Summary Of Nv Energy V. Nev. Dept. Of Taxation, 130 Nev. Adv. Op. 93, Ashleigh Wise

Nevada Supreme Court Summaries

The Court determined that NRS 372.270 is not severable because the legislative intent of the statute was to protect local mines and the exemption does not extend to all mine and mineral proceeds. The Court also determined that violations of the dormant Commerce Clause are remedied by compensating for the negative impact to the claimant as measured by the unfair advantage provided to the claimant’s competitors.

Faculty Publications – Biological Sciences

Background

Life-history studies of wild bird populations often focus on the relationship between an individual’s condition and its capacity to mount an immune response, as measured by a commonly-employed assay of cutaneous immunity, the PHA skin test. In addition, haematocrit, the packed cell volume in relation to total blood volume, is often measured as an indicator of physiological performance. A multi-year study of a wild population of house wrens has recently revealed that those exhibiting the highest condition and strongest PHA responses as nestlings are most likely to be recruited to the breeding population and to breed through two years …

The Unseen World: Environmental Microbial Sequencing And Identification Methods For Ecologists, Naupaka Zimmerman, Jacques Izard, Christian Klatt, Jizhong Zhou, Emma Aronson

Department of Food Science and Technology: Faculty Publications

Archaea, bacteria, microeukaryotes, and the viruses that infect them (collectively “microorganisms”) are foundational components of all ecosystems, inhabiting almost every imaginable environment and comprising the majority of the planet’s organismal and evolutionary diversity. Microorganisms play integral roles in ecosystem functioning; are important in the biogeochemical cycling of carbon (C), nitrogen (N), sulfur (S), phosphorus (P), and various metals (eg Barnard et al. 2005); and may be vital to ecosystem responses to large-scale climatic change. Rarely found alone, microorganisms often form complex communities that are dynamic in space and time. For these and other reasons, ecologists and environmental scientists have become …

Fred and Harriet Cox Senior Design Competition Projects

Part of every UNLV engineering student’s academic experience, the senior design project stimulates engineering innovation and entrepreneurship. Each student in their senior year chooses, plans, designs, and prototypes a product in this required element of the curriculum. A capstone to the student’s educational career, the senior design project encourages the student to use everything learned in the engineering program to create a practical, real world solution to an engineering challenge. The senior design competition helps focus the senior students in increasing the quality and potential for commercial application for their design projects. Judges from local industry evaluate the projects on …

Do Gasoline Prices Affect Residential Property Values?, Adele C. Morris, Helen R. Neill Dec 2014

Do Gasoline Prices Affect Residential Property Values?, Adele C. Morris, Helen R. Neill

Brookings Mountain West Publications

This paper estimates the effect of gasoline prices on home values and explores the degree to which the relationship varies across a city. Using data from 930,702 home sales in Clark County, Nevada, from 1976 through 2010, we find that gasoline prices have significantly different effects on the sales price of homes in different neighborhoods. A ten percent increase in gasoline prices is associated with changes in location-specific average home values that span a range of over $13,000. This suggests that energy policies may affect household housing wealth via gasoline prices, a heretofore unrecognized distributional outcome.

Rationale & Literature Review Of Vocational Training Tools & Skill Implementation In Mental Health Populations, Matthew R. Olivier Dec 2014

Rationale & Literature Review Of Vocational Training Tools & Skill Implementation In Mental Health Populations, Matthew R. Olivier

Honors Theses

Persons diagnosed with any type of cognitive impairment are oftentimes given labels by society members; they face unjust hardship, and unfounded prejudice because of it, especially in workplace settings. In Kalamazoo, Michigan two different programs - that exclusively work with mentally ill adults – actively seek to counteract these unjust labels by using work-related exposure. The goal is to increase job competence, self-efficacy, safety, and the social participation of the members of these programs. Both programs required supplemental training tools to help their workers’ transition into their new roles. The populations served were 1) patients working for the Kalamazoo Psychiatric …

Stand Structure And Acorn Production Of The Island Scrub Oak (Quercus Pacifica), Mario B. Pesendorfer, Kathryn M. Langin, Brian Cohen, Zachary Principe, Scott A. Morrison, T. Scott Sillett

Monographs of the Western North American Naturalist

Island scrub oak (Quercus pacifica), a keystone chaparral species on Santa Rosa, Santa Cruz, and Santa Catalina islands, provides habitat for a diverse assemblage of plant and animal species. The restoration of oak habitat is a management priority, but little is known about Q. pacifica stand structure and acorn production, 2 parameters that are important in the species’ recovery. To investigate whether species interactions and abiotic conditions have an effect on stand structure and acorn production, we sampled within-stand densities, tree sizes, and acorns in the 3 island populations that have been exposed to different herbivores, seed predators, …

Summary Of Nevada Ass’N. Servs. V. Eighth Jud. Dist., 130 Nev. Adv. Op. 94, Michael Valiente

Nevada Supreme Court Summaries

The voluntary payment doctrine provides an affirmative defense to a claim for the recovery of money that a plaintiff voluntarily paid. The duress/coercion exception to the voluntary payment doctrine requires the plaintiff show no reasonable alternative to payment existed. Additionally, the defense of property exception requires the plaintiff show an imminent risk of losing the property.

Cross V. Vandyke: Admitted Only Means Admitted, Tyler Stockton Dec 2014

Cross V. Vandyke: Admitted Only Means Admitted, Tyler Stockton

Montana Law Review Online

Five delegates to the 1972 Montana Constitutional Convention sued to block Lawrence VanDyke’s (“VanDyke”) name from appearing on the ballot as a candidate for the Montana Supreme Court, arguing he did not meet the minimum eligibility requirements. The Court, in a 4–3 vote, found VanDyke eligible because Article VII, Section 9(1) of the Montana Constitution only requires one be “admitted” to the Montana Bar and not “admitted” and on “Active Status” per the Montana Bar ByLaws.

A Giant Leap For The Montana Law Review, Jim Nelson Dec 2014

A Giant Leap For The Montana Law Review, Jim Nelson

Montana Law Review Online

The Editors in Chief of the Montana Law Review asked me to write a piece to kickoff the new MLR website. Specifically, I was asked to comment on one or both of the student notes referred to on the website: State v. Cooksey and Montana Cannabis Industry Association v. State of Montana. I agreed to do that. But there was more I wanted to say and the Editors very graciously gave me the liberty to write what I wanted. Law review pieces are typically compartmentalized, and I’ll endeavor to follow that format, although this is certainly not a scholarly …

State V. Zunick: Second Guessing A First Impression, James Murnion Dec 2014

State V. Zunick: Second Guessing A First Impression, James Murnion

Montana Law Review Online

State v. Zunick presented the Montana Supreme Court with a question of first impression: what constitutes a proper colloquy under Montana Code Annotated § 46–12–211(4), and when must the colloquy occur? This statute governs the process of when a district court judge refuses to accept the terms of a plea agreement following the entry of a guilty plea. Specifically at issue in this case is the statute’s requirement that the court allow the defendant an opportunity to withdraw his guilty plea following a deviation from the agreed-upon sentence.

This note first examines how a defendant could historically withdraw a plea …
