Noriega V. Activision/Blizzard: The First Amendment Right To Use A Historical Figure's Likeness In Video Games, Joshua Sinclair Nov 2015

Noriega V. Activision/Blizzard: The First Amendment Right To Use A Historical Figure's Likeness In Video Games, Joshua Sinclair

Duke Law & Technology Review

Panama’s former dictator, Manuel Noriega, recently sued Activision Blizzard in the California Superior Court for using his likeness and image in the popular video game “Call of Duty: Black Ops II.” In his complaint, Noriega alleged that the use of his likeness violated his right of publicity. Former New York Mayor, Rudy Giuliani, came to Activision’s defense, and filed a motion to dismiss, which was granted. In granting Activision’s motion, the court held that Activision’s use of Noriega’s likeness was transformative and did not violate his right of publicity. This Issue Brief argues that the California Superior Court should not …

Use Of Spirometry For Medical Clearance And Surveillance In Occupations Requiring Respirator Use, Ushang Prakshbhai Desai

USF Tampa Graduate Theses and Dissertations

Medical certification of workers for respirator use is an important activity of occupational medicine health professionals. Spirometry is a diagnostic tool to evaluate respiratory distress/insufficiency that may affect respirator use. In this study, we analyzed the pulmonary function data of 337 workers from different occupations which required medical evaluation to wear a respirator. The American Thoracic Society and National Fire Protection Association criteria were used to evaluate employees. Of 337 workers who were cleared for respiratory use on the basis of medical questionnaires for respirator compliance, 14 (4.15%) failed to pass respirator compliance on the basis of NFPA criteria and …

Molecular And Phenotypic Studies Validating The Role Of The Ecdysone Receptor In The Human Parasite Brugia Malayi, Amruta Mhashilkar

USF Tampa Graduate Theses and Dissertations

Filariasis and onchocerciasis are debilitating diseases affecting 120 million people globally. The massive socio-economic impact of these diseases energized the international community to declare a goal of eliminating filariasis 2020. This resulted in a dramatic increase in the efforts to eliminate filariasis and onchocerciasis, employing a strategy of mass drug administration (MDA). However, these programs rely upon the small arsenal of drugs. This leaves these programs vulnerable to failure in the face of developing resistance and local intolerance to the current drug regimens. Thus, new drugs against these infections are critically needed. A homologue of the ecdysone receptor (EcR), a …

Art Education In My Backyard: Creative Placemaking On An Urban Farm, Jodi Kushins Nov 2015

Art Education In My Backyard: Creative Placemaking On An Urban Farm, Jodi Kushins

Artizein: Arts and Teaching Journal

An art educator describes how she used her knowledge and experience of artistic and educational initiatives that forefront collective activity in real world settings to transform her backyard into an urban farm with the help of friends and neighbors. She combines an autoethnographic account of her experiences, including original photographs, with research on conceptual artists, participatory culture, and creative placemaking to position her work as participatory environmental art education. The paper is organized around the major steps one undertakes in planting a garden – siting, amending, seeding, tending, and harvesting - to draw parallels between the processes of maintaining a …

Other-Than-Ego Consciousness: Approaching The “Spiritual” In Secular Art Education, Nico Roenpagel Nov 2015

Other-Than-Ego Consciousness: Approaching The “Spiritual” In Secular Art Education, Nico Roenpagel

Artizein: Arts and Teaching Journal

Alternative worldviews bring forth alternative visions of education. This article sheds light on one contemporary approach to a spiritual worldview and its implications for secular art education. It proposes that high school visual art is a particularly conducive environment to engaging teenagers with existential and spiritual questions. An approach to spirituality grounded in a worldview of “profound interconnectedness” and “other-than-ego consciousness,” rather than religious systems, offers a timely basis for renegotiating the spiritual in secular art education settings. Through five concepts, the article bridges broader discussions on spirituality with concrete learning and teaching in the art classroom. For example, it …

Inverse Inclusion: A Model For Preservice Art Teacher Training, Angela M. La Porte Nov 2015

Inverse Inclusion: A Model For Preservice Art Teacher Training, Angela M. La Porte

Artizein: Arts and Teaching Journal

A university community-based intercession course offers preservice art teachers a unique opportunity to experience inverse inclusion in an art class for special needs adults. Inverse inclusion allows preservice teachers to become students working side-by-side with an equal or greater number of special needs learners, and also places them in occasional roles as teacher, teacher’s assistant, and videographer. Their observations and interactions within these roles provide preservice teachers with perceptive insights and perspectives about teaching, and nurture a better understanding of special needs students’ personal interests and abilities. Applying, reflecting upon, and adapting open-ended art curriculum theory and practice from multiple …

Poems For Artizein, Sally A. Gradle Nov 2015

Poems For Artizein, Sally A. Gradle

Artizein: Arts and Teaching Journal

This is a collection of seven poems all of which have to do with being a teacher or an observer of artistic growth in children, one's self, or the differently abled. I view the teaching of art as something of a spiritual quest for greater understanding of the self and the world. I hope to have conveyed a bit of the essence of what it means to unfold in this regard.

Reflexive And Reciprocal Constructions In Modern Irish, Brian Nolan Nov 2015

Reflexive And Reciprocal Constructions In Modern Irish, Brian Nolan

The ITB Journal

This paper examines reflexive (and reciprocal) constructions in modern Irish, a VSOX language for which the generative analysis using c-command is problematic. Reflexive and reciprocal constructions are best reflected in the inherent VSOX word order. The reflexive occurs in transitive constructions with the reflexive marker féin, which can also be used non-reflexively but emphatically. A continuum is observed with a human/animate participant as the subject argument at the reflexive pole and a nonhuman inanimate at the emphatic end. Motion is an ingredient in reflexivity. Fictive or nontranslational motion are both non-reflexive. Translational motion alone allows reflexivity. Reciprocals are complex in …

Extending Physical Simulation To The Audio Domain, Graham Mccann, Hugh Mccabe Nov 2015

Extending Physical Simulation To The Audio Domain, Graham Mccann, Hugh Mccabe

The ITB Journal

Using physical simulation to control movement and interactions between objects in a 3D environment, such as a computer game, has become increasingly common However; this idea has not been extended in a general sense to the audio domain. The audio component of these systems usually comprises of pre-recorded WAV files that are triggered in response to events. We argue that this approach has serious limitations and propose instead that the physical information made available by physics engines provides an opportunity to carry out synthesis of appropriate sounds from scratch. We outline a framework for adding a sound synthesis module to …

Lexical Semantics And Patterns Of Causation, Brian Nolan Nov 2015

Lexical Semantics And Patterns Of Causation, Brian Nolan

The ITB Journal

In this paper we provide a brief account of patterns of causation in modern Irish that occur with lexically causative verbs. Three types of causation are found in modern Irish: lexical, periphrastic and morphological. In terms of the relative weightings of each type, the morphological causative is the least productive. Its use appears to be highly constrained to two very specific domains and it is signalled by particular morphological affixes. Lexical causatives are more productive than the morphological causative. By contrast, periphrastic or analytical causatives are highly productive and wide-ranging in their deployment. A claim of this paper is that …

The Jam Suite - A Voice-Enabled Network-Based Virtual Band Application, Brian Nolan, Martin Cummins, Irene Flanagan, Niall O’Brien

The ITB Journal

The Java Audio Music-suite (J.A.M. for short) is a suite of applications that provides tools and audio processing utilities for musicians. It’s core functionality includes a means whereby musicians who are geographically dispersed can play music together. An additional utility determines the actual musical notes from a piece of music using Fourier Transform techniques. All of these functions are complemented by a voiceenabled, animated help agent that takes in voice commands using speech recognition and reports errors via text-to-speech technology.

Reduced Voluntary Running Performance Is Associated With Impaired Coordination As A Result Of Muscle Satellite Cell Depletion In Adult Mice, Janna R. Jackson, Tyler J. Kirby, Christopher S. Fry, Robin L. Cooper, John J. Mccarthy, Charlotte A. Peterson, Esther E. Dupont-Versteegden

Physical Therapy Faculty Publications

BACKGROUND: Satellite cells, or muscle stem cells, have been thought to be responsible for all muscle plasticity, but recent studies using genetically modified mouse models that allow for the conditional ablation of satellite cells have challenged this dogma. Results have confirmed the absolute requirement of satellite cells for muscle regeneration but surprisingly also showed that they are not required for adult muscle growth. While the function of satellite cells in muscle growth and regeneration is becoming better defined, their role in the response to aerobic activity remains largely unexplored. The purpose of the current study was to assess the …

The Elements Of A Perfected Song Cycle: A Lecture Recital On Schumann’S Frauenliebe Und Leben, Kristen M. Christopherson Nov 2015

The Elements Of A Perfected Song Cycle: A Lecture Recital On Schumann’S Frauenliebe Und Leben, Kristen M. Christopherson

Senior Honors Theses

A lecture recital is a quintessential representation of the music student’s knowledge and skill in a synthesis of performance and instruction. This thesis will encompass the extensive research and preparation necessary to perform a lecture recital about Robert Schumann’s song cycle Frauenliebe und Leben (A Woman’s Love and Life). This marvelous work is an excellent example of Schumann’s enhancement of the song cycle genre. A standard work in soprano repertoire, Frauenliebe und Leben provides the opportunity for extensive musicality through vocal coloring, legato lines, ornamented turns, various phrasal structures, and clear dramatic direction. In addition to its rich history and …
