A Reappraisal Of The Indigent's Right Of Access To Bankruptcy Proceedings, Timothy E. Gammon

Akron Law Review

IN 1963, Robert F. Kennedy stated, "To a serious extent, the scales of justice in this country are weighed against the poor"' One year later, the Office of Economic Opportunity was created, which helped balance the scale in some areas by providing legal service programs2 for indigents. Nevertheless, the enormous need of legal service for indigents has not and cannot be met under present programs.' The 1964 legal service program failed to provide money for fees and court costs in judicial and administrative proceedings so petitioners who could not proceed in jorma pauperis were denied access to those proceedings. Ohio's New Rape Law: Does It Protect Complainant At The Expense Of The Rights Of The Accused?, Barbara Child

Akron Law Review

WITH THE ENACTMENT of Am. Sub. S.B. 144,1 Ohio has now joined the small group of states' that are revising their rape laws in measures significant enough to indicate that a trend may be underway. Ohio's new law is designed to protect victims of sex offenses: it contains major provisions affecting (1) the definition of rape itself; (2) new services for victims; (3) record suppression; (4) evidence rules; and (5) sentencing for certain offenders. The new law attempts to secure complainants' rights to privacy and equal protection together with defendants' rights to a fair trial and due process; however, the …

Executive Summary

Introduction: Human trafficking is an issue of national importance, but it is also an issue that touches communities at the local level. While progress is being made with regards to better understanding this phenomenon nationally, examining how human trafficking and the policies crafted to address it take shape within the local context is also important. One-size-fits-all approaches to human trafficking are not likely to understand local contextual variation. It is important to understand the local context so that efforts to address human trafficking can be sensitive to the situational needs of different communities. This report seeks to examine …

International Trade V. International Property Lawyers: Globalization And The Brazilian Legal Profession, Vitor Martins Dias Aug 2015

International Trade V. International Property Lawyers: Globalization And The Brazilian Legal Profession, Vitor Martins Dias

Maurer Theses and Dissertations

This work analyzes a distinctive characteristic of the globalizing Brazilian legal profession. Namely, intellectual property (IP) lawyers who once were leaders in opening the Brazilian economy and were key players in cross-border transactions are now losing ground to their peers with an expertise in international trade. The thesis of this article is that the manner in which Brazilian lawyers are being educated is in shambles. Generally speaking, Brazilian legal education has, overall, become degraded and provincial. Yet, Brazilian international trade lawyers, unlike Brazilian IP-lawyers, have overcome their deficient legal training by seeking legal education abroad. By traveling overseas, especially to …

First Amendment; Freedom Of Speech; Commerical Speech And Advertising; Metpath, Inc. V. Imperato, Sheryl S. Kantz Jul 2015

First Amendment; Freedom Of Speech; Commerical Speech And Advertising; Metpath, Inc. V. Imperato, Sheryl S. Kantz

Akron Law Review

"The decision of Metpath, Inc. v. Imperato is indicative of the growing trend of the judiciary toward affording "commercial speech" the protective shield of the first amendment. As shown by Metpath, where the concern is advertising by a medical clinic, speech with commercial overtones is afforded protection where a public interest in the subject and content of the speech is demonstrated. However, the perimeters of such protection have not been defined by this or previous decisions."

Internationalizing Legal Education: A Cooperative Tool In A Globalized World, Jamie J. Williams Jul 2015

Internationalizing Legal Education: A Cooperative Tool In A Globalized World, Jamie J. Williams

Indonesian Journal of International Law

The term “globalization” has been applied to everything from economics and technology to social media and market trends. Its use has become somewhat of a cliché1, and it is almost impossible to read a treatment of globalization that does not acknowledge the ambivalence and hyperbole surrounding the term. The phrase “globalization of legal education” has the power to conjure visions of sophisticated lawyers-in-the-making jockeying for positions in transnational mega firms, or interning at international courts and dreaming of combating injustice on an international scale. It has been posited that a working knowledge of the global legal landscape is as indispensible …

The Grand Jury: A Critical Evaluation, Ovio C. Lewis Jul 2015

The Grand Jury: A Critical Evaluation, Ovio C. Lewis

Akron Law Review

It seems in retrospect that our grand jury was a microcosm of grand juries generally in that many of the problems noted in the literature were manifest throughout our term. This supports the proposition that the weaknesses and defects of grand juries are not reflective of lack of zeal or devotion to duty on the part of individual members of the juries, but rather are indicative of systemic and institutional dysfunctionalities that are inherent in the grand jury system as it is presently constituted and organized. Thus, the critical comments that appear herein ought not to be taken as an …

The Legal Profession: A Time For Self-Anaylsis, Ralph M. Nader Jul 2015

The Legal Profession: A Time For Self-Anaylsis, Ralph M. Nader

Akron Law Review

Law Day is always a good occasion to look over the role of the profession. Traditionally in many gatherings around the country, the profession has used Law Day to praise itself. This is an occupational trait of the legal profession which is not restricted to Bar Association banquets. I was asked to speak to a number of New York lawyers recently at one such event in New York. As I sat awaiting my turn, the lawyers first praised themselves and after they finished, they began praising judges and gave them awards, scrolls, and plaques. Finally I got up and I …

Book Review: Lawsuit: By Stuart M. Speiser, Lawrence P. Wilkins Jul 2015

Book Review: Lawsuit: By Stuart M. Speiser, Lawrence P. Wilkins

Akron Law Review

The seven ages of a lawsuit are portrayed in new light through the lively prose of Mr. Speiser, as he tells the backstage stories in seven major tort cases in which he or members of his firm have participated during his distinguished career. More than just chronicled events observable by anyone, the author's stories reveal some of the thinking processes which turn the seven ages of a lawsuit into working tools in the resolution of controversies. More than just another collection of "stories-about-cases-the-author-has-won," the book is a discourse on the author's thesis that the American "trinity of torts" (jury trial, …
