The fiduciary relationship is one of the most fundamental legal relationships, and its importance for both public and private law is increasingly recognized. Fiduciary mandates typically involve one person—the fiduciary—administering the affairs or property of other persons—an individual beneficiary or group of beneficiaries. Yet, as we will demonstrate, this is not the only way fiduciary relationships are structured. Most accounts of fiduciary law oversimplify the law because they exclude a categorically different form of fiduciary relationship. A significant set of fiduciary relationships feature governance mandates in which the fiduciary is charged with pursuing abstract purposes rather than the interests of …

Hatching success in birds is influenced by the temperature and turning rate of the egg, but our understanding of the environmental factors that effect incubation temperatures and egg turning rates in birds is limited. Especially little is known of these effects for species that nest in burrows or crevices, such as the Cassin's auklet. On Southeast Farallon Island, California, USA, a subset of the Cassin's auklet (hereafter auklet) population nest in artificial nest boxes. The nest boxes are above ground and made out of a single layer of plywood. Temperatures in unshaded nest boxes can increase significantly with high ambient …

Elucidation Of The Role Of Poly(Adp-Ribose) Polymerase In Drug-Induced Toxicity, Kambria Haire

Drug toxicity may cause liver injury, resulting in damage to cells and tissues. This damage can lead to cytotoxic events that may result in an activation of poly (ADP-ribose) polymerase (PARP). A study was conducted to determine if cocaine and acetaminophen toxicity lead to DNA damage and to the activation of the repair protein, PARP in the liver using the hepatotoxicants: cocaine and acetaminophen (APAP).
A dose-response analysis for cocaine concluded that a dose as low as 20 mg/kg resulted in elevated ALT levels. A higher dose of 60 mg/kg was tested for analyses but resulted in severe hemorrhaging. The …

Fibronectin (Fn1) is an evolutionarily conserved extracellular matrix glycoprotein essential for embryonic development. Global deletion of Fn1 leads to mid-gestation lethality from cardiovascular defects. However, severe morphogenetic defects that occur early in embryogenesis in these embryos precluded assigning a direct role for Fn1 in cardiovascular development. We noticed that Fn1 is expressed in strikingly non-uniform patterns during mouse embryogenesis, and that its expression is particularly enriched in the pharyngeal region corresponding with the pharyngeal arches 3, 4, and 6. Now, We Hear Through A Voice Darkly: New Media And Narratology In Cinematic Art, James Anthony Ricci

This dissertation explores the intersection of new media and narrative, as it is presented through a cinematic aesthetic. The narrative language of film is analyzed through the theoretical framework of Bakhtin’s concepts of Heteroglossia, Chronotope, and Dialogism. Bakhtin’s ideas of classifying language act as strong tools for demonstrating how cinematic narrative can inform and alter the perception of its spectators. Lev Manovich’s principles of New Media, specifically Variability, Modularity, and Automation are also utilized to demonstrate how cinema is a constantly evolving paradigm.

Inflammatory demyelination of the central nervous system (CNS) is the hallmark of multiple sclerosis (MS), a chronic debilitating disease that affects more than 2.5 million individuals worldwide. It has been widely accepted, although not proven, that the major pathogenic mechanism of MS involves myelin-reactive T cell activation in the periphery and migration into the CNS, which subsequently triggers an inflammatory cascade that leads to demyelination and axonal damage. Virtually all MS medications now in use target the immune system and prevent tissue damage by modulating neuroinflammatory processes. Although current therapies such as commonly prescribed disease-modifying medications decrease the relapse rate …

Avian Haemosporida are common, vector-transmitted blood parasites of birds throughout the world. During my dissertation research, I explored how multiple host species respond immunologically to natural infections in the wild (Chapter 1) and to experimental infections in the laboratory (Chapter 2). Despite their tractability as a model host-parasite system and a burgeoning literature on avian Haemosporida, little is known about how their populations interact across large areas (hereafter “regions”). I present data from parasite surveys of birds across eastern North America suggesting that continental parasite populations track host populations across the region, but also that the host breadth of a …

The main research question explored in this curriculum capstone is what are some simple things that children could know about where they live and what edible wilds grow around them that would enrich their sense of place? A goal of this project is to get children outside with an adult companion exploring natural settings by way of foraging for wild edibles. The purpose of this wild edibles guide is to give novice foragers the basic tools necessary to ensure wildcrafting success. To determine the comprehensiveness of neonatal resuscitation documentation and to determine the association of various patient, provider and institutional factors with completeness of neonatal documentation. Multi-center retrospective chart review of a sequential sample of very low birth weight infants born in 2013. The description of resuscitation in each infant’s record was evaluated for the presence of 29 Resuscitation Data Items and assigned a Number of items documented per record. Covariates associated with this Assessment were identified.

Exploratory Study Of Counseling Professionals’ Attitudes Toward Distance Clinical Supervision, Brittani Fiore Munchel

Many forms of distance clinical supervision (DCS) have been used in the last decade, but a sparse amount of research addressing (DCS) in counselor education exists to date. The author used random and snowball sampling to survey American Counseling Association members, with a analytic sample total of 96 participants. In the sample, 54.2% of participants were licensed counseling professionals and 39.6% were student or post-masters level interns. The average participant age was 43, ranging from 23 to 74 years. Participants had a mean of 8.1 years of experience. A total of 37.5% of participants had used DCS at some point …

MicroRNAs have been identified as potential cancer biomarkers due to their presence and stability in many body fluids including urine and plasma, but the relationship of the pattern of expression of these messengers across various biological media has not been addressed and could provide important information in order to translate these biomarkers for epidemiologic or clinical use. We analyzed microRNA of matched FFPE-tumor tissue, plasma, urine exosomes (n = 16) and WBCs (n = 11) from patients with bladder cancer, using Nanostring miRNA assays and droplet digital PCR for validation. Weather support to space launch operations, while similar to that for traditional aviation, presents significant additional challenges. Embry-Riddle Aeronautical University (ERAU) currently offers three courses in traditional aviation meteorology, two needed by aeronautical science students seeking private pilot through airline transport pilot (ATP) FAA certifications, and one to provide meteorology majors with operational experience supporting an actual air race. However, with the advent of a new degree program in Commercial Space Operations (CSO), the need to modify and extend traditional aviation weather instruction to include space launch weather requirements has become increasingly important. Overall, science teaching at the university level has remained in a relatively static state. There is much research and debate among university faculty regarding the most effective methods of teaching science. But it remains largely rhetoric. The traditional lecture model in STEM higher education is limping along in its march toward inclusion and equity. The NGSS and Common Core reform efforts do little to help university science teachers to change their orientation from largely lecture-driven practice with laboratory supplements. While it is impossible to address all diverse student groups, the need for accommodations tend to be overlooked. As a Deaf …

Scientists worldwide believe that sustainable resource management must be based on results derived from successful research (Strigl, 2003). Therefore, scientists are constantly engaged in research projects in order to obtain more results and create new knowledge. In this constant pursuit of knowledge, the international scientific community is minimally participating in the development of human capacity, especially when their research is based in low-income countries (LIC) (Strigl, 2003).
