Health Care Reform Implementation In Minnesota: Mission Advanced But Not Accomplished, Thaddeus Mason Pope
Faculty Scholarship
Minnesota has long been, and remains, a leader both in the quality of its population's health and in the quality of its health care. Still, the Affordable Care Act has required and prompted massive changes. Roughly five years after enactment of the ACA, it seemed prudent to assess the impact of those changes. Accordingly, the Hamline University Health LawInstitute' and the Hamline Law Review2 hosted an interdisciplinary Symposium entitled "Health Care Reform Implementation in Minnesota: Mission Advanced but not Accomplished."
Regional and national experts explored the real, outstanding, and upcoming law and policy issues relating to the implementation of …

Organized Crime In Insurance Fraud: An Empirical Analysis Of Staged Automobile Accident Rings, Chris Longino
USF Tampa Graduate Theses and Dissertations
The growing trend of insurance fraud continues to cost US consumers billions of dollars a year through increased premiums. In 2015, the Coalition Against Insurance Fraud estimated the cost of insurance fraud as being at least $80 billion dollars a year. Even though an increasing number of criminals are drawn to the low risk, high reward of insurance fraud, little criminological literature has explored this topic and the public remains relatively unaware of the extent of the problem.
One alarming aspect of insurance fraud is the involvement of organized criminal groups. These organized criminal enterprises are formed for the sole …

Improving The Law School Classroom And Experience Through Prayer: An Empirical Study, David A. Grenardo
Improving The Law School Classroom And Experience Through Prayer: An Empirical Study, David A. Grenardo
Faculty Articles
Dr. Martin Luther King, Jr. once said, “To be a Christian without prayer is no more possible than to be alive without breathing.” There are approximately fifty religiously affiliated law schools in the United States. As faith-based communities, these law schools can integrate their faiths into the education they provide by, among other things, incorporating in the classroom a central characteristic of most religions – prayer.
This article includes anonymous survey responses from students at four different Catholic law schools across the nation concerning whether the students liked the fact that their professors prayed at the beginning of class. The …

International Financial Law: The Case Against Close-Out Netting, Vincent R. Johnson
Faculty Articles
In financial transactions today, a practice called “close-out netting” plays a key role in controlling and allocating risks. If anchored in the parties’ chosen contractual language and recognized by law, close-out netting can circumvent normal bankruptcy processes by providing for the acceleration of mutual obligations and the efficient calculations and settlement of the net balance. When correctly implemented, close-out netting can eliminate the risk that arises under ordinary bankruptcy principles.
Despite the support for close-out netting by lenders, scholars, regulators, and policy makers, a few attentive observers of financial law argue that close-out netting is unsound, and the argument against …

Internprofessional Education, Patricia E. Roberts
Internprofessional Education, Patricia E. Roberts
Faculty Articles
As legal educators consider how to improve the outcomes of legal education, maximizing the knowledge, skills, and values taught during the law school experience, consideration should be given to increasing interprofessional learning opportunities in the curricula. As Best Practices for Legal Education suggested, the creative thinking necessary for effective problem-solving includes an understanding of interprofessional dimensions of practice, but interprofessional opportunities are still the exception rather than the norm in legal education. Interprofessional legal education intentionally asks law students to blend the knowledge, skills, and values of two or more professions in order to address complex legal problems. Placing students …

Global Delivery Models: The Role Of Talent, Speed And Time Zones In The Global Outsourcing Industry, Stephan Manning, Marcus Larsen, Pratyush Bharati
Management Science and Information Systems Faculty Publication Series
We investigate antecedents and contingencies of location configurations supporting global delivery models (GDMs) in global outsourcing. GDMs are a new form of IT-enabled client-specific investment promoting services provision integration with clients by exploiting client proximity and time-zone spread allowing for 24/7 service delivery and access to resources. Based on comprehensive data we show that providers are likely to establish GDM configurations when clients value access to globally distributed talent pools and speed of service delivery, and in particular when services are highly commoditized. Findings imply that coordination across time zones increasingly affects international operations in business-to-business and born-global industries.

Drafting General Partnership Laws On The "Aggregate" Or "Entity" Theory, Peter Winship
Drafting General Partnership Laws On The "Aggregate" Or "Entity" Theory, Peter Winship
SMU Law Review
It has been “a matter of considerable dispute” whether partnership legislation should treat a general partnership as an entity. The dispute is about whether to draft the legislation on the “entity” theory (the partnership is a separate legal entity) or on an “aggregate” theory (the partnership is an association — but not a legal entity — of persons carrying on a business as co-owners). Scotland and civil law jurisdictions (including Louisiana) have long recognized the partnership as an entity. Until the late 19th century, however, partnership law in common-law jurisdictions was judge- made law, and most judges treated partnership issues …
