The Department of Justice recently argued that immigrants who have not been legally admitted to the United States have no right to claim protections under the First Amendment. If the DOJ argument is right, then most of the 11 million unauthorized immigrants in the U.S. could be censored or punished for speaking their minds – as many of them have in support of comprehensive immigration reform and the Dream Act. This Essay explores the complicated and conflicted case law governing immigrants’ free speech rights, and argues that, contrary to the DOJ position, all people in the United States are protected …

This Article challenges the constitutionality of indiscriminately restraining civil immigration detainees during removal proceedings. Not only are immigration detainees routinely placed in handcuffs, leg irons, and belly chains without any individualized determination of the need for restraints, but Immigration and Customs Enforcement (ICE), the prosecuting party, makes the decisions about the use of restraints, rather than the judge. After examining the rationale for the well-established prohibition against the indiscriminate use of restraints during criminal and civil jury trials, and discussing how some courts have extended this rationale to bench trials, this Article contends that ICE’s practice violates substantive and procedural …

For decades, scholars of immigration law have anticipated the demise of the plenary power doctrine. The Supreme Court could have accomplished this in its recent decision in Kerry v. Din, or it could have re-affirmed plenary power. Instead, the Court produced a splintered decision that did neither. This essay examines the long process of attrition that has significantly gutted the traditional plenary power doctrine with regard to procedural due process, while leaving it largely intact with regard to substantive constitutional rights.

With the ascendance of the terrorist group known as the Islamic State of Iraq and Syria (ISIS), the international community has struggled to adapt to the new international security context. Among the challenges that are currently being confronted are questions relating to how states may effectively facilitate international cooperation to counter ISIS (especially among countries in the Middle East and North Africa). ABSTRACT This thesis details the writing process, rehearsals and performance of the author‘s devised play, Joan: A Play With Broken Songs. The play aims to reimagine events occurring the evening before the death of French folk hero and Catholic Saint, Joan of Arc. The play exists in the moments between sleep and waking, in which Joan is visited by her own patron Saints (Margaret and Catherine,) as well as the Archangel Michael. Building on Professor Andrew Taslitz’s work, this article explores how Fair Price Theory can help us analyze the fairness of guilty pleas. In Judging Jena’s D.A., Professor Taslitz used Fair Price Theory to explore how prosecutors could strive to achieve fairness and reduce the perception of racial stigma. He used Fair Price Theory to propose a system of prosecutorial ethics that takes into account racial stigma. This article considers how Fair Price Theory challenges courts to analyze guilty pleas differently, by focusing on price without relying on the agency of prosecutors. The purpose of this thesis was to create a non-traditional Advanced Mathematics course paired with Math XL® for School (MXL) for senior-level students with low ACT Math scores. The Advanced Math course was created with the purpose of helping students increase their ACT Math scores and preparing them for first-year college math, College Algebra. The course was taught at a private high school in Louisiana for the 2014-2015 school year and is attached to this thesis as an appendix. A parallel discrete particle modelling framework (PAR_DPM3D) is applied to study three fundamental multiphase flow problems: The sedimentation of a cluster of particles in a viscous ambient fluid, multiphase flow in a bench-scale fluidized bed and granular segregation and mixing dynamics in a rotating drum. Various phenomena including torus formation and particle cluster breakup are reproduced. We provide new insights into the volume fraction dependence of the dynamic characteristics of a settling particle cluster and find a similar dependence in the simulations as in the theoretical predictions of Nitsche and Batchelor 1. The purpose of this study is to investigate the predictors of psychological distress in children following the Gulf Coast hurricanes of 2005. Previous literature has suggested that children that experience natural disasters, such as hurricanes, may face the same psychological dangers as children that experience other types of traumatic experiences. Thus, it is expected that children that were exposed to various stressors throughout the occurrence of the hurricanes will display more symptoms of psychological distress in the aftermath of the storms. The purpose of this research is to address how the issue of masculinity functioned in British propaganda during the First World War, and how it affected individuals. Propaganda relied on prewar conceptions of masculinity to appeal to audiences for reasons such as enlistment or continued support for the war. Propaganda often amplified these conceptions of prewar masculinity, and men would internalize propaganda’s message. The British state, however, did not create propaganda uniformly, and there existed major differences between the goals of propaganda posters and propaganda films. This was largely due to the king’s skill at image manipulation and communication. This dissertation offers three independent studies that each contributes to the literature on trade facilitation. The papers are built on the gravity model framework where the relationship between trade facilitation variables and the volume of agricultural exports across the border are examined. To deal with the issue of endogeneity, instrumental variable regression is used. The study also corrects for sample-selection bias present in the trade data. The first paper examines the role of e-governance on bilateral agricultural trade. The study finds that better quality of e-governance promotes agricultural exports. Fluorescence methods for disease diagnosis and detection of important analytes are becoming popular route as a technique, as they offer a simple non-invasive approach. Recently, many novel fluorophores and probes have been reported for selectively and sensitively detecting low abundance biological species in disease pathways. This paper rejects the dichotomy between patient and consumer roles and focuses instead on how attributes of each are meaningful to those seeking health care. Arguing that health care is already commodified, it suggests that both medicine and the market offer strategies for handling commodification. The important questions are how we understand these attributes and their role in care relationships, and which attributes we should encourage. The medical profession and patient role have long accommodated commodification, using fiduciary roles, flat fees and opaque pricing to distance payment and pricing from care provision. This article analyzes the relationship between sexualized stereotypes of Asian women, specifically the Asian prostitute epitomized in the Suzie Wong stereotype, and the tendency of American immigration law, even in pro-women legislation such as the TVPA, to promote conservative norms regarding female sexuality and domesticity. Part I explains the significance of Asian prostitution in the history and evolution of United States immigration policy. In the nineteenth century, the Asian prostitute was constructed as the antithesis to normative American sexuality, as a foreign peril that threatened the integrity of the American domestic unity and therefore required rejection and exclusion. Space is a vantage point from which masculinity can be critiqued and understood. Documentary film-makers employ specific mode(s) to relate space to masculinity by positioning themselves vis-à-vis the interviewees, and the interviewees vis-à- vis the viewers. A financial crisis may threaten the hegemonic masculinity embodied by Wall Street’s lonesome cowboys and provide a chance for film-makers to critique this type of masculinity. This article analyses three documentary films, I.O.U.S.A., Capitalism: A Love Story, and Floored, which were released after the 2008 economic crisis in the United States. The films contain three prototypes: the lonesome cowboy; white, working-class masculinity; and hypermasculinity. …

The current study investigated the relationship between supervision, job satisfaction, and burnout among live-in and live-on Housing and Residence Life professionals. The literature review consists of empirical research for each construct presented (supervision, job satisfaction, and burnout). The study sample consisted of live-in and live-on Housing and Residence Life professionals employed at colleges and universities across the United States and abroad. Multiple regression and Multivariate analyses were used to answer specific research questions. Results confirmed that there was a statistically significant relationship between supervision, job satisfaction, and burnout. Findings are thoroughly reviewed and compared to previous research in the field. …

Rice yield is adversely affected by various abiotic and biotic stresses. Jasmonic acid (JA) signaling has been implicated in stress response of plants. The nuclear localized basic helix loop helix (bHLH) Myc2 transcription factor is known to be a master regulator of genes involved in the response of the JA-mediated signaling pathway during stress and plant development. Community violence, in the form of direct victimization or witnessing violent acts, is a prevalent public safety concern in many communities. Individuals who are exposed to community violence often exhibit a variety of associated mental health concerns, including anxiety, depression, and posttraumatic stress symptoms. One of the most common negative outcomes associated with violence exposure among adolescents is engaging in aggressive or violent behavior.
