The New Ada Backlash, Nicole Buonocore Porter

Faculty Publications

[T]his paper explores whether courts are using the reasonable accommodation provision or the qualified individual inquiry to limit the number of individuals entitled to the special protection of the ADA...

This paper will proceed in five parts. Part II provides a brief history of the ADA, both of its structure and legislative history. It then proceeds to a discussion of the major Supreme Court cases that dramatically narrowed the coverage of the ADA through a narrow interpretation of what it means to be an individual with a disability. I will also discuss why courts may have narrowly construed the statute. …

Study On Interior Permanent Magnet Synchronous Motors For Hybrid Electric Vehicle Traction Drive Application Considering Permanent Magnet Type And Temperature, Javad Soleimani, Abolfazl Vahedi, Abdolhossein Ejlali, Mohammadhossein Barzegari Bafghi

Turkish Journal of Electrical Engineering and Computer Sciences

Recently, interior permanent magnet synchronous motors (Interior-PMSMs) have become known as a good candidate for hybrid electric vehicle (HEV) traction drive application due to their unique merits. However, the dynamic and steady-state behaviors of these motors are quite dependent on the permanent magnet (PM) type, configuration, and volume in rotor structures. This paper uses a novel structure of Interior-PMSMs for traction applications with fragmental buried rotor magnets in order to achieve low torque ripple, iron losses, and cogging torque. In this paper, first, the effect of the PM type on a d-q equivalent circuit model is examined. Next, the design …

The Syntheses, Characterizations, And Applications Of Novel Photo- And Electrochemical Catalysts, Lauren Rae Grabstanowicz

Graduate Research Theses & Dissertations

This dissertation investigates two separate clean energy applications, emphasizing material applications and electrochemistry techniques. The first section examines environmentally friendly alternatives for water purification to avoid carcinogenic by-products. To diminish such possibilities, research has shifted towards photoelectrochemical catalysts, such as titanium dioxide (TiO2), because pure TiO2 has limited absorption in the ultraviolet region. Therefore, Ti3+, a self-dopant, has become an attractive candidate for environmentally friendly alternatives. This dissertation demonstrates a novel oxidation procedure to form self-doped Ti3+ in the bulk of rutile TiO2. A brief overview of the work will be given and supporting data including material, methods, structural characterization, …

Destructive Leader Behavior : Assessing Public School Leader Behaviors And Workplace Attitudes, Daniel Scott Woestman

Graduate Research Theses & Dissertations

The primary purpose of the planned study was to investigate professional educators in Northern Illinois to determine the relationship between manifestations of destructive leader behaviors (DLB) and K-12 workplace attitudes: subordinate likelihood of leaving, job satisfaction, levels of stress, and ability to perform work duties. The study demonstrated the presence of destructive leadership at all levels of educational leadership. Subordinate-directed behavior was perceived more than Organization-directed behavior and Sexual Harassment. Specific behaviors were found to be predictors of subordinate high job stress, low job satisfaction, high likelihood of leaving, and low perceived ability to perform work duties.

Resolving Deep Relationships Of Pacmad Grasses : A Phylogenomic Approach, Joseph L. Cotton Jan 2014

Resolving Deep Relationships Of Pacmad Grasses : A Phylogenomic Approach, Joseph L. Cotton

Graduate Research Theses & Dissertations

The phylogenetically recognized PACMAD (Panicoideae, Aristidoideae, Chloridoideae, Micrairoideae, Arundinoideae, Danthonioideae) clade of grasses has been the subject of numerous phylogenetic studies that have made an attempt at determining subfamilial relationships of the clade (Clark et al., 1995, GPWGI, 2001, Duvall et al., 2007, GPWGII, 2012). The purpose of this thesis was to examine chloroplast genome sequences for 18 PACMAD species, and analyze them phylogenomically. These analyses were conducted to provide resolution of deep subfamilial relationships within the clade. Divergence estimates were assessed to determine potential factors that led to the rapid radiation of this lineage and its dominance of open …

Nodal Solutions Of Nonlocal Integral Boundary Value Problems, Jeremy E. Chamberlain Jan 2014

Nodal Solutions Of Nonlocal Integral Boundary Value Problems, Jeremy E. Chamberlain

Graduate Research Theses & Dissertations

In this dissertation, we study the nonlinear, non-local boundary value problem consisting of the second order equation -( p(t)y') ' + q(t) = w( t)f(y) on [a,b] and one of two boundary conditions involving a Riemann-Stieltjes integral. By relating the problems to the eigenvalues of the corresponding linear Sturm-Liouville problem with a two-point separated boundary condition, we obtain results on the existence and nonexistence of nodal solutions to these problems. The shooting method and a generalized energy function are used to prove the main results. We also discuss the changes in the existence of different types of nodal solutions as …

Single-Molecule Analysis Of Alzheimer's Β-Peptide Oligomer Disassembly At Physiological Concentration, Chen Chen Jan 2014

Single-Molecule Analysis Of Alzheimer's Β-Peptide Oligomer Disassembly At Physiological Concentration, Chen Chen

Theses and Dissertations--Chemistry

The diffusible soluble oligomeric amyloid β-peptide (Aβ) has been identified as a toxic agent in Alzheimer’s disease that can cause synaptic dysfunction and memory loss, indicating its role as potential therapeutic targets for AD treatment. Recently an oligomer-specific sandwich biotin-avidin interaction based assay identified the Aβ oligomer dissociation potency of a series of dihydroxybenzoic acid (DHBA) isomers. Because the sandwich assay is an ensemble method providing limited size information, fluorescence correlation spectroscopy (FCS) was employed to provide single molecule resolution of the disassembly mechanism.

Using FCS coupled with atomic force microscopy, we investigated the size distribution of fluorescein labeled synthetic …

How Are Curious People Affected By Seductive Details In Written Texts? : Exploring The Various Relationships Among Curiosity, The Seductive Details Effect, And Learning Outcomes, Edward James Hansen

Graduate Research Theses & Dissertations

Seductive details are pieces of information in educational texts that are irrelevant to the most important content of the educational material. Although it may seem logical to include such details to get readers interested in a subject, the presence of seductive details in educational texts has consistently been shown to decrease learning outcomes. This negative effect on learning is referred to in the literature as the seductive details effect. The current experiment proposed hypotheses that would refine conventional seductive detail research in three ways. First, this study investigated whether people with high amounts of specific or diversive curiosity may be …

Truman, Kennedy, And Reagan: Assessing The Impact Of Assassination Attempts On The Organizational Culture Of The U.S. Secret Service, Briana D. Bowen

Undergraduate Honors Capstone Projects

The U.S. Secret Service (USSS), one of the most elite security agencies in the world, is charged with protecting the President of the United States at any cost. Three American presidents fell to assassins' bullets before the USSS was assigned the role of presidential protection; one more would later be slain despite USSS protection. This study examines the organizational culture of the USSS, employing the methodology of cultural topography (CTOPS) to identify the agency's norms, values, identity, and perceptual lens. We review three of the most impactful twentieth-century assassination attempts-two failed, one successful-and their formative effect on USSS organizational culture. …

The Scope Of Precedent, Randy J. Kozel Jan 2014

The Scope Of Precedent, Randy J. Kozel

Journal Articles

The scope of Supreme Court precedent is capacious. Justices of the Court commonly defer to sweeping rationales and elaborate doctrinal frameworks articulated by their predecessors. This practice infuses judicial precedent with the prescriptive power of enacted constitutional and statutory text. The lower federal courts follow suit, regularly abiding by the Supreme Court's broad pronouncements. These phenomena cannot be explained by—and, indeed, oftentimes subvert—the classic distinction between binding holdings and dispensable dicta.

This Article connects the scope of precedent with recurring and foundational debates about the proper ends of judicial interpretation. A precedent's forward-looking effect should not depend on the superficial …

Beta version.

This book seeks to give insight into the people and processes that create theatre. Like any other world—be it horse racing, fashion, or politics—understanding its complexities helps you appreciate it on a deeper plane. The intent of this book is not to strip away the feeling of magic that can happen in the presence of theatre but to add an element of wonder for the artistry that makes it work. At the same time, you can better understand how theatre seeks to reveal truths about the human condition; explores issues of ethics, gender, ethnicity, class, sexuality, and spirituality; …

Representation And Identification: Hap Grieshaber’S Polish Way Of The Cross, Johann G. Roten Jan 2014

Representation And Identification: Hap Grieshaber’S Polish Way Of The Cross, Johann G. Roten

Books and Book Chapters by University of Dayton Faculty

The two expressions representation and identification are key words of the artistic program of Expressionist art.

Expressionism, if it were possible to reduce this multi-form movement to a common denominator, takes the past and its stories and recreates them for the present. However, the story is no longer a succession of events separated by the logic of space and time. Narration becomes representation, the story is abbreviated until it fits the concise space of the icon. Using to a maximum the expressive power of reduced pictorial form, Expressionism delivers a message where details and the narrative movement are abandoned for …

Revisiting The Tax Treatment Of Citizens Abroad: Reconciling Principle And Practice, Michael S. Kirsch Jan 2014

Revisiting The Tax Treatment Of Citizens Abroad: Reconciling Principle And Practice, Michael S. Kirsch

Journal Articles

In an increasingly mobile world, the taxation of citizens living abroad has taken on increased importance. Recent international administrative developments — most notably, the weakening of foreign bank secrecy and expansion of global information sharing norms — have further raised the profile of this issue. While U.S. law traditionally has taxed U.S. citizens living abroad in the same general manner as citizens living in the United States, a number of scholars have proposed abandoning the use of citizenship as a jurisdictional basis to tax. In its place, they would apply residence-based principles — i.e., exercising full taxing rights over U.S. …

The Experience Of A Pastoral Advocate And Implications For The Church, Bryan Massingale Jan 2014

The Experience Of A Pastoral Advocate And Implications For The Church, Bryan Massingale

Theology Faculty Research and Publications

This chapter presents a critique—based on the chapter’s author’s own experiences as a university teacher, parish minister, and pastoral advocate—of the deleterious effects of what he calls “the pervasive climate of fear” and reactivity that surrounds even modest attempts at open conversation among Catholics about sexual diversity and the church. It suggest that this climate of fear is debilitating and dangerous, especially within a faith community charged by Jesus to “be not afraid.” Left unaddressed, this fear has wide-ranging effects that threaten the well-being not only of LGBT Catholics but of all Catholics and indeed the very mission and identity …

Stability Studies Of Membrane Proteins, Cui Ye Jan 2014

Stability Studies Of Membrane Proteins, Cui Ye

Theses and Dissertations--Chemistry

The World Health Organization has identified antimicrobial resistance as one of the top three threats to human health. Gram-negative bacteria such as Escherichia coli are intrinsically more resistant to antimicrobials. There are very few drugs either on the market or in the pharmaceutical pipeline targeting Gram-negative pathogens. Two mechanisms, the protection of the outer membrane and the active efflux by the multidrug transporters, play important roles in conferring multidrug resistance to Gram-negative bacteria. My work focuses on two main directions, each aligning with one of the known multidrug resistance mechanisms.

The first direction of my research is in the area …
