Slavic Village Neighborhood Retail Market Study, Kirby Date

All Maxine Goodman Levin School of Urban Affairs Publications

Slavic Village is a revitalizing urban neighborhood in the southeast area of the City of Cleveland. A historic neighborhood that was once home to 75,000 immigrants of Polish and Slavic descent, it has seen steady decline since the 1960’s, along with other Cleveland neighborhoods, and was especially hard hit during the housing and foreclosure crisis of 2007-2010. However, in the present day, it has many assets and opportunities that make it poised to become one of the vibrant Cleveland neighborhoods of the future.

This study was done as part of a student project to look at the potential to re-invigorate …

In Defense Of Disparate Impact: An Opportunity To Realize The Promise Of The Fair Housing Act, Valerie Schneider Jun 2015

In Defense Of Disparate Impact: An Opportunity To Realize The Promise Of The Fair Housing Act, Valerie Schneider

School of Law Faculty Publications

Abstract:

Twice in the past three years, the Supreme Court has granted certiorari in Fair Housing cases, and, each time, under pressure from civil rights leaders who feared that the Supreme Court might narrow current Fair Housing Act jurisprudence, the cases settled just weeks before oral argument. Settlements after the Supreme Court grants certiorari are extremely rare, and, in these cases, the settlements reflect a substantial fear among civil rights advocates that the Supreme Court’s recent decisions in cases such as Shelby County v. Holder and Fisher v. University of Texas are working to dismantle many of the protections of …

The Politics Of Procedure: An Empirical Analysis Of Motion Practice In Civil Rights Litigation Under The New Plausibility Standard, Raymond H. Brescia, Edward J. Ohanian

Akron Law Review

This Article attempts to assess, empirically, whether the Court’s introduction of the so-called “plausibility standard” in the context of civil pleadings has had a disparate impact on civil rights claims, particularly in employment and housing discrimination cases. In a previous study conducted by one of the co-authors of this Article, it was revealed that in a sample of employment and housing discrimination cases, courts were more likely to dismiss these cases based on the lack of specificity of the pleadings after the Court’s decision in Iqbal. Furthermore, that study also found, after Iqbal, a significant rise in both the number …

Examination Of Organizational Structural Capacity For Change In The Context Of Litigated Reform, Ariel Alvarez, Gautam Nayer Jun 2015

Examination Of Organizational Structural Capacity For Change In The Context Of Litigated Reform, Ariel Alvarez, Gautam Nayer

Journal of Public Management & Social Policy

Increasingly child advocates have become involved with persistent litigation in order to improve the performance of publicly administered state child welfare agencies. However, strategic plans for change are often implemented without sufficient attention given to assessing the level of and strengthening organizational structural capacity to support system-wide change. Using the conceptual foundation of organizational structural capacity by Hall et al. (2003), a two agency case study was conducted examining the structural capacity factors of relationships and networks, infrastructure and process, and planning and development in the context of litigated reform of the Washington State and New Jersey child welfare agencies. …

Inmates’ E-Mails With Their Attorneys: Off-Limits For The Government?, Amelia H. Barry Jun 2015

Inmates’ E-Mails With Their Attorneys: Off-Limits For The Government?, Amelia H. Barry

Catholic University Law Review

The attorney-client privilege is vital to inmates who otherwise have limited opportunities for private communications in prison. Traditionally, inmates have only been able to communicate with their attorneys via in-person visits, phone calls, and mailed letters. As federal inmates have begun using e-mail to converse with their attorneys, courts have had to determine if these conversations are protected by the attorney-client privilege. This Comment discusses courts’ approaches to this question, many of which have found that inmates’ e-mail communications with their attorneys are not privileged because by using the federal prison e-mail system, which warns users that conversations can be …

A Good Rule, Poorly Written: How The Financial Crisis Highlighted The Inadequacy Of Iolta Rate Rules, Andrew Arthur Jun 2015

A Good Rule, Poorly Written: How The Financial Crisis Highlighted The Inadequacy Of Iolta Rate Rules, Andrew Arthur

Catholic University Law Review

Interest on lawyer trust accounts (IOLTA) provide a substantial component of funding that is used to provide legal aid to needy individuals throughout the United States. However, IOLTA program revenues fluctuate with the deposit interest rates, which have remained near zero after the onset of the 2008 global financial crisis. The Comment examines IOLTA rate rules across the country, and the impact of reduces IOLTA revenues on legal aid programs. The Comment further asserts that IOLTA rate rules are not adequately designed to account for fluctuation in central bank interest rates, causing unanticipated problems for legal aid funding. Finally, the …

Conducting Design Research In Pakistan’S Craft Sector: Opportunities And Limitations, Gwendolyn Kulick

Nordes Conference Series

Craft production in Pakistan has many facets, from cheap exploitative mass production to exquisite product lines, highlighting the beauty of the handmade. For my current PhD research, a specific field of practice has been identified: craft projects aiming to develop income generation opportunities for poor craft producers. The development of successful strategies towards including them into craft business value chains long term is the aim of the research, presented in this paper. Aspects of the complex relationship between craft tradition, craft production, poverty alleviation and empowerment inform my topic. Research methods like a case study investigation are described. My simultaneous …

Aging In Place: Perceptions Of Older Adults On Low Income Housing Waitlists, Angela L. Lavery Jun 2015

Aging In Place: Perceptions Of Older Adults On Low Income Housing Waitlists, Angela L. Lavery

Electronic Theses and Dissertations

Many American older adults with low incomes wait years for affordable housing or housing assistance. Insight is needed on the concerns of older adults who need to move but cannot. In addition, within the study of aging in place, there is a paucity of research regarding older adults with low incomes. The purpose of this study was to explore the perceptions and experiences of aging in place from the perspective of older adults with low incomes, and to understand the process in making the decision to move to agesegregated housing. The purpose incorporated an examination of potential oppressive factors that …

Whatever Happened To The Seveloff Fix?, Andy Harrington Jun 2015

Whatever Happened To The Seveloff Fix?, Andy Harrington

Alaska Law Review

This Article suggests that the Supreme Court has not deprived Alaska Native Villages of a valid basis for claiming the authority to create and enforce their own tribal alcohol regulations. Every federally recognized Alaskan Native Village is situated in an area over which Congress extended the federal Indian liquor laws in 1873, in an enactment Congress has never repealed; this should logically empower Alaska Native Villages to exercise the same federally-delegated authority within their federal Indian liquor law Indian country as lower-48 tribes have within their reservations or “dependent Indian communities.” Since this delegated authority is shared with the states, …

Brief Of Amici Curiae Human Rights Organizations In Support Of Plaintiffs-Appellants, Georges V. United Nations, Docket No. 15-00455 (Second Circuit 2015), William Aceves, Baher Azmy, Sarah Dávila-Ruhaak Jun 2015

Brief Of Amici Curiae Human Rights Organizations In Support Of Plaintiffs-Appellants, Georges V. United Nations, Docket No. 15-00455 (Second Circuit 2015), William Aceves, Baher Azmy, Sarah Dávila-Ruhaak

Court Documents and Proposed Legislation

Amici Curiae consist of twenty-four human rights organizations from the United States and around the world that are committed to the rule of law and respect for fundamental rights, including the essential requirement of accountability for wrongdoing. Amici are deeply concerned that thousands of innocent victims of the 2010 cholera outbreak in Haiti, which is widely acknowledged to have been caused by the United Nations and the United Nations Stabilization Mission in Haiti (“MINUSTAH”), have received no redress for their suffering and injuries. This cholera epidemic compounded the profound suffering already experienced by the Haitian people as a result of …

"The Shameful Wall Of Exclusion": How Solitary Confinement For Inmates With Mental Illness Violates The Americans With Disabilities Act, Jessica Knowles Jun 2015

"The Shameful Wall Of Exclusion": How Solitary Confinement For Inmates With Mental Illness Violates The Americans With Disabilities Act, Jessica Knowles

Washington Law Review

Although solitary confinement is conventionally challenged under the “cruel and unusual” standard of the Eighth Amendment, this approach presents several intractable legal hurdles to successful claims. The Americans with Disabilities Act (ADA), 42 U.S.C. §§ 12101 et seq., and its precursor, the Rehabilitation Act, provide innovative and non-constitutional causes of action for inmates with mental illness1 to challenge their solitary confinement. It is estimated that at least thirty percent of inmates in solitary confinement are mentally ill, a high percentage that is due to both the disproportionate number of mentally ill inmates who are isolated from the general prison population …

A New Generation Of Class Action Cy Pres Remedies: Lessons From Washington State, Cecily C. Shiel Jun 2015

A New Generation Of Class Action Cy Pres Remedies: Lessons From Washington State, Cecily C. Shiel

Washington Law Review

The use of cy pres as a mechanism to distribute residual funds in class actions has become increasingly common and the subject of much controversy. In the class action context, cy pres is an equitable remedy used by courts to appropriate class action settlement funds remaining after all identified class parties have been compensated to the funds’ “next best use,” usually to a charity. The controversy has stemmed primarily from a lack of clear judicially enforced standards on how and when to use cy pres. In light of recent controversy, both the Federal Rules Committee, and potentially the Supreme Court, …
