The Person We Knew: Perceptions Of The Identity Of Loved Ones With Dementia By Family Caregivers, Amber Jannusch, Dena Huisman Dec 2015

The Person We Knew: Perceptions Of The Identity Of Loved Ones With Dementia By Family Caregivers, Amber Jannusch, Dena Huisman

Speaker & Gavel

While several studies have looked at the identity of dementia patients, most focus on the point of the view of the patient. However, caretakers’ and family members’ view of the identity of the dementia patient is unstudied. This study attempts to see how family caregivers’ view of their family member’s dementia manifests in communication about the loved one. This study is a preliminary examination of family caregivers’ constructions of the identity of their loved one, revealing that caretakers have one of three views: the patient without an identity, the patient as a different person, or the patient as “not lost” …

Mcdonald V. Chicago, Self-Defense, The Right To Bear Arms, And The Future, Richard L. Aynes Dec 2015

Mcdonald V. Chicago, Self-Defense, The Right To Bear Arms, And The Future, Richard L. Aynes

ConLawNOW

In this article, Professor Richard L. Aynes, who was cited for his research by the majority in McDonald, delivers his critique on the opinion, the concurrence, and the dissent. Professor Aynes provides an in-depth analysis of Justice Thomas’ concurrence, which asserts the proper vehicle for incorporation to be the Fourteenth Amendment’s Privileges and Immunities Clause, as opposed to the traditional method employed by the court – the Due Process Clause. With contemporary legal scholarship in agreement with Justice Thomas, Professor Aynes asserts that just as the Privileges and Immunities Clause commanded the support of a ratifying nation, “it will …

Judicial Elections: The Case For Accountability, Jack Park Dec 2015

Judicial Elections: The Case For Accountability, Jack Park

ConLawNOW

In this article, Jack Park defends the use of partisan elections as a method of selecting state court judges. He first frames the debate and describes its participants. The author then discusses the competing values that supporters and opponents of judicial elections advance. Finally, Mr. Park addresses the arguments for and against judicial elections, showing that, while they may not be a perfect method of selecting judges, neither are the alternatives.

The Second Amendment Standard Of Review After Mcdonald: "Historical Guideposts" And The Missing Arguments In Mcdonald V. City Of Chicago, Patrick J. Charles Dec 2015

The Second Amendment Standard Of Review After Mcdonald: "Historical Guideposts" And The Missing Arguments In Mcdonald V. City Of Chicago, Patrick J. Charles

ConLawNOW

In this article, Patrick Charles addresses the first step in analyzing Second Amendment challenges – whether the challenged conduct was “publicly accepted” or “publicly understood” as within the scope of the Second Amendment, circa 1791. This article also analyzes two premises on which the McDonald plurality based its decision, ultimately concluding that those premises are inaccurate. In his opinion, Justice Alito asserted that State constitutions at the time of the founding generally protected an individual right to keep and bear arms. However, an in-depth examination of all State constitutional provisions suggests otherwise. Secondly, John Bingham’s understanding of what the Fourteenth …

Chief Justice Roberts And The "Forty Thieves", Keith R. Fisher, Konstantina Vagenas Dec 2015

Chief Justice Roberts And The "Forty Thieves", Keith R. Fisher, Konstantina Vagenas

ConLawNOW

“What’s in a name? That which we call a rose/ By any other name would smell as sweet.” Whether or not one agrees with the young Shakespeare about names – and many decidedly do not – numbers (as numerologists undoubtedly will assure you) are decidedly a different story and have always been thought to have extrinsic significance.

The number forty, for example, has extensive numerological significance, principally (though not exclusively) in biblical texts. A time period in the Bible – whether in days, months, or years and whether in the books of the Old or New Testament – that features …

On Marriage, Religious Freedom, Equality And Homosexuality: A Reply To Professor Huhn, George W. Dent Jr. Dec 2015

On Marriage, Religious Freedom, Equality And Homosexuality: A Reply To Professor Huhn, George W. Dent Jr.

ConLawNOW

As Professor Huhn says, there is much on which we agree. I concur that the Free Exercise Clause gives citizens no power to override an Equal Protection decision by the Supreme Court (his answer to his Question 1), or a decision of a state supreme court to compel legal recognition of same-sex “marriage” (SSM) (his answer to his Question 2). We part company, though, over the meaning of equality and its application to marriage.

Ten Questions On Gay Rights And Freedom Of Religion, Wilson R. Huhn

ConLawNOW

I have prepared a series of ten questions that will progressively narrow the issues concerning gay rights and free exercise rights until we come to the principal point upon which Professor Dent and I disagree – the definition and application of the principle of equality.

The athletes completed a survey that was previously used and created by Brian Primack and reprinted with the author's written consent. The following …

The Epigenetics Of Post-Traumatic Stress Disorder In Women And Ptsd In Women Veterans: Implications For Health Policy, Cheryl R. Brubaker Msn, Sdnp, Fnp-Bc, Judith Milner Psyd Dec 2015

The Epigenetics Of Post-Traumatic Stress Disorder In Women And Ptsd In Women Veterans: Implications For Health Policy, Cheryl R. Brubaker Msn, Sdnp, Fnp-Bc, Judith Milner Psyd

DNP Forum

Women have long served in the military during war whether recognized or unrecognized, whether praised or unpraised, whether there by choice or not there by choice. Men and women both feel the wounds of war. So many times those wounds are very hard to ignore, and often those wounds are not so visible yet take their toll. Post-traumatic stress disorder (PTSD) is commonly associated with combat, with war, and with being a veteran (Fischer, 2014). Our understanding of women formally deployed as soldiers into combat and the consequences for these women is less well defined. Through a meta-synthesis of published …

Risk Assessment Strategy For Late Preterm Infants, Nisha Nair, Constance Hill Dec 2015

Risk Assessment Strategy For Late Preterm Infants, Nisha Nair, Constance Hill

DNP Forum

Late preterm infants (LPIs), born between 34 and 36 6/7 weeks gestation, face many challenges. These infants comprise 71% of preterm births and 8.7% of all births in the United States (Hamilton, Martin, & Ventura, 2010). They have a higher incidence of medical complications than their full-term counterparts leading to longer hospital stays or readmissions (Consortium on Safe Labor, 2010; Khashu, Narayanan, Bhargava, & Osiovich, 2009; Pulver et al., 2010). The nurse’s role in educating parents of LPIs is pertinent as these babies are at heightened risk for a number of significant complications. The purpose of this project is to …

A Review Of The Principles And Benefits Of Cue-Based Feeding, Diana M. Cormier Dec 2015

A Review Of The Principles And Benefits Of Cue-Based Feeding, Diana M. Cormier

DNP Forum

Literature reflects that neonatal clinical practices are increasingly infant-driven, and promote, developmentally based care. Particularly, in the area of oral feeding, practitioners are moving away from traditional gestational age criteria for the initiation of oral feeding, or progressing feedings based on volume, instead they are trending toward feeding protocols that are based on developmental maturity.

A statement released by the American Academy of Pediatrics (2008), made the attainment of independent oral feeding one of the critical criteria for hospital discharge of preterm infants. This statement not only reflected the increased research attention on oral feeding acquisition and outcomes, it caused …

Commentary: Are Emergency Nurses Sbirt-Ready To Assist Vets And Other Chronic Non-Cancer Pain Patients?, Dorothy J. Moore, Danette K. Dutra

DNP Forum

Emergency Department (ED) Registered Nurses (RNs) spend significant time treating chronic pain patients. Chronic pain affects up to 100 million Americans (Simon, 2012) and as much as 30% of all opioid pain medications in the United States (US) are prescribed from EDs (Todd, Cowan, Kelly, & Homel, 2010). Abuse of these prescription drugs is America’s fastest growing drug problem (Paulozzi, Jones, Mack, & Rudd, 2011). For veterans of Operation Enduring Freedom (OEF), Operation Iraqi Freedom (OIF) and Operation New Dawn (OND), chronic non-cancer pain is the most frequent diagnosis (Higgins et al., 2014), and it is closely associated addiction disease. …

Understanding Veteran’S Health Beliefs: An Essential Part Of A Patient-Centered Approach To Treatment Adherence, Susan E. Phillips Dnp, Mph, Pmhcns, Mary Dolansky Rn, Phd

DNP Forum

Background: Patient centered care is a mechanism to encourage healthcare consumers to work together with health care professionals to achieve quality outcomes In the VA, non-adherence to treatment recommendations is problematic. Non-adherence results in poor use of VA resources as veterans come in for care but do not follow through with recommended treatment plans. Besides asking veterans about their health goals and preferences, understanding the veteran’s orientation regarding health beliefs and motivators for adherence to recommended treatment plans is essential for nurses who aim to help the veteran achieve healthy lifestyle behaviors.

Objective: The purpose of this study was to …

Handoff Communication In The Emergency Department, Kristen Matichko Dec 2015

Handoff Communication In The Emergency Department, Kristen Matichko

DNP Forum

The communication of patient information through use of handoff ensures continuity of care and patient safety. A study of hand-off reports between pre-hospital personnel and staff in the emergency department revealed a lack of complete or formal information dialogue. Nurses play a vital role in the process of communication and information exchange through the use of handoff despite minimal guidelines for that exchange in current nursing practice. The pre-hospital hand-off informational exchange impacts patient safety as well as the planning and implementation of nursing care based upon that information.

The sample used was from a convenience sampling of patients arriving …

Use Of Core Stabilization Exercise And Medical Exercise Therapy In The Treatment Of A Patient With Chronic Post Partum Low Back Pain: A Case Report, Zachary Chaloner, Kirsten Buchanan

Case Report Posters

Low back pain and lumbar hyper-mobility are common during and after pregnancy. Chronic postpartum low back pain (LBP) can be difficult to manage. Core stabilization exercises (CSE) have been shown to improve function and reduce pain in patients with chronic LBP due to lumbar instability. Medical Exercise Therapy (MET) has shown good outcomes in reducing pain in patients with LBP but has not been thoroughly investigated in the treatment of chronic post partum LBP. There is limited research reporting the use of a combined treatment protocol utilizing CSE and MET in the treatment of chronic LBP in postpartum women. The …

Multimodal Physical Therapy Management Of A Patient With Unilateral Neglect Post-Stroke In An Outpatient Setting: A Case Report, Meghan Riley

Case Report Papers

Background and Purpose: Unilateral neglect (ULN) syndrome negatively affects recovery post-stroke and is often associated with falls, longer stays in rehabilitation, and the need for more assistance at discharge. Typical physical therapy treatments include voluntary trunk rotation, visual scanning exercises, mirror therapy, hemispheric activation, sensory awareness training, and lower extremity loading but the efficacy of these treatments is still unclear. The purpose of this case report is to describe multimodal physical therapy (PT) management that includes common PT interventions to alleviate symptoms of ULN and report upon the outcomes of the various treatment methods for rehabilitation of neglect during functional …
