Predicting Aqueous Solubility Of Pharmaceutical Agents By Solid Dispersion Prepared By Solvent Evaporation Method, Karthik Reddy Patlolla
Predicting Aqueous Solubility Of Pharmaceutical Agents By Solid Dispersion Prepared By Solvent Evaporation Method, Karthik Reddy Patlolla
University of the Pacific Theses and Dissertations
Solubility of active pharmaceutical agents is a crucial process that determines drug absorption and ultimately its bioavailability. Many of the new therapeutically beneficial compounds discovered are lipophilic requiring various solubility enhancement strategies to improve their solubility. Among these strategies, solubility enhancement using solid dispersions is a leading method. To obtain a desirable increase in the solubility of a poorly-soluble compound, a good understanding of the molecular descriptors influencing the enhancement of solubility is essential. Therefore, the major research objective was to determine the descriptors which significantly influence the solubility enhancement by solid dispersions. After enhancing the solubility of selected poorly-soluble …
Crash Risk Associated With Cellular Phone Use While Driving, Tiffani Ann Fordyce
Crash Risk Associated With Cellular Phone Use While Driving, Tiffani Ann Fordyce
Walden Dissertations and Doctoral Studies
There are inconsistencies in the published literature on the effect of cellular phone use while driving. The objective of this study was to estimate an adjusted nationwide crash rate associated with cell phone use while driving and to compare statewide crash rates prior to and following the implementation of legislation banning cell phone use while driving. Crash rates in nationally representative databases were calculated based on imputed values for cell phone use using the propensity score method. The imputed nationwide crash rate for fatal crashes (1.61 per 100 fatal crashes) and all crashes (1.409 per 100 crashes) represented a 2 …
Business Processes Management In The Netherlands And Portugal: The Effect Of Bpm Maturity On Bpm Performance, Kevin J. Janssen, Pascal Ravesteyn
Business Processes Management In The Netherlands And Portugal: The Effect Of Bpm Maturity On Bpm Performance, Kevin J. Janssen, Pascal Ravesteyn
Journal of International Technology and Information Management
In the last decade, business process management (BPM) has become essential for corporations to maintain their control over business processes. Therefore it is highly important for companies to know which factors influence business process performance. Consequently, this study focuses on the relationship between BPM maturity and BPM performance. The paper aims to determine (1) whether BPM maturity has a significant effect on BPM performance and (2) whether there is a significant difference between a country that is in a relatively more mature stadium with regard to BPM practices and one that is still going through an adapting phase. In this …
Conceptual Model For Successful Implementation Of Big Data In Organizations, Mohanad Halaweh, Ahmed E. Massry
Conceptual Model For Successful Implementation Of Big Data In Organizations, Mohanad Halaweh, Ahmed E. Massry
Journal of International Technology and Information Management
The term ‘big data’ has gained huge popularity in recent years among IT professionals and academicians. Big data describes the massive amount of data that can be processed and analyzed using technology to gain business values that will help organizations to achieve competitive advantages. The current paper aims to develop a holistic model that includes the factors that would affect the success or failure of the implementation of big data in organizations. Furthermore, this research examines the opportunities that organizations would attain from implementing big data, as well as the challenges that could hinder this implementation. The proposed model provides …

An Adaptive Neuro-Fuzzy System With Semi-Supervised Learning As An Approach To Improving Data Classification: An Illustration Of Bad Debt Recovery In Healthcare, Donghui Shi, Jozef Zurada, Jian Guan, Sandeep Goyal
Journal of International Technology and Information Management
Business analytics has become an increasingly important priority for organizations today as they strive to achieve greater competitiveness. As organizations adopt business practices that rely on complex, large-scale data, new challenges also emerge. A common situation in business analytics is concerned with appropriate and adequate methods for dealing with unlabeled data in classification. This study examines the effectiveness of a semi-supervised learning approach to classify unlabeled data to improve classification accuracy rates. The context for our study is healthcare. The healthcare costs in the U.S. have risen at an alarming rate over the last two decades. One of the causes …
Developing Individualized Education Programs With Culturally And Linguistically Diverse Families From Low-Income Homes : A Heuristic Inquiry Of Special Education Teachers, Kristen E. Clark
University of the Pacific Theses and Dissertations
Research shows evidence of overrepresentation of culturally and linguistically diverse children enrolled in special education services, a positive correlation between parent involvement and academic success, and a plethora of barriers impeding active 6 parent participation in IEP development. Barriers include language, culture, low income, . and school climate and team dynamics. The aim of this study was to explore: (a) In what ways do special education teachers engage with culturally and linguistically diverse families from low-income homes in the IEP development process? (b) In what ways do special education teachers address culturally and linguistically diverse children's educational needs while also …

Hobby Lobby And The Dubious Enterprise Of Religious Exemptions, Ira C. Lupu
Hobby Lobby And The Dubious Enterprise Of Religious Exemptions, Ira C. Lupu
GW Law Faculty Publications & Other Works
The experience of the past fifty years, culminating in Burwell v. Hobby Lobby Stores, Inc., is grounds for deep skepticism of any sweeping regime of religious exemptions. Part I of this essay locates the problem in the current legal and cultural moment, which includes religious objections to employer-provided contraceptive care for women, and religion-based refusals by wedding vendors and others to facilitate the celebration of same sex marriages. Part II broadens the time frame to analyze the regimes of religious exemption – federal and state, constitutional and statutory -- in which such disputes play out. Such regimes will tend …
Religious Exemptions And The Limited Relevance Of Corporate Identity, Ira C. Lupu, Robert W. Tuttle
Religious Exemptions And The Limited Relevance Of Corporate Identity, Ira C. Lupu, Robert W. Tuttle
GW Law Faculty Publications & Other Works
Corporate religious liberty appears to be on the rise. The Supreme Court’s unanimous decision in Hosanna Tabor v. EEOC (2012) energized sweeping theories about “freedom of the church.” The Court’s more controversial decision in Burwell v Hobby Lobby Stores, Inc. (2014) determined that for-profit entities may be legally entitled to claim a corporate religious character. Speaking in the language of rights, commentators have vigorously debated the foundations and meaning of these decisions.
This chapter argues that these debates are misdirected. The special treatment of religion in American constitutional law does not properly rest on any theory that religious entities …
Eyes On The Prize, Head In The Sand: Filling The Due Process Vacuum In Federally Administered Contests, Steven L. Schooner, Nathaniel E. Castellano
Eyes On The Prize, Head In The Sand: Filling The Due Process Vacuum In Federally Administered Contests, Steven L. Schooner, Nathaniel E. Castellano
GW Law Faculty Publications & Other Works
The article introduces readers to the recent proliferation of federal prize contests, which sovereigns have employed, albeit sporadically, since the mid-sixteenth century to incentivize breakthrough innovation. In the past decade, the federal government’s use of prize contests has skyrocketed, which makes sense in an era of constrained government resources. Prize contests offer seemingly unlimited potential to break through existing technological barriers at less expense than traditional innovation incentivizing tools such as contracts, grants, and patents. But that upside potential comes at a cost.
For every ebullient prizewinner, there are potentially innumerable “losers,” many of whom feel wronged, exploited, or, at …

Public Procurement Law: Key International Developments In 2014 — Part I: An American Perspective On The New European Public Procurement Directives, Christopher R. Yukins
GW Law Faculty Publications & Other Works
The year 2014 saw major developments in European public procurement law, as a number of new procurement directives finally came into force. This paper focuses on the two elements of the new European Union procurement directive, 2014/24/EU, most likely to affect the U.S. procurement community: new flexibility in the use of best-value negotiations, and expanded grounds for excluding potential contractors, for corruption or otherwise. The paper also will discuss how the new procurement directive may affect ongoing trade negotiations, especially between the United States and Europe under the Transatlantic Trade and Investment Partnership (TTIP).

Class, Politics, Gender And The Marriage Divide In The United States, Naomi R. Cahn, June Carbone
GW Law Faculty Publications & Other Works
In this article we use the idea of the 'marriage divide' to describe the transformation of the family to meet the needs of the information economy and the divisions that the transformation has created. In doing so, we emphasise three types of 'marriage divides' in the United States: class and racial, ideological and political, and family law/gender ideology.
Moving Targets: Obergefell, Hobby Lobby, And The Future Of Lgbt Rights, Ira C. Lupu
Moving Targets: Obergefell, Hobby Lobby, And The Future Of Lgbt Rights, Ira C. Lupu
GW Law Faculty Publications & Other Works
The recognition of marriage equality in Obergefell v. Hodges, just one year after Burwell v. Hobby Lobby Stores, Inc. broadened the law of religious freedom, highlights the potential collision course of these movements. This paper is an attempt to navigate the waters where such a collision is most likely. As LGBT rights grow, the choice between generic religious privilege, typified by the Religious Freedom Restoration Act (RFRA), and specific religious accommodations, such as the treatment of religious non- profits in federal law, will define the terms of the conflict. Part I addresses current federal law, and focuses on the extent …

We are in the midst of a paradigm shift in the food industry. People are more closely examining the impact of food not only on their health and wellness but also on the environment. Some are also concerned about the relationship between food and animal welfare as well as resource scarcities. Big food conglomerates face competition from upstart rivals. The for-profit companies profiled in this work, Nu-tek Food Science, Lyrical Foods, Hampton Creek, Beyond Meat, Impossible Foods, Modern Meadow, and Rosa Labs, are leading the reinvention of condiments and food. Although picking winners and also-rans represents a difficult endeavor, some …
The Peter Humphrey/Yu Yingzeng Case And Business Intelligence In China, Donald C. Clarke
The Peter Humphrey/Yu Yingzeng Case And Business Intelligence In China, Donald C. Clarke
GW Law Faculty Publications & Other Works
The case of Peter Humphrey and Yu Yingzeng, convicted in China on August 2014 on charges of unlawful acquisition of citizens’ personal information, raises important issues about Chinese law. A narrow but important issue is how Chinese law draws the line between lawful and unlawful acquisition of information, a practice routinely carried out by businesses and individuals. This article examines the trial transcript and judgment in the Humphrey/Yu case and finds that it sheds regrettably little light on what remains a murky question. A broader issue is whether the Chinese legal system can be counted on to operate in a …

The high-risk business model of large financial conglomerates (frequently called “universal banks”) was an important cause of the financial crisis. Universal banks rely on cheap funding from deposits and shadow banking liabilities to finance their speculative activities in the capital markets. By combining deposit-taking and short-term borrowing with underwriting, market making, and trading in securities and derivatives, the universal banking model creates a strong likelihood that serious problems occurring in one sector of the financial industry will spread to other sectors. To prevent such contagion, federal regulators have powerful incentives to bail out universal banks and protect all of their …

An International Legal Framework For Se4all: Human Rights And Sustainable Development Law Imperatives, Robert L. Glicksman
GW Law Faculty Publications & Other Works
Governments around the world recognize the link between human development and access to safe, secure, and affordable sources of energy. Nevertheless, many people have access to only rudimentary and inadequate energy sources, depriving them of opportunities for economic development and creating serious health risks. Even in countries in which access to energy services is adequate, the provision of those services has both health and environmental effects. In particular, the production of energy using fossil fuels generates greenhouse gases that contribute significantly to climate disruption, which is likely to create disproportionate risks to the same undeveloped nations already suffering from a …

The Identification Of Customary International Law And Other Topics: The Sixty-Seventh Session Of The International Law Commission, Sean D. Murphy
GW Law Faculty Publications & Other Works
The International Law Commission held its sixty-seventh session in Geneva from May 4 to June 5, and from July 6 to August 7, 2015, under the chairmanship of Narinder Singh (India). Notably, the Commission’s drafting committee completed a full set of sixteen draft conclusions on the topic of “identification of customary international law,” paving the way for those conclusions with commentaries to be approved by the Commission on first reading in 2016.
Additionally, the Commission provisionally adopted with commentaries initial draft guidelines on “protection of the atmosphere” and initial draft articles on “crimes against humanity,” as well as one further …
Johnson’S Differentiation Theory: Is It Really Empirically Supported?, Joan S. Meier
Johnson’S Differentiation Theory: Is It Really Empirically Supported?, Joan S. Meier
GW Law Faculty Publications & Other Works
Michael Johnson’s differentiation of ‘‘types’’ of domestic violence has had a significant impact on courts and providers, in part because of its claim to an empirical basis. Unfortunately, the label ‘‘situational couple violence’’ has already been used by judges and evaluators to minimize abuse claims in custody cases. Johnson’s repeated assertion that SCV is the most common form of domestic violence reinforces the marginalizing of domestic violence. But what do his data actually show? Here Professor Meier takes a close look at the research Johnson relies on and finds that it fails to prove his thesis. Rather, the data suggest …
Debunking Revisionist Understandings Of Environmental Cooperative Federalism: Collective Action Responses To Air Pollution, Jessica Wentz
Debunking Revisionist Understandings Of Environmental Cooperative Federalism: Collective Action Responses To Air Pollution, Jessica Wentz
GW Law Faculty Publications & Other Works
The federal Clean Air Act initiated Congress's venture into cooperative environmental federalism in 1970. Forty-five years later, misconceptions about the nature of that venture (and similar examples of cooperative federalism under other federal environmental statutes) persist. In particular, some recent judicial decisions characterize environmental cooperative federalism as an equal partnership between the federal Environmental Protection Agency and the states. They also take umbrage at efforts by EPA to override state policies and initiatives that fail to conform to the minimum responsibilities that the statutes impose on the states, characterizing them as unlawful affronts to state sovereignty.
This chapter argues that …

Next Generation Compliance, David L. Markell, Robert L. Glicksman
GW Law Faculty Publications & Other Works
Enforcement has long been a central component of the Environmental Protection Agency’s (EPA) administration of the nation’s environmental laws. EPA’s latest Strategic Plan identifies as one of the Agency’s five strategic goals protecting human health and the environment by enforcing laws and assuring compliance. Yet, outside observers and the Agency itself have identified a series of longstanding as well as emerging challenges to effective enforcement.
EPA has responded to these criticisms and challenges by embarking on what it terms a “transformative” enforcement initiative, which it calls Next Generation Compliance (“Next Gen”). Cynthia Giles, Assistant Administrator for OECA, has emphasized that …

Although the Clean Air Act is an imperfect tool for addressing the nation’s greenhouse gas emissions, it is the only available federal mechanism for directly addressing power plant carbon emissions. The Obama Administration’s Clean Power Plan, published in final form in August 2015, tackles the challenge. This paper from the Center for Progressive Reform (CPR) compiles 13 separately authored essays from 11 CPR Member Scholars, each addressing a different topic related to the Clean Power Plan, and each representing the expertise and views of its individual author(s). Published in July 2015, just before the release of the final rule, the …

This article analyzes the past twenty years of data privacy disputes between the European Union and the United States, beginning with Safe Harbor in the late 1990s and concluding with the Schrems judgment in 2015. We argue that the recurring transatlantic disputes and the difficulty in reaching a stable political compromise can be explained by fundamental differences in privacy law between the two jurisdictions. The comparison with EU law brings out four important characteristics of U.S. law: constitutional law has relatively little to say in the policy area of data privacy; the substantive limits in statutory law on data collection, …

The Law Of Intimate Work, Naomi Schoenbaum
GW Law Faculty Publications & Other Works
This Article introduces the concept of intimate work — intimate services provided by paid workers to a range of consumers — and seeks to unify its treatment in law. The concept explains multiple exceptions to work law that have previously been viewed as random and even contradictory. From the daycare worker to the divorce lawyer, the nurse to the hairstylist, intimate work introduces an intimate party — the consumer — into the arm’s-length employer-employee dyad on which work law is premised. This disruption leads to limited enforcement of non-compete agreements, the waiver or imposition of fiduciary duties, and exceptions to …

The Environmental Protection Agency’s (EPA) Clean Power Plan (CPP) is one of the most controversial and highest-stake rules ever issued by any agency. Proponents of the rule maintain that it is essential to mitigating the potentially devastating effects of climate change. Opponents, by contrast, argue that it is unlikely to be effective for its intended purpose and that it jeopardizes the reliability of the electricity grid. We are in the awkward position of agreeing with both the proponents and the opponents of the CPP. We want the rule to succeed in accomplishing its intended purpose but we fear that it …

Consume Or Invest: What Do/Should Agency Leaders Maximize?, William E. Kovacic, David A. Hyman
GW Law Faculty Publications & Other Works
In the regulatory state, agency leaders face a fundamental choice: should they “consume” or should they “invest?” “Consume” means launching high profile cases and rule-making. “Invest” means developing and nurturing the necessary infrastructure for the agency to handle whatever the future may bring. The former brings headlines, while the latter will be completely ignored. Unsurprisingly, consumption is routinely prioritized, and investment is deferred, downgraded, or overlooked entirely. This essay outlines the incentives for agency leadership to behave in this way and explores the resulting agency costs (pun intended). The U.S. Federal Trade Commission’s health care portfolio provides a useful case …

The conventional wisdom is that the FTC was the governmental equivalent of a leper colony prior to 1969, and its credibility and reputation were restored only by the adoption of the wise recommendations in the 1969 ABA Report. There is no question that the FTC deserves plenty of criticism for its pre-1969 performance. It is also beyond doubt that there has been a dramatic turn-around in the intervening forty-five years, as the FTC adopted the recommendations in the 1969 Report. But, before we simply genuflect at the wisdom of those responsible for the ABA Report and the inherent virtue of …

This study seeks to examine the relationship between stressful life events and risky sexual behavior in Spit for Science: the VCU Student Survey. Research has shown that when facing a stressful life event, an individual can experience negative and lasting consequences long after the event is over. All subjects used in this study were VCU juniors who entered VCU in the fall of 2011 (n=970). Participants were asked about exposure to different types of traumatic life events (natural disaster, transportation accident or assault). Stressful life events were also measured by creating a sum score based on the total number of …

Psychiatric involuntary holds are initiated when an individual suffering from mental illness is deemed a danger to themselves or others. Each state and the District of Columbia has its own legislation outlining the process for involuntary holds and the assessments that take place during a hold. A variety of individuals, professional and non-professional, can be involved in the process. Each state also sets a time limit during which a person can be held, and specific language that details the behavior of individuals that are eligible for psychiatric involuntary holds. This information was gathered by examining each states' codes involving psychiatric …
