v. Baker and the development of Indian law in the Lower 48, Alaska tribes already possess inherent jurisdiction over criminal offenses within their Native villages. With the gamut of social challenges facing Alaska Natives in rural …

Promoting Clinical Legal Education And Democracy In India, Sital Kalantry Jun 2015

Promoting Clinical Legal Education And Democracy In India, Sital Kalantry

Cornell Law Faculty Publications

Clinical legal education emerged in the United States in the 1960s to give valuable skill-based instructions to law students while providing legal services to people who could not otherwise afford them. This essay proposes another reason why both Indian and American law schools should support the development of law clinics. Drawing on the works of John Dewey and Martha Nussbaum, I argue that clinical legal education promotes democracy. Both elite American and Indian universities are largely unrepresentative of the respective population demographics of their countries. In clinics, law students bridge this divide by undertaking representation for people from different racial, …

Beliefs About The Lgbtq Community Among Social Work Graduate Students, Gina V. Florez, Guillermina Hall

Electronic Theses, Projects, and Dissertations

This research project was a quantitative survey study design to examine the attitudes of 49 Master of Social Work students attending California State University, San Bernardino. Recently, laws regarding same-sex marriage have been rapidly changing. As of this project completion, 37 states have legalized same-sex marriage. Therefore, now more than ever before, it is imperative that social work graduate students feel prepared to adequately provide services to the lesbian, gay, bisexual, transgender and queer (LGBTQ) populations.

Additionally, and of primary concern to the researchers, this project sought to determine whether graduate students felt that they had received adequate training and …

Delaware’S Familiarity, Brian J. Broughman, Darian M. Ibrahim Jun 2015

Delaware’S Familiarity, Brian J. Broughman, Darian M. Ibrahim

San Diego Law Review

This Article builds on our prior empirical research showing that, everything else equal, start-up firms financed by out-of-state investors are more likely to incorporate in Delaware. We argue that this finding is due to out-of-state investors’ familiarity with Delaware corporate law, and relative lack of familiarity with the corporate law of the start-up’s home state. In the current project, we extend our prior research by (i) developing an informal model distinguishing investor familiarity from related economic theories of network effects and learning effects, (ii) showing that our data are more consistent with familiarity than with these alternative explanations, and (iii) …

Deliberate Destitution As Deterrent: Withholding The Right To Work And Undermining Asylum Protection, Lori A. Nessel Jun 2015

Deliberate Destitution As Deterrent: Withholding The Right To Work And Undermining Asylum Protection, Lori A. Nessel

San Diego Law Review

This Article critiques the United States’ bar on employment for asylum seekers on a number of fronts. Beginning with a historical perspective, I explore the more humane regime that existed in the United States until 1995. Under this prior system, asylum seekers with bona fide claims were permitted to work while their claims proceeded. This Article examine the underlying fears and policy goals that led Congress to dramatically curtail protection and the right to work for asylum seekers. By situating the prohibition on work for asylum seekers within the larger context of overall punitive immigration reforms and the increasing criminalization …

Successful Implementation Of Solution-Based Casework; A Child Welfare Casework Practice Model?, Naomi Weisel Schear May 2015

Successful Implementation Of Solution-Based Casework; A Child Welfare Casework Practice Model?, Naomi Weisel Schear

Dissertations, Theses, and Capstone Projects

Across the country, child welfare agencies have started to implement casework practice models in an effort to improve the safety, permanency and well-being of vulnerable children and families. In their effort to do so, child welfare systems have faced complex contextual challenges to implementation. To date, however, there has been limited empirical research describing successful implementation of these practices. Moreover, little systematic feedback exists concerning service providers' perspectives of various aspects of the implementation process.

The purpose of this qualitative research study was to explore child welfare supervisors' and case workers' responses to various methods of implementation of Solution-Based Casework …

Dissertations

In 2002, President Bush signed into law the No Child Left Behind Act, which required all students to be proficient in English and Math by 2014. (Congress, 2002), including all subgroups. Students with disabilities were expected to meet the proficiency criteria along with all other subgroups. NCLB also required schools to report assessment scores to reflect the achievement of students as well as demonstrate all students were meeting, or at least making gains to achieve, proficiency. If students did not reach the expected benchmark the school was identified as failing and placed in Program Improvement. (CDE, 2011) Each school year, …

Criminal Responsibility For Arbitrators In Chinese Law: Perversion Of Law In Commercial Arbitration, Duan Xiaosong May 2015

Criminal Responsibility For Arbitrators In Chinese Law: Perversion Of Law In Commercial Arbitration, Duan Xiaosong

Pace International Law Review

This article is prompted by a recent Chinese criminal provision governing the impartiality of arbitration. The goals of the article fare to critically examine the new criminal statute created by the provision and to put forward some proposals for reform, which could be employed to resolve the tension that exists between arbitrator impartiality and deference to arbitration. Although the new provision appears to eliminate the abuse of arbitral power, it may raise more questions than it resolves. This article explores the problems and undertakes a comparative analysis of the corresponding U.S. provision, as well as an analysis of some cultural …

Investigating Jurors On Social Media, Caren Myers Morrison May 2015

Investigating Jurors On Social Media, Caren Myers Morrison

Pace Law Review

This essay proceeds in three parts. First, it examines the current state of jury investigations, and how they differ from those conducted in the past. Then, it describes the evolving legal and ethical positions that are combining to encourage such investigations. Finally, it offers a note of caution–condoning such investigations while keeping them hidden from jurors may be perceived as unfair and exploitative, risking a possible backlash from outraged jurors. Instead, I propose a modest measure to provide notice and explanation to jurors that their online information is likely to be searched, and why.

Friends Of Justice: Does Social Media Impact The Public Perception Of The Justice System?, Nicola A. Boothe-Perry May 2015

Friends Of Justice: Does Social Media Impact The Public Perception Of The Justice System?, Nicola A. Boothe-Perry

Pace Law Review

This article will demonstrate how the unregulated use of social media by participants in the justice system (judges, attorneys and jurors specifically) affects the public perception and subsequently the integrity of our justice system. The article will provide a holistic review of social media use by judges, attorneys and jurors, and demonstrate why their use of social media should be harnessed in a manner to ensure compliance with ethical rules and reduce potential negative effects to the social contract between law and society.

Social media is like a culvert. It catches pictures, novelties, personal profiles, gossip, news, unfiltered opinions, and …
