This Article examines the tendency of many legal scholars to overextend the scope of a previous scholar’s original idea—in this case, Professor Joseph Sax’s reconceptualization of the largely moribund common law public trust doctrine. Legal scholars are induced to write immoderately either to enhance their standing within the academic community or, more selflessly, to achieve law reform. These expansionist tendencies, however, are not without risk—a common law doctrine that becomes too unmoored from its historical shackles may lose the support of the courts that is required for its implementation. A New Subspecies Of Lyciasalamandra Flavimembris (Urodela: Salamandridae) From Muğla, Southwestern Turkey, Nazan Üzüm, Azi̇z Avci, Emi̇n Bozkurt, Kurtuluş Olgun

A new Lycian salamander subspecies, Lyciasalamandra flavimembris ilgazi subsp. nov., is described from southwestern Anatolia, Turkey. It differs from nominate subspecies by its characteristic color pattern, especially the ground color of the dorsum, tail, upper eyelids, and limbs. Its distribution is limited to the type locality (Kötekli, Muğla Province, Turkey).

The aim of this paper is to document the presence of the avian trematode Collyriclum faba in Egypt. During bird migration, parasitological research was carried out along the East European bird migration flyway (Jordan, Palestine, Egypt) in 2012-2014. A total of 1783 birds belonging to 87 species, mainly passerines, were macroscopically examined for the presence of parasites. An adult male individual of the willow warbler, Phylloscopus trochilus, examined in Aswan, southern Egypt, presented 5 subcutaneous cysts containing parasites identified as C. faba located on its thighs, above the eye, and on the body under the wing. The “Confession of Renard,” Branch XIV of the twelfth-century animal epic Roman de Renart (Romance of Reynard the Fox) explores the potential risks of the rite of confession, including the danger of whetting the appetite of the sinner by having him recount and re-live his delicious past sins. The fact that Renard, the “repentant” sinner, actually eats his confessor, suggests not only that merely talking about sin, particularly sexual sin, is a perilous business, but also that confession, like digestion, is a transformational process for both the penitent and the confessor.

John Hatcher’s The Black Death: A Personal History is an unconventional text. It recounts the experience of plague by a single, extraordinarily well-documented village in Suffolk, England: Walsham le Willows. While such a focus perhaps seems fairly standard of case studies or microhistory, Hatcher’s book is more than a narrow treatment of a corner of England. The double negative phrase ”forbiddeth to abstain” as found in D&C 49:18 can be confusing and syntactically challenging for readers. While some have argued that the phrase should be read and understood literally, the Doctrine and Covenants of The Church of Jesus Christ of Latter-day Saints indicates that a literal reading is not correct. In this article I demonstrate that the phrase ” forbid to abstain” was an accepted English idiom prior to and for a few decades following the receipt of D&C 49, even though it has vanished from contemporary usage completely. This paper examines how individual agency in medieval society might be expanded through posthuman configurations; in so doing, it pushes the boundaries of traditional practices in medieval research to include more contemporary ideas. Although as scholars, we must avoid anachronistic readings of these texts, ignoring modern thinkers like N. Katherine Hayles (How We Became Posthuman) and Donna Haraway (“A Cyborg Manifesto”) too easily disregards their valuable – and timeless – insights. While the term “posthuman” can evoke images of cyborgs or superhuman mutants using wormholes to traverse space and time, this pop culture perspective often overlooks less technoscientific examples of …

This article examines the role cruelty played in marriage separation cases in fourteenth-century Paris. Cruelty was an effective and relatively successful means for women to initiate separation litigation. The archdeacon’s court regularly cited saevitia as a reason for its decision to legally separate marriages. Marital cruelty, however was a complicated issue and what constituted cruelty was not defined within the text. One of the intriguing things about religious texts is how long of a life and how long of an afterlife they have. Slouching Towards Monell: The Disappearance Of Vicarious Liability Under Section 10(B), Ann Lipton

Liability under section 10(b) of the Securities Exchange Act is one of the primary mechanisms for enforcing the federal securities laws. Section 10(b), however, prohibits only intentional or reckless deception, and there has never been consensus as to how to determine whether an organization, rather than a natural person, harbors the relevant mens rea. Traditionally, organizational liability under federal law is determined according to agency principles, and most courts pay lip service to the notion that agency principles govern under section 10(b). As this Article demonstrates, they do not.

This article addresses the Cherokee tribe and their historic conflict with the descendants of their former black slaves, designated Cherokee Freedmen. This article specifically addresses how historic discussions of black, red and white skin colors, designating the African-ancestored, aboriginal (Native American) and European-ancestored people of the United States, have helped to shape the contours of color-based national belonging among the Cherokee. This article also suggests that Homi K. Bhabha’s notion of postcolonial mimicry offers a potent source for analyzing the Cherokee’s historic use of skin color as a marker of Cherokee membership. Many cancer cells rely predominately on glycolysis for their energy production, even in the presence of oxygen. They proceed further and reduce the glycolysis product pyruvate to lactate, by means of fermentation, for continued ATP production. This phenomenon is called the Warburg effect, and is associated with an upregulation of glycolysis and increased lactate production. A persistent increase in glycolysis and ATP turnover leads to an intracellular proton accumulation, which could eventually lead to cell damage and death by cytosolic acidification. However, cancer cells avoid acidification and maintain an appropriate intracellular pH by employing monocarboxylate transporters for the coupled export …

In this thesis, we describe a new framework for client-server isosurfacing on volumetric data. Regions of the data set that contain no visible part of the isosurface are determined on the server. The visible regions of the data set are then transferred to the client for isosurfacing. In addition, the framework transfers some non-visible regions to the client that may become visible when the viewpoint changes. Experimental results for application of the framework to volumetric data are also presented here.

Wheat stripe rust, caused by Puccinia striiformis, is a common disease that was found primarily in the Pacific Northwest prior to 1990, with occasional minor outbreaks in the eastern wheat regions. A physiological adaptation to higher temperatures that occurred around 1990 led to stripe rust becoming a major disease problem in the Gulf Coast. Race (pathotype) changes have occurred several times since 2000, resulting in cultivars with previously effective resistance genes becoming susceptible. Aquaculture is a multi-billion dollar industry worldwide. The United States is a significant consumer to both fresh and marine aquaculture products. Aquaculture sales in Rhode Island have dramatically increased in the last 20 years. In Rhode Island nearly 4.3 million oysters were produced via aquaculture in 2012. Currently, hatcheries and nurseries in the United States produce large amounts of a variety of species of oysters, clams and scallops. This dissertation asserts that the cool’s significance in 20th-century American culture exceeds that assigned to it by current critiques. It assays a rhetorical model which describes coolness as stillness in behavior that surprises witnesses, given the assumptions they make about the still person and context for his or her behavior. Such stillness agitates witnesses’ normative assumptions about all those in the rhetorical situation, including assumptions about affect, gender, race, class and sexuality. This work, consisting of three manuscripts, addresses natural resource management under risk due to variation in climate and weather. In three distinct but theoretically related applications, I quantify the role of natural resources in stabilizing economic outcomes. Manuscript 1 examines policies for controlling the risk of outbreaks of cyanobacteria, algae blooms, stimulated by excess nutrient loading transported by uncertain and possibly changing rainfall patterns for a drinking water watershed in Rhode Island. Prevalence of non-alcoholic fatty liver disease (NAFLD) and obesity both in the young and adult population is increasing at an alarming rate globally. Along with traditional risk factors, such as diet and sedentary life style, exposure of environmental chemicals is suspected to be a risk factor for metabolic disruption.
