America's Forgotten Constitutions: Defiant Visions Of Power And Community, Christopher Barker

Civil War Book Review

Constitutional Visions of Ethics and Culture

Anyone who has lectured on written constitutions knows how hard it is to capture the magic of fundamental law. Specific clauses can be unlocked through historical examples, but it is very difficult to lecture on the clauses themselves. In....

A Comparison Of Vitamin D Levels In Children With Early Childhood Caries, Vanessa O. Hofilena

Theses and Dissertations

Purpose: To determine if there is an association between early childhood caries (ECC) and vitamin D deficiency, as measured via a serum sample. An exploratory goal was to investigate the possibility of measuring vitamin D with a salivary assay. Methods: Serum samples of patients who were scheduled for a dental or otolaryngology procedure under general anesthesia were assessed for 25-hydroxyvitamin D (25(OH)D), parathyroid hormone and calcium. Results: Our analysis indicates that the vitamin D levels of the controls and ECC group were significantly different. There were significant inverse correlations between: 1) PTH levels and vitamin D and 2) decayed, missing, …

Jurisprudence And (Its) History, Dan Priel, Charles L. Barzun Jan 2015

Jurisprudence And (Its) History, Dan Priel, Charles L. Barzun

Osgoode Legal Studies Research Paper Series

It is not obvious that philosophers and historians of law should take much interest in the scholarly enterprises of the other. Many legal philosophers understand their task as one of clarifying the meaning of such familiar legal concepts as “right,” “duty,” or “law” by offering analyses of them that purport to be general, abstract, and timeless. Meanwhile, historians tend to be suspicious of speculative claims ungrounded in fact and so often prefer to focus on the concrete, particular features of actual legal regimes.

The Kirtland Safety Society And The Fraud Of Grandison Newell: A Legal Examination, Jeffrey N. Walker Jan 2015

The Kirtland Safety Society And The Fraud Of Grandison Newell: A Legal Examination, Jeffrey N. Walker

BYU Studies

The Kirtland Safety Society has long been the source of research and debate within the historical community. Most commentators agree that the Safety Society was an imprudent venture. Some have even argued that its failure marked an almost fatal blow to Joseph Smith’s leadership. Charges of personal gain and illegality are sometimes included in their critique. In addition to the good work done by many scholars, there is more to be said about the legal history of the Kirtland Safety Society. This article seeks to provide a more thorough analysis of the legal establishment of the Society and the challenges …

Tamworth Conservatism And The Repeal Of The Corn Laws: The Foundation Of Modern Conservative Political Discourse, Jonathan James Hedeen Jan 2015

Tamworth Conservatism And The Repeal Of The Corn Laws: The Foundation Of Modern Conservative Political Discourse, Jonathan James Hedeen

Theses and Dissertations

In the early morning hours of May 16th, 1846 Parliament gathered for the final reading to repeal the Corn Laws. While the Corn Laws had been a highly contested topic within Britain for over two decades, it was at this juncture that the Conservative party of Sir Robert Peel fractured. As this study shall demonstrate, the Corn Law crisis of 1846 did not destroy Peel’s version of Conservativism as has often been argued, but rather put it into a state of suspended animation. The division of the party only twelve years after its formation has long been a topic of …

Intimacy And Autonomy: Twentieth Century American Women And The Quest For Self-Realization, Mary Florence Barford Jan 2015

Intimacy And Autonomy: Twentieth Century American Women And The Quest For Self-Realization, Mary Florence Barford

Open Access Dissertations

This dissertation examines the effects of culturally managed gender expectations on intimate spaces. The study of these intimate spaces is rooted in the biographies of four relationships in the post-war period. Through exploration of these individual stories an understanding emerges of how monolithic cultural paradigms work for men and for women in very different ways. For purposes of archival availability and continuity, this dissertation focuses on a very specific group of people, namely women of great talent and ambition who were either married to or in a relationship with a man whose fame eclipsed her own. My question became how …

The Counterfactual History Novel In Nineteenth-Century British Literature, Elizabeth Moline Cuddy Jan 2015

The Counterfactual History Novel In Nineteenth-Century British Literature, Elizabeth Moline Cuddy

Open Access Dissertations

Although scholarship has long since established the history novel’s general course, few critical readings of the history novel address the innovative means through which writers could manipulate the use of history within these novels. Nor, for that matter, have many scholars considered the relationship between the slow decline of this form of literature as a consequence of the combined effect of the rise of historical studies as a serious academic discipline during the 1830s, and the growing trend for the realist novel throughout the following decades. My dissertation explores how Britons’ fascination with history not only shaped the progress of …

The Road To Vienna: Habsburg And Ottoman Statecraft During The Time Of Grand Vizier Kara Mustafa Paşa (1676-1683), Yasir Yilmaz Jan 2015

The Road To Vienna: Habsburg And Ottoman Statecraft During The Time Of Grand Vizier Kara Mustafa Paşa (1676-1683), Yasir Yilmaz

Open Access Dissertations

This dissertation comparatively analyzes Habsburg and Ottoman decision-making and statecraft during the time of Grand Vizier Kara Mustafa Paşa (1676-1683). I synthesize Habsburg diplomatic reports and Ottoman chronicles to show that during the peace negotiations between the Habsburg envoys and Kara Mustafa Paşa’s court before the second Turkish siege of Vienna in 1683, the two state’s diplomatic postures were shaped by their different court structures. At the end, in response to the religiously-oriented explanations of early modern Habsburg-Ottoman confrontations, I argue that the monumental encounter in 1683 was a product of the difference between the two states’ governmental priorities and …

First Graders As Sensitive Social Partners And Skilled Readers, Zaira R. Arvelo Alicea Jan 2015

First Graders As Sensitive Social Partners And Skilled Readers, Zaira R. Arvelo Alicea

Open Access Dissertations

This mixed methods dissertation is guided by a sociocultural framework and a pragmatist stance to contribute to early literacy scholarship about minority children. In particular, I explore the relationship between low socioeconomic status Puerto Rican children’s reading experience and their social cognition by: (1) assessing them through quantitative and qualitative measures that reveal their capacities in these areas at the end of their first grade year, and (2) documenting their reading experiences at home and at school through ethnographic qualitative methods. The analyses revealed significant positive correlations between the tests of reading and social understanding, a scarcity of conventional reading …

Pediatric Nurses' Perceptions Of Continuing Professional Development Opportunities, Suzanne Taylor

Walden Dissertations and Doctoral Studies

With the growth in healthcare research and rapid changes in technology, nurses' participation in lifelong learning is a critical factor in providing excellent patient care. However, many nurses encounter difficulties engaging in continuing professional development (CPD) activities. The purpose of this case study was to understand pediatric nurses' perceptions of CPD opportunities at a tertiary, freestanding, children's hospital in Southern California. Social cognitive theory was the framework for the study. Interviews and focus groups were conducted with a purposeful sample of 39 nurses comprised of day- and night-shift nurses plus nurse managers. The data were coded into categories and themes …

Approaches For Developing A Model For Information And Communication Technology (Ict) Implementation In The Higher Education Environment, Thomas Edward Kurtz

CCAC Theses and Dissertations

This dissertation investigates approaches for the development of an implementation model for ICT systems in the higher education environment. ICT systems have been implemented in various education settings, but have been narrowly focused in nature. There lacks a generalizable model to implement these systems in higher education settings. The research questions in this study sought to identify the criteria that can be used to develop and evaluate the implementation model.

The design science research methodology selected for this study used product criteria defined in a literature review to guide the development of the model. An expert panel consisting of administrators, …

The United States has always administered territorial governments and the primary entity entrusted with this authority is the United States Congress. This dissertation, using an American Political Development framework, seeks to uncover the variety of ways in which Congressional decision-making over territorial policy has shifted. The goal is to understand how the United States Congress worked toward establishing and maintaining an American Empire via the use of territorial policy. Conceptualizing Classified Staff As Collaborative Partners, Michael Perini Jan 2015

Conceptualizing Classified Staff As Collaborative Partners, Michael Perini

Collaborative Librarianship

Academic librarians have varied roles within the higher education community and librarian perceptions of these duties establish their professional identity. Applying Whitchurch’s “blended professional” model of professional identity, the findings of this case study of librarian perceptions of their roles and functions suggest that academic librarians fail to consider all of the collaborative partnerships available to them due to institutional restrictions or perceived structural and hierarchical constraints. This discussion analyzes the effect of these impediments on academic librarians and advocates utilizing classified staff in a more substantive manner.

Boundary Stones: Morbid Concretions And The Chemistry Of Early Nineteenth Century Medicine, Edward Allen Driggers Jr. Jan 2015

Boundary Stones: Morbid Concretions And The Chemistry Of Early Nineteenth Century Medicine, Edward Allen Driggers Jr.

Theses and Dissertations

My dissertation is the story of communities of physicians seeking to understand the morbid concretion of the body using the new chemistry from the late eighteenth century. Morbid concretions, or calculi, were occurred in the urinary passages, lungs, joints, pancreas, uterus, and other areas of the body. At the turn of the nineteenth century, some physicians saw analytical chemistry, emerging out of the so-called chemical revolution, as applicable in understanding and treating stone-based diseases. However, some physicians and surgeons saw the treatment of stones with chemistry as evidence of the need to return to older practices of medicine, like humoral …
