Looking For ‘Justice’ In All The Wrong Places: An International Mechanism Or Multidimensional Domestic Strategy For Mass Human Rights Violations In Sri Lanka?, Sujith Xavier Jan 2015

Looking For ‘Justice’ In All The Wrong Places: An International Mechanism Or Multidimensional Domestic Strategy For Mass Human Rights Violations In Sri Lanka?, Sujith Xavier

Osgoode Legal Studies Research Paper Series

I use the United Nations Panel of Experts on Accountability in Sri Lanka’s recommendation to create an international mechanism and recent demands for justice as a springboard to argue that the creation of a new ad hoc international or hybrid criminal tribunal for Sri Lanka may not produce the expected results of prosecuting those responsible for mass human rights violations. I argue that such an initiative will not heal the ruptures and cleavages among the different ethnic communities in Sri Lanka. By teasing out the political nature of international criminal law and the embedded nature of the history of international …

Legal Realism And Natural Law, Dan Priel, Charles L. Barzun Jan 2015

Legal Realism And Natural Law, Dan Priel, Charles L. Barzun

Osgoode Legal Studies Research Paper Series

The possibility of any meaningful relationship between the legal realists and natural law looks at first rather far-fetched. When it first appeared on the jurisprudential scene, legal realism was savagely attacked by proponents of natural law theory. To this day legal realism is depicted as a modernist, critical, at times almost nihilist approach to law, the polar opposite of the ancient natural law theory that traces its roots to Greek and Roman philosophy, and insists on unchanging objective values. And yet, two of the most famous legal realists, Karl Llewellyn and Jerome Frank, expressed in some of their writings more …

The Bunk House Rules: Housing Migrant Labour In Ontario, Adrian A. Smith Jan 2015

The Bunk House Rules: Housing Migrant Labour In Ontario, Adrian A. Smith

Osgoode Legal Studies Research Paper Series

The paper tackles the recent controversy surrounding an application to convert an abandoned school into housing for migrant agricultural workers in Ontario, Canada. It examines how the written reactions of community residents to a proposed municipal zoning by-law amendment convey and invoke understandings of the legal regulation of temporary labour migration. When viewed through a legal consciousness analytic lens, reconstituted to attend to the material practices and context underpinning residents’ discursive and ideological responses, what I term a ‘materialist legal consciousness studies’, it is evident that the residents’ submissions intervene in the organization and regulation of agricultural production. While framed …

A History Of Preferential Share In Ontario: Intestacy Legislation And Conceptions Of The Deserving Or Undeserving Widow, Louise M. Mimnagh, Mcnamara Pizzale Jan 2015

A History Of Preferential Share In Ontario: Intestacy Legislation And Conceptions Of The Deserving Or Undeserving Widow, Louise M. Mimnagh, Mcnamara Pizzale

Osgoode Legal Studies Research Paper Series

Ontario’s current method for trying to ensure the fair distribution of an intestate’s estate, or the estate of an individual without a valid Last Will and Testament, is outlined in the Succession Law Reform Act. Specifically, section 45(1) outlines the foundational concept of a “preferential share,” which entitles the surviving spouse to a prescribed financial interest in the estate which is prioritized above all other heirs.

The concept of a preferential share stands in sharp contrast with historical English common law methods of devolving intestate estates in which legal entitlements were heavily influenced by an individual’s gender and marital status. …

Systemic Corruption In An Advanced Welfare State: Lessons From The Québec Charbonneau Inquiry, Denis Saint-Martin Jan 2015

Systemic Corruption In An Advanced Welfare State: Lessons From The Québec Charbonneau Inquiry, Denis Saint-Martin

Osgoode Legal Studies Research Paper Series

The Quiet Revolution in the 1960s propelled the province of Québec onto the path of greater social justice and better government. But as the evidence exposed at the Charbonneau inquiry makes clear, this did not make systemic corruption disappear from the construction sector. Rather, it adapted to its new institutional environment and was significantly shaped by the incentives structure it provided. The patterns of corruption emerging from the Charbonneau inquiry bear the imprint of the so-called “Québec model” inherited from the Quiet Revolution in at least three ways: (i) in the economic nationalism that made public policies partial towards French-speaking …

Temper, Mounds, And Palisades: The Walford Site (22su501) Of Sunflower County, Mississippi, Kimberly Nicole Harrison Jan 2015

Temper, Mounds, And Palisades: The Walford Site (22su501) Of Sunflower County, Mississippi, Kimberly Nicole Harrison

Electronic Theses and Dissertations

The Walford site is a multicomponent site with Archaic, Woodland and Mississippian components located in the northern Yazoo Basin of Mississippi. The site has been recorded by several surveys, and was subjected to salvage excavations from 2003–2007. This excavation confirmed multiple components identified in previous surveys, and added a wider chronological range and occupation area. Current excavations also identified a palisade constructed before all of the adjacent Mississippian structures, as well as one of the mounds. Using stratigraphy, GIS, and ceramic analysis, the date of this palisade was determined to be Late Woodland or Early Mississippian.

Pocket Monsters And Pirate Treasure: Fantasy And Social Platforms In The 21st Century, Jacob Waalk Jan 2015

Pocket Monsters And Pirate Treasure: Fantasy And Social Platforms In The 21st Century, Jacob Waalk

Electronic Theses and Dissertations

POCKET MONSTERS AND PIRATE TREASURE: FANTASY AND SOCIAL PLATFORMS IN THE 21ST CENTURY is an anthropology project examining media, fantasy, ideology, and social groups in order to build a better foundation for the ways in which economic and social changes influence social networking, popular media, and values by using the anime-manga subculture as an example. The thesis draws from three major theorists: Thomas LaMarre, Anne Allison, and Ian Condry as well as major anthropological theorists such as Pierre Bourdieu. As an ethnography, the project was split into two sections: one consisting of interviews with eight anime-manga subculture participants drawn primarily …

A Stepping Stone Toward Companion Animal Protection Through Compensation, Zachary Paterick, Timothy Paterick, Sandy Sanbar Jan 2015

A Stepping Stone Toward Companion Animal Protection Through Compensation, Zachary Paterick, Timothy Paterick, Sandy Sanbar

Animal Law Review

Despite the fact that many Americans view their companion animals as part of the family, the law treats companion animals as personal property. The courts have viewed companion animals as property for over 200 years, however, this precedent no longer adequately accounts for the important role companion animals play in modern day lives, and no longer appropriately compensates for the true value the animal has to the owner. A modified investment approach, stemming from wrongful death precedent, provides both a qualitative and quantitative approach to adequately measure the compan-ionship value these animals have to humans. While courts have entertained various …

Learning From Experience: A Critical, Collective Process Following International Short-Term Mission Travel, Nancy Vigander Winfrey Jan 2015

Learning From Experience: A Critical, Collective Process Following International Short-Term Mission Travel, Nancy Vigander Winfrey

Educational Studies Dissertations

This qualitative dissertation seeks to explore the impact of short-term mission (STM) travel on American Christian volunteers, leveraging the small group structure already present in many churches. Using a participatory action research approach, small groups from two different Protestant churches engaged in cycles of dialogue, reflection and action. The group process was framed by Habermas’ concept of communicative space with emphasis on emotional knowing, cognitive reasoning, and creative expression. Data were collected from session recordings, written documents and process field notes. Content and process analyses were guided by transformative and situated learning theories. Findings were unique to each congregational group, …

Mission Santa Clara In A Changing Urban Environment, Lee M. Panich Jan 2015

Mission Santa Clara In A Changing Urban Environment, Lee M. Panich

Faculty Publications

Since its secularization in the 1830s, Mission Santa Clara de Asís and its associated grounds have seen major transformations. These changes include the gradual abandonment of the mission by its native inhabitants, the Californio and early Anglo-American use of mission structures, as well as the founding and growth of Santa Clara College (now Santa Clara University) and the City of Santa Clara. Through the analysis of historic maps, photographs, and archaeological findings, this paper provides an overview of the far-reaching physical changes that have fundamentally altered the original mission-era landscape, including the mission churches, cemeteries, and neophyte village. Information is …

Sustainability, Ideology, And The Politics Of Development In Cabo Pulmo, Baja California Sur, Mexico, Ryan B. Anderson Jan 2015

Sustainability, Ideology, And The Politics Of Development In Cabo Pulmo, Baja California Sur, Mexico, Ryan B. Anderson

Faculty Publications

Based upon twelve months of anthropological fieldwork in Cabo Pulmo, Baja California Sur, Mexico, this article uses political ecology and theoretical work on ideology to examine how local residents use the concept of sustainability to advocate for alternative visions of development. Conceptually, the idea of sustainability has a long, often conflicted history. As political ecologists have pointed out, sustainability can be everything from a tool of dominance and pacification to a strident defense of environment, place, and local rights. Between 2010 and 2012, the residents of Cabo Pulmo waged a campaign against a large-scale tourism development that was perceived as …

Scalia’S Short Reply To 125 Years Of Plenary Power, Michael Scaperlanda Jan 2015

Scalia’S Short Reply To 125 Years Of Plenary Power, Michael Scaperlanda

Oklahoma Law Review

With its plenary power doctrine, the Supreme Court erred by rejecting the universal in favor of the particular. Liberal immigration theorists, on the other hand, make the opposite error by rejecting the particular in favor of the universal. Drawing on classic international law publicists and the Catholic philosophical tradition, this essay argues that the two concepts—the state’s greater duty toward its own citizens (the particular) and equal dignity and worth of all human beings (the universal)—go hand in hand: complementing each other and giving the state a qualified right to limit immigration along with a qualified duty to admit vulnerable …

Economies Of Violence, John Protevi Jan 2015

Economies Of Violence, John Protevi

Faculty Publications

I discuss "economies of violence," comparing non-state (acephalic forager bands and horticultural chiefdoms) and state societies. Capital punishment and tolerated personal revenge in forager bands is both anti-war and anti-state, while some chiefdoms practice war as an anti-state practice.

‘‘Where I’M From’’ And Belonging: A Multimodal, Cosmopolitan Perspective On Arts And Inquiry, Tiffany A. Dejaynes Jan 2015

‘‘Where I’M From’’ And Belonging: A Multimodal, Cosmopolitan Perspective On Arts And Inquiry, Tiffany A. Dejaynes

Publications and Research

The paper draws upon a year-long practitioner inquiry with adolescents who conducted auto-ethnographies as part of a research course in their urban public high school. Through ethnographic data collection, youth researched their own lives, cultures, and beliefs with the end goal of producing multimodal films that represented their embodied senses of ‘‘Where I’m From’’, broadly defined. As youth collected and interpreted culturally and personally meaningful artifacts, stories, memories, and family discourses, the cosmopolitan habits of mind and heart that it is argued are important for nurturing reflective citizens of the world. In the process of video production or self-curation, youth …

Practicing To Aim At Truth: Theological Engagements In Honor Of Nancey Murphy, Ryan Newson, Brad Kallenberg Jan 2015

Practicing To Aim At Truth: Theological Engagements In Honor Of Nancey Murphy, Ryan Newson, Brad Kallenberg

Theology and Religious Studies Faculty Publications

Well-meaning evangelicals unfamiliar with Nancey Murphy’s philosophical theology frequently worry that her work in philosophy of mind has the effect of depriving us of our souls. When such an objection is voiced after a speaking engagement, Murphy’s “reassurance” is predictable: “Don’t worry! There is nothing to be lost; we never had souls to begin with!”

Underneath her wry reply is a deep concern that philosophical confusion about “having a soul” is seriously undermining Christian discipleship. For example, it has become second nature for many Christians to hold that the soul is more important than the body; regardless of the state …

We Do Not Know How To Love: Observations On Theology, Technology And Disability, Jana Marguerite Bennett Jan 2015

We Do Not Know How To Love: Observations On Theology, Technology And Disability, Jana Marguerite Bennett

Theology and Religious Studies Faculty Publications

Does technology enable those who are disabled to be fuller members of society, or does it ultimately seek to eradicate disability and so promote a kind of eugenics against those who are disabled? In the late 1990s and early 2000s, literature and debate on this question ran rampant. A common example is that of cochlear implants, which endured much debate at the time within the Deaf community regarding whether they eradicate an impairment— or whether implants actually do away with entire communities of the Deaf and thus displace an important minority culture. Yet, very little is written today on this …

Vatican Ii And Intellectual Conversion: Engaging The Struggle Within, Dennis M. (Dennis Michael) Doyle Jan 2015

Vatican Ii And Intellectual Conversion: Engaging The Struggle Within, Dennis M. (Dennis Michael) Doyle

Theology and Religious Studies Faculty Publications

In 1980 I took a course with Joseph Komonchak entitled “The History and Theology of Vatican II” at the Catholic University of America. True to the title, Komonchak was doing history and theology together at the same time on a class-by-class basis. He would bring in documents from the Council and from the times leading up to it, often in Latin, and he would talk about how his goals as a theologian required him to work in a historical manner. To understand Vatican II, or the Church itself for that matter, required not just understanding theological concepts but also grasping …

Surgery As A Science: The Intellectual And Practical Evolution Of European Surgery From The 16th To The 18th Century, Molly Nebiolo

Undergraduate Honors Thesis Collection

This thesis will highlight some of the major technological inventions in the field of surgery during this time range, but more importantly will utilize the scarce resources available to piece together why these technologies did advance and how they played a role in the professionalization of surgery as a whole. The resources currently available to determine the advances in surgical tools and techniques either lack written descriptions of their uses, and are just picture books, or are beyond my ability to use since they are in foreign languages. Not only this, but there are no written works already published that …

Successful Alternative Education: Still Reproducing Inequalities? The Case Of The Community School Program In Egypt, Lucy El-Sherif, Sarfaroz Niyozov Jan 2015

Successful Alternative Education: Still Reproducing Inequalities? The Case Of The Community School Program In Egypt, Lucy El-Sherif, Sarfaroz Niyozov

Institute for Educational Development, Karachi

Community schools are an alternative form of education that center on partnerships between the community and/or the state, aid organizations, and non-governmental organizations. The Community School Program (CSP) in Egypt sparked a social movement in education in that country, with disparate actors all coalescing around the CSP as an alternative, empowering model of education. This study examined the relationship between the CSP and the dynamics that formed, shaped and co-opted it through in-depth interviews and observations. Our analysis examined the program’s processes and legacies on its former students. The study found that critical factors in the program’s success were its …
